YELLOW CAB COMPANY OF PITTSBURGH On February 16, 2001, BTS filed a Complaint against Yellow Cab, alleging violation of 66 Pa. C.S. §1501, and 52 Pa. Code §29.313(a), for failure to transport a customer, Richard Yarosz, to his requested destination. BTS requested that the Commission fine Yellow Cab $500.00. The Initial Decision of ALJ Porterfield, issued May 8, 2002, concluded that BTS met its burden of proving that Yellow Cab violated 66 Pa. C.S. §1501, and 52 Pa. Code §29.313(a), by failing to provide reasonable service to Mr. Yarosz. The ALJ, however, denied BTS’ request that a $500.00 civil penalty should be assessed for the violation. BTS filed Exceptions to the Initial Decision on May 17, 2002. RECOMMENDATION that the Commission adopt the proposed draft Opinion and Order which grants BTS’ Exceptions.
