Request approval of notification to the City of Atlanta on the County’s position regarding the
annexation of approximately 271 acres into Atlanta.

Section 36-36-113 of the Official Code of Georgia requires the Board of Commissioners to notify the
annexing municipality of any intent to object within 30 days of receiving the notice of intent to annex
from the municipality, as well as provide a basis for the objection. Objections shall be made by
majority vote of the Board of Commissioners.

Fulton County received a notice of annexation letter dated April 8, 2015 from the City of Atlanta
requesting to annex approximately 271 acres of property in unincorporated South Fulton County and
referred to as the Loch Lomond community. The approximately 271 acres area proposed for
annexation is zoned R-3 (Residential) and is designated on the 2030 Fulton County Comprehensive
Plan Map as Suburban Neighborhood.
O.C.G.A. § 36-36-113 provides that Fulton County may by majority vote object to an annexation
within 30 days of receipt of the notice of proposed annexation. O.C.G.A. § 36-36-113 further
establishes the grounds upon which Fulton County may object to a proposed annexation. Fulton
County may object to an annexation because of a material increase in burden upon the County
directly related to any one or more of the following:

The proposed change in zoning or land use;
Proposed increase in density; and
Infrastructure demands related to the proposed change in zoning or land use.
The City of Atlanta proposed zoning of R-3 (single family residential) and land use designation of
single family are consistent with the current Fulton County zoning and the County’s land use
designation, therefore based on the criteria set forth in 36-36-113, staff has found no basis upon
which to file a valid objection and seeks the Board’s approval to notify the City of Atlanta
accordingly.

The total assessed value of the parcels to be annexed is $11,640.520.00 and based upon the SSD
millage rate of 0.012469; the fiscal impact of annexation would be $145,145.64.

Dear Mr. Eaves:
This letter has been sent to you by certified mail, return receipt requested, within five (5)
business days of acceptance by the City of Atlanta of an annexation application for the above
referenced community.
Please be advised that upon validation of the annexation application, the City of Atlanta plans to
initiate the legislative process to annex the above referenced community as depicted in the
enclosed map at a regularly scheduled meeting of the Atlanta City Council. If annexed, the City
of Atlanta intends to concurrently adopt similar land use and zoning to that of Fulton County for
the community, specifically a single-family land use classification and the R-3 (single-family
residential) zoning district.
Pursuant to O.e.G.A. § 36-36-7 and O.e.G.A. § 36-36-9, you must notify the governing
authority of City of Atlanta, the Atlanta City Council, in writing and by certified mail, return
receipt requested, of any county facilities or property located within the community to be
annexed, within five (5) business days of receipt of this letter.

resolution process, you must notify Charletta Wilson Jacks, Director Bureau of Planning, within
thirty (30) calendar days of the receipt of this notice.
