VENDOR PACKAGE RULES AND REGULATIONS Eligibility • Any Restaurant/Food Truck/Catering Company/Licensed BBQ Team (Vendor) wishing to participate at Porkapalooza must be open for business in Alberta and must complete the Application. • Any Vendor who participated at Porkapalooza in 2014 will be given the first right to participate and select booth placement provided that such Returning Vendor has complied with all applicable contracts, laws and regulations. • Any returning Vendor wishing to participate at Porkapalooza shall provide Alberta Pork with a signed copy of this Agreement on or before May 29, 2015, as well as the fee required for participation. • Once Alberta Pork informs a vendor that they have been accepted to participate at Porkapalooza, the fee provided shall immediately be the sole property of Alberta Pork. • Notwithstanding any other Section in this Agreement, Alberta Pork, in its sole and unfettered discretion, reserves the right to refuse any application it receives from any Foodservice Company that wishes to participate in the Porkapalooza. Application Fee (1) The fee for participating at Porkapalooza is as follows: (a) $250 per day plus 5% of revenue (b) $500 for 2 days (full weekend) plus 5% of revenue Site Selection Foodservice Companies will get to pick their booth on a first come, first served basis, based on the order in which Alberta Pork received both the signed Agreement and corresponding fee. For clarity, the first accepted Company that provides Alberta Pork with a signed Agreement and corresponding fee will have the first opportunity to pick its booth site. As we look to provide a festive atmosphere throughout the park, Alberta Pork will have final say regarding restaurant/truck placement. 2 RULES AND REGULATIONS Site Set-Up and Tear Down All vendors will have access to its booth as of 9:00 am the day of participation. All companies will have site access as of 9:00 am on both days. • Once the Company’s booth is complete, Alberta Pork will complete a final inspection of the site, tent, truck and surrounding area. • Any damages sustained or cleanliness issues to the Vendor’s site, rentals or surrounding areas, as determined in the sole and unfettered discretion of Alberta Pork or any Porkapalooza supervisor, shall be deducted from the Vendor’s Proceeds. • Vendors are not permitted to commence any form of move-out from their site until 11:00 pm on any event evening with the exception of Sunday evening where move-out will commence at 8:00 pm. • For public safety reasons, Vendors are not permitted to bring a vehicle on to the Festival Location until 11:00 pm on any given event evening and must be accompanied by verbal clearance from Alberta Pork. Should a Vendor be observed violating this policy a fine of $250 will be incurred. Vendor Revenue ALL food will be sold at Porkapalooza by means of a food ticket arrangement. The food ticket arrangement for Porkapalooza shall be as follows: • Alberta Pork will sell food and drink tickets to patrons of Porkapalooza for a total price of One dollar per ticket (inclusive of GST). • The food tickets purchased by patrons can be redeemed with any Vendors for menu items offered at the Vendor’s site. • The food tickets returned by the Vendor to Alberta Pork (at a time to be determined by Alberta Pork) will be weighed and the ticket weight, as determined by Alberta Pork in its sole and unfettered discretion, will indicate the number of food tickets that were redeemed at the Vendor’s site; • 5% of total ticket sales will be held back by Alberta Pork. All other revenue will be paid out to all Vendors within 48 hours of that day’s business. For those Vendors participating in the full event, ticket revenue will be paid out within 48 hours following Porkapalooza. • Alberta Pork shall not be responsible for any lost, stolen or destroyed food tickets. • Under NO circumstance shall the Vendor accept cash from a patron of Porkapalooza in exchange for a menu item. If a Vendor is found to have accepted cash in exchange for a menu item, as determined by Alberta Pork in its sole and unfettered discretion, the Vendor will be issued a warning. Committing a second offence will lead to the Vendor being evicted from its site and prohibited from participating in any future Alberta Pork events. Alberta Pork Obligations 3 RULES AND REGULATIONS • Unless otherwise stated herein, Alberta Pork, at its sole cost, will provide the Vendor with the following for the Vendor’s site and booth: • One 10 ft. x 10 ft. tent if required • One 8 ft banquet table • One 15 amp 120 volt electrical hook-up • Garbage and recycling collection • The on-site sale of ice • Access to Men’s, Women’s and Handicap bathrooms • Required plumbed sinks with hot and cold running water • One banner identifying the Vendor’s name and logo, as well as the Alberta Pork logo • One menu sign identifying the menu items that will be served by the Vendor and the corresponding number of tickets required for purchasing each menu item. • Any additional power requirements of the Vendor must be detailed in the “Electrical Request Form” Additional power will come with an additional cost. • Site Map • On-site Support and Troubleshooting Signage • All banners provided by Alberta Pork are the property of Alberta Pork and must be returned immediately to a staff member upon the Vendor tearing down its booth. • All menu boards provided by Alberta Pork are allowed to taken by the Vendor. Vendor Responsibilities 4 RULES AND REGULATIONS • Hours of operation are: ·· 11:00am–10:00pm Saturday | 11:00am–8:00pm Sunday • Vendors must have adequate food and staff to stay open for complete operating times. Vendors failing to operate their booth within the prescribed operational times may be fined $250. Vendors are responsible for supplying and providing the following: • Storage facilities at its site (excluding refrigeration units) • One dry chemical fire extinguisher with 40 BC rating • All food supplies • Cooking units • All recyclable plates, bowls, forks, knives, spoons and napkins Parking There will be complimentary parking for all Vendors on-site. All Vendors must provide Alberta Pork with vehicle information by filling out the “Vendor Parking Form”. Based on the required amount of parking stalls, Alberta Pork will provide the Vendor with the associated amount of parking passes. • Vehicles will not be allowed to be parked at the Vendor’s site once the event begins. Any Vendor found violating this policy will be fined $250 for each infraction. Menu Items • Vendors are required to indicate on its Application, all menu items which it would prefer to serve at Porkapalooza. All menu items served at Porkapalooza MUST be BBQ themed which can include grilled, smoked and slow roasted items. We welcome different takes on BBQ including ethnicity. • Vendors may be asked to provide a sample of one or more items to be presented to the committee at a future “Menu Tasting Meeting.” • In addition the Vendor shall provide Alberta Pork with a comprehensive list of the ingredients that make up each of its proposed menu items. • Vendors may be denied certain menu items if there is overlap or duplication of items. • All menu items will be reviewed by Alberta Pork and its “Food Committee” headed by Food and Beverage Director Charles Rothman. • All Vendors shall only offer high quality, safe and edible food products to patrons of Porkapalooza. All Vendors food products shall be properly stored, cooked and prepared so as to be fit for the consumption by patrons as stated by Alberta Health. 5 RULES AND REGULATIONS Booth • Unless otherwise provided by Alberta Pork all companies must remain within the specified boundaries of its predetermined site. • Any Vendor requiring event or catering equipment can secure preferred pricing from Special Event Rentals. All rental items will be delivered on-site the day prior to said Vendor’s operations. Any damage or theft to equipment rentals is the sole responsibility of the Vendor. • All Vendors are responsible for operating and maintaining their entire site, booth, contents, and the surrounding area in an impeccable manner. The Vendor shall regularly remove garbage from its site, clean surrounding areas, and maintain the cleanliness of the site’s floor, sink, and any surrounding equipment. Failure to comply with this section, as determined by Alberta Pork, may result in additional charges being levied against the Vendor. • The Vendor shall ensure that all individuals working at the Vendor’s booth conduct themselves in a professional manner and that all personnel are wearing appropriate attire (no open toed shoes, long hair must be tied back, etc). • Any products or supplier recognition (i.e. banners, signage, and umbrellas containing a recognized trademark (i.e. Coors Light) being displayed by the Vendor must be approved by Alberta Pork. • Alberta Pork, the City of Edmonton and Alberta Health shall have access at all times to the Vendor’s site and booth. Use of Equipment • All hot cooking equipment must be a minimum distance of one meter away from the sidewalls of the Vendor’s tent and must have a drywall or some other means approved by the Fire Inspector. Environmental • Without limiting the generality of any other section herein, the Vendor shall, at its own cost, comply with all applicable Federal, Provincial, or Municipal statutes, regulations, and by-laws relating to environmental matters and the protection of the environment, including the handling, use, storage, disposal, transportation or method of application of any substance or thing which may be adverse to the environment. • All waste vegetable oil must be discarded in the pre-assigned dumping area provided by Alberta Pork. All waste vegetable oil will be collected by Green Grease to be converted into biodiesel for sustainable use. • All public waste and recycling stations will be maintained by Porkapalooza staff. 6 RULES AND REGULATIONS Insurance • The Vendor shall obtain and keep in full force and effect at all such times a comprehensive General Liability Policy with limits of no less than TWO MILLION ($2,000,000.00) DOLLARS showing Alberta Pork, Mison Consulting, and the City of Edmonton as additional named insureds. A copy of the required insurance policy is due on or before Friday May 29, 2015. Failure by the Vendor to provide Alberta Pork with a copy of the required insurance policy will automatically result in the Vendor losing its right to participate at Porkapalooza. Risks • All property of the Company at any time brought on the Porkapalooza Festival location or any part thereof shall be entirely at the risk of the Company. Indemnification • The Vendor hereby indemnifies and holds Alberta Pork and its directors, officers, employees, volunteers and agents harmless from and against any claims, whatsoever, for any loss, damages, or costs, whatsoever, and for all costs and expenses (including on a solicitor and his own client basis) incurred by Alberta Pork in defending such a claim, advanced by any person or entity, which is caused, results or arises from or is contributed to by the Vendor, including, without limiting the generality of the foregoing, any claim arising from the Vendor’s use of any parking pass provided by Alberta Pork. Compliance • The Vendor shall ensure that all of its employees, agents, servants, contractors, permitted invitees, directors, officers, and anyone whom in law the Vendor is responsible for, comply with all applicable statutes, regulations, rules, by-laws, policies and directives of Alberta Pork, the Federal, Provincial, Municipal governments or any other governing body whatsoever. • Without restricting the generality of any section herein, the Vendor is responsible for meeting all Health & Fire Regulations during Porkapalooza. Failure to comply with the Health & Fire Regulations may result in fines being levied against the Vendor or closure of their booth. • The Vendor acknowledges that Alberta Pork has entered into a license with the City of Edmonton regarding Alberta Pork’s use of the Festival Area. The Vendor acknowledges that it is responsible for reviewing and becoming familiar with the contents of such license (a copy of which will be made available for the Vendor to review and copy at the Alberta Pork office), and for ensuring that neither it nor anyone for whom it is responsible for in law will do or omit to do anything which would be inconsistent with such license. 7 RULES AND REGULATIONS General • Alberta Pork promotes Porkapalooza at the Festival Location with various decorations, entertainment, and signage. Alberta Pork reserves the right to bring in any vendors to the Festival Location in its sole and unfettered discretion, that it determines would be a welcome addition at the Festival Location (i.e. ice cream vendors). • Unless Alberta Pork provides otherwise, all meetings referred to in this Agreement shall be held at the offices of Alberta Pork. • After the Vendor Application form is received and accepted, all Vendors will receive an updated Timeline Schedule. TIMELINES Registration Deadline Friday May 29 Must include submission of application, payment, menu, site requirements and insurance documentation. Monday June 1 Vendor Meeting at Alberta Pork (Attendance is mandatory!)
