Subject: Request for nominations for Orientation Programme on Legal Rights and Entitlements for Women from
13 – 17 October, 2014 at NIPCCD, New Delhi.
Sir/Madam,
The Institute is organizing Orientation Programme on Legal Rights and Entitlements for Women from
13– 17 October, 2014 at NIPCCD, New Delhi. The objectives of the programme are to sensitize the participants about
women empowerment and women’s rights and their effective implementation; make them aware of Constitutional
provisions, and Legislations relating to women; familiarize them about existing support services for women; and promote
networking among NGOs and Institutions providing support services to women for their rights.

You are requested to nominate a senior or middle level official of Government/ representatives of Voluntary
organizations associated with capacity building and empowerment/development of women in the
organization/Department. The participants from Voluntary organizations who attended any training programme of
the Institute or its regional Centres in last two years may kindly not be nominated. It is mandatory for the
nominating Voluntary organization to have obtained the registration granted by the Planning Commission under the
NGO partnership system.

The participants from NGOs will be reimbursed travel grant up to AC-III tier rail fare (excluding Rajdhani,
Shatabdi, Duronto Express and AC bus) by the shortest route to and from venue of the programme. The journey by road
to the nearest railway/bus station will be paid to the non-officials participants on the basis of actual expenditure subject to
ceiling of Rs. 300/- each way. The official deputed from government departments will draw their TA from their
respective institutions/departments. However, the Institute will provide free board and lodging facilities to all the
outstation participants at its hostel located at its premises in New Delhi for the entire duration of the programme.

The Institute will charge a nominal registration fee of Rs. 500/- (Rupees five hundred only) at the time of
registration from NGOs participants. A non-refundable processing fee of Rs.50/- may be enclosed along with
nomination proforma (without which nomination will not be accepted) in the form of Demand Draft in favour of
“Director NIPCCD Delhi’, payable at New Delhi. It would be adjusted against the registration fee of Rs. 500/-. There is
no registration fee for Government Officials.
5.
It is requested that nomination in the enclosed proforma duly completed with a recent passport sized colour
photograph should be forwarded by Head of the Organization and be sent to the Institute at the earliest and latest by 15
September, 2014. Participants above the age of 65 and below the age of 21 years and those having educational
qualification below matriculation may not be nominated. It is requested that the candidate may proceed for the
programme only after receiving confirmation from the Institute. It is mandatory for the confirmed participants to show
proof of their identity (Passport, Election Card/ PAN Card/ Aadhar Card) while reporting in the hostel and at the
time of registration for the programme. The programme design and nomination proforma can also be downloaded from

Programme Design
The status of women in India has been undergoing a sea-change. Supported by
Constitutional guarantees to ensure dignity and equal opportunities, their active participation in
all walks of life including education, politics, sport etc., has been growing. Taking note of
women’s role in the nation-building activities, the Government had declared 2001 as the year of
Women’s Empowerment by adopting a National Policy to offer “Swashakti” to women. Several
laws have also been adopted to empower women socially, economically, legally and politically.
Considering the role of rural India, the country’s backbone, the Government had taken several
measures to strengthen Pachayanti Raj system with the active participation of women. This gave
a boost to increase the number of women being elected to the Lok Sabha and State Assemblies,
an indication to suggest their political empowerment. The Constitution not only grants equality
to women, but also empowers the State to adopt measures of positive discrimination in favour of
women. Within the framework of a democratic polity, our laws, development policies, plans and
programmes have aimed at women’s advancement in different spheres.
India has also ratified various international conventions and human rights instruments
committing to secure equal rights of women. Key among them is the ratification of the
Convention on Elimination of All Forms of Discrimination against Women (CEDAW) in 1993.The
Legal rights of women refers to the social and human rights of women. One of the first women’s
rights declarations was the Declaration of Sentiments. The dependent position of women in
early law is proved by the evidence of most ancient systems. Rights are legal, social, or ethical
principles of freedom or entitlement; that is, rights are the fundamental normative rules about
what is allowed of people or owed to people, according to some legal system, social convention, or
ethical theory. Rights are of essential importance in such disciplines as law and ethics, especially
theories of justice and deontology. Rights are often considered fundamental to civilization,
being regarded as established pillars of society and culture and the history of social conflicts
can be found in the history of each right and its development.
The Constitution of India not only grants equality to women but also empowers the
State to adopt measures of positive discrimination in favour of women for neutralizing the
cumulative socio economic, education and political disadvantages faced by them. Fundamental
Rights, among others, ensure equality before the law and equal protection of law; prohibits
discrimination against any citizen on grounds of religion, race, caste, sex or place of birth, and
guarantee equality of opportunity to all citizens in matters relating to employment. Articles 14,
15(a), 15(3), 16, 39(a), 39(b), 39(d) and 42 of the Constitution are of specific importance in this
regard. The Protection of Civil Rights Act,1955, and the Scheduled Castes and the Scheduled
Tribes (Prevention of Atrocities) Act,1989, which provide for offences of the practice of
untouchability and atrocities against members of SCs and STs, by persons not belonging to SCs
and STs, respectively.
Article 46 of the Constitution states that, “The State shall promote, with special care, the
education and economic interests of the weaker sections of the people, and, in particular of the
scheduled Castes and Scheduled Tribes, and shall protect them from social injustice and all
forms of social exploitation. "Article 330,332,335,338 to 342 and the entire Fifth and Sixth
Schedules of the Constitution deal with special provisions for implementation of the objectives
set forth in Article 46. Similarly, Article 30 (1) provides for the rights of the minorities to
establish and administer educational institutions of their choice. In addition, the existing
legislations on violence against women such as the IPC provisions on rape (Section 375 to 376D),
cruelty to married women (Section 498A), dowry death (Section 304B), outraging and insulting
the modesty of a woman (Sections 354 and 509), importation of girls (Section 366A), Dowry
Prohibition Act, 1961, Protection of Women from Domestic Violence Act, 2005 and Prohibition
of Child Marriage Act, 2006 can also be used by SC women and children.
With a vibrant women’s rights movement in India, there are constant demands for better
laws, provisions, and accountability for implementation. Currently, better provisions in IPC &
CRPC such as Sections 375 and 376 of the Indian Penal Code, there have been small but
significant amendments in legal instruments concerning women. For example, “Protection of
Women against Domestic Violence Act, 2005”, provides protection from violence in the
household from not only male perpetrators, but also female perpetrators like mothers-in-law
and other female members in extended families. It is a well known fact that majority of women
experience violence from those close to them, either in the family or in the neighbourhood. The
Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013,
seeks to cover women working both in the organised and unorganised sectors as well as those
who enter the workplace as clients, apprentices, students, patients etc.
There are many committed organizations and non-governmental organizations (NGOs) in
India working for the advancement of women's rights in addition to government appointed
agencies. But only legislations and law enforcement agencies cannot prevent the incident of
crime against women. There is need of social awakening and change in the attitude of masses, to
give due respect and equal status to women. This awakening can be brought by educational
campaign among youth making them aware of existing social evils and the means to eradicate
same. Mass media can play an active role as in present days it has reached every corner of the
nation. The NGOs also play an important role in an united expression of international, national,
regional and local level voice to assist and stand-up for those who can’t speak for themselves.
The Non-governmental organizations (NGOs) often play a critical role in advocating for changes
in law, policy, procedure and administrative rules. Hence, it is important to advance knowledge of
personnel both in Government and NGO's, working with women of recent developments on the
subject of legal rights and entitlement of women so that they can, in turn, empower women for
securing their rights, services and entitlements. Keeping this in view, the Institute proposes to
organize an Orientation Programme on Legal Rights and Entitlements for Women from 13–17
October, 2014 at NIPCCD Headquarters, New Delhi -110016.
Objectives: The main objectives of the programme would be to:(i)
Sensitize the participants about women empowerment and women’s rights and their
effective implementation;
(ii) make them aware of Constitutional provisions and Legislations relating to women;
(iii) familiarize them about existing support services for women ; and
(iv) promote networking among NGOs and Institutions providing support services to women for
their rights.
Course Contents: The course contents would broadly include constitutional provisions;
fundamental rights and directive principles relating to equality and special provisions; policies
and programmes for empowerment of women; laws related to women, domestic violence and
atrocities against women; legislations relating to dowry, property, marriage, trafficking,
indecent representation; IPC relating to rape, dowry, sexual harassment; Equal Remuneration
Act, Minimum Wage Act, Maternity Benefit Act state interventions and supportive services.
Methodology: The contents of the programme would be covered through a combination of
methods including lecture- cum-discussion, group discussion and group exercises; and films etc.
with emphasis on participatory approach to learning. Besides the faculty of the Institute,
resource faculty will be drawn from government, non-governmental organizations, academic and
technical institutions with relevant expertise in the subject matter and experience. The study
material comprising background reading material, handouts and exercise formats would be
distributed to the participants during the programme.
Participants: About 30-35 senior and middle level officials of National and State level
Government (GOs) and Non- Government Organizations from various States of the country
engaged in capacity building and empowerment/ development of women would attend the
programme. The participants will be selected on the basis of criteria which may include
educational qualifications; work experience, regional/local representation, language skill etc.
The selection of the participants is purely discretionary and will be decided by the
competent authority of the Institute.
Travel Board and Lodging: The representatives from voluntary organizations will be paid travel
grant up to AC III tier rail or ordinary bus fare by the shortest route to and from the venue of
the programme (excluding Rajdhani, Shatabdi, Duronto express and AC bus). The journey by
road to the nearest railway/bus station will be paid to the non-official participants on the basis
of actual expenditure subject to ceiling of Rs.300/-. Local participants will be paid actual
expenditure incurred on local conveyance subject to a limit of Rs.200/- each way per day.
However, officials deputed from Government departments, will draw their TA from their
respective departments/organizations. The Institute will provide free board and lodging
facilities to all the participants for the entire duration of the training and a day before and a
day after the programme i.e. from 12-18 October, 2014.
Registration Fee: While the Institute will continue to subsidize its programmes, it has been
decided to charge a nominal Registration Fee of Rs.500/- (Rs. Five Hundred only) per participant
at the time of Registration. A non-refundable processing fee of Rs. 50/- may be enclosed
with Nomination Performa (without which nomination will not be accepted) in the form of
Demand draft drawn in favour of ‘Director, NIPCCD payable at New Delhi. It would be
adjusted against the registration fee of Rs. 500/-. The participants would pay only Rs. 450/- at
the time of registration. No registration fee will be charged from Government Officials.
General Instructions
1.
The enclosed nomination form duly filled and sponsored by the competent authority of the
voluntary organization/ government department should reach the Institute at the earliest and
latest by 15 September, 2014. Participants above the age of 65 and below the age of 21
years and those having educational qualifications below matriculation should not be
nominated.

A passport sized photograph should be affixed on the nomination form duly attested by
the sponsoring organization. The registration number obtained from planning Commission is
mandatory for considering the nomination from Voluntary Organization.
3.
The Institute will confirm the participation on receipt of nominations. Nomination will not
be accepted in case the details regarding participation of the nominee in the earlier programmes
organized at NIPCCD have not been mentioned in the nomination Proforma.
4.
The participants are advised to proceed only after receiving the confirmation about your
participation from the institute. No substitute would be permitted to attend the course
without prior permission. Confirmed participants should report for the programme at 9.15 a.m.
on 13 October,2014
5.
It is mandatory for all the participants to get one of their identity proofs
(Passport/Election card/ Adhar card) and show the same while reporting in the hostel and at the
time of registration for the programme. Government officials may show their official identity
card.
6.
The participants are required to attend the programme for its entire duration. The
participants reporting late or leaving the course before its conclusion would not be entitled for
TA and certificate.
7.
The Institute will have no responsibility what so ever towards board and lodging in respect
of family members, relatives or friends of the participants.
