2013 MYER FASHIONS ON THE FIELD TERMS AND CONDITIONS HOW TO ENTER 1. Rules on how to and when you may enter the competition and details of the prize[s] and their value may be found at www.melbournecup.com/fashionstyle/myer-fashions-on-the-field/ and form part of these terms and conditions. 2. Entry may be refused if a contestant does not meet one or more of the Contestant Criteria, which are available on the day, or by visiting www.melbournecup.com.au. 3. By participating in the Myer Fashions on the Field event, entrants agree to observe and be bound by these terms and conditions. ELIGIBILITY 4. Contestants must be 18 years of age or more on the day of the competition that they are entering. Proof of age needs to be provided at the time of registration. 5. Employees, directors and other representatives of the Promoter, host race clubs and organisations involved in sponsoring or conducting any Fashions on the Field event (and any individuals so involved, including judges) are ineligible, as are members of their immediate families and households. 6. Entrants in the Myer Fashions on the Field – Design and Millinery Award Competition and winners of the Myer Fashions on the Field – People’s Choice competition are not eligible to enter the Myer Fashions on the Field event. Any person who is in any way involved with, works as or otherwise works for an organisation (including designers) that produces fashion clothing, hats or similar for profit, is also ineligible to enter the competition. NO COMMERCIAL INVOLVEMENT 7. Neither contestants nor their outfits are permitted to commercially promote a brand, store, or designer or any other commercial enterprise. 9. Contestants may only enter the competition in their own private capacity and not on behalf of a third party including any commercial enterprise. 10. Contestants must not receive any payment or benefit from a third party (including any commercial enterprise) for entering (or otherwise in connection with) the competition. WINNERS AND PRIZES 11. The Promoter will select the judging panel and the judges’ decision is final. In the event of a draw, the Promoter’s Adjudicator will determine the winner. This competition is a game of skill. Chance plays no part in determining the winner(s). All entries will be judged individually on their merits based on the Contestant Criteria. The judges may also rank additional entries as First Runner-Up, Second Runner-Up and so on in case the first chosen winner is ineligible to receive their prize (see below). 12. Winners will be notified on the day of their event. 13. All prizes must remain the property of the winner once awarded. No interest in a prize may be granted or transferred to a third party. 14. Conditions apply to Myer Gift Cards and can be found at www.giftcards.com.au/Gift-Card-Terms-of-Use.aspx . Myer Gift Cards cannot be used to make credit payments. 15. All travel and accommodation prizes must be taken exactly as specified, and by 30 June 2014, unless the Promoter or prize provider advises otherwise. Any vehicle lease prizes require the prize winners to commence their lease within 6 weeks of the winner being announced, unless the prize provider advises otherwise. Conditions of travel, accommodation and vehicle leasing apply and travel and accommodation prizes are subject to availability. 16. Prizes are non-transferable, non-exchangeable and not redeemable for cash. 17. Prizes are subject to change at the discretion of the Promoter for other prizes of equal or greater value. 18. Contestants who win the major prizes must be available for a minimum of eight promotional appearances, if required by the Promoter, during 2013/2014. 19. The national winner of the 2013 Myer Fashions on the Field Women’s Racewear competition will temporarily loan her winning outfit (including all accessory items such as headwear, shoes and bags) to the Promoter for 12 months commencing Monday 12 November 2013. The outfit will be on display in the Flemington Heritage Centre (at Flemington Racecourse) until conclusion of the 2013 Melbourne Cup Carnival. The outfit will be kept at the Promoter’s risk, provided that the Promoter’s total liability in connection with any damage, theft or loss will not exceed $2,500. 20. Should a winner prove to be ineligible for a competition, be unable to fulfil the Contestant Criteria in any way, not agree to any of the Terms and Conditions, breach these terms or interfere with the fair running of the competition (or attempt to do so) or, if despite using all reasonable attempts to do so, the Promoter is unable to contact the winner on the day in order to award the prize at the prize winners ceremony then some or all of their prizes may be passed on to the First Runner-Up. If the First Runner-Up similarly fails to qualify for a prize, then the prize will be transferred to the Second RunnerUp and so on. 21. All Finalists (including Daily, State and National Finalists) from the 2013 Myer Fashions on the Field event are not permitted to enter the 2014 competition in the same outfit. 22. The winner of the 2013 Myer Fashions on the Field event must not become an ambassador, face of or spokesperson for any other racecourse in Australia, unless approved in writing by the Promoter, within 12 months after winning the 2013 Myer Fashions on the Field competition. 23. Once a contestant has entered the Heats of the 2013 Myer Fashions on the Field competition, the contestant is not permitted to make any further alterations or additions to any of the garments; otherwise they will be disqualified from the competition. 24. Contestants who fail to appear for their competition judging at the correct time will be disqualified from the competition. 25. Entrants must not in any way disparage or make derogatory comments in any form (whether verbally, electronically or otherwise) about the Promoter, the competition or other contestants at any time. If a contestant is seen to be doing so they will be immediately disqualified from the competition and all other competitions run or promoted by the Promoter in 2013. 26. The 2013 overall winners of the Myer Fashions on the Field Women’s and Men’s Racewear competitions are not permitted to enter those competitions in 2014. PHOTOGRAPHS AND PERSONAL DETAILS 27. The Promoter collects personal information via competition registration forms, and otherwise on request from contestants, in order to conduct the competition and provide prizes (and may provide such information to third parties for these purposes). If the information requested is not provided, the contestant may not participate in the competition. Contestants may access and correct the personal information that the Promoter holds about them by contacting the Promoter’s Privacy Officer at 448 Epsom Road, Flemington, Victoria 3031. All entries will be entered into a database and, by placing an “X” in the box provided upon registration, the Promoter and sponsors (including Myer Pty Ltd) may use a contestant’s name and contact details for general marketing and promotional purposes, and to send the contestant offers, marketing materials and other information, including electronic messages. 29. Contestants agree that their image (including in still and video format) and name may be used by the Promoter, host race club, partners and sponsors (including Myer Pty Ltd) for future promotional and publicity purposes including in television, radio, social media and other forms of communication without any compensation or reward. GENERAL 30. All entries become the property of the Promoter when submitted. 31. At the time of publishing all information was correct. 32.
