Commission will take final action on it at this meeting. When the Commission does

On August 16, 2001, the Complainant filed a Formal
Complaint against the Respondent. The Complainant
alleged that he had been improperly billed for certain
electric usage that had not been registered by his
residential meter due to a malfunction. The Initial
Decision of ALJ Schnierle was issued on April 3, 2002,
recommending that the instant Complaint be sustained, in
part, and dismissed, in part. The Respondent filed
Exceptions to the Initial Decision on April 23, 2002.
RECOMMENDATION that the Commission adopt
the proposed draft Opinion and Order which denies the
Respondent’s Exceptions and adopts the ALJ’s Initial
Decision.

On July 25, 2001, the Complainant filed a Formal
Complaint against the Respondent alleging a billing
dispute for the period from December 7, 1996 to
May 26, 1997. On March 22, 2002, the Initial Decision
of ALJ Nguyen was issued recommending that the instant
Complaint be sustained in part. On April 8, 2002, the
Complainant filed Exceptions to the Initial Decision.
RECOMMENDATION that the Commission adopt
the proposed draft Opinion and Order which denies the
Complainant’s Exceptions and modifies the ALJ’s Initial
Decision.

SAFETY v. YELLOW CAB COMPANY OF
PITTSBURGH
On February 16, 2001, BTS filed a Complaint against
Yellow Cab, alleging violation of 66 Pa. C.S. §1501, and
52 Pa. Code §29.313(a), for failure to transport a
customer, Richard Yarosz, to his requested destination.
BTS requested that the Commission fine Yellow Cab
$500.00. The Initial Decision of ALJ Porterfield, issued
May 8, 2002, concluded that BTS met its burden of
proving that Yellow Cab violated 66 Pa. C.S. §1501,
and 52 Pa. Code §29.313(a), by failing to provide
reasonable service to Mr. Yarosz. The ALJ, however,
denied BTS’ request that a $500.00 civil penalty should
be assessed for the violation. BTS filed Exceptions to
the Initial Decision on May 17, 2002.
RECOMMENDATION that the Commission adopt
the proposed draft Opinion and Order which grants
BTS’ Exceptions.
