HOW TO OBTAIN A COUNCIL PLANNING CONSENT
TO COMMENCE DEVELOPMENT
INTRODUCTION:
This information sheet advises you how to make an application for Council's Planning Consent
and how the application is processed.
Council Planning Consent must be received before you can obtain a building licence. Obtaining
this Planning Consent does not enable you to start construction of your building as you still
must obtain a building licence and ascertain action to comply with any other Environmental
Health and Operational Service requirements.
WHAT TYPES OF DEVELOPMENT REQUIRE A PLANNING CONSENT:
Council Planning Consent to commence development is required for all new buildings and
additions, and land uses in the following categories:
1.
Proposals for a second dwelling house on rural land;
2.
Ancillary accommodation attached to a dwelling house or what is commonly known as a
"granny flat";
3.
Group Dwelling developments (e.g. 2 or more dwellings on the one lot);
4.
All Special Use Zones;
5.
Home Occupation Activities;
6.
Industrial Developments;
7.
Commercial Developments (e.g. shops, offices, showrooms, warehouses, car yards etc);
8.
Wineries;
9.
Cottage Industry Activities;
10.
Holiday or Tourist Accommodation Developments (e.g. motels, hotels, caravan parks,
chalet parks, resorts, bed and breakfast activities etc);
11.
Community Uses (e.g. churches, private clubs and sporting facilities, etc);
12.
Requests for variations to development standards/requirements, including building
envelopes;
13.
Extractive Industries;
14.
Other Special Development types not listed above.

15.
Council Planning Consent is not required for a Single Dwelling House and associated
outbuildings within areas zoned Residential, Special Rural and Rural where the
development complies with development requirements of the Town Planning Scheme
and is not affected by Special Planning controls.
WHAT SHOULD YOU KNOW BEFORE MAKING AN APPLICATION FOR PLANNING
CONSENT:
1.
Enquire about the Town Planning Scheme Provisions for your locality where you are
proposing to develop, to ascertain what you can and cannot do, both for "land use"
activities and "development".
2.
Obtain and read all Shire Policies which may be applicable to the peculiarities of your
proposal.
3.
Obtain and read other Shire Division information sheets/forms, for example:
Environmental Health Services
(i)
Septic Tank & Leach Drain Application & requirements.
(ii) Water Supply requirements.
Development/Building Services
(i)
Construction requirements.
(ii) Building Licence Application requirements.
Operational Services
(i)
Construction & Drainage requirements in respect to vehicle parking & manoeuvring
areas and crossovers.
(ii) Fill Level requirements.
Please ask the counter staff about the availability of written literature in respect to matters you
need to know. If there is any particular matter you are still unsure about, please contact an
officer in the relevant section for assistance.
MAKING AN APPLICATION:
In order for the Shire to carry out an assessment of your proposals the following information is
required:
1.
Submission of a completed Application Form (see Form 1) for Council Planning Consent
to Commence Development, the required processing fee (see Fee Schedule) and
Development Application Checklist. (see Advisory Notice A1)
2.
Submission of three (3) copies of a site plan showing the location of existing and
proposed buildings and other land use proposals in accordance with the site plan
requirements. (See Advisory Notice A2).
3.
Submission of three (3) copies of the building plans showing sufficient detail to determine
the floor area, height (elevations), appearance and building materials to be used in
construction.
4.
A covering letter providing any additional information which you consider the Council
should be aware of in consideration of your proposals.
Please Note: Submission of the above information in the required format will enable quicker
processing. If your application is lacking in information or you wish to contest a requirement,
delays will be experienced.

THE ASSESSMENT TIMETABLE:
There are two different approaches which can be taken in the assessment of an application for
Council Planning Consent to Commence Development. The type of approach taken is
determined by the nature of your proposal. The approaches are:
(a)
An approval given on behalf of the Council by staff which is an approval granted under
“delegated authority”; or
(b)
An approval granted at a meeting of full Council.
1.
DELEGATED AUTHORITY APPLICATIONS
Delegated authority type applications are generally the more straight forward proposals
which comply with the Shire’s requirements and therefore can be approved without
reference to Council. Because of the simplicity of these applications, they can normally
be processed within four weeks of lodgement of the application if no public advertising is
required.
The type of application which can be dealt with in this approach can be established on
enquiry to the Shire Planning staff.
2.
COUNCIL MEETING APPROVAL
Where an application cannot be dealt with by delegated authority it is required to be
presented for Council consideration.
The Council meets on Wednesday of the second and fourth weeks of the month.
An application which requires to be submitted to Council must be submitted at least ten
days prior to the Council meeting to enable presentation of a report and inclusion of the
proposal on the Council Agenda.
All Extractive Industry applications are required to be submitted to Council.
(c)
A letter will be forwarded to you normally within one week of the Council’s meeting,
conveying its conditional approval or refusal.
Please note: The timing indicated in the above process may vary, depending on the nature of
the proposal and the type of research to be undertaken.
WHEN WILL YOUR PLANNING CONSENT EXPIRE:
When the Planning Consent specifies a length of time during which it remains valid, for
example twenty four (24) months, this is the time within which time a building licence should
be obtained and development commenced.
If the approval is likely to lapse before you commence or complete the development, an
extension to the approval may be obtained by submitting a new development application.
CAN YOU COMMENCE DEVELOPMENT ON RECEIPT OF THE DEVELOPMENT APPROVAL?
The development approval that is issued for your proposal will identify certain conditions which
you are required to comply with in the construction of your proposed development. You will
need to carefully read these conditions and discuss each condition with the relevant Shire Staff
that are responsible for the requirement. In some instances you will find that the conditions
must be met prior to commencing development such as in the case of obtaining a building
licence and in respect to others, you will not be able to comply with them until you have

completed the development, however, it is essential that you are aware of the Council's
requirements in satisfying each of the conditions imposed prior to commencing development.
