1998, and January 5, 1999. An Initial Decision was
issued January 22, 2002, wherein the ALJ concluded
that Complainants failed to meet their burden of proof
and dismissed the Complaint. Complainants filed
Exceptions to the Initial Decision.
RECOMMENDATION that the Commission adopt

Complainants’ Exceptions and adopts the ALJ’s Initial

On July 25, 2001, the Complainant filed a Formal
Complaint against the Respondent alleging a billing
dispute for the period from December 7, 1996 to
May 26, 1997. On March 22, 2002, the Initial Decision
of ALJ Nguyen was issued recommending that the instant
Complaint be sustained in part. On April 8, 2002, the
Complainant filed Exceptions to the Initial Decision.
RECOMMENDATION that the Commission adopt

Complainant’s Exceptions and modifies the ALJ’s Initial
Decision.

This case involves sixteen consolidated Complaints that
were filed against Redstone alleging inadequate service.
By Opinion and Order entered February 9, 2001, the
Commission disposed of the Exceptions and directed
Redstone to perform an engineering feasibility study and
to submit a plan for implementation within twelve months
of the entry date of the Order. Redstone filed a Petition
for Review with the Commonwealth Court. The Court
granted Redstone’s request for a stay of the
Commission’s Order. The Court also granted
Redstone’s request for a limited remand.
RECOMMENDATION that the Commission adopt
the proposed draft Opinion and Order which modifies
the Commission’s Order entered on February 9, 2001,
and extends the completion date for the study and the
implementation plan.
