How to apply for Find and Claim

How to apply for Find and Claim
The Personal Property Securities Act 2009 (Cth) provides
for a process of data migration, whereby security interests
on certain existing registers (Migrating Registers) will be
migrated to the Personal Property Securities Register
(PPSR). The PPSR has new rules about how the details of
secured parties, grantors, and collateral, are recorded on it.
This will mean that the information coming across from
Migrating Registers may not be presented in the same way.
As part of the data migration exercise, there will be a „Find
and Claim‟ process to enable secured parties to find and
claim their migrated secured party groups (SPG) so that the
associated registrations can be transferred to a new SPG
(target SPG) on the PPSR which has the correct details – in
particular, the correct address for service to which various
notifications are sent from PPSR.
Following the registration commencement time, account
customers who have the role „F&C – Access post-RCT Find
& Claim catalogue‟ may find and claim their migrated SPGs.
Accounts are not assigned this role at the time the account
is set up. Account customers seeking to find and claim their
migrated secured party groups, must first apply to the ITSA
National Service Centre (NSC) to have the role assigned to
their account.
An account customer should apply via email to
[email protected]. The email should be sent from the
Account Administrator of the account, headed „F&C –
Access post-RCT Find & Claim catalogue – Acc no.
[account no.] application‟ and contain the following
information:

the account number

the name of the account

the Account Administrator‟s name, username and
email address, and

a statement to the effect that the Account
Administrator requests that the role “F&C – Access
post-RCT Find & Claim catalogue” be assigned to
the account.
Following receipt of an application, the NSC will
assign the role “F&C – Access post-RCT Find &
Claim catalogue” to the account and send email
confirmation to the Account Administrator.
The Account Administrator will then need to
assign that role, via a „group‟, to appropriate
users of the account. For further information on
how to create groups and assign roles please
see the „Setting up permissions in a multi-user
account‟ fact sheet.
Users who have been assigned a group which
contains the „F&C – Access post-RCT Find &
Claim catalogue‟ role will then be able to search
for and claim any unclaimed migrated secured
party groups matching their „find‟ criteria. For
further information on what to do if your migrated
SPG is claimed see the „Find and Claim migrated
registration disputed claim procedures‟ fact
sheet.
Important: Any person who makes a fraudulent
claim for a migrated SPG, may be prosecuted
under the Criminal Code Act 1995 (Cth) and face
a term of imprisonment.
