Police today said he has been sent to Kotbalwal jail in Jammu after being shifted from Srinagar during the night. Bhat had applied for bail before Chief Judicial Magistrate Budgam which heard the arguments of the prosecution and the petitioner's counsel yesterday. The court has reserved its orders on the bail plea till Saturday. Farmers’ problems old, need to find solutions collectively: PM NEW DELHI, April 23: Sharing “pain” over the suicide by a farmer here, Prime Minister Narendra Modi today said the agriculture community’s problems are “old, deep-rooted and widespread” which need to be addressed collectively and expressed willingness to accept any suggestion with an open mind. Making a statement in Lok Sabha after members expressed deep anguish over yesterday’s incident, he said the farmers cannot be left to fend for themselves and assessment would have to be made about “shortcomings” that occurred before his government came as well as during his tenure. “Yesterday’s incident has caused pain to the entire nation. Members here also expressed the pain. I share the pain,” Modi said about the suicide committed by a farmer from Rajasthan at a rally organised by Aam Aadmi Party here. Observing that nothing is more important than a farmer’s life or for that matter a human life, he said, “The problem (afflicting the farmers) is old, deeprooted and widespread and we have to seek solutions in that context.” He said it needs to be ascer- tained as to what “mistakes” have been made and “what shortcomings” have been there before his government came as well as during his tenure. The inquiry revealed that the suspects See 4 EDU on page 11 Sino-Pak Bid to Remove Line on UN at Asia-Afro Summit Foiled Former health minister to face trial in sexual harassment case JAKARTA | APR 23: Former Jammu and Kashmir minister Shabir Ahmad Khan will face trial in a sexual harassment case filed against him by a woman doctor after a court here ruled that there was "sufficient material" on record to proceed against the Congress leader. "Prima facie, there is sufficient material to presume that accused has committed offence under section 354, 509 RPC and ground exists for holding trial against him," Chief Judicial Magistrate Srinagar V S Bhou said yesterday. The court observed that the concluding lines of statement of victim specifically pinpoint the allegations, which fall within the ambit of Sections 354 and 509 RPC. The woman doctor had alleged that Khan, the then Minister of State for Health, "acted like a sexual predator" and tried to molest her in his office at Winter Secretariat here on January 28 last year. The court directed the prosecution to "lead evidence in substance of charge" on May India today thwarted attempts by Pakistan and China to remove a crucial line on the United Nations from a declaration adopted by Asian African Summit here. Over 100 countries from Asia and Africa adopted two declarations -- Bandung message 2015 and "Reinvigorating the New Asian African Strategic Partnership (NAASP)" -- with both calling for reforms in the world body. Diplomatic sources said Pakistan and China were lobbying hard to remove a line from the NAASP declaration but India with the help of African countries blocked that attempt. Vohra, the Governor, released a book titled “Dogri Ekanki” and two comic books in Dogri language. The book and the two comics have been translated and published by the Dogri Sanstha, Jammu, with financial support from Shri Mata Vaishno Devi Shrine Board. The Governor congratulated the Dogri Sanstha for bringing out a volume which contained selected one-act Dogri plays translated into Hindi. He observed that the publication of the Hindi version of well known Dogri one-act plays would contribute towards the promotion of Dogri language and make its literature known all over India and beyond. The Governor advised the Sanstha to explore the possibility of securing wider circulation of its publications, both within and outside the State. He exhorted upon them to adopt a proactive approach for realizing the objective of transforming education system and making J&K a real knowledge society. The Minister said this in an interaction held with the Deputy Commissioners of Jammu Division, CEOs and Principals of DIET. The Minister was accompanied by Minister of State for Information, Education and Culture, Priya Sethi. Commissioner Secretary Education, Commissioner Secretary Higher Education and Director Education, Jammu were also present in the meeting. The Minister asked the DCs to identify and adopt at least one school each in their respective districts under the model school concept and act as virtual administrator of the school. It would help streamline the system and bring in the much needed change, Akhtar maintained. The Minister asked the Deputy Commissioners to utilise their administrative acumen, resources and goodwill to take new and innovative measures to help create an atmosphere of vibrancy and involve school students and faculty in various social activities in the district. Youth festivals, Sports events, cultural programmes, competitions and other activities could be organised at intra and inter district levels, the Minister added. Urging the DCs Akhtar said “take this as a social responsibility and lead from the front to contribute in transforming the education system”. Patients go to private hospitals because govt hospitals are overcrowded lacking essential facilities and can- not take care of serious and critical patients. Most of the equipments in Govt. Hospitals are not in working order. Virtually private medical centres are reducing burden of govt hospitals service tax imposed by the govt is directly effecting patients not nursing homes. There is no such fax in the entire country. Hindustan Shiv Sena demanded immediate withdrawal of service tax. They want the farmers to hold on to their land, howsoever small and unproductive it is. They are not well-wishers of the farming community. The acquisition of land, including farm land, to gain higher factor productivity in essential industrial/manufacturing, has always been problematic in developing countries where high moral value in agricultural production and nonmonetary value to farmers’ well-being is attached implicitly in the polity. However, data on the extent of crop land as a proportion of total land of comparable counties will show that, barring in a few nations like Pakistan, farmers in India have held on to the largest land chunks (60 per cent of the total), while producing a modest but invaluable quantum of grains that gives the country an operating surplus and strength to even contemplate a universal PDS. China, the US and Brazil have high grain output with smaller areas of land in agriculture, due to superior irrigation and overall farm technology. China for instance, produces 500 million tonnes and more (numbers are not very transparent there), with 55 per cent of land under crops. Larger areas under agriculture of nonirrigated sustenance category is symptomatic, conversely of low investment in agricultural productivity and resultant low per agricultural worker productivity. A comparison of per worker value created in agriculture in India, Pakistan, China, Brazil, Japan and the US, is revealing. India compares poorly at $522 (at 2000 prices to Brazil at $4,300, Pakistan at $614, China at $530, Japan at $40,000 and the US at $52,000. The countries having 100 times per agricultural worker productivity have farm land between 40 per cent and 55 per cent only. What is germane is speeding up the per farmer productivity so that the country is largely unaffected by the conversion of comparably low-producing non-irrigated land to expand the manufacturing base. The expansion of the base can in turn boost the farm sector, both directly and indirectly. The debate, therefore, should be on why the US and the Japanese farmers are reaping many times the value that their Indian counterpart gets and has the capacity to feed a fifth of the world with 50 per cent land under agriculture. Then, one might look at the figures funding agricultural research and innovation in the country more closely. Those who do so will detect both stagnation in the public sector (the Indian Council of Agricultural Research) as well as the low incentives available to develop agricultural innovation by the private sector. Confused and convoluted regulations, as seen in the case of GM crops, need reassessment. Leadership befitting a leading innovation-driven country, must be ushered here. Sadly, the farm sector in India has been debated at a much lower threshold of intellectual worth than it merits. Moving land across to manufacturing may look like depriving the farmer, but the policymaker must address the requirement of both farmers and the economy, by boosting per farmer productivity, than be pre-occupied over the crop acreage lost transiently. Unleashing world-class research in crops all over once again while mitigating the negative environmental impact of intensive agriculture, is pertinent. It is not that manufacturing is polluting and farming is environmentally-delightful. There has been rampant abuse of farm inputs, especially pesticides. The impact of having 60 per cent of land value under semi and intensive farming has had a huge spillover impacts on eco-health and even human health. The high rate of human cancer in Punjab after the much heralded Green Revolution, is another case in point. Nobody disputes the right of the farmer to be compensated or made a beneficiary of the project that takes over his farm land. A consensus on what constitutes timely fair compensation must not be difficult. But to argue that it is a development objective to farm the largest acreage in the world, wasting immense human labour using a relatively underdeveloped technology regime and without sound innovation, exemplified by huge losses in storage and transit (unofficially at 20 per cent) is fallacious. The sound objective should be to maximise the productivity of both crop farming and manufacturing, and to also maximise per unit and per worker productivity. The inter-relationship of the farm machinery economics and grain productivity can show the way.The ethics and distributor effects of the manufacturing industry need separate analysis, but the present slogan, that is being promoted by certain political parties and politicians, to protect the farmer from ceding any farm land at all, is in scant recognition of what drives the farmers to keep his farm land as farm land. It is higher factor productivity than comparable land uses like manufacturing or compensation for a new highway, that preserves farm land. Putting public money in better-monitored agricultural research, would be the right step. But for this, political parties, that are loudly chanting the ‘Kisan mantra’ slogan in an attempt to rejuvenate their fortunes, need to introspect. Removing artificially erected barriers to cutting-edge research, can also help. P JAMMU FRIDAY APRIL 24, 2015, PAGE 6 Three speeches, three futures BY : SHIV VISVANATHAN olitics has a strange way of making you rethink ideas & stereotypes by merely juxtaposing events. Just as one finishes typecasting persons and parties and feels smug about such judgments, politics delivers a series of googlies forcing a rethink. Last Sunday, one saw such a juxtaposition of events when three leaders addressed mass meetings. The triad of speeches included one by Rahul Gandhi who was returning from his sabbatical and addressing a kisan rally. In the second, Sitaram Yechury was taking over as the general secretary of the Communist Party of India (Marxist) from his more tacitum predecessor, Karat. Finally, Prime Minister Narendra Modi was addressing a rally of (BJP) workers after his return from Canada. Foil to the other None of the three speeches was by itself exceptional. But each of the trio, and then together, created a conversation as if three hit movies had been introduced on the same day. The first surprise was that of Mr. Modi. He looked almost reluctant to be in India after the highs experienced after visiting Europe and Canada. In all his overseas visits, it is clear that Non Resident Indians (NRIs) dote on his nationalism and his alleged efficiency while he revels in their success and their enthusiasm for him. After the exciting NRI engagements, India almost seems banal and disappointing to him, one could say. Mr. Modi, in his speech, seemed to complain about the Indian gene that discourages an approval of authority. The native Indian, unlike his counterpart abroad, is a determined contrarian. Worse, the Opposition seemed to have stolen Mr. Modi’s punch lines. His voice had more of a bully’s humour and he almost sounded like yesterday’s newspaper. In contrast, Sitaram Yechury sounded human, relaxed, even casual. As visual appearances go, the careful grooming of Mr. P inance Minister Arun Jaitley’s 2015-16 budget speech signalled the government’s commitment to formally legalise India’s public procurement system as a part of its continuing reforms in public financial management. Following this, the Ministry of Finance is seeking suggestions to refine the Public Procurement Bill of 2012, introduced by the previous government. The jurisdiction of the Bill covers any Ministry or Department and any public sector undertaking of the Union government, or any company in which the government has a stake of more than 50 per cent. The procurement processes of the States and the local governments are thus not covered by the Bill. It is in this context that we focus on three aspects relating to the Bill: its potential benefits, selected design features, and implementation challenges. BENEFITS There are many benefits of a welldesigned and well-implemented public procurement policy. These include fiscal savings from annual procurement expenditure; generating much needed fiscal space; and enhanced flexibility to channel government expenditure into growth-enhancing areas. It could also help in a shift towards rule-based institutional procurement. However, the poor quality of data on procurement expenditure and its major components means that we don’t have a good esti- F mate of potential savings from a better process. The problem needs to be addressed. Our crude estimate of potential savings generated by the revised Bill ranges between 0.6 per cent and 1.2 per cent of GDP, depending on the extent of efficiency achieved. This could assist in addressing the revenue deficit of 2.9 per cent of GDP projected for 201415 by the budget. The savings would be greater if the States, whose expenditure equals that of the Union government, and all the public enterprises, also initiated similar procurement reforms. This task could be entrusted to NITI Aayog. Several measures may be suggested to improve the design features. In its present form, the Bill’s objective is too complex, which dilutes accountability. Hence, a simpler set of objectives, as is also a global practice, would be desirable. This would also assist in improving the accountability of procuring agencies, and facilitate the task of internal and external auditing agencies. Second, the Bill’s definition of the ‘procurement process’ implies that post-tendering steps such as contract management, payment, monitoring and so on, after the award of a contract, are excluded from the ‘procurement process’. The definition should be broadened to include the post-tendering procedures. Third, given judicial delays and the lack of economic literacy often displayed by the judiciary, non-judicial procurement redress committees would be preferable. This needs to be tle fiefdom, and cited how 400 of them swore to him that if they lost their land, they would become naxalites. Rahul seems more alive, almost grateful for the land issue. What began as a morsel of an issue might turn out to be the crystal seed of a Congress revival. Rahul attacked Mr. Modi with ease contrasting the indifference of the BJP to the Congress’s attempt to side with the farmer. Reinventing a party I was watching the show with Kiran Majumdar Shaw of Biocon who detected a deep immaturity in the Congress. She claimed that in being a pro-farmer, pro-tribal, Rahul sounded anti-development. For a corporate leader, there is no greater heresy. She ended by saying that the Land Acquisition Act needs to be read and understood. Suddenly one realises that what one has on hand is a major class battle. It is here that the CPI(M) was in the limelight. In his acceptance speech, Mr. Yechury was relaxed, uttering a few happy lines in Telugu and Hindi. His ease of language was a foil to Rahul’s, and his relaxed sense of leadership, a dramatic contrast to Mr. Modi’s. Whether it is the Congress party’s masses or the CPI(M)’s classes, both seem ready to battle the aspiring generation of Mr. Modi. There was a vestige of scientism in Mr. Yechury’s speech. He talked of the objective situation and referred to the BJP as a communal party enacting the neo-liberal agenda. He accused the BJP of confusing history with mythology, of being anti-scientific. Like most Marxists, he appealed to history, claiming that history is on his side, inviting the CPI(M) to enter into battle with the BJP. Yet, he was so amiable that one was not quite sure whether he was delivering a lecture on table manners or on class war. One wished that there was less certitude and more doubt. He talked of his comrades dying in West Bengal due to the Trinamool Congress’s aggressive and violent ways. There was no moment of reflection, or of guilt that this culture of vio- Murder by 377 BY : PATRALEKHA CHATTERJEE t is important to impress upon lawmakers that activists are not asking for a total repeal of Section 377, but for it to be ‘defined down’ so as not to apply to consenting adults in private. Middle-class urban India woke up to some bitter truths last week when a young woman doctor ended her life in a hotel room in New Delhi’s Paharganj area. The tragedy hammered home some stark realities underpinning our ecosystem. The woman worked as an anaesthetist at the All India Institute of Medical Sciences (AIIMS). She had had an arranged marriage with another doctor, also working at AIIMS. She loved her husband but things started souring when she discovered that he was gay by foraging through his emails. In the four-page anguished suicide note she left behind, the woman claimed she was prepared to accept her husband’s homosexuality, and was even ready to put up with a marriage devoid of physical intimacy. But subsequent alleged torture by her husband led her to take the extreme step, according to media reports. On the basis of the allegations, which included harassment for dowry, the husband has been arrested. The investigation is on. We don’t have all the facts. But from what we know, several troubling issues arise. What does a woman do if she discovers that her husband is gay? How does she cope with the deceit and despair? Gay husbands and straight wives — does it necessarily mean shattered lives? These are not easy questions for women or their spouses anywhere in the world. It is particularly tough in a country where homosexuality is criminalised, where gays can’t come out publicly, and where social mores place a premium on marriage at any cost. No politician in the country has publicly reacted to the alleged suicide, but the sordid tale of a marriage based on lies and deceit for over five years has turned the spotlight once again on the infamous Section 377 of the Indian Penal Code. The law, a remnant of the colonial era, criminalises “carnal intercourse against the order of nature”, effectively pushing India’s LGBT (lesbian, gay, bisexual and transgender) community into criminality alongside continued social stigmatisation. In 2001, Naz I Revamping public procurement BY : MUKUL G. ASHERTARUN SHARMA Modi was not for him. Mr. Yechury almost looked like an absent-minded boy scout being asked to take over his party. He presented a clenched fist which lacked a dramatic touch. This gesture was informal, almost absentminded, as if he was flagging down an auto. Yet, one realised why he is the human face of the party. He sounded almost matter of fact. The CPI(M) tried to create a sense of drama but the performance on the podium appeared almost listless. While Mr. Yechury enacted his leadership role, I looked at how Rahul addressed the kisan rally. For once he was coherent, sentences flowed into each other; now, he seems ready to be a leader. Senior Congressmen smiled with content that their “slow” nephew had blossomed at last. The realists knew that he has years to go but at least for the 22 minutes he spoke, his spirit of leadership seemed willing. Each leader enacted a characteristic script which acted as a perfect foil to the other. Mr. Modi began, didactic as ever, realising that his party has been slipping while he was playing to audiences abroad; the BJP is now losing initiative and is being seen as anti-poor and anti-farmer. Mr. Modi has begun to sound like a speaker at a FICCI meeting and when he declaims that his party has been pro-poor, he sounds hollow. The charisma is gone. The poor do not interest him. He projects them as a Congress conspiracy. Now, Mr. Modi wants to talk of the second stage of development; of his exploits and negotiations abroad. He wants to tell his aspiring masses that his negotiations with France and Canada have enabled him to access nuclear energy. He sounds like Father Christmas but the audience is not convinced. Rahul worked hard in presenting a propoor Congress, listing out the party’s attempts to waive rural debt, and remembering how he had promised to fight for them. He contrasted this with Mr. Modi repaying his electoral debt to the capitalists by selling land. He talked of the tribals from Niyamgiri, Odisha, as his lit- better specified in the Bill to prevent undue discretion by procurement agencies and redress committees. Fourth, the international practice is to designate a nodal agency for procurement. Hence, we need to clarify whether the proposed Central Purchasing Organisation (CPO) will be such an agency. When a framework for the nodal agency is established, it will need to be reconciled with the decentralised procurement process, which has also been suggested by the two recent committees to the Indian Railways. Fifth, the Bill is not applicable to procurements for less than Rs. 5 million, emergency procurements made for disaster management, and procurements for the purpose of national security. While excluding the latter two government activities is routine, the basis for discretion for procurements below Rs. 5 million, which is a significant amount, is not defined. The corresponding procedures for such procurements should also be specified. Sixth, the Bill also permits the procuring entity to limit competition in order to achieve other objectives, as well as exempt certain procurements from any of the provisions in the legislation such as the transparency requirements in “public interest”. However, in case of limited competition, certain other requirements such as reporting requirements, advance contract award notice, risk management techniques should be introduced to ensure that transparency is achieved. Foundation, an NGO working on HIV prevention, mounted a constitutional challenge to Section 377 in the Delhi high court by filing a public interest litigation seeking legalisation of homosexual intercourse between consenting adults. In 2009, in a historic judgment, the court overturned the 150-year old section, legalising consensual homosexual sex between adults. Having a legal system that was not hostile to homosexuals did not change everything on the ground but it bolstered their confidence. Many gays went public about their sexuality, not only before others but also to themselves. But this order was challenged. In 2013, the Supreme Court reinstated Section 377 of the IPC. Since then, India’s LGBT community has been in a limbo. With legal censure returning, fear has also staged a come-back. The few who had been emboldened to come out publicly about their sexual orientation earlier are now afraid. It is back to the closet. The matter is currently pending before the Supreme Court. Recriminalisation of gay sex has been a political hot potato. Most religious groups support Section 377. The Parliament has the power to amend the law, usher in change but lawmakers are wary. When it was in power, the Congress Party criticised the Supreme Court decision but the legislative amendment wasn’t a top priority. The ruling Bharatiya Janata Party has been speaking in multiple voices on gay rights. In a television interview last year, Arun Jaitley said personally he tended to agree with the Delhi high court judgment that removed the criminal tag from being gay. But others like home minister Rajnath Singh view gay sex as “unnatural”. No one knows Prime Minister Narendra Modi’s views on the matter. The deafening silence of our legislators on the tragedy underlines the dangers of not being encouraged to face up to who one really is, to acknowledge one’s sexual orientation. Many professionals I know, both men and women, are shocked that a professionally qualified working woman could not muster the courage to walk away from her marriage and chose to end her life. Or that an educated and successful man would not have the courage to tell his parents that he was not interested in marriage. But as we know too well, education does not necessar- Once a revised Bill is passed by Parliament, the following implementation challenges will need to be addressed. First, data management capabilities and standardisation must be enhanced. Both bidders and procuring agencies have significant data and information needs to ensure transparency in public procurements. Hence, the new procurement regime needs to be accompanied by streamlined data and information systems for various aspects of public tenders that are put out and the standardisation of information provided in the submitted bids against the tenders. Second, the 2012 Bill contains more than 20 references to ‘rules’. However, the general principles on which the rules will be based require clarity. Once defined in ily translate into empowerment. What should we do? Anjali Gopalan, founder and executive director of Naz Foundation, argues that the law criminalising homosexuality inhibits people from acknowledging and accepting who they are. Legal changes are vital if we are to prevent tragedies such as the one last week. But law alone cannot change the ground reality if social mores don’t change. On the legal front, it is important to impress upon lawmakers that activists are not asking for a total repeal of Section 377, but for it to be “defined down” so as not to apply to consenting adults in private. This will go a long way in helping gay men come out and prevent the kind of tragedy that we saw. It will not lead to a situation like the one in Bengaluru last year, when a man was arrested after his wife caught him on a spycam allegedly having sex with another man in their home. On the support front, there are a few groups run by LGBT activists for both gay and straight partners who are trying to separate. We need many more. On the social front, it is important not to see last week’s tragedy as a woman’s rights versus gay rights issue. At one level, both were victims. The man, because he did not have the courage to tell his parents and the woman that he could not go ahead with the marriage and the woman who was trapped into remaining in a relationship despite lack of reciprocity from her partner. The tragedy underscores a fact — if educated and financially independent men and women do not challenge the prevailing social system, change will be difficult indeed. the Bill, the rules must be coherent and credible, while permitting flexibility. Third, there is an implementation challenge concerning the skill sets of the officials, who will be at the interface of public procurement. Public procurement should be regarded as a task requiring professional skills. Capacity building in this direction should be undertaken urgently to ensure appropriate skill sets and that an understanding of business practices and logic is inculcated in the officials and in the organisations seeking procurement contracts. Designing and implementing a strong procurement policy is a long overdue step towards better public financial management, and it has large potential fiscal and governance benefits. Its early passage, therefore, lence was initiated by the CPI(M) when in power. The personality of the man dominated the moment. With the entry of Mr. Yechury, even people critical of the CPI(M) felt that “acche din aagaye hai” (good times are here). In his speech, he did not have to strain for effect like Mr. Modi or Rahul had to. It was clear that the CPI(M) has found a leader who can reinvent the party of the future. However, his claim that socialism is the way for the future sounds happily old-fashioned. One needs to contrast the atmosphere of the three speeches. The CPI(M) oozed a sense of solidarity. The Congress looked at its potential leader avuncularly. There was a sense of hope, and of modest expectation. On the other hand, the BJP atmosphere was surly. Mr. Modi was almost disappointed with India and he told his cadres to work hard and ignore ‘the games of the media’. This response reminded one of sour grapes. The man who was, hitherto, the darling of the media, suddenly felt that things are not the same. One could sense unease beneath the superficial calm in his party. He realises that the BJP faces an uphill battle in Bihar and that his party has messed up the script in Jammu and Kashmir. A hollowness Even as the detached spectator prepares the report cards of the three men awarding an ‘A’, ‘B’, ‘C’ to Mr. Yechury, Rahul and Mr. Modi respectively there is an unmistakable sense of dread. One wants to join in the celebration of the prospect of revival of the CPI(M) and the Congress but there is clearly a degree of hollowness around this political exercise. One wonders whether the three parties can offer much to address the ongoing crises in agriculture, the way to revive the economy and open and good governance. All three thrive on old categories and have little sense of the future. There has never been a time where political ideas in the public sphere have lagged so far behind the imperatives of institution building. Stumped by Kolkata and its vibrancy BY : HIRANMAY KARLEKAR I must begin with a confession. Apart from admiring his very considerable literary attainments, I am extremely partial to Günter Grass for a very personal reason. His book on Kolkata, Show Your Tongue, is dedicated to “Mr and Mrs Karlekar and the Calcutta Social Project.” The reference is to my late parents, Kalyani, and Govind Vinayak, Karlekar, who established the Calcutta Social Project in the 1960s for serving Kolkata's poor, particularly slum and street children. It ran schools, a craft training centre, and a shelter for those who had nowhere to go, and conducted sports activities, music classes and nutritional programmes. It had a committed and distinguished executive committee, whose members included Mrs Dipali Mitra, The Pioneer's editor and proprietor, Chandan Mitra's mother. During his five-month stay — originally intended to be for a year — in Kolkata in 1986-87, with his wife, Ute, Grass was a frequent visitor to the CSP, as the organisation is usually referred to. Later, he wrote warmly and approvingly of the project in Show Your Tongue, and continued to support it with donations even after leaving Kolkata. This was in sharp contrast with the general tenor of the book which was harshly critical of the city, where it came for some very sharp reaction. Having stated my bias, required by norms of journalistic ethics, I would like to make a few observations about the writer and the book. The former is known to be gruff, direct and blunt, with a marked proneness to see the world in sharply contrasting colours. The book and his decision to come and live in Kolkata, stemmed from his ideological position, which was markedly left of centre. He was strongly supportive of a wide assortment of non-establishment intellectual, literary and cultural groups as well as human rights organizations. He had close links with the leaders of the 1968 Student’s uprising in Europe and had campaigned for the German Social Democratic Party, of which he became a member. Grass had a strong, deeply emotional, and perhaps a trifle simplistic view of poverty, which, he seemed to believe, existed because of a lack of ameliorative action. He did not seem to recognise that social and cultural conditions also contributed, along with exploitative economic relations, to perpetuating it. What seemed to intrigue, and also perhaps anger, him was the joy that illuminated the lives of even the poorest of the poor of the city. How could they be happy despite their terrible living conditions? Here one sees the limits of the rational and humanist mindset emerging in the West in the wake of the Renaissance and Reformation, which is deeply condemnatory of the irrational and the emotive. It fails to recognise that both are powerful presences in the human psyche and can have a most beneficial impact on society. Thus, the rational decision for Britain might have been to make peace with Germany after the latter had overrun the whole of Europe during World War II. But it fought back, stood up to the ordeal of the London Blitz, and played a key role in defeating Hitler. Equally, many revolutions are exercises in hope in defiance of reason and their success, triumphs of the human spirit over daunting adverse circumstances. Grass was steeped in Western humanism except for a brief and ephemeral association with Nazism in his youth. Given his background, his criticism of Kolkata, which he had visited four times, should be seen not as the outpouring of a sneering Westerner, but of a humanist, cast in the classical mould, who was puzzled and exasperated by a phenomenon which defied all Western understanding of logical human behaviour. But then, he is not the first Occidental to be stumped by Kolkata's celebration of life in the teeth of killing odds. In case the user needs an eyeglass prescription, the technician will send results of the screening to an optometrist, who will send back a prescription within 24 hours, according to MIT Technology Review. Developed by the US start up EyeNetra, Blink's eye exam tools include a black device which takes the place of an autorefractor for measuring the level of focusing error. The device uses a Blink app shown on the smartphone's display to shine red and green beams of light at a user's eyes. The users line up these beams with a dial and the app figures out their refractive error by measuring the difference between where the beams are on the screen and how much they adjust them. Agencies Cape Town, Apr 23: Police in South Africa were on Thursday investigating whether an 86-yearold nun of Austrian origin found murdered had also been raped. The body of Sister Getrud Tiefebacher from the Sacred Heart Home Convent in the village of Ixopo, southwest of Durban, was discovered in her room on Saturday. Police said her hands were tied with an electric typewriter cord and she had been suffocated with a towel. "It is also suspected that the victim was raped before she was killed," a statement said. An undisclosed amount of foreign currency was taken from Tiefebacher`s room. The killing has shocked the small village, which is the setting for Alan Paton`s famous novel Cry the Beloved Country. "Police have not made any arrests in connection with the crime. The search is ongoing," police spokesman Thulani Zwane said. Zwane said Tiefebacher came to South Africa 50 years ago and had spent all her time working for the Roman Catholic Church. The report quoted a letter sent to the education ministers this week by a former teacher which claimed that female students were being discriminated against at the school. "The principal holds beliefs that if females run excessively, they may 'lose their virginity'," the letter said adding "The principal believes that there is scientific evidence to indicate that if girls injure themselves, such as break their leg while playing soccer, it could render them infertile". The principal of the col- lege, Omar Hallak, has been accused of stopping girls from competing in sporting events believing potential injuries could also make them infertile. "A few complaints were received regarding cartelisation in bidding," Coal and Power Minister Piyush Goyal said in a written reply to Lok Sabha. It is not possible to conclu- sively establish the same until investigation are carried out by competent authority," he added. The government has not approved the recommendation of nominated authority (NA) for declaration of successful bidder in case of four coal mines-Gare Palma IV/2, Gare Palma IV/3, Gare Palma IV/1 and Tara -- as final closing closing bid price was not found to be reflecting fair value, he said. Jindal Power, a subsidiary of Jindal Steel and Power Ltd, has emerged as successful bidder for Gare Palma IV/2, Gare Palma IV/3 and Tara coal blocks, while Balco had emerged as successful bidder for Gare Palma IV/1 coal block. "The estimated amount of revenue likely to be generated from the auction/allotment of these 67 coal mines is Rs 3,35,370 crore approximately," Goyal said. In addition, the benefits to consumers in terms of reduction of electricity tariffs is likely to be about Rs 69,310.97 crore, he added. Out of 204 coal blocks cancelled by the Supreme Court last year, government has so far allocated 67 coal mines through auction and allotment in the current year. "One coal block namely, Ardhagram where the successful bidder was declared, has been handed over to designated custodian in view of the court case," he said. He, however, said that no time limit has been fixed for completing the allocation process of all the 204 mines. Of the total 67 mines, the maximum no of 20 mines went to Jharkhand, followed by 14 to Chhattisgarh and 11 to West Bengal among others. Madhya Pradesh, Maharashtra, Odisha and Telengana are the other states to which the mines were allocated. "BSNL has introduced unlimited free calling during night hours from its landline phones to all landline phones and mobile phones of all service provider's network on all India basis from 1st May," BSNL said. Under the scheme, all major landline general plans of rural and urban areas, landline special plans as well as all major Combo (landline with broadband) plans are covered. As per latest TRAI data, BSNL which dominates landline market was the biggest loser of fixed-line customers in February while Airtel emerged as top gainer. The company had over 1.66 crore landlines at the end of February. Even after losing 162,556 landline customers in February, the company dominated the market with 62.26 percent share.(PTI) Govt considering clarificatory amendments to MAT rules: Sinha New Delhi, April 23: The government is considering clarificatory amendments to the rules relating to Minimum Alternate Tax (MAT) for the benefit of foreign investors who have been battling tax demands worth Rs 40,000 crore. "Clarificatory amendments to MAT rules are under consideration of the government," Minister of State for Finance, Jayant Sinha, told reporters on the sidelines of a conference on climate change held here Thursday. Sinha, along with top government officials, had held meeting with Foreign Institutional Investors (FIIs) yesterday, pressing for government's Rs 40,000 crore tax demand, saying they should approach courts to get relief on these matters. However, the government also made it clear that such demands would not apply to the entities from DTAA countries such as Singapore and Mauritius. In case of investors from jurisdictions having Double Taxation Avoidance Agreements (DTAAs) with India, the treaty benefits would override the tax demands. The Revenue Department has already sent notices to FIIs, demanding 20 percent MAT on capital gains made by them till March 31, 2015. For all other foreign investors except those falling under DTAA, the only remedy left is to challenge the levy of 20 percent MAT on capital gains they made in past three years. A growth rate of more than 7.5 percent may not be "sustainable" for India in the present scenario and the country needs to resolve tax issues that are impacting its investment climate, global rating agency Moody's said Thursday. It said however that the grow rate of 7.5 percent projected for the current fiscal is "good" and India's outlook is better than its peers. "What is positive for India is political willingness to take a longer term reform measures. 7.5 percent growth rate for current fiscal is a good growth and in present scenario higher than 7.5 percent is not sustainable," Moody's vice president Atsi Seth told reporters. She underlined the need for resolving the tax issues saying "uncertainty on tax issues is a deterrent to investment climate. Clarity on tax issue is important. "We are looking at long term growth prospects for five year horizon. We are looking at sustainability of growth." The tax department has recently sent notices to FIIs demanding Rs 40,000 crore as Minimum Alternate Tax (MAT) on the capital gains made by them till March 31, 2015. Although the decision to slap tax notices follows a court ruling, it has generated lot of controversy. As regards the growth outlook, Seth said India's prospects appear better than its peers but the policies are needed to incentivised to push private sector. "India's outlook is relative better to other peers (and)...Constraints appear to be easing. India's inflation has been higher. Inflation could be a concern. Current Account Deficit (CAD) has improved quite dramatically. Growth will be pushed by private sector and for that policies will have to incentivised." While directing DGP to pay compensation, Division Bench observed that this contempt petition is filed for non-compliance of the order dated 27.12.2011 wherein the Division Bench affirmed the order dated 07.10.2010 made in SWP No.1599/2002. The Writ Court gave the directions to the respondents to consider the case of the petitioner for appointment as Follower and the SSP Samba was directed to refer the case of the petitioner to General Administration Department for relaxation of his upper age limit in terms of Rule 5 of Civil Services (Classification Control and Appeal) Rules, 1956 within a period of three months. Instead of referring the matter, an appeal was filed which was dismissed by the Division Bench directing the respondents to comply with the directions of Single Judge within a period of two months. Decline in number of workdays under MGNREGA: Government Agencies NEW DELHI, Apr 23: The number of workdays being provided under the rural job flagship scheme MGNREGA has registered a decline, Lok Sabha was informed today. Minister of State for Rural Development Sudarshan Bhagat, in a written reply to Lok Sabha, said "there has been a decline in the number of persondays created in 2014-15." "MGNREGA is a demand driven programme and the demand for work itself is influenced by various factors such as rainfall pattern, availability of alternative and remunerative employment opportunities outside MGNREGA and prevailing unskilled wage rates," he said. The minister said that the government remains "actively engaged" with state governments in establishing the system that ensures provision of work as per demand. The annexure of data of workdays provided to each household under MGNREGA shows a constant decline in last three years in most of the states barring Maharashtra, Jharkhand and Goa, where it has shown a marginal growth in comparison to last year. He said that the states and Union territories have been asked to take a number of measures like expanding scope and coverage of demand registration system to ensure that the demand for work under MGNREGA do not go unregistered and organise 'Rozgar Diwas' periodically to capture the latent demand under the programme. Figures show while the Act provides for a maximum of 100days employment to each household, the average of actual workdays being provided has come down from 46 in 201213 and 2013-14 to 40 workdays in 2014-15. The decline is all the more noticeable in North Eastern states like Manipur, Mizoram, Nagaland and Sikkim. In Mizoram, which recorded 88 workdays per household in 2012-13, it came down to 75 in 2013-14 and then to a drastic 22 in last financial year. In Nagaland, it was down to 21 from 45 and 63 earlier while in Manipur it was 20 in the last financial year down from 25 in 2013-14 and 62 in 2012-13. SVC reviews institutional reforms in JK deptts to check graft Jammu, Apr 23: To check corruption, the State Vigilance Commission (SVC) today reviewed the implementation of institutional reforms in various government departments of Jammu and Kashmir and issued advisories to its officers. The State Vigilance Commission, under the chairmanship of Chief Vigilance Commissioner (CVC) Kuldeep Khoda, reviewed the progress at a high-level meeting here, a SVC spokesman said. The meeting focused on the implementation of institutional reforms in public health engineering, irrigation and flood control department, public works department (roads & buildings), rural development department and health & medical education department, besides social welfare department. The commission also issued advisories to the government departments and Departmental Vigilance Officers, State Vigilance Organisation (SVO), the spokesman said. Among major decisions taken to check malprac- tices, the departments were directed to strictly follow e-tendering, e-processing and e-payment of all works indented and executed. "The departments shall upload all the tendered works on website. The works under implementation along with the cost involved shall also be uploaded without delay to ensure that vigil from the general public acts as a deterrent against any corrupt practices," the spokesman said. The complaints originating from public regarding any deviation on ground from the description given on website will be freely entertained by the Commission and Vigilance Organisation, he said. The Commission asked the departments to go for mechanism to introduce transparency and this was discussed at length, the spokesperson said, adding, directions were issued to ensure deduction of TDS and recording of PAN details in payments made to contractors. Principal Sessions Judge Kathua Mr. Vinod Chatterji Koul observed that the fact that the accused/convict Rakesh Singh S/O Major Singh R/O Mangloor, Tehsil Hiranagar, District Kathua, had been facing trial since 03.12.2008, he is sentenced to undergo imprisonment for a period of five years and fine of Rs. 10,000/- (rupees ten thousand only) for offence u/s 306 RPC and imprisonment for one year and fine of Rs. 1,000/- (rupees one thousand only) for offence u/s 498-A RPC. In default of payment of fine, he shall further undergo imprisonment for a period of six months u/s 306 RPC and one month u/s 498-A RPC. Both the sentences shall, however, run concurrently. The Governor also approved the Shrine Board’s undertaking plantation activities in Katra Town and executing such other works of immediate importance which are identified for being carried out within a definitive time frame.The Administrator informed that as had been desired by the Governor in the earlier meeting held on 21.02.2015 at Raj Bhavan, a suitable piece of land has been identified for dumping of garbage at some distance from Katra Town and that necessary steps for its approval are being taken. The Governor asked the Administrator to make a time bound Project for getting the landfill site approved from the concerned Regulatory Authorities, including the State Pollution Control Board, and to very early get prepared a Project for a Solid Waste Management on scientific lines. In a significant decision, the State Government Thursday announced that despite shortfall in ration allocation from the Centre, it would provide rations to the people of the State as per 2011 census. “Rationees would be provided ration on subsidized rates by the State Government as per 2011 census till the Government of India releases additional quota projected by J&K,” Minister for CA&PD and Tribal Affairs, Choudhary Zulfkar announced at a press conference here. He said the announcement is in tune with the commitment made by the PDP-BJP Coalition Government in its Agenda for Alliance. He said all the Deputy Commissioners have been asked to provide, within one month, village-wise list of beneficiaries under different categories. The Minister said at present the State Government is providing rations to 19.72 lakh families with 1.01 crore souls as per 2001 census. He said as per the 2011 census the requirement of ration is for 22.73 lakh families with 1.25 crore souls. He added that the State Government is getting ration from Government of India/FCI for 18.02 lakh families with 99.45 lakh souls as per projected population for 2000 resulting in shortfall of 16500 MTs per month. He said the rations are presently being provided under four categories including BPL, Annapurna, Annatodya and APL. In order to fill the shortfall gap minister apprised that the matter has already been taken up with the Central Government and issue is being pursued at various forums. Referring to renewal/issuance of new ration cards, the Minister said that for this purpose the J&K Bank has been given a time of one month for the printing of new ration cards. He said the new ration cards will be both for rationees and non-rationees. Enumerating the measures to be taken by the Department to check pilferage of rations, the Minister said that GPS system is being put in place to track the movement of vehicles carrying the rations. He said e-transfer mechanism is also being adopted to check corruption. The Minister also announced that electronic weighing machines will be installed at all the Fair Price Shops soon. The aim of up-grading the Public Library is to enable everybody from all walks of life like students, women folk, employees and elderly people of Reasi to have equal access to information, fostering interest in Literature and Arts and advancing life long learning. He further said that other channels of information like TV, Internet etc. though in use and beneficial, yet importance of library for its benefit of information and personality development has not at all reduced.
