Slathia led thousands of people who accompanied him to submit the memorandum which raises the crucial issue of New Recruitment Policy and host of other issues related to the Vijaypur Assembly Constituency. He said the people are constrained to invoke the attention of the Governor, as the Coalition Government has been most lackadaisical and nonchalant towards the problems of the people. A large number of people, mostly youngsters, and farmers whose crops were damaged due to recent rains and floods were present on the occasion. Elaborating on apprehensions about the new job policy, the memorandum stated, “We express our deep concern and anguish over the insistence of the present dispensation in bringing about an Ordinance on New Recruitment Policy, despite being sagaciously returned by the Hon’ble Governor in the recent past. The move, as may be appreciated, is a brazen attempt to bypass the well established mechanism of recruitment agencies like Jammu and Kashmir Public Bring required amendment in SRO 64: NMC appealed CM GOF Staff Reporter Jammu, May 12: President of the National Conference(NMC) Mazdoor Subash Shastri today appealed to the Chief Minister to bring about required amendment in SRO 64 and take decision in the first cabinet meeting is being scheduled in summer capital of the State to pave way for regularization of 61000 daily rated workers deployed in various departments of the state Govt. since long urging him to look this matter personally and on priority so that these workers may be regularized before the enforcement of model code of conduct to ensuing civic election in the state likely to be held in a few months. Talking to media persons here, Shastri pointed out that these daily rated workers facing serious financial hardship due to inflation and price hike as their services have not been regularized for the last 19 to 24 years nor they are getting salary in time stated that about 61000 families of these workers are involved forming parts of state electorate and these voters are likely to play major role in the coming civic elections added that forthcoming civic election will be acid test for the PDD/BJP led coalition Govt. and its acclaimed people friendly policies. Shastri also urged that the sincere efforts at the level of Chief Minister Mufti Mohd. Sayeed are required to take such a bold decision to regularize the services of these poor daily rated workers. He stressed on the need for early creations of separate head in all concerned departments and budgetary allocations made separately so that till their regularization, these workers are able to get their monthly wages regularly and first day of every month. Emphasizing for immediate release of 6% DA due from January last and 5th installment of 6th pay commission, Shastri hoped that decision would be taken by the State Govt at the earliest. Others demands highlighted on the occasion included removal of pay anomalies of clerical cadre of the state Govt. in SRO 93, enhancing medical allowance to rupee one thousand per month, merging 50% DA into basic pay/pension, increasing monthly salary of daily rated workers to rupee ten thousand per month and strictly enforcement of CP Fund deduction scheme in all departments etc. Service Commission and State Subordinate Recruitment Board. This is a calculated move to undermine the constitutional role of these institutions, which is fraught with danger of encouraging corruption, nepotism and exploitation of unemployed educated youth. This will certainly lead to politi- cisation of recruitment and hence cause frustration among the talented and educated unemployed. Perhaps conscious of these bottlenecks, the Hon’ble Governor was kind enough to return the proposed Ordinance reportedly with certain observations. We urge immediate roll back of the Policy in order to send a right message to youth, who have all the reason to feel deprived and get demoralised. The PDP-BJP Government should not make it a prestige point and insist on implementing the Policy notwithstanding the widespread resentment of the youngsters across the State”. Drawing the attention of the Governor towards other issues, the Memorandum refers to the havoc created by the recent unprecedented and unseasonal rains to the farm produce across the Constituency and states, “Farmers plight is miserable and the present dispensation has shown immense degree of insensitivity by not coming to their rescue. No survey has so far been carried out and no relief provided to hapless farmers. We demand Rs 3,000 compensation per Kanal in lieu of damaged crops, free ration for six months to the suffering families, fodder for livestock etc. Since the mango orchards have been worst affected in Kandi areas of the Constituency, the farmers need to be adequately compensated. Besides, the farmers should be allowed to cultivate the land falling under zero-line of the International Border”. “In the wake of incessant rains and flash floods, power supply has been most hit in the Constituency, which has resulted in disruption of connection to the pump sets in agricultural fields. This has potential of denial of irrigational facilities during most crucial cropping season. This needs to be attended on priority by restoring connectivity. Since the farmers have suffered massive damages, the Government should announce one-time waiver of loans under Kisan Credit Cards. Also the power tariff on account of irrigational and other facilities should be waived to give some respite to the farming community”, it added. The Memorandum also stated that the recent rains have exposed the vulnerability of the areas in the close periphery of Devak River. “In the wake of rains, the threat of floods looms large over the people. In fact, most of the peripheral areas got inundated in the recent heavy downpour. Therefore, there is crucial need of constructing a bund at Devak River to save the agricultural fields in general and residential areas in particular. This year over 4,000 kanals of agricultural in villages Barota Camp, Khanpur, KessoKamore, Rangoor Camp and Nanga got heavily inundated. The previous government had recommended Rs. 44 crores for the construction of Bund. The proposal needs to be revived and processed for immediate sanction so that the construction can be taken up this working season”, it maintained. Welcoming the decision on estab- lishment of All India Medical Institute in the Kashmir, the Memorandum presented by Mr Slathia states, “We strongly deplore the unfortunate and unwarranted controversy generated over it and sincerely feel the need for one more such facility for the Jammu region, keeping in view its population, topography and accessibility to the adjoining Himachal and Punjab states. Besides, over ten million pilgrims throng to this part of the country which again calls for specialised medical services. Also, in view of the sensitivities involved between the regions, the establishment of AIIMS will go a long way in assuaging the aspirations of the people of this region besides forging harmony between Kashmir and Jammu. This had been perhaps the motivating factor while allowing two Central Universities as a special dispensation for Jammu and Kashmir. The NCP today demanded booking of officers of Transport and Traffic departments under criminal cases for their alleged responsibility in the Udhampur bus accident in which 24 people were killed. "State NCP demanded criminal cases to be registered against the officials of Transport and Traffic departments, responsible for allowing old model buses and not checking overloading of the vehicles," state NCP unit chief and former minister, Thakur Randhir Singh told reporters here. He alleged they are responsible for plying of outdated buses and failing to check overloading of the passenger vehicles in rural areas of the state, particularly in this case. Twenty four people died and 49 others were injured, five of them critically, when an overcrowded bus rolled down into a 300-feet deep gorge in Maroti belt in Udhampur district of Jammu and Kashmir yesterday. NCP has demanded Rs ten lakh compensation to the next of kin of the deceased and Rs 5 lakh to the injured besides special treatment to the injured on government expenses. Claiming that more people have died in road accidents than in militancy in Jammu province, he said, "Hundreds of innocent people of these hilly areas have died and many have become disabled in frequent road accidents because of bad roads and lack of latest transport facilities. "So far, the state government has not learnt any lesson from frequent fatal buses accidents resulting in the deaths of innocent people," Singh said. Zulfkar Ali today convened a follow up meeting with District Commissioners of Development Kashmir Division to review the progress of verification to ascertain the exact number of additional families under different categories so that rations are provided as per Census-2011 from next month. On the occasion, the Minister sought the status of constitution of the district, Tehsil and block level committees for early completion of verification process and further tasked them to conduct door-to-door survey so that no deserving family is left uncovered. Stressing the need for preparing comprehensive list of beneficiaries under different categories, the minister said department will provide rations as per the data submitted by concerned deputy commissioners so it should be authentic and pragmatic. He said action would be taken against officers if loop- holes are noticed in the data. Zulfkar asked the Deputy Commissioners to submit report within stipulated time frame, adding the government is determined for supply of rations according to 2011 census from June this year. He also di- rected the concerned DCs and Assistant Director CAPD to submit updated lists of BPL, AAY, APL and other categories of rationees at the earliest. Meanwhile, the Minister also took stock of supply position at each district and asked the con- cerned to ensure that rations reach before 10th of every month to all districts in order to maintain proper and regular supply and fair distribution. But the panel that is set to replace the collegium is not without serious flaws either. That critical moment, which the entire legal fraternity and constitutional experts have been waiting, has finally arrived. On April 13, the National Judicial Appointments Commission Act, 2014, along with the Constitution (Ninety-ninth Amendment) Act, 2014, came into force. The new laws introduce a fresh mechanism to appoint judges of the Supreme Court and High Courts, that will ultimately lead to the scrapping of the existing collegium system for appointments. Both Acts was notified by the Union Government, after the request to keep the law on hold was turned down by a three-judge Bench, headed by Justice AR Dave. Since most issues raised in the public interest litigations were constitutional in nature, Justice Dave transferred the matter to the five-judge constitutional Bench, which is now headed by Justice J S Khehar. Since the matter is under the active consideration of the highest court of the land, it will be improper to air personal views and assessments about the merit of either side of the argument at this point of time. Still, a few issues of public interest may be highlighted. First, is the unanimity and solidarity displayed by elected representatives in both Houses of Parliament in supporting and passing these two Bills with such urgency. What made bitter political rivals bury their hatchets on this issue and agree to vote so overwhelmingly in favour of the Bills is a mystery. What interest binds bitter enemies, of diverse political outlook, on this issue is a matter of wild speculation. Second, the alacrity and speed with which the two Bills were passed in both Houses of Parliament and nearly 20 State Assemblies, is also striking. Both were passed in Parliament after opposition parties fell in line with the Government. However, attempts by the political class to project the National Judicial Appointments Commission as a harbinger of transparency must be viewed with caution. Politicians have an axe to grind against the higher judiciary which has often given discomforting judgements. For example, the judiciary, in a bid to cleanse the political system, ordered that elected leaders declare their assets, educational qualifications and criminal antecedents. There can be no denying that the existing collegium system has a number of shortcomings. Disturbing examples of corruption in the higher judiciary has been brought to public knowledge through sensational disclosures by jurists themselves. However, such shortcomings should be addressed through judicial accountability mechanisms; they must not become an excuse to rob the judiciary of its independence. The political class's decision to abolish the collegium system allows the executive to call the shots in the appointment of judges. This is a clear case of throwing the baby out with the bath water. Indeed, this is the greatest assault on the judiciary by the political class. It is a fact that if there is any entity in our polity that can rein in the legislature and executive from abusing their powers, it is the judiciary. However, if the judiciary itself is tamed and turned into a pet, through pliant appointments by the political class, who will save the citizens from the tyranny of the Legislature and the executive? NARAYANAN he combination of an excess of nationalism, belief in exceptionalism, and of the inevitability of a Sino-centric world is an aspect India cannot overlook during Prime Minister Narendra Modi’s visit to China. He must focus clearly on the strategic aspects of the relationship, and less on trade and economic ties. Prime Minister Narendra Modi’s forthcoming visit to China, beginning May 14, is of considerable interest not only to peoples inhabiting the two countries, but also to leaders and strategic analysts globally. In China, Mr. Modi will be visiting Xian, Beijing and Shanghai over three days, before leaving for Mongolia and South Korea. Mr. Modi’s visit follows Chinese President Xi Jinping’s trip to India in September 2014. There is a great deal hinging on its outcome with China being viewed today as a pivot-state, and India the only nation in the region capable of maintaining the balance in the region. For his part, Mr. Modi has, no doubt, indicated that trade and economic ties with China would be his main priority. However, there is much more to an Indian P’s visit to China than economic relations unstated though this may be. This visit is again taking place at a time when China has unveiled a new strategic vision, and elements of the strategy conform to Sun Tzu’s principle of “winning without fighting”. It implicitly includes rewarding nations that it perceives as “friends” and, by implication, excluding nations that stand in its way. New security paradigm China is also currently affording an opportunity to nations in the region to become a part of a Beijing-contrived “security alliance”, holding out the promise of a new Asian security paradigm, previously embedded in Chinese President Xi Jinping’s “Code of Conduct for Asia” (2014). The latter contained a veiled “warning” to countries forging military alliances to counter China. Perhaps, having waded too far out by its ref- T fter a long and convoluted progress through the courts, Ms. Jayalalithaa has finally been acquitted by the High Court. This was with regard to the former Tamil Nadu Chief Minister’s appeal against conviction for possession of assets disproportionate to her income. The 919-page judgment of the Karnataka High Court tested precisely this proposition. Ms. Jayalalithaa’s conviction by the Special Court, under Section 13 (1) (e) of the Prevention of Corruption Act 1988, had all the elements of a potboiler a popular mother figure, an old accusation from an impetuous past, and a judgment that could be delayed no longer but with even more twists and turns than a movie script. In 1995, when Ms. Jayalalithaa attended the lavish wedding of her now disowned foster son V.N. Sudhakaran, she and her other co-accused in the case, Sasikala, would have hardly envisioned what would follow. Public revulsion at her unaccountable ostentation turned into electoral fury in 1996. Ms. Jayalalithaa lost power and was arrested in several corruption cases. Section 13 (1) (e) of the Prevention of Corruption Act of 1988 states: “A public servant is said to commit the offence of criminal misconduct, if he or any person on his behalf, is in possession or has, at any time during the period of his office, been in possession for which the public servant cannot satisfactorily account, of pecuniary resources or property disproportionate to his known sources of income.” It further explains “known sources of income” as “income received from any lawful source and such receipt has been intimated in accordance with the provisions of any law, rules or orders for the time being applicable to a public servant.” What this means is that at any stage, a public servant should be able to prove that assets owned or controlled by him or her are attributable to proven, lawful sources. On a Re. 1 salary When Ms. Jayalalithaa was Chief Minister for the first time, between 1991 and 1996, she took a monthly salary of Re. 1 only. Her career as actor had ended in 1980, and seemed to yield no great savings or assets beyond her house in Poes Garden in Chennai. Sasikala and her family were accused of possessing property on Ms. Jayalalithaa’s behalf. A first-term Chief Minister often has no idea of the job requirements. Associates need to be strictly warned that proximity to powerful figures cannot turn familiarity into a revenue model. But a lonely prima donna exalted to an empress may perhaps be forgiven for indulging a favourite. However, when the indulgence was extended to complicity with a whole family and tribe, it made a case for the prosecution. The essential premise of the charge laid before the trial court was that it was all for one and one for all. Thus, assets of several companies in which Ms. Jayalalithaa, along with Sasikala and her relatives, was a personal stake- sertiveness, have produced an unstable equilibrium. Impact of developments Consequently, while there are many issues that would be uppermost in Mr. Modi’s mind, the visit provides an excellent opportunity for him to assess, at first hand, where China is headed. It will give him a chance to estimate the potential impact of recent developments on Sino-Indian relations. The Prime Minister could begin by making a realistic appraisal of China’s “Defence Posture” and the kind of threat this poses to India. Rising defence budgets (the 2015 defence Budget is estimated at $141.5 billion — the 26th year of normal double digit increases since 1989), unveiling of a host of new state-of-the-art weapons such as the DF-21D “Carrier Killer” anti-ship ballistic missile (the Assassin’s Mace according to the United States) and the J-20 stealth fighter aircraft, employment of asymmetric tactics which conform to Sun Tzu’s precepts, all send out a clear message that China is no longer willing to watch from the sidelines where its immediate and longterm security interests are concerned. ‘Outreach’ programme Mr. Modi would also have the opportunity to understand, first hand, the implications of China’s “Outreach Programme”. The launch of the New Development Bank and the Asian Infrastructure Investment Bank has already demonstrated Beijing’s determination to build an alternative financial architecture. The “One Belt, One Road” initiative (inclusive of a Silk Road Development Fund) aims to boost connectivity with China’s Central Asian neighbours, and establish a Eurasian land corridor from the Pacific Coast to the Baltic Sea, which possibly signals China’s determination to undermine the U.S. Pivot to Asia. The contribution of Rao, the man who pulled India’s economy out of the rut a quarter century ago, and laid the foundations for the country’s spectacular economic growth, has never been acknowledged by previous Governments, including those headed by his own party, the Congress. Apart from being the chief architect of economic reforms, Rao’s sagacious leadership in the 1991-96 phase also helped stamp out the secessionist forces in Punjab and save the country’s unity and integrity. Yet, despite those extraordinary achievements, the Congress, probably giving in to the insecurities of its own leaders, sought to effectively stamp out Rao from the national consciousness. Rao came on the scene when all seemed lost and the nation was adrift on choppy seas. India’s foreign exchange reserves had crashed to perilous levels and the nation was on the brink of default. It had dollars just enough to pay for petroleum imports for two weeks. The rate of inflation was 13 per cent, which soon climbed to 17 per cent. Industrial growth had come to a grinding halt and the Eighth Five-Year Plan had been abandoned. The economic crisis was so huge that Rao’s predecessor had mortgaged gold to the Bank of England to raise a measly $200 million. This was the time when doomsayers were having a field day because, apart from this gargantuan economic crisis, Rao had inherited the Punjab problem, where centrifugal forces were pulling the State away from India’s orbit and there were innumerable other flashpoints, including the smouldering communal crisis and the post-Mandal casteist fires stoked by another predecessor, VP Singh. Many Western analysts believe that China is presently demonstrating a degree of “strategic autism”, resulting from its growing power. The Indian side needs to factor this in its calculations. Under President Hu Jintao and Premier Wen Jiabao, China had, by and large, displayed a benign face. It was during this period, in 2008, that India and China unveiled a “Joint Strategic Vision for the 21st Century”. This was considered unusual even then for China generally finds it difficult to endorse a common vision. Under Mr. Xi, China has moved away from Deng Xiaoping’s injunction “to hide our capabilities and bide our time and never claim leadership”. It now countenances the employment of diplomacy as an instrument for the effective application of Chinese power in support of China’s ambitious and longterm foreign policy agenda. Effectively, therefore, the 2008 “Shared Vision Concept” is all but buried, and it would be useful to see what happens next. The Indian side must avoid falling into any kind of trap of arriving at decisions on strategic issues, made seemingly easy by the Chinese employing very simplified, schematic representations of highly complex realities. Meanwhile, current realities in the region are becoming more complex having entered a period fraught with change. The emergence of new dangers in West Asia, the uncertainty in Afghanistan, with the Islamic State (IS) now siding with the Taliban, tensions among different nations in South-East Asia and East Asia, and evidence of increasing Chinese as- holder, ended up being attributed in the trial court judgment to Jayalalithaa. Her political fortunes turned in 2001 when she led her party to victory despite the pending corruption cases. Her return to power began to reflect in the special court in Chennai. Several witnesses turned hostile, and the prosecutor seemed to be going through the motions of a trial. An acquittal for lack of evidence appeared imminent. At this stage, the Dravida Munnettra Kazhagam’s senior-most leader K. Anbazhagan moved the Supreme Court, saying a fair trial of the Chief Minister was not possible in Tamil Nadu. The court agreed and transferred the trial to Karnataka. It also directed the appointment of a Special Public Prosecutor by the Karnataka government, who would be approved by the High Court. An expeditious trial was ordered. One of Karnataka’s most respected lawyers, B.V. Acharya, was persuaded to prosecute, and the case commenced. However, a whole host of issues was litigated from time to time by Rao was called upon to cope with all this, with his hands tied behind his back he did not have the numbers in the Lok Sabha. The Congress had secured just 232 seats and was 41 short of a majority in the 1991 Lok Sabha poll. Given this reality, only a cerebral and decisive Prime Minister could have ensured the country’s political and geographic unity and economic recovery both of which he achieved in a matter of five years. Rao picked up persons of calibre and gave them a free hand to craft policies that would result in a turnaround. He chose Manmohan Singh as his Finance Minister, shielded him from the fiercest political attacks in and out of Parliament, and asked him to re-work the economic policy. The two together opened up the economy to domestic and foreign investors and dumped Nehruvian socialist policies which had all but killed the entrepreneurial skills of Indians. These policies, which were pursued with greater vengeance by Jawaharlal Nehru’s daughter, Indira Gandhi, had reduced industrialists to a bunch of licence and permit grabbers who were called upon to master the art of bribing their way through the corridors of power. Such was the stranglehold of the state over the economy that the Government had a virtual monopoly in the manufacturing sector from condoms to telephone instruments. Also, much of the services were in Govt hands, be it telecommunications or airlines, thus pulling the economy down through their inefficiencies. The Rao Government’s first Budget of 1991 was a watershed as it began the process of dismantling the rusted Nehruvian framework, brick by brick. By the time his term ended, the grand revival of Indian business and industry had begun and hope was once again in the air. The long-term impact of his policies can be gauged from the fact that the country’s foreign exchange reserves, which had dried up when he took charge, had climbed to $140 billion when he passed away in December 2004. A fortnight ago, it stood at a robust $345 billion. Rao displayed similar grit in tackling the other big monster at India’s door in the 1990s secessionism in Punjab. The seeds of separatism were sown during Indira Gandhi’s prime ministership and the plant flowered during Rajiv Gandhi’s tenure. The State was virtually slipping away because the previous Governments had failed miserably to quell the forces that were out to wreck India’s unity. Rao gave then Punjab Chief Minister Beant Singh and police chief KPS Gill a free hand to tackle the problem. This brought in dividends. But for Rao’s shrewdness, Punjab could have become the first State to secede from India. Following his demise, the media was full of reports of how the United Progressive Alliance Government headed by Manmohan Singh did not want Rao’s last rites to be performed in Delhi. It was also widely reported that the Congress leadership prevented his body from being taken to the premises of the All India Congress Committee on Akbar Road. Rao was eventually cremated in Hyderabad. The Narendra Modi Government has, therefore, its task cut out. Beginning with Rao, it must correct many of the injustices of the past, especially those pertaining to the marginalisation of some of the nation’s real heroes and leaders, irrespective of which party they belonged to. For starters, the Government must allocate land on Rajpath for both Netaji Subhas Chandra Bose and Sardar Vallabhbhai Patel. We have the Jawaharlal Nehru Bhavan, housing the Ministry of External Affairs on one side of Rajpath. On the other is the Indira Gandhi Centre for the Arts. A 100 metres away in this key area is the Rajiv Gandhi Bhavan. But what about Sardar Patel, the iron man, without whom we would never have had the India that he stitched together with grit, determination and extraordinary foresight? And what about Netaji Bose, the man who raised an army to oust the British and showed extraordinary courage and commitment to free India from foreign rule? A grateful nation must at least now grant them their rightful place in the history books and on the nation’s most prominent promenade. Anything short of such tributes will smack of ungratefulness. This is one of the many responsibilities that the Narendra Modi Government has to shoulder, but it is an important one because it will correct some of the injustices of the past and also rejuvenate our national consciousness. one or the other accused. Delay is a known defence tactic. The defence team kept up a slew of dilatory motions. The ordered speedy trial was dragged and litigated at the Supreme Court at every stage. Five different special judges heard the case over 18 years. Lost steam Curiously, after Ms. Jayalalithaa lost power again in 2006, the prosecution itself seemed to lack the vigour to pursue the case. In 2010, ahead of the Assembly polls of 2011, the case again picked up steam. A second series of interim motions and legal manoeuvring ensued. The process also later led to the resignation of Mr. Acharya, who had brought the case to near fruition. He was replaced by Mr. Bhavani Singh, who appeared to command little praise and less love. Into this background stepped Justice Michael D’Cunha as the last trial judge, with a reputation for thoroughness and probity. In September 2014, Jayalalithaa and her associates were convicted. The trial court held that most of the assets were to be taken as held by the accused personally or on her behalf. Ms. Jayalalithaa appealed immediately, but hearing on the admission and bail was delayed. Bail was denied by the High Court, but the Supreme Court in appeal granted it after 20 days of incarceration. The Supreme Court also made an expeditious disposal of the appeal a condition of the bail, thus eliminating any dilatory tactics by the defence. The hearing of the appeals began again in January this year and was concluded by midMarch. An issue then arose about whether the Special Public Prosecutor Bhavani Singh had been properly appointed to conduct the appeal. Mr. Anbazhagan again approached the Supreme Court, seeking a fresh hearing of the appeal, with another public prosecutor being specifically authorised. The judgment The result of all this is the compendious High Court judgment exhaustive and also thoroughly exhausting. The reasoning can only be discerned from the last 150 pages. Each transaction has been analysed; each explanation considered and ruled on. The expenditure on the wedding is not attributed to Ms. Jayalalithaa alone, since she was on the groom’s side of the event; the bride’s side of the family, including the late actor Sivaji Ganeshan, are seen to have contributed to it. Loans taken by Ms. Jayalalithaa to acquire property have also been considered as reducing the disproportion in the assets. A detailed calculation of her income and assets in tabular form was considered, and the High Court concluded that the property was acquired from lawful sources. The footwear and apparel were also not seriously taken into account, as the prosecution had failed to segregate them according to their individual users, given that there were four people in the house. port cities along the Silk Road. This could well result in circumventing and circumscribing India’s own outreach diplomacy. The ambit of China’s “Public Diplomacy” including the rapid expansion of Confucius Institutes (there are over 415 such institutes around the globe including around 15 in India at present) also merits the Prime Minister’s attention. The interconnecting links between these Institutes and the authorities in China are matters which require to be better understood in the context of China’s current “soft power” offensive. As in the case of China’s “Peaceful Rise”, there is room for worry and concern. China has already notched up several diplomatic successes some of these will have an adverse impact on India’s external relations. The transformation in China-Russia relations is clearly one. This has been facilitated by the $400 billion gas deal, but it should not be overlooked that Russia was possibly the first overseas destination for Mr. Xi. What should specially concern India and Mr. Modi, is that China and Russia are now determined to deepen their “comprehensive strategic partnership” and “contribute to lasting world peace”. Likewise, China has gained a strategic beachhead in West Asia with its Iran connection. China is reaping the reward of standing by Iran. This will clearly put India on the back foot in a region which it has carefully nursed for a long time. China-Pakistan connection However, it is the further deepening of the China-Pakistan connection that should be cause for graver concern, and Mr. Modi could seek from his Chinese host what exactly China’s intentions are. The $46 billion promised by China for the China-Pakistan Economic Corridor, which would link western China with the Gwadar port in Pakistan through (PoK), by itself is worthy of India’s attention, but it is also apparent that the quid pro quo includes China gaining strategic access to the Gwadar port. Social security or fraud? Gujaratis have business in their veins and Prime Minister Narendra Modi is no exception. He is in fact a champion who can sell you a ping-pong ball and make most believe it’s a football! On May 8, he launched three new “social security” schemes. The schemes which include accident insurance, life insurance and a pension plan supposedly target people from the economically deprived and unorganised sections, people who are neither covered by any form of insurance nor get any. But there is a catch. Only people who have a bank account can avail them. Out of a population of 1.2 billion, only 150 million have bank accounts, and of these a good one-third don’t have any credit balance. Pointing out the necessity for such schemes, Mr Modi in his address said, “The journey to development will be incomplete if the poor do not share its fruits… Banks were nationalised for the poor but did we see the poor in the banks? Eighty to 90 per cent of the people do not have access to pension and insurance… But all the troubles happen to the poor, not the rich… They sleep on footpaths, they have to die...” Since 80 to 90 per cent of the population does not have bank accounts, the Prime Minister’s new “social security” schemes do not apply to them. So what is he talking about? The Pradhan Mantri Suraksha Bima Yojana (PMSBY) will offer a renewable accidental death-cum-disability cover of Rs 2 lakh for a premium of Rs 12 per annum. The Pradhan Mantri Jeevan Jyoti Yojana (PMJJY) will offer a renewable one year life cover of Rs 2 lakh for a premium of Rs 330 a year. The Atal Pension Yojana (APY) will focus on the unorganised sector and provide subscribers a fixed minimum pension of Rs 1,000, 2,000, 3,000, 4,000 or 5,000 per month, starting at the age of 60, depending on the contribution option exercised between 18 and 40 years of age. The period of contribution by any subscriber under APY would be 20 years or more. Very simply put, this means that you will get back what you invest. One cannot say you will get back more than you invest because in all such schemes you will get only a part of what your money would amount to after interest is factored in. This is where the element of fraud comes in. These three schemes do not receive any government input nor is there any budgetary support provided. The Union finance minister’s 2015 Budget speech did not have a word on these. From the sketchy details provided on these three schemes, it is clear that they are meant only for those with bank accounts, for those with money in their accounts and those willing to part with their money for any or all of these. The schemes by themselves are quite good, but neither are they new nor is there any budgetary input from the government. It is your money that will be returned to you. Then how can the government and the Prime Minister claim ownership of these schemes? One can understand the Prime Minister naming a scheme after himself or any of his mentors, when the government provides the financial support for it. The previous UPA government had the unhealthy habit of announcing governmentfunded schemes named after Jawaharlal Nehru, Indira Gandhi, Rajiv Gandhi and sometimes even after lesser members of the family like Motilal Nehru, Kamala Nehru and even Sanjay Gandhi. It made an exception for its flagship program, the National Rural Employment Guarantee Act, which was named after Mahatma Gandhi. The National Democratic Alliance government during its previous term in office had introduced the Varishtha Pension Bima Yojana (VPBY) as a pension scheme for senior citizens. Under the scheme 3.16 lakh annuitants are being benefited and the corpus amounts to Rs 6,095 crore. The finance minister in his Budget speech proposed to revive the scheme for a limited period from August 15, 2014, to August 14, 2015, for the benefit of citizens aged 60 and above, and an appropriate provision was made for this. But none of the schemes launched with so much fanfare on May 8 are government funded. Nowhere in his 253 paragraphs long Budget speech did the finance minister make any mention of these three “new” schemes. "As per the report of Indian Council of Medical Research (ICMR), National Cancer Registry Programme, Time Trends in Cancer Incidence Rates 1982-2005 (2009), nearly half of the cancers in males and onefourth of cancers among females are tobacco related," Health Minister J P Nadda said. He said that as per the World Health Organisation (WHO), the use of tobacco is a major risk factor for four major non-communicable diseases namely cardiovascular disease, cancers, diabetes and chronic respiratory disease. "WHO studies show that smoking substantially increases the risk of tuberculosis and deaths from TB. As per the Global N Adult Tobacco Survey, India report (2010), 40 per cent of the TB burden in India may be attributed to smoking," Nadda said. Replying to another question, he said that as per the findings of a study titled 'Economic Burden of Tobacco Related Diseases in India 2014', commissioned by his ministry and conducted by Public Health Foundation of India, the total economic costs attributable to tobacco use from all diseases in India in 2011 for persons aged 35-69 amounted to Rs 1,04,500 crore. He said that as per the Global Adult Tobacco Survey - India (GATS 2010) conducted by his ministry, in the age group of 15 years and above, 20.3 per cent of the females consume tobacco in some form or the other. Replying to another question, he said that as per the 'Report of Tobacco Control in India 2004', published by the Health Ministry, each year 8-9 lakh deaths in India can be attributed to tobacco use. The estimat- ed number of tobacco-related cancer deaths in India as per ICMR in 2014 was 1,47,269 while it was 1,42,671 in 2013. In 2012, it was 1,38,261, the minister said. "As per the report 'Cigarette Package Health Warnings International Status Report 2014', published by Canadian Cancer Society, India is ranked 136 on its status of compliance with the cigarette package health warnings," he said. "This ranking is based on the size of the existing pack warnings i.E 40 per cent of the principal display area limited to the front panel only," Nadda said. Replying to another question, Nadda said that a committee was constituted in July 2014 to review and suggest amendments to the Cigarettes and Other Tobacco (Prohibition of Products Advertisement and Regulation of and Commerce, Trade Production, Supply and Distribution) Act (COPTA), 2003. The committee made a number of recommendations with regard to prohibition of smoking in public places, advertisements at point of sale, minimum legal age for sale of tobacco products, loose sale of tobacco products, depiction of tar and nicotine contents and the penal provisions. "After consideration of the a draft recommendations, amendment bill along with notes on clauses was prepared and placed in public domain, as part of the pre-legislative consultations with a view to elicit comments from stakeholders including general public upto February 15, 2015," Nadda said. Speaking about the measures taken for tobacco control, the Health Minister said COPTA 2003 was enacted, the National Tobacco Control Programme was launched and Food Safety and Standards (Prohibition and restrictions on sales) regulations 2011 under the Food Safety and Standards Act 2006 was issued which lays down that tobacco and nicotine shall not be used as ingredients in food products among other steps. Delhi Police have registered an FIR against Arindam Chaudhuri, founder of Indian Institute of Planning and Management (IIPM), on the basis of a complaint by the University Grants Commission of "misleading, cheating and fooling" its students as its courses were not recognised by any recognised authority. "We have registered an FIR under Section 420 of IPC against IIPM Dean Arindam Choudhari and his father Malayendra Kisor Chaudhuri, who is a Director, based on the UGC complaint. We are probing the matter," Joint CP (Crime) Ravindra Yadav said. A notice has been sent to both of them to join the investigation, police said. "The current immunisation rate in urban India is 67.4 per cent and that in rural India is 58.5 per cent. "The reasons for the low rate of immunisation are lack of awareness among the parents about the benefits of vaccination, fear of side-effects of vaccination (adverse events following immunisation) and non-availability of vaccines or vaccinators at session sites etc," Health Minister J P Nadda said in a written reply in Rajya Sabha. Nadda said that the funds allocated by the government to promote immunisation programme in India in 2012-13, 2013-14 and 2014-15 are Rs 221.70 crore, Rs 188.91 crore and Rs 189.26 crore respectively. "No funds have been allocated by the government for the development of new vaccines in the last three years," Nadda said. Elaborating about steps taken by the government to improve immunisation rates, Nadda said that the government has been providing flexible funds to states for mobility support, alternate vaccine delivery and mobilisation of children accredited social health activists. He said that government has also conducted special immunisation weeks from time to time in areas with pockets of low immunisation coverage while it is also implementing 'Mission Indradhanush' and target areas with partial immunisation and no immunisation in 201 high-focus districts. Under the Mission, vaccination is provided to protect children against seven lifethreatening diseases including diphtheria, pertussis, tetanus, polio, tuberculosis, measles and Hepatitis B. The court was hearing a plea filed by advocate Mehmood Pracha who has not only sought quashing of the LOC allegedly issued against him, but has also sought "disbanding" of IB. He has also sought that a Rs 10 crore penalty be imposed upon IB for its action. The court had on April 20 asked the agency to inform it whether an LOC was issued against the advocate and, if yes, what was its status. However, due to the strike, only a proxy counsel nominated by DHCBA was present on behalf of the government and IB and could not answer the court's query as to whether an LOC was issued. Pracha has sought disbanding of IB, saying the agency has not been set up under any statute and is not accountable to anyone. (PTI) Industrial output growth slows Govt to modify new income tax to 5-month low at 2.1% return forms New Delhi, May 12: Industrial production grew at a five-month low of 2.1 percent in March even as both manufacturing activity and capital goods' offtake improved during the month. The factory output, as measured by the Index of Industrial Production (IIP), had contracted by 0.5 percent in March 2014. For 2014-15 fiscal, industrial production grew at 2.8 percent as against contraction of 0.1 percent in 2013-14, the data released by the Central Statistics Office on Tuesday showed. Meanwhile, the IIP for February has been revised downwards to 4.86 percent percent from the provisional estimate of 5 percent released last month. The IIP had grown at 2.77 percent in January, 3.56 percent in December and 5.2 percent in November. The factory output contracted by 2.7 percent in October. Manufacturing out- put, which constitutes over 75 percent of the index, grew by 2.2 percent in March against a contraction of 1.3 percent in the same month a year ago. The production of capital goods, a barometer of demand, grew by 7.6 percent in March as against a contraction of 11.5 percent in same month of last year. Mining sector grew by 0.9 percent in March 2015 against 0.5 percent expansion in the same month last year. Overall, 13 out of 22 industry groups in the manufacturing sector showed positive growth during the month of March. For whole 2014-15, the manufacturing sector expanded by 2.3 percent, against a contraction of 0.8 percent in 2013-14. Capital goods output grew by 6.2 percent in last fiscal as against a dip of 3.6 percent in 2013-14. Mining output rose by 1.4 percent last fiscal against a contraction of 0.6 percent in 2013-14. (PTI) Sensex tanks 630 points on Retail inflation worries over land, tax reforms eases to 4-month low at 4.87% in April New Delhi, May 12: New Delhi, May 12: Retail inflation in April softened further and fell to a four-month low of 4.87 percent as prices of food items, vegetables and fruits turned cheaper. The retail inflation measured on the basis of Consumer Price Index (CPI) was revised upwards to 5.25 percent from 5.17 percent in March 2015. Fall in food inflation was mainly driven by fruits, vegetables, milk and related products. Food inflation, based on Consumer Food Price Index, fell to 5.11 percent during the month from 6.14 percent in March. Prices of fruits and vegetables increased at a slower pace in April with inflation standing at 5.08 percent and 6.63 percent, respectively. The rate of price rise in cereals and products was slower than a month ago at 2.15 percent, while inflation in milk and its products was at 8.21 percent. While, the rate of price rise in most of the protein rich items remained higher in April with inflation in 'meat and fish' category at 5.5 percent and 'pulses and products' at 12.52 percent. Egg prices continued a downward trajectory with inflation at (-)1.46 percent in April. However, the rate of price fall was slower than previous month's (-)3.47 percent. Among others, inflation in oils and fats category fell to 1.77 percent in April, sugar and confectionery at (-)5.99 percent, spices (8.70 percent) and in non-alcoholic beverages it was 4.68 percent. Inflation in prepared meals, snacks and sweets category rose to 7.68 percent. Of other items calculated under CPI, inflation in clothing and footwear category came down to 6.15 percent, housing at 4.65 percent and food and beverages at 5.36 percent, respectively. The Income Tax department had notified new income tax return forms on April 15. In the ITR-2, Finance new Minister Arun Jaitley said, the information relating to foreign travel which has been sought to be captured is as per the recommendation of Special Investment Team on Black Money constituted as per directions of the Supreme Court. Such information can help in developing risk profiles for deduction of evasion of tax, he said in the written reply to the Rajya Sabha, adding that these details are not required in ITR-1 or ITR-4S which is filed by majority of individual taxpayers. "The government has received representation on the new return forms notified on April 15, 2015 and taking into account concerns raised, the government has decided to modify the return forms," Jaitley said. ITR-1 (SAHAJ) is for individuals having income from salary/one house property/income from other sources. ITR-2 is for individuals and HUFs not having business/professional income. ITR-4S is for indideriving viduals/HUFs business income and such income is computed in accordance with special provisions (44AD and 44AE). The Finance Minister also said the government has constantly endeavoured to make the ITR filing procedure simple and hassle free with the introduction of electronically filed ITR forms in 2006-07. The process of electronic filing has been made simpler over the years, he added. As a result, during 2014-15, 3.41 crore returns were filed electronically which constituted 87 percent of the all the returns filed in the fiscal. BUSINESS NEWS Asset quality woes not over for banks; GNPAs to rise: Crisil Mumbai, May 12: Asset quality woes of banks will continue in the current fiscal with gross non-performing assets (NPA) ratio for the system growing at 0.20 percent to 4.5 percent by March 2016, credit rating firm Crisil said on Tuesday. Even though restructuring has been discontinued, the newly introduced 5/25 scheme for infrastructure loans will act as a "mask" for the stress, it said, pointing to potential issues around transparency. The scheme allows banks to refinance or sell long-term project loans after every five years. For banks to avail such a facility, the loan tenor cannot be more than 25 years. Crisil said banks may not report such loans unlike the restructured advances. "We believe that the asset quality challenges will persist in the current year," Crisil director Rajat Bahl told reporters on a conference call. He said both the disappearance of the regulatory forbearance of restructuring as well as slippages from the previously recast loans will weigh-in on the asset quality. The agency estimated that the 'stressed assets', which it defines as the GNPA plus loans sold to asset reconstruction companies and estimates of loans turning bad under 5/25 scheme (15 percent) and already restructured assets (35 percent), to stay flat at 6 percent (Rs 5.3 trillion) in FY16. Crisil expects Rs 80,000 crore of assets to get transfered under the 5/25 scheme for infrastructure loans introduced last year to take care of the asset liability mismatches for the system. A bulk of the asset quality woes in the recent past has been attributed to trouble with infra loans. With the greater amount of provisioning that such stressed assets will require, the agency said the banks will also suffer on the profitability front. It said private banks, which have a better leash on asset quality due to composition of assets, will overtake the state-run lenders on profits at an aggregate level. With the government shifting to supporting only the better performing banks, Crisil said the capital constraints will force many to go slow on their credit expansions. The well-capitalised private sector banks' credit growth at 24 percent will be double that of state-run lenders' 12 percent, it said, adding that the overall system credit growth will be 15 percent, up from the 10 percent in FY14.(PTI) Sigve Brekke Telenor Group's new President and CEO Mumbai, May 12: Norwegian telecom major Telenor Group on Tuesday said it has appointed Sigve Brekke President and Chief Executive Officer (CEO) effective August 17, 2015. JAMMU WEDNESDAY, MAY 13, 2015, PAGE 11 Glimpses of Future Petroleum shortage in valley Union Minister asks oil companies to resolve issue within two days Srinagar, May 12: In the backdrop of fuel crises in Kashmir valley, Union Petroleum Minister Darmendra Pradhan Tuesday chaired a high level meeting with Federal Petroleum companies and asked them to resolve the issue within two days. Vivek Dhasmana one of the top officials in Joint secretary refinery and administration told KNS over phone from New Delhi that the meeting was held between the Petroleum Minister and officials of the federal petroleum companies on Tuesday afternoon. “The Minister has instructed the oil companies to resolve the issue within two days. I can tell you with the responsibility that the issue will be resolved within two days,” he said. Dhasmana said that the Minister expressed his anger against the petrol companies and oil and regulatory authority for not keeping the storage of petrol and diesel in Jammu and Kashmir. “Three major oil supplying companies that supply oil to KashmirIndian Oil Corporation (IOC), Bharat Petroleum (BP) and Hindustan Petroleum (HP). The supplies to Jammu and Kashmir have been delayed as operation of five refineries has been affected due to technical upgrade and maintenance shutdown amid an unusual spike in demand,” he said. Petroleum dealers in the Valley Monday alleged that distribution of petrol and diesel through petrol pumps in Srinagar and other areas was in disarray due to shortage of fuel supply. Meanwhile, petroleum dealers Tuesday rejected government claims that valley has petrol stock of 17 days and said that the stock was available only up to Tuesday evening. “Not a single liter of Earthquake over 8,000 people and flattening thousands of buildings besides destroying whole villages. "All available helicopters along with Medical Team; SSR Team going to be mobilised to Dolakha and Sindhupalchowk soon," said Nepal's National Emergency Operation Centre. The Indian Air Force (IAF) has stationed eight helicopters in Nepal and one of them conducted an aerial survey soon after today's quake. Nepal's only international airport, the Tribhuvan International Airport, was briefly closed by authorities and flights to Kathmandu were diverted. Authorities have also ordered all schools to be closed for the next two weeks. Strong tremors were felt in Kathmandu where people ran out of their houses in panic and some even started crying. Authorities appealed to people to stay in open field. The temblor triggered landslides and toppled buildings in Nepal that recently witnessed its worst quake in over 80 years and over 160 aftershocks. At the main hospital in Kathmandu, patients hurt in last month's quake were brought out in wheelchairs to avoid further injury. Today's quake had its impact in several cities in Bihar, West Bengal and UP and tremors were felt across vast stretches of east and northeast India, where the death toll has reached 17 so far. The tremors were also felt in China, where one woman was killed in Tibet. A high-intensity earthquake measuring 7.3 on the ichter scale epicentred in Nepal sent strong tremors through several eastern and northern parts of India today, leaving 17 dead, including 16 in Bihar, and causing panic. Bihar once again bore the brunt of the temblor that occurred less than three weeks after the monster quake that devastated Nepal, with 38 of the 39 injuries reported from the state. Union Home Ministry sources said Bihar's capital Patna accounted for the largest number of four deaths, followed by Darbhanga and Saran (two each), besides Siwan, Nawada, Samastipur, Muzaffarpur, Sitamarhi, Madhepura, Motihari and Purnia recording one death each. Another death was reported from Uttar Pradesh. The April 25 earthquake had left 58 dead in Bihar, the largest in the country. The Nepalese Embassy in Delhi, quoting information till 1640 hours, said the fresh quake and aftershocks left 21 dead and 543 injured, even as the country is grappling with a humanitarian crisis of Himalayan proportions, with the April 25 temblor having claimed over 8000 lives. Today's quake struck at 12:35 PM some 70 kilometres east of capital city Kathmandu at a depth of 18.5 kilometres, followed by three aftershocks of 6.2, 5.4 and 4.8, Indian Meteorological Department said. Though the quake was felt in areas far apart from Delhi to Chennai, there were no reports of casualties or major loss of property from these places. The ripples from today's quake brought back the memories of April 25, with panic-stricken residents rushing out of buildings in Delhi, West Bengal, Assam, Odisha and Uttar Pradesh. At least 12 students were injured in a school in Darbhanga in Bihar as children rushed out to safety from class rooms after the tremors. The Delhi Secretariat as well as many government buildings in the national capital were evacuated immediately after the quake. Metro services were immediately restricted. Prime Minister Narendra Modi reviewed the situation in the aftermath of the fresh quake and directed the authorities concerned to be on alert to rush in relief and carry out rescue operations wherever necessary. "PM took stock of the situation following the fresh major earthquake felt in Nepal and parts of India, at a high-level meeting," the Prime Minister's Office said. The Home Ministry is collecting information from states about the damage caused by the quake and National Disaster Response Force has been put on alert, Union Home Minister Rajnath Singh said. Director General of IMD LS Rathore said aftershocks could continue for weeks or maybe months. The Indian Army said in a statement that its teams are assessing the damage and working in close coordination with the Nepal Army. The Advanced Light Helicopter (ALH) continue to be employed for rescue efforts in Pokhra and adjoining areas in spite of weather and terrain limitations and have conducted 8 sorties and brought to safety 27 people besides delivering nearly eight tonnes of relief material to inaccessible areas. The Indian Army Field Hospital at Senamangal treated seven Nepal Police personnel with minor injuries apart from activating two medical teams with ambulance for receiving casualties at Kathmandu Airport, the statement said. With Nepal again struck by a high intensity temblor today, External Affairs Ministry has set up control rooms both here and in Nepal to provide information. While the ministry set up the control room here, it also re-opened the command room in Nepal which was established after the April 25 massive earthquake. Meanwhile, the Spokesperson in the MEA said, "Our Embassy in Kathmandu and all staff members reported to be safe." A powerful earthquake measuring 7.3 on Richter scale with epicentre in Nepal sent ripples through large parts of east and north India, including Delhi during noon, less than three weeks after the region was struck by a devastating quake. NDRF stock of the situation and directed authorities concerned to be on alert for carrying out rescue and relief petrol or diesel will be available from tomorrow. Government claims are false that valley has stock of 17 days. I can say with the surety that the petrol pumps will be dry from tomorrow morning,” Bilal Ahmad Bhat, general secretary of Kashmir Valley Petroleum Dealers told KNS. According to KNS correspondent anxious people of the valley rushed to refill their vehicles on Tuesday, while long queues were seen outside the filling stations in the summer capital due to emerging fuel crisis in the Kashmir valley. Several dealers in the valley also preferred to shut-down their petrol pumps after raising an alarm that they were facing a shortage in fuel supply due to which many outlets have begun to dry up. “We are facing huge inconvenience as our deposits are running dry which in turn has affected the public,” a dealer said. He said there is no dearth of land for development purposes as 40 per cent of land in the SEZ was lying unutilised but the NDA government was hell-bent on taking the land only from the farmers. Terming the government as anti-farmer and anti-poor, Rahul said it does not want to acquire land in Bundelkhand or in the deserts of Rajasthan but those near big cities like Noida, Gurgaon and Pune to make money as their prices have been rising. The Congress leader said the law enacted in 2013 had a provision that land, acquired from a farmer, will have to be returned to the farmer if no project comes up in five years. It can either be that their mind changed, or they are scared lest they say something wrong," the Congress leader said. P Venugopal (AIADMK) accused the government of creating "history of sorts by bringing the second (land acquisition) bill even before the first bill has been passed". Expressing "serious apprehensions" about its provisions, he said the government should be reconsider the measure. Sudip Bandopadhyay (TMC) opposed the bill, saying his party has been against any move for "forcible acquisition of land" and had protested such moves in Singur in West Bengal. Questioning the necessity of bringing the new bill, he said it had opposed the earlier bill also, which was then supported by both BJP and Congress. Opposing the measure, B Majhi (BJD) warned that land acquisition had "major repercussions" as those displaced never got proper compensation and were pushed into penury. Arvind Sawant (Shiv Sena) demanded that the bill be sent to the joint parliamentary committee, as he sought explanation from the government as to why the consent clause was being removed or social impact assessment not being done. Noting that those displaced by Koyna Dam or Narmada projects were yet to be properly rehabilitated, he said "I am pained that you (government) have not thought of these issues." Maintaining that a job would be given to only one member of a displaced family, Sawant said even this job would be given only after the project comes up. He also wanted to know whether "you will remove a factory along one km of an industrial corridor or just take land from the farmer." Opposition members, including AIADMK, protested moving of the bill for consideration, saying it was a futile exercise as a similar bill was already passed by the House earlier. They sought a division but Speaker Sumitra Mahajan adjourned the House for ten minutes. When the House re-assembled, Parliamentary Affairs Minister M Venkaiah Naidu said the government was willing to send the bill to a parliamentary committee and the opposition should decide if they want to discuss it or not. Saugata Roy (TMC) said they wanted division but Mahajan adjourned the House noting that the strength of the treasury benches was low that time and sought a ruling from her. An upset Mahajan said, "Don't say so. Don't let incorrect matter go on record". She said the motion for consideration and passage of the bill was adopted. Mulayam Singh Yadav (SP) cautioned the government against taking away land from farmers saying if they commit this "sin", they will again become opposition party in Parliament. Yadav said his party is not against industrialisation, but demanded to know from the government the names of the corporates who would acquire land, how many people would get employment and what kind of job would they be given. Md Salim (CPIM) said the Centre is undertaking "futile exercise" and bringing Ordinance as they are unable to pass legislations in Parliament. He said the government is unable to assess the gravity of the situation and alleged that some members of the treasury benches were sleeping when the land Bill was debated in the House. The ruling party considers farmers to be "helpless" lot and hence do not think necessary to take their consent for land acquisition. "The amendment to 2013 Land Acquisition Act is based on greed and not on need," Salim said, adding that the Centre is now following the Gujarat model which is based on giving away land to corporates. Rajamohan Reddy (YSRCP) opposed the Bill saying the party is against acquisition of multi crop and fertile land. Opposing certain amendments in the Bill, N K Premachandran (RSP) demanded that it be referred to the JPC. He said even if the consent clause is being done away with in case of defence projects, the social impact assessment should remain for all projects. B Vinod Kumar (TRS) demanded to know in which states are the corporates facing trouble in land acquisition. He demanded that the Government should have discussed with all political parties and Chief Ministers and then bring the legislation. He also wanted the Bill be referred to JPC. The Chief Minister went around the golf course and inspected the site for creating additional accommodation and developing a ski slope to the north of PGC, which will provide basic training to children and ski enthusiasts. The 18-hole Pahalgam Golf Course, with sprawling greens and fairways, is considered one of the most ideally located courses in the country. Mufti Sayeed directed Chief Engineer PDD to install automatic governance system to ensure uninterrupted power supply by the end of this year in Pahalgam Resort. A search operation was launched in the forest area of Sagipora, falling under Sopore police area, following information about presence of a militant hideout there, a police official said. He said during the search operation, a hideout was busted and large quantity of arms and ammunition were recovered. The recoveries included 33 IEDs, 44 grenades three UBGL, 4.5 kg gunpowder, eight detonators and seven safety fuses, the official said. Four AK rifles, 15 magazines, 756 AK rounds, three pistols and 19 pistol rounds were also recovered from the hideout, he added. J&K "The outcome of appropriation audit shows that in 47 cases, the saving exceeded Rs one crore in each case or by more than 20 percent of the total provision," a CAG report on state finances for the year ending March 31, 2014 said. The report stated that against the total saving of Rs 7,424.66 crore, the saving of Rs 6,970.06 crore (94 percent) occurred in 20 cases relating to 16 grants. As per the Budget manual, the spending departments are required to surrender the grants, appropriations or portion thereof to the finance department as and when the savings are anticipated, the CAG report added. CAG further revealed that at the close of 2013-14, there were 27 grants and three appropriations in which the savings occurred. However, during the year to which the report pertains to, no surrender of savings was made by the concerned departments, it said. The savings in these cases was of the order of Rs 7,424.66 crore in 47 cases where the savings per case were Rs one crore and above per case. "Non-surrender of the saving funds deprived the government to transfer these funds to the needy sectors", the report said. The petitioner after locating the parents of the child rushed to their Village Ragura at the outskirts of Jammu near ASCOMS Sidhra, Jammu and the poor parents informed her that since 12-04-2015 their child is missing from the residence of the aforementioned Judicial Officer and the Police has miserably failed to locate the missing child and the parents further disclosed that their ward was working in the residence of the aforementioned Judicial Officer as a domestic help for the last three years and the said Judge had promised initially to send him to the School and later to employ him suitably by using his contacts. They further divulged that the said Judge and his wife have refused to share the details of their missing son and have closed their doors for them and infact have used unparliamentarily language against them and have further threatened to deal with them since he is a Judicial Officer. The Minister has sought a report in this regard within a week. He also called for fixing responsibility so that appropriate action is taken. Kohli asked the traffic authorities to ensure better coordination with the concerned agencies to avert such mishaps in future. He said adequate corrective measures should be taken to avoid recurrence of such tragic incidents. The Minister said that the Motor Vehicles Act would be further strengthened and drivers involved in overloading, rash driving and other traffic violations would be dealt with severely under the law. Stressing on prompt and fair implementation of road safety measures, the minister instructed the concerned officials for putting in place an effective mechanism like installation of crash barriers, checking overloading and rash driving to ensure safety of passengers. Praying for eternal peace to the departed souls, the minister conveyed his condolences to the bereaved families. He asked the district administration to ensure specialized treatment to the injured and all assistance to the bereaved families. He also wished the injured early recovery. The Minister was speaking as Chief Guest on the occasion of first ever ‘Youth Parliament’ organised in the State. The Group Level Competition for the 12th National Youth Parliament was organised by the Department of Student Welfare, University of Kashmir. Vice Chancellor, University of Kashmir, Prof. Khursid I Andrabi was the Guest of Honour, while as Vice Chancellor, Central University of Kashmir, Prof. Mairaj-ud-Din, Group Coordinator, Union Ministry of Parliamentary Affairs, Dr Harshad Bhosale and Deans and faculty of various departments were also present on the occasion. Reiterating the commitment of giving focused attention to human resource development in the State, the Minister said that he has been trying to identify himself with the community of teachers and students and making efforts to bring back the glory of education system with focus on students. “We have to make a conscious effort to build human resource out of opportunities, hope, encouragement, talent, untapped energies and unexploited potential that we have,” the Minister said. He also suggested the Vice Chancellor to take a lead role to have a formal students union in the University because it is them who DB stays Dr Showkat Choudhary’s demotion; directs Writ Court to decide all petitions CYM K Jammu, May 12: In a LPA filed by filed by Dr. Showkat Choudhary challenging his demotion, A Division Bench of State High Court Comprising Justice Hasnain Massodi and Justice Janak Raj Kotwal after hearing Adv Vikram Sharma appearing for the appellant whereas Deputy AG PS Chandel appearing for the state and Adv Ajay Abrol appearing for the caveator, ordered that this Division Bench is of the opinion that the respondents in terms of the writ court order dated 28.04.2015 are required not to act upon and implement the government order No. 139-HME of 2015 dated 22.04.2015 ( whereby Dr. Shoket Choudhary was demoted) till the matter comes up before the writ court and is modified, altered or extended. DB observed that as order called in question in LPA is a threshold order and learned writ court has exercised discretion in favour of the appellant and passed the interim order in his favour though according to appellant liable to be misinterpreted, we find it appropriate to take up the appeal for final disposal at the outset. Aggrieved with Government order No. 139-HME of 2015 dated 22.04.2015 whereby government order Nos. 367HME of 2013 dated 26.06.2013, 415-HME of 2013 dated 22.07.2013 and 220-HME of 2014 dated 23.04.2014 stand revoked ab-initio and the seniority of Lecturers in discipline of Medicine in Government Medical College Jammu notified vide Government Order No. 265-HME of 2013 dated 16.04.2013 restored, appellant has filed the Writ Petition being SWP No.1216/2014. Division Bench further observed that appellant is currently holding the position of Assistant Professor in Own Pay and Grade (OPG) in Medical Gastroenterology, Super Specialty Hospital, Jammu and seeking quashment of Government Order No.139-HME of 2015 dated 22.04.2015 inter alia on the ground that the order has been passed at his back without affording him opportunity to put forth his stand. It is pleaded that the order impugned in the writ petition does not only reduce him in rank but changes his seniority in the cadre of lecturers and the respondents therefore were required to hear the appellant before passing the impugned Government Order. Division Bench while passing the order, Writ Court obviously intended to preserve the lis so that the appellant was not non- suited till the respondents disclosed their stand and matter was considered and also to avoid multiplicity of litigation. In the event, order impugned in the aforesaid writ court was allowed to be implemented, number of issues would arise triggering further litigation between the parties and even the colleagues affected by the order. Division Bench there is substance in the argument advanced by counsel for the appellant that the status quo order is likely to be misinterpreted as protecting the steps if any taken under the im- was transferred. He further submitted that the beneficiary of the illegal transfer of the land has already been arrayed as respondent and thus there is no need to file the fresh application. Upon this Division Bench recorded the submission of counsel for the petitioner. Advocate Ahmed further submitted that then Divisional Commissioner Jammu Shantmanu in his enquiry report has established that land measuring 20 Kanals comprised in Khasra NO 1442 was illegally sold by tempering the revenue records and no action has been taken against the arraying officials and the beneficiary. He further submitted that action taken report be summoned from GAD which had ordered the holding of enquiry into the matter. After hearing both the sides, Division Bench in the open Court directed General Administration Department to file Action Taken Report before the Court with regard to enquiry report submitted by then Divisional Commissioner Jammu Shantmanu before the June 10, 2015. There is merit in the argument that ad interim order is required to be passed with sufficient clarity so that all chances of misinterpreting the order are excluded and the intended purpose while passing the order achieved. Mr. P S Chandel, Dy Advocate General appearing for the Health and Medical Education and Sr. Adv. Bhardwaj, appearing for private respodent would argue that the case set up by the appellant before the writ court is bereft of any merit and that having regard to the law laid down supreme Court, interference would not be warranted. Division Bench after hearing both the sides observed that We don’t propose to embark upon an exercise to examine the merits of the case projected before Writ Court. The order questioning the present appeal as already indicated is a threshold order and it would be appropriate to leave it to the writ court to make such exercise once the pleadings are complete. We are only concerned with import of writ court order questioned in the Letters Patent Appeal in the background of the grounds urged in the appeal including the ground that the impugned order may be taken to be one declining ad interim relief to the petitioner. With these observations Division Bench ordered that the respondents in terms of the writ court order dated 28.04.2015 are required not to act upon and implement the government order No. 139-HME of 2015 dated 22.04.2015 till the matter comes up before the writ court and is modified, altered or extended. Division Bench also requested Writ Court to make an effort to dispose of all the petitions preferably within a period of four weeks thereafter, so that the question of inter se seniority between appellant and respondent no.3 gets settled once for all and the parties, who are specialists in their respective disciplines, teach the medical students, serve the patients admitted in Government Medical College Jammu, instead of making repeated rounds of law courts.
