TERMS AND CONDITIONS ARTICLE 1 – ORGANISATION The “POM PROMO – Start your day the Wonderful Way” (“Competition”) is organised by WONDERFUL BRANDS BVBA, with its registered offices on F. Rooseveltlaan 348U, B - 9000 Ghent (Crossroads Bank for Enterprises (CBE) no. 0891170375 “Organiser”). In the organisation and monitoring of the Competition, the organiser may be represented by its communications agency SA THE MANIFEST, with its registered offices at Rue Saint-Lambert 135, B-1200 Brussels (CBE no. 0842167856 “Agency”) The Competition shall begin at 00:01 (GMT) on 04/05/2015 and run until 23:59 (GMT) on 31/07/2015. It can be accessed online at http://pompromo.com/en/ in the United Kingdom only. These terms set out the general terms and conditions applicable to the Competition (“Terms”.) ARTICLE 2 – PARTICIPATION The Competition is open to all persons of 18 years of age or older on the date of entry and residing in United Kingdom, with the exception of staff employed by the Organiser or the Agency, their families and any third party having an interest in the organisation of this Competition. The Competition shall be run exclusively online at http://pompromo.com/en/ and entry implies full and unconditional acceptance of these Terms and all decisions taken by the Organiser in connection with this Competition. No written or telephone communication regarding the competition shall take place; except for emails as stated in these Terms. Winners shall be declared using the method stipulated by the Organiser in these Terms. The Organiser reserves the right to modify the Terms or cancel the Competition due to force majeure and/or if circumstances beyond its control render such a cancellation necessary. ARTICLE 3 – PRIZES The Organiser reserves the right to modify the Terms or to change them during the course of the Competition in accordance with article 6 (below). The prizes on offer are as follows: - Main prize: “Breakfast by a chef at home” – as described below. - Second prize: “£1 off coupon” valid for the purchase of two (2) 710ml bottles of POM Wonderful Juice from concentrate – any blend. Main prize – “Breakfast by a chef at home” By the end of each week, starting from 01/05/2015 until 31/07/2015, eight (8) vouchers will be awarded to eight (8) different participants each week. Winner will be randomly selected from all eligible entries, contacted via e-mail only and shall receive a voucher to redeem the aforementioned prize – “Breakfast by a chef at home”, provided by “La Belle Assiette” on behalf of Wonderful Brands BVBA. • Total available number of prizes: 104 • Prize description: A qualified chef will be appointed to come to the winner’s address in the UK to prepare a breakfast for two people. • Vouchers will be valid until 30/04/2016 and redeemable only in the UK. TERMS AND CONDITIONS Second prize: “£1 off coupon” All participants will receive a £1 off coupon valid on the purchase of two (2) 710ml bottles of POM Wonderful Juice from concentrate – any blend. This coupon is only valid in the UK and it cannot be combined with any other existing price-cut/reduction offer. Money off coupons shall be sent via e-mail to the address supplied by the participant. These are to be printed by the participant him/herself and handed over at the till when buying two 710ml bottles of POM Wonderful juice from concentrate. Coupons are valid for 6 months from the moment they are printed and are only valid in the country selected by the participant when entering the competition. Prizes cannot be transferred to another individual and they cannot be exchanged for another prize or cash. Prizes cannot be divided and must be accepted as awarded. Each participant can only win one prize per week. ARTICLE 4 – RULES OF PARTICIPATION The Competition shall be made public via different channels of communication (advertising at point of sale, on-pack advertising and on the promotional website). To enter the Competition, participants must purchase a 710ml bottle of POM Wonderful juice from concentrate bearing the “POM PROMO – Start your day the Wonderful Way” neck-hanger. Any bottle of POM Wonderful not bearing the promotional neck-hanger must be regarded as exempt from this competition. The participant should then visit http://pompromo.com/en/ where they shall be redirected to the POM PROMO online platform. Once on the platform, participants must first select their country of residence (i.e. the UK). They will then be asked to enter their unique code, found on any purchased participating pack. Participants will then be asked to answer two Competition questions and complete the Competition entry form. A unique code serves as a Competition entry ticket. Please note that the online platform will not allow the participant to enter the Competition without a unique entry code. Once participants have answered the Competition questions, they must fill in the form with their contact details in order to receive a £1 off coupon via e-mail. The coupon can be used for their next purchase of two 710ml bottles of POM Wonderful juice from concentrate – any blend. The coupon is valid for 6 months from the moment it’s printed and only in the country selected by the participant. Should no personal details be submitted, no coupon shall be sent and the Organiser will be unable to contact the participant should he/she be a winner of any prize. If a participant’s personal details are incomplete or incorrectly filled in on the Competition entry form or have been wrongly entered, the entry form shall be declared null and void and the participant shall be denied Competition entry. Winners shall be the persons who have either correctly answered the first Competition question or whose answer is the closest to the correct one. The “higher” answer shall prevail over a “lower” answer should more than one answer be the closest to the correct answer. In case of several identical answers, answers to the second Competition question will serve to determine the winner. In the event of a tie, the first answer to the first Competition question to be registered shall prevail. If still multiple identical answers remain, a draw shall be held to determine the winner. All communications between the organizer and the participants will be done by e-mail only. By the end of every week during this promotion, winners will be contacted to learn how to redeem their prize provided by “La Belle Assiette”. The £1 off coupon is for all participants and they will be able to print it immediately after participation in the sweepstake using their unique codes. If the contact information provided by the participant is incorrect, the prize shall be awarded to another winner. TERMS AND CONDITIONS Any incomplete submission or entry requested by any other means than the Competition entry form shall be deemed null and void. The Organiser may, at any time, request that participants submit their unique codes as well as proof of purchase. All incurred expenses by participants in taking part of the Competition (internet connection, computer, programs etc.) shall be borne by the participant. Participants may not, under any circumstances, claim reimbursement of costs incurred in taking part in the Competition. Participants may only enter the Competition on their own behalf and may not, under any circumstances, use pseudonyms or participate on behalf of a third party. Any attempt to enter the Competition via a programme or means different to the website’s programme, or by the modification or adaptation thereof, is forbidden and shall lead to the participant being excluded from the Competition. The Organiser reserves the right to disqualify anyone who has attempted to cheat, has compromised the proper functioning of the Competition or has infringed the Terms. In such cases, the participant/winner shall forego their right to any prize. The Organiser reserves the right to personally award prizes to winners and to use their names for promotional purposes. Winners explicitly accept the publication of their names on the Organiser’s social media pages with no payment or compensation necessary. In taking part in this Competition, participants acknowledge that should they win a prize, their names, photos and addresses may appear on websites and other online media which fall under the editorial responsibility of Wonderful, including the website and online media of the Organiser and its partners and the written press. In addition, they acknowledge that they may be filmed as part of a television report on the Competition with no geographical or temporal limitations. ARTICLE 5 – LIABILITY The Organiser, Agency, sub-contractor or partners shall not be held liable for any circumstances beyond their control which cause the cancellation of the Competition or hinder the running thereof. Competition participation implies the understanding and acceptance of the characteristics and limitations of the internet vis-a-vis technical aspects, the risk of connection failure and, more generally, all risks inherent to internet connection and the exchange of data, i.e. protection of data against misappropriation and the risk of contracting webbased viruses. The Organiser and the Agency may not, under any circumstances, be held liable for technical problems which may arise in connection with the website or e-mail system or any incompatibility between the technology used in the Competition and the hardware or software configuration used by a participant. More specifically, the Organiser may not be held liable for the following (non-exhaustive list): - Online submissions - Internet or software malfunction, viruses, bugs, technical defects or limitations - Any technical or software limitation of any kind. The Organiser reserves the right to modify these Terms or cancel the Competition in case of force majeure and /or if an event beyond its control occurs, thus rendering such a cancellation or modification necessary. The Organiser reserves the right to change the announced Competition duration dates as these are only provided for information purposes. TERMS AND CONDITIONS The Organiser and/or the Agency may not, under any circumstances, be held liable for damages caused directly or indirectly by connecting to the fan-page or the Competition website. Connection to the fan-page or website and Competition participation are the sole responsibility of the participants. Each participant shall take every necessary measure to protect his/her data and/or software and/or website and shall protect them against any degradation. The Organiser may not, under any circumstances, be held liable for: - Loss or delay caused by Internet service providers - Technical problems regarding the fan-page or website - Any incompatibility between technology used in the Competition and any hardware and/or software configuration used by the participant. The Organiser provides no guarantees concerning prizes. Should a problem arise, winners should contact the manufacturer/distributor of the service or product. The Organiser shall not be held liable for accidents or damage caused directly or indirectly by the prize or for any fault relating to the prize. The Organiser shall manage the Competition and the website as prudently as possible. However, it is possible that data may still be incomplete or incorrect. All inaccuracies, spelling mistakes or other errors of this appearing on the Organiser’s website or any other (promotional) material, of any kind, distributed by the Organiser may not be used against the Organiser or to create an obligation incumbent upon the Organiser. The Organiser accepts no responsibility and shall not be held liable for any loss and/or delay concerning the delivery of prizes. ARTICLE 6 –TERMS The running of the Competition is left to the Organiser’s discretion. The Organiser shall ensure the smooth running of the Competition, the strict application of the Terms, the declaration of the winners and the award and delivery of prizes. No appeal may be filed against a decision taken by the Organiser, especially concerning the declaration of the winners. A copy of the Terms is available in electronic format for download and subsequent printing at http://pompromo.com/en/. No written or telephone communication relating to the Competition or the declaration of the winners shall occur, bar that which is stipulated in the Terms. No decision taken by or communication from the Organiser relating to the Competition may be challenged. In entering the Competition and/or submitting personal data, participants accept the Terms in their entirety and all decisions taken by the Organiser in relation to the Competition. Any additional communication relating to the Competition should be considered as being an integral part of the Terms. If necessary, the Organiser may modify the Terms at any time by making mention of such a modification on the fan-page or website. Participants who enter the Competition before a change to the promotional campaign conditions is made shall be subject to the former conditions and shall not be subject to the modified conditions. ARTICLE 7 - PERSONAL DATA AND PRIVACY All personal data collected shall be for the sole use of the Organiser. Participants are duly informed that their name, age, sex and e-mail address shall be stored and processed. The use of such data is limited to the drawing up of internal statistics relating to the number of web site visits. Subject to the express prior agreement of the participant (opt-in (see below)), the Organiser may use personal data submitted for direct marketing purposes. Personal data may only be used for the following purposes: providing information relating to products and services, direct marketing or promotional campaigns, statistical analysis with a view to improving the Organiser’s products and services. TERMS AND CONDITIONS The Organiser would like to keep entrants informed of products and services available from The Organiser which may be of interest by email, post and/or telephone. However, if you specifically do not want to be contacted, please let us know by ticking the box on the relevant entry form or through such other method as may be specified in the published details of the Competition. You can also let us know by writing to us at the address in Article 1. The Organiser will not pass your email address to third parties for marketing purposes, but The Organiser may from time to time make your name, postal address and/or telephone number available to carefully screened companies, whose products we believe may be of interest to you. However, if you specifically do not want your details passed to third parties please let us know by ticking the box on the relevant entry form or through such other method as may be specified in the published details of the Competition. You can also let us know by writing to us at the address in Article 1. Personal data submitted as part of a Competition entry is processed in accordance with the current UK data protection legislation. Participants have the right to consult, modify or delete personal data at any time and may, without providing justification and at no cost, submit a request to the Organiser, at any time after the Competition, that their personal data not be used for direct marketing purposes, in accordance with the current UK data protection legislation. The Organiser shall take all necessary steps to protect the data it receives. By clicking on the “send” button and thus submitting their personal data, the user acknowledges that submitting data via the internet is never without risk. The Organiser is not responsible for damage caused by the use of personal data by unauthorised individuals. ARTICLE 8 - APPLICABLE LAW IT data pertaining to the Organiser or sub-contractors shall be considered by the parties as being the proof of communication of content between the parties. These Terms are governed by English law. Any dispute in connection with the Competition shall be the subject to the non-exclusive jurisdiction of the courts of England.
