Terms And Conditions
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN THE CONTEST.
CONTESTANTS WILL BE ADMITTED TO THE FESTIVAL FREE OF CHARGE.
CONTEST PERIOD: The North Fork Horseradish Festival “Root Lugging Contest” will take place at the North Fork
Horseradish Festival on April 19th, 2015. The contest will begin at 3:00pm. Contestants will compete in heats of 2
teams. All entry forms must be received by 4:45 pm E.S.T on April 10th, 2015. ONLY THE FIRST 20 ENTRIES WILL BE
ACCEPTED.
ELIGIBILITY: The Contest is open only to individuals who are legal United States residents physically residing in one of
the 50 United States/District of Columbia. Contest is subject to all applicable federal, state, municipal and local laws and
regulations. By participating in this Contest, entrants agree to comply with and be bound by these Official Rules and the
decisions of the Sponsor, which shall be final and binding in all matters pertaining to The Contest (“Eligible Entrant[s]”).
AGREEMENT TO OFFICIAL RULES: By participating in the Contest, Entrant agrees to these Official Rules and
Sponsor’s and/or Administrator’s decisions, which are final and binding in all matters related to this Contest. These
Official Rules form a binding legal agreement between the Eligible Entrant and the Sponsor with respect to the Contest.
WINNER SELECTION: The team to cross the finish line with the greatest number of horseradish roots by weight in
their sacks within one minute will be awarded the winner. All contestants must adhere to the contest rules or risk being
disqualified.
GENERAL: By entering this Contest, Entrant agrees to abide by these Official Rules, and agrees to the use of
his/her name in any form of publicity or marketing determined by the sponsor and event producer. Entrants
waive any right to claim ambiguity in these Official Rules.
DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising
out of or connected with this contest or any prize awarded shall be resolved individually, without resort to any form of
class action, and exclusively by the state and federal courts located in New York; (2) any and all claims, judgments and
awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest, but
in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to
obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages
and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages
multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and
enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with
the contest shall be governed by, and construed in accordance with, the laws of the State of New York, without giving
effect to any choice of law or conflict of law rules (whether of State of New York or any other jurisdiction), which would
cause the application of the laws of any jurisdiction other than the State of New York.
