NOTICE INVITING TENDER
For and on behalf of the President of India, the Principal Chief Commissioner
of Income Tax, U.P. (East), Lucknow invites tenders in sealed cover in the two bid system
from entities having experience in the relevant area of work in the respective fields, for
The Partition Work Of Cabins At Building "Moti Chamber" 13/1, Rana Pratap Marg,
Lucknow. Tender document may be obtained from the office of the Principal Chief
Commissioner of Income Tax, U.P. (East), 5-Ashok Marg, Lucknow by paying a sum of
Rs.100/- as non-refundable tender fees on all working days between 10.00 AM and 05.00
PM. Last date of issue of tender document is 08.05.2015. The tender document may also
be downloaded from the website www.incometaxindia.gov.in (Tab Tenders). In case of
downloading the tender document from the departmental website, the bidder shall be
required to deposit the cost of tender in the shape of a Demand Draft per Rs.100/favoring the Pr. Chief Commissioner of Income Tax, Lucknow.
Interested bidders are required to furnish Technical and Financial Bids in
separate sealed covers and should be kept in a sealed cover together. The main sealed
covers should be superscripted as 'Tender For Partition Work Of Cabins' and
addressed to the Income Tax Officer (PR), O/o the Principal Chief Commissioner of
Income Tax, U.P. (East), 5-Ashok Marg, Lucknow-226001. Tender forms should be
accompanied with a Demand Draft to be drawn in favour of the Pr. Chief Commissioner
of Income Tax, Lucknow as Earnest Money Deposit of Rs.10,000/- (Rs. Ten thousand
only). Duly filled sealed tender covers can be sent by post or can be hand-delivered in the
office of the Principal Chief Commissioner of Income Tax, U.P. (East), 5-Ashok Marg,
Lucknow. Last date for submitting the tender document is 15.05.2015 and tenders
received beyond 3:00 PM on 15.05.2015 will not be considered.

Chamber" 13/1, Rana Pratap Marg, Lucknow-regardingGENERAL INSTRUCTION FOR TENDER
1. The Principal Chief Commissioner of Income Tax, Lucknow invites tenders for the
partition work of cabins at building "Moti Chamber" 13/1, Rana Pratap Marg, Lucknow226001.
2. Incomplete and conditional bids shall not be considered and will be out rightly rejected
at the very first instance.
3. All entries in the tender form should be legible and filled clearly. If the space for
furnishing of information is insufficient, a separate sheet may be attached. No
overwriting or cutting is permitted in the Financial Bid Form. In such cases, the tender
shall be summarily rejected. However, the cuttings, if any, in the Technical Bid
Application must be initialed by the person authorized to sign the tender bids. All the
pages of the bid shall be signed by the authorized signatory in ink with rubber stamp of
the bidder.
4. The envelope containing Technical Bid shall be opened first on the scheduled date and
times at the premise of the Principal Chief Commissioner of Income Tax, Lucknow,
located at 5-Ashok Marg, Lucknow, in the presence of the duly authorized
representative of the bidder, if any, who wish to be present on the spot at that time.
Financial bids of only technically qualified bidder shall be opened on the same date in
presence of authorized representatives of bidders.
5. The technical bids will be opened in the presence of the bidders or duly authorized
representatives. The date and time of opening of technical bid will be intimated to each
of the bidders in advance by the department.
6. The Financial bid of those technical bidders whose technical bid has been successful
in respect of all pre-qualifications would be opened on a date & time intimated to each
of them in advance. The successful bidder shall have to execute the contract within
three days of the offer and furnish a sum of Rs.50,000/- in the form of an
Account-Payee demand draft drawn in favour of the Pr. Chief Commissioner of Income
Tax, Lucknow payable at Lucknow as performance guarantee for safeguarding the

-3interest of the department in all respects. The security deposit shall remain valid for a
period of 60 days beyond the date of completion of all contractual obligations of the
service provider. The security deposit will be forfeited in case the completion of
assignment given by the department is delayed beyond the period stipulated by
department or on non-compliance / non-performance of the terms of agreement by the
bidder.
7. The Department reserves the right to annul any or all bids without assigning any
reason.
8. Area mentioned in Financial bid (Annexure-II) may be varied on physical inspection.
9. The bidder shall submit the technical & financial bids as per the format enclosed as
Annexure I & II.
10. The bidder should fulfill the technical specifications as per Annexure-I.
11. The bidder should have at least two years experience in executing similar works.
12. The bidder should be registered with Commercial Tax Department and have its own
Bank Account and PAN.
13. The bidder shall submit affidavit stating that the agency is / has not been black listed
by Central Government/State Government/any PSU.
14. Non Compliance with any of the above conditions by the bidder will amount to noneligibility for the work for which tender has been floated and its tender will be ignored
summarily.
OTHER TERMS & CONDITIONS
1. The price quoted should be inclusive of taxes, transportation etc.
2. No advance payment will be made by the Department.
3. The bidder should adhere to the provisions of all laws in every respect.
4. The successful bidder shall have to finish the work at the building "Moti Chamber" 13/1,
Rana Pratap Marg, Lucknow-226001.
5. The Bidder shall submit the bills after satisfactory completion of the work so as to
enable the department to initiate the process of payment to the Bidder.
6. Liaison shall be maintained with Income Tax Officer (HQ)(PR), Lucknow for smooth and
efficient completion of the described work.
7. Any tax as per laws in force shall be paid by the Bidders.

-48. Any damages, loss or theft will have to be borne by the Bidder/Contractor.
9. Failure by the Bidder to comply with any statutory requirements and / or the terms of the
agreement during the period of contract will result in termination of the contract and
subsequent disqualification from participation in any future tender of the department.
10. No negotiation will be undertaken with any bidder except the successful bidder.
11. The Bidder will not sublet or transfer any part of the contract.
12. If the quality of any items is found not satisfactory by this office then the Bidder will
replace them immediately at the bidder's cost.
13. The Bidder shall have all statutory license / registration which are essential /
mandatory for executing the work at the building "Moti Chamber" 13/1, Rana Pratap
Marg, Lucknow-226001.
FINANCIAL
1. Tender forms should be accompanied by Earnest Money Deposit of Rs.10,000/(Rs. Ten Thousand only) by Demand Draft, drawn in favour of the Principal Chief
Commissioner of Income Tax, Lucknow. The sealed covers should be superscribed as
"Tender For Partition Work Of Cabins' and addressed to the Income Tax Officer
(PR), O/o Principal Chief Commissioner of Income Tax, 5-Ashok Marg, Lucknow.
FRAUD AND CORRUPT PRACTICES
1. The bidder and its respective officers, employees, agents and advisers shall observe
the highest standard of ethics during the bidding Process. Notwithstanding anything to
the contrary contained herein, the Office may reject an Application without being liable
in any manner whatsoever to the bidder, if it determines that the bidder has, directly or
indirectly or through an agent, engaged in corrupt practice, fraudulent practice, coercive
practice, undesirable practice or restrictive practice in the Bidding Process.
LEGAL
1. The bidder shall be responsible for compliance of all statutory provisions relating to
Commercial Tax and any other Laws / Taxes / Acts / Rules etc. governing the matter /
issues etc.
2. The Tax Deduction at Source (TDS) shall be deducted as per the provisions of Income
Tax law, as amended from time to time.
3. The Department reserves the right to withdraw/relax any of the terms and conditions
mentioned in the tender document so as to overcome any problem encountered at any
stage.

-54. The Department reserves the right to accept/reject any tender or all tenders without
assigning any reason.
ARBITRATION
1. In the event of any question, disputes or differences arising between the parties relating
to the interpretation and application of these provisions of this agreement, such disputes
or differences shall be resolved amicably by mutual consultations. Venue will be the
Office of the Principal Chief Commissioner of Income Tax, 5-Ashok Marg, Lucknow. On
failure, the matter shall be referred for arbitration to the nominee of the Principal Chief
Commissioner of Income Tax, Lucknow. The decision of Arbitration to the agreement in
this regard shall be final and binding upon both the parties.
2. The parties shall continue to perform their obligation under this agreement during
arbitration proceedings.
