follow up.
"States are in chaos about whether
they should have a Plan or not. The 14th
Finance Commission has changed fiscal
federal system in India (but) there is no
corresponding follow up about how this
will work," he said. (PTI)
The Jammu and Kashmir government, in which BJP is a partner, on
Wednesday indicated that it may not implement the Goods and Services Tax
(GST) regime being pushed by the central NDA government, saying it will compromise the state's special position.
"Jammu and Kashmir is unlikely to
implement GST regime as it compromises its special position.... J&K is the only
state that has the authority to legislate on
all taxes and this will go with the new
GST regime," state's Finance Minister
Haseeb Drabu said.
Drabu, who belongs to PDP, was
speaking at a function at Kashmir
University on current fiscal's Economic
Survey by Chief Economic Advisor
Arvind Subramanian.
The Centre plans to roll out the GST
regime of indirect taxes by April 1, 2016.

Decision on
Geelani passport
after considering
security issue:

New Delhi, May 20
A decision on granting passport to
Kashmiri separatist leader Syed Ali Shah
Geelani will be taken considering various issues, including national security, Minister of
State for Home Kiren Rijiju said today.
"The Home Ministry has not yet received
anything regarding his (Geelani) application
for passport. When we will receive it, we will
take a decision taking into account various issue like national security," he told reporters
here. Rijiju was replying to a question on the issue of granting passport to the hardline
Hurriyat faction leader who has applied for the
travel document to visit his ailing daughter in
Saudi Arabia. Jammu and Kashmir's ruling
coalition partners PDP and BJP were sharply
divided today over the Geelani passport issue
with the regonal party saying it would approach
the Centre for granting the travel document on
"humanitarian" grounds.
Official sources said Geelani and his family
members want to travel to Jeddah and had applied for passports online. But he has not yet visited the regional passport office in Srinagar to
give his biometric data and clicking the photograph. As per the new rules, an application must
visit the passport office in person to give biometric details and click the photograph.
Sources said after Geelani visits the passport office to complete the formalities, his application will be sent to the Ministries of Home and
External Affairs for their comments as he falls
in prior security clearance category for issuing
a passport. The Ministries, then, in consultation
with the Jammu and Kashmir government,
would take a final decision on granting the passport to him. Geelani was issued passport in 2007,
2008 and 2011 with a validity of one year in each

curbing the activities of anti-national elements is mandatory for
better.
Mr Kumar said coordination
among different agencies would
lead the efforts towards a right direction for ensuring a lasting
peace in the State. All stakeholders have to follow a people friendly approach while dealing situations and exhibit tolerance,
avoiding excess use of force.
During the meeting, officers representing different agencies gave
appraisal about the security, law
and order scenario in the Valley.

As many as 40, 580 students
including 21, 745 male and 18, 835
girls appealed in the examination
for plus two in Higher Secondary
out of which only 19, 775 could
clear the examination. Out of 19,
775 pass percent, 9, 720 were male
and 10, 005 girls. The percent of
pass girls was 53.38 percent which
was higher than boys as their pass
percent was 44.70 %. In this result,
around 2, 677 students got failed in
the examinations and 18, 128 oth-
ers got reappear in various subjects. Pertinently, a total of 86 students, which include 62 girls,
shared 40 positions in four sub-

83 percent schools in
JK have no computer,
internet facility
Srinagar, May 20:
At a time when a dismal performance is shown by the government
schools during the recently conducted
class 10th exams, figures are enough to
reveal why government run schools lag
behind the private ones in JK.
There are 83 percent of the schools
in Jammu and Kashmir without the internet facility at present and more than
12 percent without the library facility,
reveals the survey conducted by MHRD
in JK. The survey in detail had revealed
that in the year 2012-13 83.93 percent of
the schools in Jammu and Kashmir
were without the computer and internet facility. After one year, in 2013-14,
83.02 percent of schools were still without the computers and using of internet
continued to remain a distant dream for
the kids studying in government
schools.
According to KNS correspondent,
the survey informed further that in the
10+2 level schools, in the year 2012-13,
there were 76.75 percent of schools without the facility of computers and internet. Meanwhile, in 2013-14, 69.63 percent
of the schools in Jammu and Kashmir
still imparted education via medieval
age methods. The survey aggregated
the percentage of all schools in Jammu
and Kashmir that in 2012-13, there were
83.92 percent of secondary as well as
higher secondary schools without the
facility of computers and internet while
as in 2013-14- the percentage keept
shocking the experts as it remained
83.03 percent. Similarly, there are 18
percent of schools in the state which
have no library facilities available at
all. The survey conducted by the ministry earlier, informed that in the year
2012-13, there were 23.27 percent of secondary schools without the libraries
and in the year 2013-14, the percent remained at a dismal note of 17.89.
There were 19.89 percent of higher
secondary schools in the state without
the facility of libraries and in 2013-14,
the percentage was 10.22. In aggregate,
the survey maintained that in 2012-13,
the percentage of schools without the library was 23.27 while as during the year

He said resorts will be developed
in a planned way and construction for
creating basic facilities for visitors
will be regulated by strictly abiding
to proper procedural norms, as laid
down in the Master Plans.

while taking separate reviews of
Sonamarg, Wullar-Manasbal &
Gulmarg Development Authorities
today. Minister for Law, Justice &
Parliamentary Affairs, Syed
Basharat Bukhari, Minister for
Education, Naeem Akhtar,
Commissioner / Secretary, Tourism
& Culture, Shailendra Kumar and
MD JKTDC and Director Tourism,
Kashmir, Farooq Ahmad Shah, were
present in the meetings. Asking private stakeholders in tourism sector to
upon making tourism infrastructure
revenue generating assets, the Chief
Minister said footprint of high-end
tourists will only improve if we take
steps for creating benchmark facilities at all major destinations. “We
should promote tourism by creating
opportunities of growth and employment in the sector,” he said, while asserting the need for undertaking a
massive publicity drive to promote
week-end and weekday packages.
While interacting with private
stakeholders, the Chief Minister also
reiterated his earlier directions for
constituting Citizen Committees
headed by Chief Executive Officers
that will take on board all stakeholders, including local representatives,
for development of tourist resorts.
While highlighting the potential
of Sonamarg in adventure tourism,
the Chief Minister issued directions
for publicizing Gangabal and
Vishensar-Kishensar Trekking
Routes for adventure tourists. He also
issued directions for engagement of
consultant for laying of golf course,
dedicated line to provide uninter-
rupted power supply, finalizing proposal for scientific disposal of solid
and liquid waste, making streetlights
in bowel functional, establishment of
high-end restaurant / Bukhara, imparting training to locals in landscaping and hospitality and registration
of ponywallas.
The Chief Minister also said he
will take up with BRO the issue of
making Sonamarg Bypass Road functional. MLA Kangan, Mian Altaf
Ahmad and DC Ganderbal, Shaukat
Ejaz, were also present in the meeting
where CEO SDA gave a detailed presentation. While taking review of
Wullar-Manasbal Development
Authority, Mufti Sayeed issued directions for developing the resort as a
major water sports destination. He
called for promoting area between
Waheedpora and Wattalbagh as a
rafting point for adventure tourists.

Tawi Artificial Lake Project should not
be shelved: M K Ajatshartu Singh

has demanded continuance of
Artificial Lake Project at river
Tawi and has asked all the stakeholders to work for realization
of this dream project. In a press
statement issued in Jammu, he
expressed his concern over the
politicization of the issue by different parties and implored upon the government to rather expedite the construction work so
that the project is completed at
the earliest.
M K Ajatshatru Singh has
asked the concerned ministries
to work out all procedural and
technical bottlenecks related to
the project at the appropriate
level and desist from making un-
necessary and controversial
public remarks about the project. Such projects generally undergo revisions and minor
changes but shelving a running
project like this is neither possible nor acceptable as it represents the aspirations of the people of Jammu. In fact, the present government should try to
improve the project by creating
better infrastructure around the
Lake. The Lake should have a
Spiritual centre, Yog centre, a
Haat displaying the rich cultural heritage of various regions of
the state and recreational activities for the tourists and local
population. Instead of making
this project a battleground for
political scoring all the stakeholders must come up with constructive opinions on the project, he opined. This project was
envisaged as a booster for
tourism, irrigation, culture, environment, afforestation, and
overall economic growth of
Jammu and its adjoining areas.
This project is a long pending demand of the people of Jammu region and it should be dealt with
accordingly. There is no question of shelving such a multifaceted project and I will personally ensure that this project is realized at the earliest, he said in
the statement.

During the rally the participant raised slogans demanding
three composite Townships
near Srinagar City for permanent rehabilitation of the
Kashmiri Pandit Migrant
Community in these Townships
with grant of political reservation both in Parliament of India
as well as in J&K State
Legislature. The protestors
have also demanded grant of minority status to the Kashmiri
Pandit Community. Shadi Lal
Pandita while addressing the
protestors has said that each
and every migrant family has
been facing a lot of Rs.2.00 lacs
yearly due to damages to their
properties in Kashmir valley
and has demanded proportionate in Kashmir Valley and has
demanded proportionate compensation for last 25 years in
favour of the Kashmiri Migrant
Pandit families.
It has been said in the rally
that encroachments have been
made over the properties of
Kashmiri Migrant Pandita in
Kashmir Valley as well as over
the properties of religious places,
Temples and Shrines the protestors have demanded immediate
eviction of unlawful occupation
of these properties for ensuring
restoration of the properties
back to original owners. It has also been said that those migrants
employed in different departs in
Kashmir Valley are being harassed by the miscreants which
has necessitated immediate
measures for restricting such harassments besides ensuring.
It has further been said in
the protest rally that in case government fails to meet the demands of this Community, the
Community will accelerate the
agitation and protest rallies and
the consequences thereof shall
be the responsibility of the

staged by causal labor/IT/CP
workers of PHE deptt in front of
Chief Engineer office BC Road
Jammu.
President Tanveer Hussain
addressed the rally in extraordinary situations of anguish and
pain meted out by the previous
state Govt, by making false
promises for regularization of
around 61,000 casual labors
working various departments.
Number of committees and
subcommittees were framed by
the Govt to resolve our long
pending issues & demands, but
every times our files seem gathering dust in the secretariat
such moves of previous government were merely eyewash.
The new coalition government formed only high power
committee for the budget. There
are no provisions for our welfare and neither any step were
taken in order to meet our vested interests. No money or funds
are sanctioned for the regular-
ization and wages of the daily
wagers and C.P Workers.
Moreover there is no increase
in the daily wage given to the casual labor & neither there is any
promise to do the same.
The Association workers
gave a dead line to government
to amicably solve their issues
before May 20, but Govt failed to
resolve their issues and thus the
organization has decided to
completely shut down their
work in both Jammu as well as
Kashmir Region. The demand
highlighted was regularization
policy for all Casual Labours /
ITI Trained/ C.P Workers, Need
based who have completed 5
years of service.
They appealed to various
other organizations and daily
wagers of all departments to
come forward and join our
struggle for better quality of

No statement from Govt regarding fate of Jammu Tulip Garden: SRS

Reiterating his demand for
CBI inquiry in the Jammu Tulip
Garden project, The Jammu and
Kashmir state president of Shri
Ram Sena, Rajiv Mahajan expressed concern over the neglect
of Jammuites, that no one from
the J&K state coalition government of PDP- BJP issued any
statement on the stalled prestigious tourism project worth Rs.
8.5 crore on 563 kanals of land at
Bhour Camp in Jammu, which
was inaugurated by the then
Chief Minister Ghulam Nabi
Azad on March 31, 2008 , meant
for growth of Jammu tourism.
Rajiv Mahajan said, despite
raising the issue of Jammu Tulip
garden on various occasions by
their organization, no one from
the government side especially
the Floriculture minister has issued any statement about the
fate of the prestigious tourism
project which was one among
prestigious
Jammu
other
tourism project like; artificial
lake on Tawi river, PanjtirthiMahamaya Gandola project,
Mansar lake, Surinsar lake,
Purmandal etc. Mahajan demanded CBI inquiry in the expenditure of Rs. 8.5 crore-sanctioned amount for the project
and the status of the garden to be
made public for information of
public. He also asked Speaker
Legislative assembly and MLA
Gandhi Nagar constituency,
Kavinder Gupta under whose jurisdiction the Tulip garden falls
to take the matter seriously and
sort out misappropriation
caused in the funds meant for

Rajiv Mahajan said, that
over the years Kashmir centric
governments have been ignoring Jammu division in growth
and development leaving this
largest region (both population
wise and area wise) starving. He
said, "Despite Jammu having the
great potential of attracting both
domestic and foreign tourists
with extra-ordinary destinations in Chenab valley, RajouriPoonch belt and upper areas of
Kathua district, the erstwhile
governments did not bother to
prepare projects and submit
them to Central Government for
financial support so that many
such areas could be developed as
attractive tourist destinations."
He added that although
some projects were undertaken
from the beginning of this century in Jammu areas, yet they
moved on a slow pace due to negligence of the authorities even
though Jammu division, by and
large, was peaceful as compared
to Kashmir Valley. "It was during a brief stint of the Chief
Minister Ghulam Nabi Azad that
some projects took off in the region for example, the establishment of Tulip Garden in the
vicinity of Jammu city.
Mahajan said the Tulip
Garden at Bhour Camp in
Jammu, which was inaugurated
by the Azad on March 31, 2008,
with the hope that it would become a major tourist destination,
is now crying for immediate attention. He mentioned adding that
the garden, which was raised at a
cost of Rs. 8.5 crore on 563 Kanals of
land on the pattern of famous
Tulip Garden in the Kashmir
Valley, is still without a compound wall as a result, various varieties of flowers in the garden are
being destroyed by cattle, which
can be seen grazing there. "Out of
563 kanals, seven varieties of flowers have been cultivated on 207
kanals," he said adding that the
hope with which the garden was
inaugurated to promote tourism
in Jammu has completely died
down because the caretakers of
the garden are not provided with
material for its maintenance.
Rajiv Mahajan further alleged
that the Floriculture Department
cannot maintain it properly as no
discreet directions were given by
the former Chief Minister Omar
Abdullah or present incumbent
Mufti Mohammad Sayeed. In the
absence of a compound wall, he
said, stray cattle enter the garden
and graze in it and thirty gardeners have no option but to watch
them destroy the garden helplessly. So has been the approach of the
former Coalition Government
headed by Omar Abdullah and
the now coalition Chief Mufti
Mohammad Sayeed towards developing tourist destinations in
Jammu. Mahajan appealed all
Jammu based political parties,
Bar association, chambers of
commerce, traders, social and religious organizations to rise on
the occasion and fight for the development of Jammu unitedly.

the new selection criteria is totally “Anti Students” in which
selection through JUET will be
based on 75 percent on merit and
25 percent through entrance,
earlier it was 60 percent on merit
and 40 percent through entrance. Through this decision,
hard working students having
lower merit are disappointed
and are against such policy
framed by university authorities. He categorically slammed
the V C for changing the norms
and hike in late fee, claiming
that earlier late fee per day was

has to pay 3800 rupees whether
he delayed for 1 or 15 days, it is
the same. He asked the V C that
why students were not consulted
before making such blind policy
and what is the reason in making

Elaborating on measures being initiated to generate employment and ensure a settled life for tribals, Minister for
Consumer Affairs and Public
Distribution and Tribal Affairs, Ch
Zulfkar Ali, today said that Govt. would
soon be launching a scheme for development and marketing of tribal produce in
the state. “The programme would go a
long way in raising socio-economic profile of nomadic populace through skill development enabling them to lead a dignified life”, the Minister maintained.

that larger objective of a separate Tribal
Ministry is to provide more attention on
integrated and holistic development of

Akhtar today announced Rs 5 lakh
for M P School Srinagar from his
Constituency Development Fund
(CDF), for development of football
ground and upgrading related facilities at the school. Stressing the need
to rejuvenate the educational scenario in Government Schools, the
Minister said that extracurricular
activities are as important as academics for over all personality development of the students. This was stated by the Minister during his visit to
M. P. School here at Bagh-e-Dilawar
Khan, Srinagar. The Minister, while
recalling the historic importance of
the area – Sheher-e-Khas where the
institution is located said that, it is
the real identity of Kashmir valley
and M. P. School is an institution of
special importance requiring special
attention of the Government.
The Minister during his visit interacted with the staff and the students, and took stock of entire gamut
of infrastructure, availability of
teaching faculty, and other related
facilities available at the school including canteen, library, sports facilities, toilets etc. The Minister asked
for promotion of extra-curricular ac-
tivities in the school and announced
constitution of a Mountaineering
Club for the institution, which
would promote culture of exploration and observatory learning
among the students. In this regard,
Mahmood Ahmad Shah, President,
J&K Hiking and Mountaineering
Club gave a detailed presentation on
the same and it was decided that the
Physical Education Master of the
School shall register the students for
a trek trip to be organized over the
week-end. The Minister also gave directions for organizing a four-day
field trip to Wadwan, Kishtwar for
the school students, for which they
shall be provided tents and sleeping
bags by the JK Police and bus facility
by the department. The Minister also instructed to have various out-
door competitions like Photography,
painting, etc. during the trip for
which he announced release of Rs
50,000 for purchase of cameras for
the school. The Minister informed
the students that there shall be after
school classes introduced from this
session for all those students who do
not have any academic guidance at
home. The faculty members of repute in each subject shall be taking
extra classes for all those students
who are willing to attend the same after school time. While going through
the books available in the library of
the school the Minister, emphasized
on strengthening the Library and also inculcating habit of reading books
in the students as well as faculty. The
Minister also paid a brief visit to
Gandhi Memorial College.

6. The bid for the work shall be remain open for acceptance for a period of 180 days from the date of the opening of bids. If any bidder/tender withdraws his bid/tender before the said period or makes any modification in the term and conditions of the bid, the said earnest money shall stand forfeited.

8. In case the work not be started within the time stipulated for start of work. The work will automatically be treated as cancelled and no correspondence shall be made for the same and CDR will be forfeited without any information. However in case the contractor applies for the grace period

time only.

7. The bid i.e. technical bid as well as financial bid is to be submitted online on web portal www.jktenders.gov.in. However, the firms will submit the
supporting documents as required to be submitted along with technical bid in off-line mode in physical form to the office of the Superintending
Engineer Hydraulic Circle, Jammu. In case supporting documents are to be submitted offline in physical form, then it should be so specified in
their technical bids & the supporting documents must be deposited in the office of Superintending Engineer Hydraulic Circle , Jammu before date
and time of opening of Tenders.
8. In case the work is not started with in time stipulated for start of work. The work will automatically be treated as cancelled and no correspondence
shall be made. However, If the bidder applies for the grace period before the date of start of work that too on valid grounds supported with documents, his request for grace period will be considered for one time only.
9. The Bidders are requested to read the detailed instructions attached with the Bid document also before submission of on line Bids.
10. In case the Bid is found un-reasonable i.e. equally or to less than 15% below the advertised cost, the bidder shall have to submit the additional security of 5% of contract amount in the shape of CDR/ FDR in advance before the last date of opening of Tech. Bid, falling which the tender shall be

Save Farmers
he peasants and farmers of India are the most resilient
and independent community. They have defended their
rights and fought injustice and bounced back after every
flood, drought and crop failure. Why then are they giving up on
life today? Why are they committing suicide in such large numbers? Addressing these questions has become a critical survival
imperative not only for farmers, but also for all of us who rely on
the food they put on our tables. The epidemic of farmers’ suicides
in India started after 1995, when agriculture policies were
changed under the pressure of the World Trade Organisation
agreements that ushered in the era of corporate globalisation.
When Lee Kyung-hae, a South Korean farmer, killed himself at
a WTO protest in Cancun, Mexico, in 2003. He wore a sign that
read, “WTO kills farmers”. Corporate globalisation has brought
four tectonic shifts to Indian agriculture as well, setting it on the
path that’s leading to devastation. Firstly, corporate globalisation replaced food sovereignty with import dependency. A false
idea was generated whereby food security did not mean growing
your own food, but, instead, importing it. For this idea to be
turned into practice, India dismantled every policy that had ensured justice for our small farmers and guaranteed our food security.They are exploited when they buy expensive seeds and
chemicals. Often these seeds and chemicals fail, which compels
the farmers to buy more seeds on credit or loan from the companies in the hope that the next non-renewable seed and the next
toxic chemical might save them. This is the seed-chemical treadmill that has trapped countless farmers across the country. Second, farmers are exploited by an industry that buys agriculture
produce at cheap rates as raw material. When farmers grow food,
they eat the food as well as sell what’s excess in the local market.
When farmers grow cotton, sugarcane, potato, corn or soyabean,
they cannot eat their produce and must sell their produce to big
industries. Industries pay exploitatively low prices, which aren’t
enough for farmers to buy the food they can eat. The epidemic of
farmers’ suicides began in the cotton belt where Monsanto,
American biotechnology corporation, has monopolised the cottonseed supply with its genetically modified organism Bt cotton.
Over the past year, suicides have spread to potato farmers in
West Bengal who are growing potatoes for Pepsi Co. When farmers don’t even receive the minimum support price, they borrow
from moneylenders and banks. After being hounded by the
banks for repayments that they cannot make, farmers end up
taking their lives. In September 2014, many sugarcane farmers
committed suicide because the sugar mill owners were unable
to pay the farmers. In spring 2015, due to untimely rains at harvest time and the subsequent destruction of crops, farmers of
Bundelkhand and Rajasthan committed suicide. They were unable to survive under an agriculture model that was failing them.
Our farmers must be liberated from seed slavery and dependence
on high cost, unreliable and ill-adapted corporate seeds. Farmers
must also be liberated from high cost and toxic inputs that are
perpetuating the cycle of debt and creating disease. Liberation
from poisons in agriculture is liberation from poisons in our food
system. Farmers’ suicides are the direct result of an exploitative
economic model seeking to maximise corporate profits at the cost
of farmers’ lives. The answer to this is not to call for the end of
small farmers, but to give them respect and justice, and recognise
that small farmers are the backbone of national food
security.Farmers keep India’s 1.3 billion-strong population fed
with their blood, sweat and tears, with their skills and knowledge. If Indian peasants and small farmers are wiped out no one
else can feed India. India’s agriculture and food systems are
based on diversity. Imagine your thali with food cooked from
GMO corn and soya (the only major crops grown in the US), without spices, without local vegetables, without indigenous edible
oils, without desi wheat or rice or millets. So let every meal become a moment to thank our farmers, our annadatas, for the diversity of food they grow to bring us health, nourishment, taste
and culture. Swaraj, sovereignity of our agriculture is not a luxury; it is a survival imperative. And it is in our hands.

No acche din for higher education

esides cuts in state funding which is a
critical area of concern, the BJP-led
government’s overall approach to education is destructive of autonomy, creativity
and diversity. Not a single Indian institution
of higher learning figures in the list of top 200
universities prepared by The
Times Higher Education Supplement. These dismal rankings are quite often taken as a
measure of the crisis of higher
education in India, notwithstanding the obvious limitations of the ranking exercise.
But all is not well with Indian
So far, the
universities.
Narendra Modi government
has done very little to address
the crisis in higher education. The government started on a controversial note. Prime
Minister Modi’s selection to head the Ministry of Human Resources and Development
raised questions about the importance of education under this dispensation as it showed
scant regard for education in spite of the fact
that the Sangh Parivar takes education very seriously.
Lower budgetary allocation
The government’s first Budget has not
delivered achhe din for higher education in
the country. The Union Budget for 2015-16 has
reduced funds for higher education to the
tune of Rs.3,900 crore in its revised budget estimates for the financial year 2014-15. The
government has revised the figure to
Rs.13,000 crore, as against Rs.16,900 crore for
the plan allocation. The overall education
budget of the Modi government is down from
Rs.82,771 crore to Rs.69,074 crore. The government has also revised allocation for the
Rashtriya Uchchatar Shiksha Abhiyan
(RUSA) — which is a Centrally Sponsored
Scheme (CSS), launched in 2013 that aims at
providing strategic funding to eligible state

higher educational institutions — to Rs.397
crore as against Rs.2,200 crore in the original
Budget. Despite the trend of passing on the
responsibility of education to the private sector, there is a strong case to expand state
funding of education. The role of publicly
funded education in the democratisation of
access to higher education in India is indisputable. Treating the higher
education system as a public
good, the Indian state has
been successful in providing
access to institutions of
higher learning to many
groups which were hitherto
not able to access it. This is
only possible if there is adequate state funding and public regulation for the entire
system of education from school to university. Far from expanding publicly funded universities with an increase in budgetary
allocation of education, state funding is being
steadily withdrawn from education in general and higher education in particular so
that private capital, both Indian and foreign,
can be encouraged. The privatisation of
higher education is now an irreversible trend
in India, where a majority of the institutions
have been established by the private sector.
In the midst of this trend, it is the arts and humanities that are being pushed aside.
Move towards centralisation
Besides cuts in state funding which is a
critical area of concern, the Bharatiya Janata
Party (BJP)-led government’s overall approach to education is destructive of autonomy, creativity and diversity. The manner in
which the state is intervening in higher education is causing concern among both teachers and students. There are alarming
proposals to change the very nature of higher
education. The most disturbing is the proposal to revive the Central Universities Act
of 2009 which will require the Central univer-
sities to follow a common admission procedure and common syllabus. Even though the
United Progressive Alliance (UPA) regime
and the current National Democratic Alliance (NDA) government have been remarkably similar in their desire to introduce
changes in the higher education system, most
of the UPA’s major proposals got drowned in
the Parliament logjam which continued till
the last session of the 15th Lok Sabha. Also,
there was some debate and opposition within
the UPA government which could be another
reason why the government couldn’t implement its agenda. This government is pursuing the reform agenda much more
aggressively leaving little scope for dissent
and disagreement. The Central University
(CU) Act seeks to replace the existing Central
universities with one single Act which would
require all universities to follow a “common”
admission and “common” syllabus along
with “transferable” faculty. India’s higher education system, serving a large and heterogeneous population, should ideally support a
diverse and decentralised system. However,
the CU Act will do the opposite; it aims at centralisation and homogenisation, ignoring the
specificities and uniqueness of each university. Each University’s Act has a specific context and mandate, and each has developed its
own pattern of knowledge production and reproduction. For example, the Delhi University Act (1922) was in response to the need to
provide for the educational needs of an
emerging India and incorporates a wide college network. The founding ideas of the Jawaharlal Nehru University, on the other hand
are quite different from other institutions.
The impulse for the Jawaharlal Nehru University (JNU) Act (1966) was to institutionalise the values and vision of “national
integration, scientific temper, and humanism”. These Acts have shaped their curriculum, academic ethos, teaching and research.

Lankan Army eliminated LTTE
supremo Prabhakaran. While he and
his outfit claimed to be campaigners for the
Tamil cause, they had killed several hundreds of fellow Tamils It was on May 19 six
years ago, that the Sri Lankan authorities
officially announced the death of Liberation
Tigers of Tamil Eelam supremo Velupillai
Prabhakaran. The day is remembered with
joy and relief by an overwhelming majority
of people in the island-nation, and in India
too. Prabhakaran and his LTTE had not
only terrorised the Lankans but also masterminded the assassination of a former Indian
Prime Minister, Rajiv Gandhi. He was our
enemy as much as he was of the Sri
Lankans. And yet, amazingly, certain
prominent politicians from Tamil Nadu continue to consider him a hero and a martyr to
the Tamil cause. They observe his death anniversary just as they celebrate his birth anniversary on November 26. Marumalarchi
Dravida Munnetra Kazhagam chief Vaiko
created an unwanted splash on the latter
day last year, by cutting a birthday cake for
the slain terrorist. People like Vaiko never
tire of flaunting their secular credentials.
So, savour this speech he is supposed to
have given, and played on loudspeakers in
areas the LTTE then controlled in the north
of Sri Lanka during its heyday: “They say
IPKF (Indian Peace Keeping Force) is killing
Tamils and raping Tamil women. There are
Maratha, Sikh, Gurkha and Madras regiments and so on. No one from the Madras
regiment will commit such atrocity. It is the
others who are indulging in such crimes”
(The Prabhakaran Saga, S Murari; Sage
Publications). Vaiko was then in the
Dravida Munnetra Kazhagam. Journalist
and author Murari writes in the book that
he was “horrified at the attribution of ethnicity to a professional and apolitical army”.
The MDMK leader forgets the exploits
of his hero, who had turned against his community’s members, using them as human
shields. He forgets the ruthless elimination
at the LTTE’s hands and at his orders, of
Tamil leaders, both in the political and the
separatist movements. And Vaiko also does
not wish to remember that the three-decade

The unreasonable fear of a coup
long war which the LTTE waged against
Colombo consumed an estimated 1,20,000
lives — most of them innocent (Sri Lanka:
The New Country, Padma Rao Sundarji;
HarperCollins). One of the tallest leaders of
Tamil Nadu and former Chief Minister M
Karunanidhi of the DMK too had never concealed his fondness for Prabhakaran. He had
refused to be present when the last contingent of the Indian Peace Keeping Force arrived in Chennai on March 23, 1990. His
explanation for the snub was: “Being a
Tamil, I cannot receive an army that has
killed and raped thousands of Tamils” (The
Prabhakaran Saga, S Murari; Sage Publications). To all these people, it never mattered
that Prabhakaran was ruthless in his bid to
establish hegemony over the violent movement. “The LTTE’s aim was to become the
sole representative of the Tamils in Sri
Lanka. The terrorist tactics of the LTTE
treated these Tamil political parties as essentially expendable” (Sri Lanka and the Defeat of the LTTE, KM de Silva; Penguin
Books). The author goes on to write,
“TULF’s (Tamil United Liberation Front)
founder and leader SJV Chelvanayagam
died in 1976 when the LTTE was operating
in its earlier phase. All the leaders of the
TULF after Chelvanayagam were killed by
the LTTE. This was done over a ten-year
stretch from 1989 onwards.”
No dissenting or differing voice was
spared. A Amirthalingam, Uma Maheswaran, K Padmanabha, Y Yogeswaran,
Sri Sabarathnam and others who belonged
to various outfits fighting for the Tamil
cause, were murdered. Padmanabha’s
killing happened on Indian soil in June 1990,
in Tamil Nadu. S Murari writes, in his book
quoted earlier, “Pathmanabha (or Padmanabha) made the fatal mistake of holding the
central committee meeting of the EPRLF
(Eelam People’s Revolutionary Liberation
Front) in Chennai…With the entire State
machinery at its disposal the LTTE had access to State intelligence.” The result was
that a killer squad made it without trouble
to the group of EPRLF leaders, and eliminated 13 members, besides Padmanabha.
Murari adds, “Karunanidhi not only allowed the killers to make a getaway, but also
rubbed salt in the wound by detaining more
than a dozen EPRLF members under the
NSA (National Security Act).”
Also, Prabhakaran’s brutal treatment of
the Tamil-speaking Muslim community of
Sri Lanka never troubled leaders like Mr
Karunanidhi and Mr Vaiko, who, otherwise,
are at their shrillest on secular causes in
India. In the book mentioned earlier, KM de
Silva notes, “…the Muslim minority, especially those in the eastern province, have
been deeply concerned about the dangers of
their political marginalization in a decentralized political and administrative structure. The mass expulsion of Muslims from
the whole of the northern province by the
LTTE on October 22, 1990, the sole example
of ethnic cleansing in Sri Lanka, naturally
strengthens these fears.”
This development was the first major
sign of things to come. Earlier, the Tigers
had sought to enlist the support of the Muslims in their war for a Tamil nation. Perhaps they did not get the desired response,
so they retaliated. This is how journalist-author Samanth Subramanian puts it: “In the
space of a few hours in October 1990, the
Tigers emptied Jaffna of its 24,000 Muslims,
suddenly and efficiently, the way a can of
peas might be overturned and thumped on
its edge to dislodge its contents” (This Divided Island, Samanth Subramanian; Penguin India). The author also describes the
loot and larceny the so-called freedom-fighters had indulged in: “Earrings were ripped
off the ears of young women, often along
with the lobes they decorated. Welfare certificates, especially those that entitled the
poor to state benefits, were confiscated.” In
case more evidence of the LTTE’s anti-Muslim carnage is needed, Messrs Vaiko and
Karunanidhi may recall the Husseiniya
mosque massacre in Batticaloa in 1990.
Their favourite superstar’s LTTE killed
more than 145 Lankan Muslims in cold
blood. This Divided Island has a chapter on
the chilling incident. (KM de Silva’s book,
Reaping the Whirlwind: Ethnic Conflict,
Ethnic Politics in Sri Lanka; Penguin, gives
the figure of dead as 120.) And there is another episode in Murari’s book, where he recounts the massacre of 600 Tamil and
Tamil-speaking policemen in mid-1990. It’s
no wonder, therefore, that the Tamil-speaking Muslim population did not buy into the
LTTE fantasy of a Tamil Eelam.
V.K. Krishna Menon was very abrasive with
the service chiefs and showed little regard
for them. Menon would often interfere by
dealing directly with military officers, bypassing the chiefs. This led to Thimayya
writing to Prime Minister Nehru tendering
his resignation. Other service chiefs were
also to tender their resignation. Rumours
started floating that a military coup was imminent. A national controversy surfaced in
the press and I can say from personal knowledge that Army officers felt very disturbed.
Nehru sent for Thimayya and asked him to
withdraw his resignation in the national interest. Being a patriotic soldier, he complied.
What happened thereafter was most unfortunate, but we need not go into the details of
that. Lt. Gen. B.M. Kaul, against the recommendations of Thimayya, had been promoted from major general and brought as
Quartermaster General at Army Headquarters. He sent for me and I was made his staff
officer as also to work with a new section
called Q (operations), which has now grown
into the directorate of operational logistics.
He would often speak to Nehru on the RAX
(restricted area exchange) telephone in my
presence. He even took liberties with the defence minister and Thimayya, then a sulking
chief. I felt that if any general had political
ambition it was Kaul, as even mentioned in
Welles Hangen’s After Nehru, Who? In 1961,
Kaul rewarded me by sending me to the UK
on a prestigious inter-service training course
at their National Defence College. Thus, I
was not in any way involved in the 1962 debacle, which changed the fortune of Kaul and
led to his quitting the Army.
When Nehru died there was an intelligence red alert of the possibility of a military
coup . An artillery brigade had been moved
from Ambala to Delhi for annual field firing
at Tughlakabad range, and this coincided
with the death of Nehru. The then director,
Intelligence Bureau, B.N. Mullik, told me
later that he was personally shadowing the
Army Chief, Gen. Joyanto Nath Chaudhuri,
during Nehru’s funeral procession. The
other incident of an intelligence alert took
place in 2010, when Gen. V.K. Singh was the
Army Chief. Two para battalions had been
moved from Mathura to Hindon for a joint
training exercise. This coincided with Gen.
Singh going to the Supreme Court against
the decision of the government on his dateof-birth controversy. The defence secretary
intervened, conveying the government’s
order to send back the two para battalions
from Hindon to Meerut. These two incidents
only highlight the apprehension of people in
authority of the Army carrying out a coup.
Having been closely associated with the
Indian Army for 70 years now, including 40
years service in the Army, I can most emphatically rule out that our Army will ever
stage a coup. It has always, with unquestioning loyalty, carried out the nation’s will and
it will never impose its will on the nation.
The fear among the bureaucracy of the man
on horseback is unfounded.

hough a military coup or a successful
military invasion may result in a soldier capturing political power, there is
a difference between the two. The former is
directed against a government to which one
owes loyalty and the latter against a government to which one does not. History abounds
with examples of both. In the modern age
military coups have been taking place while
in the earlier days the other was more common. Early examples of military coups are
those of Julius Caesar, Oliver Cromwell and
Napoleon Bonaparte. In modern times, several military coups have taken place, particularly in countries liberated from colonial
rule in Asia and Africa. Modern India has a
shining military coup-free record. There
have been only two instances, both very long
ago. The great Mauryan Empire founded by
Chandragupta Maurya, comprising presentday India, Pakistan and Afghanistan, had
shrunk considerably in 185 BC. The latter
Greeks under Demetrius had come to the
border, threatening invasion. Brihadratha,
the last Mauryan ruler, was an imbecile. His
commander-in-chief, Pushyamitra Sunga,
assassinated him and became the ruler. The
other instance was that of Hyder Ali, a successful military leader, removing the Wadiyar ruler of Mysore. Hyder Ali’s son Tipu
Sultan succeeded him on his death.
All countries gaining independence
T
from their colonial rulers in Asia and Africa
have had military coups, except India. Coups
have been endemic in Pakistan. Both the Indian and Pakistan Armies have a common
origin and were part of the undivided Indian
Army, but they have gone completely different ways. The main reason is that India had
the advantage of having Jawaharlal Nehru
as Prime Minister for 17 years. The country
had political stability under him. A great democrat, he established democratic polity on
a firm footing. In Pakistan, Muhammad Ali
Jinnah, the founder of Pakistan, died within
a year of its independence, leading to political instability. Even the first Prime Minister,
Liaquat Ali Khan, was assassinated not long
after. Because of political instability, Pakistan has witnessed a series of military
coups. Unlike Pakistan where the officer
class is almost entirely Punjabi and Pathan
— who have much in common — the officers
of the Indian Army have a very diverse background. Moreover, the Indian Army is multireligious, with a secular outlook. On the
other hand, the Pakistan Army has become a
one-religion army of religious fundamentalists. In spite of the Indian Army’s apolitical
record, the fear of the man on horseback has
been a constant factor in India, particularly
among civil servants who have exploited this
to feather their own nest and keep the Army
under stifling control. They have persistently denied the Army its legitimate dues
and have isolated it from decision-making on
military matters. Nehru was quite clear that
a military coup was not likely in India. In his
letter of February 5, 1948, to chief ministers,
he wrote, “We know that many attempts
have been made to tamper with the Army
but we also know that the Army has withstood these attempts and is a significant
force, disciplined and loyal to the government.” Yet, the apprehension about the man
on horseback did not disappear in our ruling
establishment. There have been a few hiccups in civil-military relations.
General K.S. Thimayya was a very celebrated soldier who had earned great professional fame. He was the only Indian to have
commanded a brigade in the Second World
War. He represented the Indian Army at the
surrender ceremony at Singapore in 1945,
when Count Hisaichi Terauchi, the Supreme
Commander of the Japanese Army in South
East Asia, surrendered to Mountbatten. Thimayya commanded the Indian brigade of the
occupation force in Japan. In December 1948,
he personally led the successful attack from
a leading tank when for the first time in history tanks were used on the forbidding
height of Zoji la. In 1953, Thimayya was appointed as chairman of the Neutral Nations
Repatriation Commission and was sent to
Korea by the United Nations. In 1957, he took
over as the Chief of the Indian Army. Apart
from his brilliant military career he was a
highly popular general who was referred to
as the “Soldier’s General”. Defence Minister
diversity and pluralism as well as to minimum autonomy without which a university
cannot function and flourish.
No academic logic
The Ministry of HRD’s idea of “reform”
is an egregious attempt to standardise higher
education and research by introducing a
common framework for Central universities
based on the myth that uniformity will
equalise quality and skills across universities. It is not at all clear that uniformity will
help in upgrading new universities or the
State universities, which is the ostensible
aim of this exercise. Some of the good universities such as JNU or the Ambedkar University, Delhi, are successful precisely because
they value heterogeneity and variation so
that creativity and innovation can thrive.
Many Central universities reflect India’s extraordinary diversity in their faculty composition and student body, and, above all, they
offer very different syllabi and courses which
has helped in their academic growth. The CU
Act advocates transfer of faculty between universities. Nowhere in the world are “transfers” between institutions practised. There is
no academic logic here.
Besides, transfers increase the possibility of vindictiveness as it can be used as a
punitive measure to silence dissent and independent voices. It is evident that the government is eager to control and direct
universities both at the Central and State
level. For this the HRD Minister is pushing
the idea of a (CBCS), first mooted by her predecessor, Murli Manohar Joshi, during the
term of NDA-I, which would have a serious
impact on the country’s education system.
The (UGC) has formulated the new proposals
for a CBCS, a common entrance test and a
central ranking system ignoring the assurances given by the government and the UGC
that it would hold wide consultations with all
stakeholders before undertaking any subsequent educational reforms.
Wastage or welfarism?

grumbling against the UPA had been that
its overemphasis on social welfare and
security has led to inflated welfare expenditures
at the cost of growth. Because, it is an empirical
truth that overprovision of welfare fails to target
resources on the most needy, and hence leads to
inefficiency and injustice. The New Right under
Narendra Modi, on the other hand, emphasises
welfare cuts and the expansion of private sector
that might lead to a deterioration of life qualities
of the poor and the needy. Sadly no emphasis is
being laid on “positive welfare” where people are
encouraged to earn a living through work,
rather than through receiving welfare. After the
Asian financial crisis, most East Asian states
had to face a tightening welfare budget. Contracting out commodification, privatisation, and marketisation of social services have become
common practices in a bid to tide over the difficult period. In Japan, the government also tried
to marketise and residualise social housing
which led to deteriorating social issues such as
homelessness, lone-parent problem and inadequate housing for the elderly. In India, Modi
moved to eliminate state controls on diesel
prices for the first time in over a decade late last
year, while also increasing prices for natural
gas, a move thought to offer fiscal savings over
time that can be used for public investment and
for other productive areas. While a case can always be made about good subsidies and bad subsidies, petroleum subsidies not too long ago
accounted for one-quarter of India’s Rs 2.6 trillion ($42.4 billion) subsidies bill. When Modi said
he wanted to cut back on the costly subsidies, the
government offered millions of Indians to ‘cushion’ the blow of those soaring prices, he, at a time
of global fall of oil prices, could afford to do that
with the softest pinch. With an objective of
shielding its consumers from international price
volatility and providing energy access for its citizens, especially the poor, energy subsidies in
India have a time-honoured role, though they
place a heavy burden on government budgets,
while often failing to reach their targeted beneficiaries. In contrast to fuel subsidies, electricity
subsidies in India are disbursed by the state governments, at considerable cost to state budgets.
Subsidy dilutions are like suicide missions.
They tend to attack entrenched interest groups,
mobilise widespread resentment, fan partisanship amongst malcontents and can become grist
to the mill of the canards of the opposition.Democratically elected leaders who do not keep an ear
to public opinion often end up paying heavier
electoral costs, as seen in the dismissal of the Left
Front in West Bengal at the crest of an agitpropist movement in Singur and Nandigram. Besides, statism being popular with many
segments of the population in developing nations
such as Brazil, India, Indonesia and Thailand,
they have rarely taken to an unqualified freemarket script. Even in China,under a one-party
dictatorship, state-owned enterprises constitute
almost all of the 20 biggest companies by valuation. In a democracy, political sustainability
trumps economic necessity every time. According to a study by Chief Economic Advisor
Arvind Subramanian in the Economic Survey
released recently, the fertiliser subsidy and the
water subsidy are the two of the worst performing subsidies. The Survey says that the fertiliser
manufacturers derive the maximum benefit
from the fertiliser subsidy since farmers have
elastic demand, and the water subsidy goes to
private taps, while 60 per cent of the poor get
their water from public taps. India embarked on
a subsidy-raj, as is wont for a welfarist state
since independence, amounting to 14 per cent of
GDP almost a decade ago, and compromising on
its expenditure on education, health, or infrastructure. Public expenditureAccording to the
UNESCO, India has the lowest public expenditure on higher education per student in the
world. As per a recent report from the Organisation of Economic Co-operation and Development
, India’s public social spending measured as a
fraction of its GDP was not only far lower than
the developed countries, but also lower than the
‘emerging economies’ like China, Russia, Brazil
and South Africa. In India, where populism runs
rife, subsidies one of the most powerful policy
tools have been used for decades to achieve a
range of economic, social and environmental objectives.

Black money: India to hold direct
talks with tax havens, others
New Delhi, May 20:
Indian tax authorities and
investigators probing black
money cases have decided to
hold one-to-one meetings with
their overseas counterparts
based in tax haven nations and
other countries to "deepen" cooperation in the fight against illicit
funds stashed abroad. As part of
the measures to combat the menace, investigators have also received a new dossier on tax-related business information on
about a dozen entities whose
names were reported by an international group of investigative journalists sometime back.

Ministry, after due consultations
with the Special Investigation
Team (SIT) on black money and
various financial probe agencies, has decided that a team of
senior officials will be tasked to
hold bilateral meetings with foreign jurisdictions either in India
or at the location of the respective counterparts, to thrash out
issues quickly. "The step is
aimed to cut down on the time
taken in paper-based documentation and communication in
cases of illegal funds stashed
abroad. A team of senior officials
drawn from the Ministry and its
various field formations will
hold meetings and put across requests related to probe in these
cases right on the discussion
table. The required sanctions in
this regard have been obtained
from the government," a senior
Finance Ministry official said.
An official communication
prepared in this regard by the
Central Board of Direct Taxes
and reviewed by the SIT underlines the need for having the new
mechanism. "Bilateral discussions, including through conference calls and face-to-face meetings with the competent authorities of our treaty partners which
now include well known tax
havens and offshore financial
centres such as British Virgin
Islands, Jersey, UAE and
Singapore are being planned
and the cooperation in this regard will be deepened in future.
"These bilateral meetings
will help India in making targeted and specific requests for information and to understand the
problems, if any, which prevent
them in providing the information, and to examine how the
same can be addressed," the
note, accessed by PTI, said.
While about three such meetings have already taken place, the
official said, about half-a-dozen are
already lined up to be held this
year including one with the
European Union. The note also
mentions that "certificates of incorporation" of eleven entities listed
in
the
International
Consortium of Investigative
Journalists (ICIJ) report which
were received from two foreign
Financial Intelligence Units have
been shared with CBDT for further action. The ICIJ brought out
these names early last year while
some additional details were published by the global group this year
on suspected world entities holding assets and shares in overseas
business structures, including
those with Indian connections.
The SIT on black money has
early this month submitted its latest report to the Supreme Court to
inform it about the development
in various probes related to black
money which included the development that the I-T department
has launched 121 prosecution cases against those whose names had
figured in the much talked about
HSBC list. The note added that the
probe in cases of about 600 suspect
names and addresses which were
obtained by the Central Economic
Intelligence Bureau (CEIB) last
year through its exclusive channels is "in progress." The official
communication also reported the
enhancement in cooperation between India and Switzerland on
these issues, a fact mentioned by
Finance Minister Arun Jaitley
quite a number of times in the past.
"Switzerland has indicated
willingness to provide information in respect of cases where investigations have been carried
out by the I-T department independently from what Swiss government considers as stolen data. This development is very significant because there are a
number of cases of account holders included in the HSBC list
which were investigated by I-T
department independent of the
HSBC list obtained from the
French government.
"Earlier, the Swiss government had not agreed to provide
any information on names which
were included in the HSBC list on
the ground that these were stolen
data and have been obtained in
breach of Swiss law," it said. Post
the visit of a high-level officers
delegation to the alpine nation in
October last year, the note said,
"Swiss
Federal

Administration has agreed that
their competent authority would
assist India in obtaining confirmation of genuineness of bank
documents on requests by the
Indian side and also swiftly provide information on requests relating to non-banking information. This willingness on the part
of the Swiss authorities would
help in our tax investigations."

also agreed to provide the requested information in a timebound manner or else indicate
the reasons why the cases cannot be answered within the

New Delhi, May 20:
Indian economy is expected
to expand at 8.5-9 percent over
10-15 year time frame once the
structural issues hampering
growth are addressed by the
government, Finance Secretary
Rajiv Mehrishi said on
Wednesday. "India has a growth
potential close to 8.5 percent to 9
percent over the next 10-15
years... The short term growth
may be lower on account of
structural issues which we are
tackling," Mehrishi told PTI.
Strong economic growth,
he added, is necessary for solving many socio-economic problems facing the country. "India's
growth is expected to be at least
8 percent in the current fiscal on
account of initiatives taken by
the government to boost investment and growth," Mehrishi
said. The Economic Survey had
projected a growth of 8.1 to 8.5
percent in the current financial
year. "Multilateral institutions
also share our growth optimism. IMF has projected a
growth of 7.5 percent for 2015-16.
Other organisations also project the growth to be in the vicinity of 7.5 percent," he added.
As per the latest World
Economic Outlook of the
International Monetary Fund
(IMF), India will surpass China
in terms of growth to become
the fastest growing large economy in the world. IMF expects
India to grow at 7.5 percent in
both 2015 and 2016, while
China's growth rate has been
projected at 6.8 percent and 6.3
percent respectively. "Though
the recovery in advanced
economies is slow, the external
environment for India is benign," Mehrishi said. The government has taken various initiatives to deal with the structural issues like going in for auction of key infrastructure inputs such as coal and spectrum,
setting up of the MUDRA Bank
and streamlining the norms for
foreign direct investment (FDI).
On India Meteorological
Department (IMD) projection of
below normal monsoon, the
Finance Secretary said: "A
weak monsoon generally leads
to low rural economic growth
and spike in prices of food commodities. However, this year
food prices are expected to remain stable."
He added: "As done in last
year, government could offload
stocks from its godowns especially wheat and rice to cool
down prices of food grains, discouraging exports of those food
commodities like potato and
onion, which has the potential
of highest price volatility and
importing those items, which
are short in supply like pulses
and edible." The government, he
further said, was also taking a
host of steps to address rural distress "through programmes
rather that price distorting

Now on India will grow faster, outpace China: UN
United Nations, May 20:
India is expected to log a growth of
7.6 percent this year and 7.7 percent,
nearly 1.5 percentage points higher
than the outlook just four months ago,
in a clear sign that it will outpace China
quite decisively, as per a UN report released here Tuesday.
In the Mid-Year Update to the
World Economic Situation and
Prospects 2015, the reason for India`s
outlook is credited to changes in the
way national income is computed, with
no specific mention of policy reforms
during one-year of Prime Minister
Narendra Modi government being the
cause. The original report of the UN
Development Policy and Analysis
Division (UNDESA), released in
January, had estimated India`s gross
domestic product (GDP) growth rate for
this year at 5.9 percent and 6.3 next year.
"This revision mostly reflects a
higher growth trajectory in India,
where the recent changes in methodology and data sources have resulted in a
considerably higher official growth figures for the past two years," said the latest report.
"India is now projected to grow by
7.6 percent in 2015 and 7.7 percent in
2016, surpassing the growth of China,"
the report added, in what should come
as another major pat for the Bharatiya
Janata Party (BJP)-led government that
completes one year in office this week.
The latest UN update matches the

projections of other international institutions like the World Bank and the
International Monetary Fund that have
also put India`s growth rate as the
fastest, and all of whom have also revised the estimates for India upward.
Last week, in fact, the UN
Economic and Social Commission for
Asia and the Pacific (ESCAP) also released a report that said the Indian
economy would grow by 8.1 percent this
year and 8.2 next year -- the highest
among the projections made by international institutions. "Overall, I think the
authorities in India have done a very
good job over the past two years and this
is actually reflected in some indicators,"
Ingo Pitterle, a UNDESA Economic
Affairs Officer and India expert, told in
an interview here Tuesday.
"In 2013 India was group grouped
together with Turkey, South Africa,
Indonesia and Brazil, and considered a
fragile economy. And now, you look at
the same variables -- today, they look
very different," Pitterle said. "When you
look at the currencies the story is
India`s is the only currency that has
held up well here, which is a sign of confidence by investors, by the international community, in the Indian economy,"
he said. Like the UN report`s outlook,
Pitterle saw several positives on the
Indian economy.

Sensex jumps 192 points to
near one-month high
New Delhi, May 20:
The benchmark BSE Sensex on Wednesday rose 192
points to its highest in near one-month at 27,837.21, as bluechips HDFC, Wipro and TCS gained on resumption of buying
by foreign investors amid prevailing rate cut hopes. Sentiment
was boosted on reports that foreign funds, which have been
selling in the past several sessions, made purchases in yesterday's trade, equity brokers said.
The 30-share Sensex commenced the day higher at
27,749.30 and advanced to touch the day's high of 27,903.01.
However, profit-booking at higher levels in some counters,
trimmed some gains. The index finally settled higher by 191.68
points or 0.69 percent at 27,837.21, a level last seen on April 22.
The broad-based 50-issue Nifty recaptured the 8,400-level by
closing 57.60 points or 0.69 percent higher at 8,423.25. It shuttled
between 8,440.35 and 8,391.45 during the session.
Forecast of a timely monsoon, coupled with the government containing fiscal deficit at 4 percent of the GDP for 2014-15
and continuing hopes of an RBI rate cut were other positive
factors, brokers added. Shares of HDFC were the top performer
at the Sensex with a rise of 2.11 percent.
Besides, Tata Power climbed 1.78 percent as the company
posted consolidated net profit of Rs 159.14 crore for the fourth
quarter of fiscal 2014-15. Other major gainers were Wipro, TCS,
HDFC Bank, RIL, Infosys, Hindustan Unilever, SBI, ICICI
Bank, Sun Pharma, GAIL, Cipla, Bharti Airtel, Vedanta, NTPC, Maruti Suzuki and ITC.
However, selling in Bajaj Auto, Tata Steel, BHEL,
Hindalco, Tata Motors, M&M, Dr Reddy's, Coal India, ONGC,
Axis Bank and L&T capped index's rise, brokers said.
Sectorally, the BSE IT index gained the most by rising 1.78 percent, followed by teck (1.51 percent), bankex (0.86 percent), infra (0.75 percent), power (0.51 percent) and healthcare (0.34 percent). Small-cap index also ended higher by 0.17

Milk prices are likely to go up again in Maharashtra as the
state government is considering coming out with a an ordinance to fix the minimum support price (MSP) for milk from
base-point suppliers at Rs 20 per litre. Following this, people in
Mumbai might have to brace for an increase in price of tea
since sellers might pass on the hike in milk prices to them.
The Maharashtra government would take a strict action
against the milk procurement centres which pay the milk producers at less than the prescribed rate, dairy development
minister Eknath Khadse had said yesterday.
Criminal cases would be filed against the procurement
centres which pay less than Rs 20 a litre, he added.
The excess milk collected by the co-operative milk federations will be checked for quality and then procured by the centres, he further said.

The Sports Ministry has
asked the Sports Authority of
India (SAI) to set up a 24-hour
helpline among implementing
other corrective measures for
well being of
the trainees in
the wake of suicide attempt
by four girl
athletes
at
SAI's
Alappuzha
centre.
The
corrective actions have been
formulated by the Ministry after examining the report submitted by SAI DG Injeti
Srinivas on the controversial
incident. As per the recommendations, SAI should empanel
counselling psychologists to
visit its centers once in a fortnight or once in a month, as may
be required, for the purpose of
group counselling as well as
one-on-one counselling.
All girls hostels must compulsorily have a full-time lady
warden and all centers should
preferably be run at least by
Assistant Director (AD) level officers. The Ministry also wants
to make Yoga as a compulsory
activity in all SAI centers.
"Part-time Yoga instructors
may be engaged
for this purpose.
Organisations
imparting Yoga
courses should
be roped in to
provide training
on Yoga," said
the Ministry in a
release. The release further added
that a two-day module on sports
psychology should be prepared in
consultation with AIIMS and introduced in all SAI centers. The
Ministry also recommended that
all eligible SAI trainees should be
covered under the newly introduced Pradhan Mantri Jeevan
Jyoti Bima Yojana (PMJJBY) and
Pradhan Mantri Suraksha Bima
Yojana (PMSBY). "Expenditure
on these measures will be met
from the allocated budget of SAI,"

They had filed for separation in
October last year. Reports suggest
the couple arrived at the Mumbai

remarks he has violated the

hatred, and sub-para 4 of Para
1, which debars "corrupt practices" and offences under electoral laws. "...now, therefore,

provisions of Model Code of
Conduct and statutory provisions and further advises you
to be more circumspect in future in your public utterances," the order said.
Responding to the show
cause notice, Raut had questioned the authority of the
Commission to issue such a notice for any violation of the provisions of poll code and stated
that by making the statement
he had not violated any provision. The Commission also reminded him of a Supreme
Court observation which said
that "the duty at the top echelons of leadership at the state
and national level of all political parties is to set the trend for
giving the needed information
to the electorate by adopting
desirable standards so that it
percolates to the lower levels
and provides a congenial desir-
able standards for a free and
fair poll." Raut had last month
waded into a controversy by
saying the voting rights of
Muslims should be revoked for
some years to ensure the community is not used for vote
bank politics.

Parliamentary Affairs minister Girish Bapat
said on Wednesday. "The decision would cost
Rs 30 to 35 crore to the ex-chequer. But, Rs 10-12
crore would be recovered through advertisements. That would not put much burden on the
state government," Bapat told reporters at a
press conference here while informing of the
decision. The appointments on various committees of the Assembly have been made and
the committees would now initiate their work
from May 26, he added. Bapat, who is also the
Food, Civil Supplies and Consumer Protection
minister, said the state was taking adequate
steps to delete 50 to 60 unaccounted LPG connections from the state's list which would help it get
increased supply of kerosene from the Centre.
He also said Maharashtra has completed construction of 65 warehouses with the support from
National Bank for Agriculture and Rural
Development (NABARD) and that the number
would reach over 100 by the end of June. The minister further said that the issue of milk adulteration would now be brought under the

Choudhary R/o Bathindhi, Jammu in violation of Child Labour Act, 1986 three years before when he was only 12. The petitioner after
locating the parents of the child rushed to
their Village Ragura at the outskirts of
Jammu near ASCOMS Sidhra, Jammu and
the poor parents informed her that since 1204-2015 their child is missing from the residence of the aforementioned Judicial Officer
and the Police has miserably failed to locate
the missing child and the parents further disclosed that their ward was working in the residence of the aforementioned Judicial Officer
as a domestic help for the last three years and
the said Judge had promised initially to send
him to the School and later to employ him
suitably by using his contacts. They further
divulged that the said Judge and his wife have
refused to share the details of their missing
son and have closed their doors for them and
infact have used parliamentary language
against them and have further threatened to
deal with them since he is a Judicial Officer.

Absconding
resident of Bhandi, in Mahore. Police

Education Officer (CEO) Lal Hussain today sent a team of officials to conduct surprise visit of various schools to ensure punctuality and work culture of the schools in border district of Poonch, an Education department officer said. During the visit, the team
found Bodh Raj (senior teacher), Rakesh
Thappa, Farooq Ahmed, Mumtaz Ahmed,
Janghir Alam and Ruqla Bi (all teachers) and
Master Mohmmad Aslam, absent from duty,
he said, adding, two other teachers,
Mohmmad Arif and Hamida Begum, had not
maintained records of attendance and midday meals properly. Taking serious view of
the above, JCEO ordered their suspension,
he said. Similarly, CEO also ordered a
chargesheet against 9 teachers and class-IV
employees for dereliction of duty and their
wages have been stopped, the officer added.

at Crime Headquarters here today.
The gazette is a first hand information
about the crime situation of the State
and provides a vital data base for strat-

Speaking on the occasion, the DGP
said that investigation of special
crimes is a major responsibility of
Jammu and Kashmir Crime Branch
and the agency has to improve its
working by adopting latest methods of
investigation helping speedy disposal
of crime cases. He said that criminals
pose a great threat to the peaceful atmosphere as the crime is a basic cause
of all evils. He said that the investigating agencies have to strengthen their
mechanism and the civil society has also an important role in crime detection.
Rajendra appreciated the efforts of
State Crime Branch, saying that the
initiative would help different wings of
Jammu and Kashmir Police to assess
and evaluate their performance and
concentrate on improvements in different fields of policing. He asked for
dedicated efforts by the investigating
officers for speedy disposal of the cases, ensuring conviction of accused on
merit.
The gazette shows decreasing
trend in crime scenario in the State
during the year 2014 as compared to
previous year. It reveals that 25390 cases were registered under various
heads of crime during the year as
against 26907 cases during 2013. It also
shows decrease in the crime against
women as 3535 cases were registered
during the year as against 3714 during
the corresponding previous year.

Muneer Ahmed Khan threw light on
the functioning of Crime Branch in the
State and briefed the DGP about the
achievements in the field of investigation by using latest methods.

Senior central Congress leader
Raj Baber on Wednesday advocated
separate AIIMS for Jammu keeping in
view its vast geographical area.
Addressing media persons at
Shaheedi Chowk’s Congress office,
Baber said that the BJP always tried to
create wedge among the people belonging to different religion instead of
concentrating on development of the
Country. He said that the Government
should give separate AIIMS to Jammu
like they have given one to Kashmir.
“Congress want equal distribution of
resources without disparity and under this policy, the UPA Government
has given two Central Universities
and Super Specialty Hospital to
Jammu and Kashmir,” Raj Baber told
journalists in the jam packed hall. He
said that the issues of Jammu should
be addressed by the Government.
Concentrating his attack on Prime
Minister Narindra Modi, Baber said,
during BJP rule in India over 600 violations have taken place on border but
‘56 inche chest’ of the PM failed to stop
such incidents.

terming him as ‘Maharaja’, he said
many soldiers and farmers have been
lost their lives following firing from
Pakistan but the Government could

It is also very important to mention
here that Mr. Gupta made a prayer in the
writ petition for release of grade of
Executive Engineer w.e.f. 15-02-1996,
which has been withhold by the RDD for
the reasons known to them. Post of
Superintending Engineer, REW, Jammu
& Srinagar both are kept vacant just not
to post Mr. Gupta, which is also a prayer
made in the said writ petition but not implemented by the Secretary, RDD for the
reasons known to him.

Court directs Bharti Airtel to compensate scribe Zulfkar asks for rationalizing
Jammu, May 20:
In a landmark judgment passed here
for the first time in the Indian history
against a telecom service provider, the
District Consumer Forum Jammu has directed Bharti Airtel to compensate a
Jammu based scribe for causing harassment, mental agony and inconvenience.
According to the order passed by Mr.
Shahzad Azeem District and Sessions
Judge who is the President of the Forum
and Mrs Veena Julmaria, Advocate as
member of the Forum, Bharti Airtel has
been directed to compensate its consumer
for unfair trade practice.
According to the petition filed before
the President District Consumer Forum
Jammu by one Bharat Bhushan, an accredited journalist through Advocate
Vishal Kapur alleged that as he could not
pay the meager bill of amount Rs 819
against his post paid number 9797637828
due to his ill health the service provider
i.e., Bharti Airtel in violation of all norms
made calls to some of his friends and his
employer informing them about his overdue bill. The complainant was surprised
to know that the service provider i.e.,
Bharti
Airtel,
through
its
employees/agents started calling complainant's friends and even employer and
telling them that complainant has not
paid his bill and started persuading them
to call complainant and ask him to pay the
bill. The complainant was shocked to hear
this from his friends. Complainant's reputation was shattered before his friends as
they were told different things like, "what
type of person is he, who could not even afford to pay a telephone bill of meager
amount", "what kind of friends do you
have who do not even pay their telephone
bills" etc. Stating the method of recovery
as illegal and facing humiliation before
the friends by Bharti Airtel, the compliant
has filed a defamation of Rs 5 Lakh against
the company.
Advocate Vishal Kapur while arguing convinced the Court that the method
adopted by the service provider has
caused harassment, mental agony and disrepute to his client and he was harassed by
numerous calls for payment of bill due towards the OP and he was also harassed indirectly by way of “PROXY STALKING” It
is pertinent to mention here that harassment of an individual can also occur when
a person is harassing others connected
with the individual, knowing that this behaviour will affect their victim as well as
the other people that the person appears to
be targeting their actions towards.
This is known as 'stalking by proxy' or
“proxy stalking” This is an illegal strategy
applied by the banks and other companies
for recovering their dues through their recovery agents in many countries and
there are laws against this illegal activity
in many countries but India. It is illegal to
call customers on numbers other than provided by them for the purpose which was
later banned by the Supreme Court of
India.
After hearing the facts put forth by
Advocate Vishal Kapur, the Court observed that although complainant prays
for compensation for harassment and inconvenience meted out to him and his
friends to the extent of consolidated sum.
It is a matter of common understanding
that if one would started spreading news
regarding non payment of dues amongst
friends and employer of a person, it would
definitely bring embarrassing position for
that person.
In addition, friends would be receiving such calls to their annoyance and inconvenience. Therefore, complainant
would be definitely entitled to compensation under the head harassment, mental
agony and inconvenience. Therefore in
view of the aforesaid discussion and after
perusing the record of the case, complainant is accordingly allowed and Ops
are ordered to pay Rs 20,000/- as compensation for causing mental agony and harassment. Sum of Rs 5000/- quantified towards litigation charges. JNF

Asks for metering
of autorikshaws
Srinagar May 20:
Minister for CAPD and Tribal
Affairs, Ch. Zulfkar Ali today
stressed on rationalization of passenger fare wherever necessary for
the benefit of commuters.
“There is need to rationalize
the fare in view of the tourist season and to redress the complaints of
commuters about overcharging by
the private transport operators”
the Minister said while chairing a
meeting here today.
He said that a transporter or
driver is first person with whom a
tourist comes in contact with.
“They (Transporters) should
charge genuine fare from the
tourists and earn their goodwill in
return,” the Minister said.
Referring to Government’s resolve of ensuring public convenience, the Minister asked the offi-
cers to ensure proper SRTC services in remote and far off areas to extend affordable facility to the commuters. The monopoly of some private Sumo owners and other vehicles causing much inconvenience
to poor people who cannot afford
their self decided fares cannot be
tolerated, he added.
The Minister also asked the
Legal Metrology Department
(LMD) to ensure cent percent calibration and metering of auto rickshaws and in this regard, he constituted a committee headed by RTO,
Kashmir which was asked to submit its report within 15 days.
In order to check overcharging
by the drivers, the Minister asked
the concerned to publish pamphlets and erect banners depicting
rates at all departure and arrival
points including airport, railway
station, bus stands, taxi stands and
other prominent places. He also
asked them to give wide publicity to
this initiative of the government
for information of general public.
The Minister directed the
RTO, Kashmir and LMD to establish 24*7 grievances redressal cell
where people can lodge their complaints and avail the facilities and
services comfortably. He directed
the IG Traffic to devise a foolproof
mechanism to keep a check on overcharging.
Deliberating upon the strategies to make Motor Vehicles Act
more stringent, the Minister said
that possibilities would be explored
to implement revised Road Safety
Act in the State at an earliest to ensure safety on roads.
The Minister asked the
Srinagar Municipality to constitute a local area committee and
identify stands where autos would
be calibrated on notified days.
Earlier, RTO, Kashmir informed that there are 12660 autos
operating in the Valley, of which
10777in Srinagar.

West Pak Refugees in RS
Jammu, May 20:
Member of Parliament & Jammu and
Kashmir BJP Prabhari Avinash Rai
Khanna, through a question raised in
Rajya Sabha, asked the Union Home
Minister whether the central government
is aware of the fact that a large number of
refugees from West Pakistan are residing
in Jammu and if the government has this
knowledge, then what are the details
about them.
Khanna further asked as to how the
rights enjoyed by these refugees were different than other people living in Jammu
and Kashmir and whether the government has any plan to recruit the youth
from this refugee community in para-military forces and if yes then the time fixed
for the same and the reasons if government do not have any such plan. The
Union Home Ministry, in its reply, con-
veyed that in 1947 when the refugees from
West Pakistan came to India, including
J&K state, there were 5754 families registered in Jammu region.
These refugees have voting rights in
the Parliament elections but not that of
the state assembly as that is governed by
J&K Constitution and a voter has to be a
permanent resident of J&K state. The
Union Home Ministry also conveyed that
the children of these refugees are allowed
to get recruited in Central Security Forces
and proof of being voters in Parliament
elections or a certificate issued by
Sarpanch, Numberdar is taken as their
identity proof and permanent resident
certificate is not insisted in their case.
Avinash Rai Khanna said that he shall be
taking up this matter with the Govt. of
India to further simplify the recruitment
process for these persons and shall also request for a special recruitment drive.
