26th in Niagara Falls.

Hello Everyone! It’s hard to believe that Easter is around the corner. Christina Borden was kind enough to
get her Professor from College to speak at our April dinner meeting. Her name is Erica Swiatek. Here is a
little bio about her: Erica Swiatek is a high energy, passionate, facilitator, consultant and trainer. Designing
and delivering instructor-led courses, games, and activities in creative problem solving, innovation,
leadership skills, change management and team building.
Erica helps clients think differently by introducing them to techniques and tools that they can use in both
their professional and personal lives. She has several years of experience working with call centers and
large health insurance companies.
Erica has presented at several creativity conferences and Association for Talent Development (ATD). Erica
graduated from Buffalo State with a Master’s of Science in Creativity and Change Leadership. She loved it so
much she became an adjunct faculty there and teaches at both the graduate and undergraduate levels.

Congratulations to our Scholarship winners this year: Robin Neary ($1,500) and Timothy Madden ($1,000).
Both winners read their essays at Associates Night and they did a great job! Letters have gone out to all of
this year’s applicants to thank them for taking the time to apply and inviting them to apply again next year if
they meet the qualifications.
Ted Wash, President and Chief Operating Officer of Walsh Insurance Group was also with us at Associates
Night and he presented the Barbara Kane Scholarship to this year’s winner Connie Smith.
Right now, Deanna Filipski and Sandy Patterson are finishing up teaching our Public Speaking class.
Stephanie Domagala, Linda Potwora, Kathleen Rapasadi, Rachel Stover and Maggie Suhanov are the class
participants and I would like to personally congratulate each one of them for taking the time to t ake this
very worthwhile training.

Convention
Hi Everyone!
Convention is only one month away! Hard to believe, we're almost there! The committee is doing some
really fantastic things, to make this convention memorable. If you haven't registered yet, please do so...you
won't be disappointed!
We still need contributions to the door prizes. This would be a small gift or gift card, of approximately $10
in value. Please let me, or Karen Willard know if you have anything to donate, so that we can get those gifts
from you.
Also, as many of you know, the charity of choice for FNYIP is the Special Olympics. Every convention, there
is a basket raffle, which benefits that charity. We are looking for donations for a basket, to be used in that
raffle. We have traditionally done a Buffalo themed basket, so if you can donate something uniquely Buffalo,
we'll put everything into a basket for our contribution to this worthy cause. Any questions, please contact
me.
Our next convention meeting will be on Thursday, April 2nd, at 5:30, at Keller & Co offices. We will be
stuffing the goody bags that everyone gets at registration. If you plan on helping out at that meeting, please

Nurse Practitioners Modernization Act
Effective January 1, 2015, the Nurse Practitioners Modernization Act removes the requirement that a
written practice agreement must exist between an experienced nurse practitioner as a condition of practice.
The implications of the Act are: a nurse practitioner with more than 3,600 hours of clinical practice will no
longer be required to have a written collaborative

E-Cigarette Use in Buffalo
A new law signed by Mayor Byron Brown makes it illegal in Buffalo to use electronic cigarettes anywhere
the City bans traditional smoking: public transportation, public elevators, City-owned and leased buildings,
many large retail and wholesale businesses and City schools (except for areas reserved for adults using
faculty rooms or other designated spots). The ban also reinforces the existing State law, making it illegal to
sell electronic cigarettes to anyone under the age of 18.
Filing of Court Papers with Personal Information
The Office of Court Administration has issued a new rule to curb identity theft. According to Uniform Civil
Rules of the Supreme and County Courts §202.5(e), personal information shall be redacted whether or not a
sealing order has been sought if any of the following is contained therein:
•
taxpayer ID number including social security number, employer identification number, and
individual tax payer identification number (except the last 4 digits);
•
date of birth, other than the year;
•
full name of any individual who is a minor except a minor’s initials; or
•
financial account number including credit or debit, bank account number, investment account
number, and/or insurance account number (except the last 4 digits).

Witness Impeachment
In a recent Fourth Department case, Town v. E.B. Burns, testimony regarding an out of state 1983 conviction for
contempt based upon the lies an expert told during trial testimony was permitted upon cross-examination of
the expert witness. Although impeachment based upon “old convictions” was typically excluded by a trial
court, a conviction based upon perjury or other acts of dishonesty or untrustworthiness is special – no matter
how long ago it was committed. The court further held that the plaintiff’s attorney should have been afforded
an opportunity to rehabilitate the expert on re-direct by asking him to explain away the contempt conviction.
The trial court refused to permit said re-direct but it was deemed to be “harmless error” as the excluded
testimony would not have brought about a different verdict.
Court Ordered Jobs Not Subject to Wage Loss
In a recent decision the Southern District, Doyle v. The City of New York, plaintiffs alleged that they deserve to
receive minimum wage for their court ordered garbage collection and clean-up of parks and bridges around
the City as part of court ordered community service. The court clarified that these individuals were given an
adjournment in contemplation of dismissal (ACD), which requires the defendants to stay out of trouble and
comply with terms ordered to win dismissal of charges against them. The court held that the definition of an
“employee” under the Fair Labor Standards Act is a broad one, but does not include individuals who are ACD
workers. Judges in the Second Circuit apply an “economic realities” test to determine whether an individual is
an employee. The court held that the reality of this case was that individuals do not perform community
service in satisfaction of an ACD to earn a living, nor did the individuals make an argument that they had a hope
of being paid when they made their decision to accept the ACD. The purpose of the ACD program is to enable
the parties to resolve the case involving minor offenses in a way which provides more substantial
consequences than an outright dismissal of the charge, but allows the Defendant the ability to avoid the risks
and anxieties associated with further prosecution and the criminal stigma which attaches to convictions. The
holding is analogous to the Labor Law Standard 240 decision from the Fourth Department in 1999, Richel,
holding that an inmate on a work release program is not an employee and thus, not a protected person.
Appeal of an Order made on Motion in Limine
The prevailing case law of an Order made on Motion in Limine is that it is not appealable as it is merely an
advisory opinion on admissibility of evidence. The Fourth Department in Dischiavi v. Calli distinguished
between an order which limits the evidence (not appealable) and an order which limits the legal theories to be
tried (appealable).
Statute of Limitations
The Statute of Limitations for an intentional injury (battery) is one year pursuant to CPLR §218. However, if a
criminal action has been brought against an individual and a civil action is sought to arise from the same event,
pursuant to CPLR §218(8) the one year statute runs from the termination of the criminal action. In a trial level
decision in New York City, Sneider v. A.B. Green Gansevoort, the court held that the “termination” of the criminal
action is, at the very earliest, the sentencing of the Defendant or “some other final disposition”. Because the
Defendant was given a conditional discharge which included a sealing of the conviction if he stayed out of
trouble for one year, the court left open the possibility that the termination of the action would occ ur upon the
sealing, which had not yet occurred.

to your family & friends. You can collect the money and sheets and give to Jean or any board member who
will get it to Jean. Thank you.
The Corporate sponsorship letters have been mailed out and one is included in the bulletin. Please pass this
on to anyone you can think of and let me know who you sent it to so we may add them to our mailing list.
This is our biggest fundraiser for the year, it supports our scholarships and our general membership as a
whole.
We are looking for volunteers to work on the committee. Please bring a bottle of wine or cheer to add to the
"Basket of Cheer Raffle". I know we ask a lot of our membership in the events that we put on each year and
"WE" do "APPRECIATE" everything that you do. If it wasn't for "YOU" the Insurance Women of Buffalo,
Inc. wouldn't be where it is today!!!

Account Manager to handle our middle market accounts. This position, which is open due to an
upcoming retirement, will require supporting, obtaining, servicing and retaining commercial accounts.

Job Summary
Please confidentially inquire to us if you have the experience conducting consultative conversation,
maintaining current and accurate records of client coverage and underwriting information as well as
producing binders, certificates, policies, proposals, summaries of insurance and other insurance
documents within designated timelines. Additional desired experience would include obtaining nonmarketed renewal quotes from existing carriers, completing renewal processes and handling nonrenewal and cancellations for cause.
Qualifications

















Pertinent knowledge of insurance products and usages
Relevant understanding of insurance documents
Ability to utilize computer programs and understand their functionality; Applied experience preferred
Excellent verbal and written communication skills
Strong organizational skills, attention to detail and multi-task abilities

Property/Casualty License; insurance designations preferred
Willingness to pursue continuing education
