From at least April 2013 through December 2013, in violation of ORS 244.047, Mr. Axelrod used his position as
a West Linn Planning Commission member (an appointed position) to lobby West Linn city staff to enter into a
contract with his private sole proprietor environmental consulting firm, Axelrod LLC. Axelrod cited his Tier 1
ESB (Emerging Small Business) status and stated contracts under $100,000 were not subject to competitive
bid as reasons to expedite a contract for his own personal gain.

Ethics Complaint - Russ Axelrod
From at least April 2013 through December 2013, in violation of ORS 244.047, Mr. Axelrod used
his position as a West Linn Planning Commission member (an appointed position) to lobby West
Linn city staff to enter into a contract with his private sole proprietor environmental consulting
firm, Axelrod LLC. Axelrod cited his Tier 1 ESB (Emerging Small Business) status and stated
contracts under $100,000 were not subject to competitive bid as reasons to expedite a contract
for his own personal gain.
The solicitation was to review and advise the city on a piece of property it was taking
possession from a local paper manufacturing company, Blue Heron. He described the work as
"issues were related to environmental cleanup and potential liability and future site use
considerations that the City needed to be aware of in the RI/FS process currently underway for
the property." He pressured the city by stating the city was "perhaps at least a year behind
already."
Mr. Axelrod's requests were made to John Sonnen, who was then West Linn's Planning and
Building Director, through a series of emails from April 2013 through the fall of 2013. There
seems to have also been some personal meetings between Sonner and Axelrod. When Mr.
Sonnen left the city in the fall of 2013, with a sense of urgency Mr. Axelrod engaged Ken
Worcester, the city's Parks & Recreation Director, who was then the acting Planning Director
while Mr. Sonnen's replacement was identified.
On December 6th, 2013, Mr. Axelrod told Mr. Worcester "John [Sonnen] was smart to recognize
the potential concerns and issues facing the City, and that it needed assistance in a 3rd party
oversight role to advise the City on cleanup matters that others were performing on property it
was assuming ownership/stewardship on. We were just about to complete a general services
(time and materials) type contract for me to assist the City in this capacity …"
Mr. Worcester was cool to Mr. Axelrod’s inquiry and did not allow the conversation to continue.
I believe Mr. Axelrod's solicitation for a contract with the City of West Linn while a Planning
Commissioner was an ethics violation and I would request the Oregon Government Ethics
Commission investigate these circumstances. I believe the relevant code is ORS 244.047, Use
of Public Office for [personal] Financial Gain. To my knowledge a contract was never issued,
however the intent of Mr. Axelrod's actions were clear and a full investigation should be
considered.

Mr. Axelrod made through that system. There may have been other emails, communications,
and personal meetings not reflected in these city records. (I believe Kathy Mollusky’s name is at
the top of each email as she was the one printing them out and relating them on behalf of the
city - she was not a party to the conversations as best I know). I do have what I believe is a full

Hi Ken,
Perhaps we are talking about different types of support?
It is most important to be involved early in the remedial investigation (RI) process so that any interests/concerns of
the City can be addressed. Otherwise, you are typically not able to have addressed in the RI/FS process the
concerns/interests that may be important to the City. This is something that John finally understood, but he was slow
to get things going because he had other priorities apparently before he left – I felt that the City was perhaps at least
a year behind already(?)
My impression from my limited understanding of the project is that the City could miss an important opportunity to
further address its interests/potential liabilities for the property. If you have the time and we can discuss this further
sometime I would be happy to meet. We are not talking about very much money to review the work to date and
provide some feedback so I believe its $$ well spent no matter the outcome.

John was smart to recognize the potential concerns and issues facing the City, and that it needed assistance in a 3rd
party oversight role to advise the City on cleanup matters that others were performing on property it was assuming

me to assist the City in this capacity when John was fired. I asked John how I should proceed in his absence and he
recommended that I work with you because of your involvement, insight and because he believed Parks & Rec will be
managing things overall for the City.
So, I am writing to see if we might advance this process working together. I would be happy to discuss the matter by
phone or better yet to meet for coffee sometime if that works for you.
I am an Oregon Certified Tier 1 Emerging Small Business (Tier 1 ESB) so any governmental agency can hire me on
contracts up to $100,000 without competitive bid. Of course we were looking at a much smaller contract to generally
assess things and provide oversight services to the City on an on-call basis, but the certification makes all of this very
easy. As sole proprietor of my company, I can also be flexible on contracting elements and can provide a very
competitive billing rate considering the senior level of my experience and capabilities on such matters. That is to say
the City can take advantage of the opportunity with minimal costs compared to it seeking such services on the open
market. It is my experience over the years that such services pay for themselves many times over in the long-run.
For your information I have attached a copy of my Tier I ESB certification and also a short profile of my company and
general services and qualifications.
I look forward top hearing from you at your convenience.

These are the things I'll be thinking about as we try get this project done. Feel free to share with Chris K, Chris J
and the commission.
I honestly think that the more we describe this as Cut the Red Tape, we lose the true purpose. It's a cliche that
doesn't really explain the project. This isn't exclusively about Economic Development. It's broader than that.
The more we talk about it as economic development, the more we lose people. If we can't explain with clarity
how each change ties to economic development the conspiracy grows and the backlash is all we hear.

Tyler has a couple of units he wants to put into a few test users hands Wednesday. Could you contact a few of the
commission that you feel would be good testers so we can get them up and going on the tablets so they can test
functionality for us? We would want feedback well ahead of the end of month planning meeting so that we could
deploy the rest of them with any adjustments at that end of month meeting and roll full paperless at that time. Tyler
will need to setup and give Shauna some guidance on the dropbox delivery of materials.

The proposed dates are ok and I can be generally flexible on timeframe with some advance. However, I would

Good afternoon
We had spoken about visiting some water resource areas to see how the standards would apply. In short: Does
the proposed language make sense in the real world?
The long range weather looks really good in the middle of next week Tuesday April 23-Thursday April 25. Are
people available to meet during the day? If not, would meeting at 5pm be better?
Two hours would be the minimum required to make the rounds.
Possible sites include:
Two ephemeral streams easily accessed from Rosemont Road.
Two ravines, one with riparian overlay in Robinwood Park and the other without riparian overlay next to
Burgerville.
One piped stream that could be daylighted on either Walling Circle or Kenthorpe.
All of these sites are easily accessed.

It is most important to be involved early in the remedial investigation (RI) process so that any interests/concerns of
the City can be addressed. Otherwise, you are typically not able to have addressed in the RI/FS process the
concerns/interests that may be important to the City. This is something that John finally understood, but he was slow
to get things going because he had other priorities apparently before he left – I felt that the City was perhaps at least
a year behind already(?)
My impression from my limited understanding of the project is that the City could miss an important opportunity to
further address its interests/potential liabilities for the property. If you have the time and we can discuss this further
sometime I would be happy to meet. We are not talking about very much money to review the work to date and
provide some feedback so I believe its $$ well spent no matter the outcome.

This past year I discussed with John Sonnen environmental issues involving the Heron site and the City of West Linn’s
acquisition of the property. These issues were related to environmental cleanup and potential liability and future site
use considerations that the City needed to be aware of in the RI/FS process currently underway for the property.
John was smart to recognize the potential concerns and issues facing the City, and that it needed assistance in a 3rd
party oversight role to advise the City on cleanup matters that others were performing on property it was assuming
ownership/stewardship on. We were just about to complete a general services (time and materials) type contract for
me to assist the City in this capacity when John was fired. I asked John how I should proceed in his absence and he
recommended that I work with you because of your involvement, insight and because he believed Parks & Rec will be
managing things overall for the City.
So, I am writing to see if we might advance this process working together. I would be happy to discuss the matter by
phone or better yet to meet for coffee sometime if that works for you.
I am an Oregon Certified Tier 1 Emerging Small Business (Tier 1 ESB) so any governmental agency can hire me on
contracts up to $100,000 without competitive bid. Of course we were looking at a much smaller contract to generally
assess things and provide oversight services to the City on an on-call basis, but the certification makes all of this very
easy. As sole proprietor of my company, I can also be flexible on contracting elements and can provide a very
competitive billing rate considering the senior level of my experience and capabilities on such matters. That is to say
the City can take advantage of the opportunity with minimal costs compared to it seeking such services on the open
market. It is my experience over the years that such services pay for themselves many times over in the long-run.
For your information I have attached a copy of my Tier I ESB certification and also a short profile of my company and
general services and qualifications.
