ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHICO AMENDING VARIOUS CHAPTERS OF TITLE 19 OF THE CHICO MUNICIPAL CODE REGARDING THE REGULATION OF BUSINESSES SELLING ALCOHOL – Final Reading and Adoption ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHICO ADDING CHAPTER 19.09 "DEEMED APPROVED ALCOHOLIC BEVERAGE SALE REGULATIONS" TO TITLE 19 OF THE CHICO MUNICIPAL CODE – Final Reading and Adoption Adopt - On April 21, 2015 the City Council introduced two ordinances amending Title 19 of the Municipal Code which would improve the City’s ability to regulate alcoholic beverage establishments. The ordinances are now returning for a final reading, and will go into effect June 19, 2015. The Community Development Director recommends adoption of the ordinances by reading of their titles only. 2.2. RESOLUTION OF THE COUNCIL OF THE CITY OF CHICO DESIGNATING CITY OFFICERS AUTHORIZED TO ORDER DEPOSITS AND WITHDRAWALS OF FUNDS IN THE LOCAL AGENCY INVESTMENT FUND Adopt - a resolution designating City Officers authorized to order deposits and withdrawals of funds in the Local Investment Fund (LAIF) pursuant to California Government Code § 16429.1. The Budget and Treasury Manager recommends the adoption of the resolution. 2.3. APPROVAL OF THE 2015/16 BUTTE INTERAGENCY NARCOTICS TASK FORCE (BINTF) PROPOSED GENERAL BUDGET The Memorandum of Understanding is extended on a year-to-year basis, and provides that each participating agency shall approve or disapprove the BINTF budget no later than June 30 th of each year. A copy of the BINTF Proposed General Budget for FY 2015/16 is attached (Exhibit A). The Chief of Police recommends approval of the 2015/16 BINTF Proposed General Budget 2.4. APPROVAL OF MINUTES FROM THE CITY COUNCIL MEETING OF 5/5/15 Approve – minutes from the City Council meeting held on 5/5/15. The City Clerk recommends approval. 2.5. HEARING TO CONSIDER INITIATING PROCEEDINGS TO ANNEX PROPERTY TO THE INCORPORATED TERRITORY OF THE CITY OF CHICO: WEST SACRAMENTO AVENUE ANNEXATION DISTRICT NO. 29 Hearing – to consider adopting a resolution initiating annexation of a 1.6-acre parcel located on W. Sacramento Avenue, immediately east of Hampshire Drive. The annexation is initiated to accommodate a future multi-family housing project. The proposed annexation falls within the scope of a Mitigated Negative Declaration adopted by Council on 01/20/15 (State Clearinghouse No. 2014112007). Pursuant to Section 15162 of the California Environmental Quality Act, no subsequent environmental review is necessary. (Report – Mike Sawley, Associate Planner) Recommendation: The Community Development Director recommends adoption of the following resolution: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHICO INITIATING PROCEEDINGS TO ANNEX PROPERTY NOW LOCATED IN THE UNINCORPORATED TERRITORY OF THE COUNTY OF BUTTE TO THE INCORPORATED TERRITORY OF THE CITY OF CHICO: WEST SACRAMENTO AVENUE ANNEXATION DISTRICT NO. 29 4. REGULAR AGENDA 4.1. CONSIDERATION OF APPOINTMENT TO THE AIRPORT COMMISSION The Council is being asked to consider an appointment to fill the vacancy on the Airport Commission due to the recent resignation of Marc Vandenplas. The term of office for this position will expire on January 1, 2017. A Notice of Unscheduled Vacancy was published three times in the Chico Enterprise Record and once in the Chico News & Review, with the recruitment period lasting three weeks. The Council is being provided with the applications of those individuals interested. (Report – Deborah R. Presson, City Clerk) Recommendation: The City Clerk recommends that the Council: (1) hear from the applicants in attendance and receive public comment; and (2) using a balloting procedure, appoint a member to complete the term of the vacated position. 4.2. CONSIDERATION OF APPROVAL OF AN EXTENSION OF THE TERM OF THE JOINT POWERS AGREEMENT ESTABLISHING THE BUTTE COUNTY ASSOCIATION OF GOVERNMENTS The Butte County Association of Governments (BCAG), which is a Joint Powers Agency (JPA) of the cities of Biggs, Chico, Gridley, Oroville, the Town of Paradise and the County of Butte, was originally established in 1969. BCAG’s current Joint Powers Agreement was last approved by the BCAG member agencies in July 2005 and included a ten (10) year term to the date of July 26, 2015. The Joint Powers Agreement was updated at that time to include BCAG’s administration of Butte Regional Transit. The proposed Resolution would extend the City’s participation in the JPA until July 25, 2017. (Report – Chris Constantin, Assistant City Manager) Recommendation: The City Manager recommends approval of the following resolution: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHICO APPROVING AN EXTENSION OF THE TERM OF THE JOINT POWERS AGREEMENT ESTABLISHING THE BUTTE COUNTY ASSOCIATION OF GOVERNMENTS May 19, 2015 Agenda Page 4 of 5 4.3. CONSIDERATION OF THE ARTS COMMISSION STRUCTURE In the past two and half years, the structure or the future of the Arts Commission has been discussed on numerous occasions. Most recently, Council took action on December 16, 2014 to limit the Arts Commission to two meetings a year (once every six months), with its efforts to be spent on moving towards the creation of an Arts Council, which was a concept of a regional approach suggested by Councilmember Coolidge that evening. The Council will be presented with information on what a regional approach could provide to the City of Chico in terms of support of the Arts. (Report – Deborah R. Presson, City Clerk) Recommendation: The City Clerk recommends that the Council consider the information regarding the regional approach and provide direction to staff. 4.4. ITEMS ADDED AFTER THE POSTING OF THE AGENDA 5.
