By entering this Competition, entrants are deemed to accept these Conditions. 1) Conditions of entry Entry into this Competition is open to residents of Australia who submit a valid entry within the Entry Period in accordance with these Conditions of Entry. Employees and their families and contractors of the Promoter and Just Group Ltd and its related companies are not eligible to enter this Competition. 2) Start and finish dates Entry into this Competition commences on 20 October 2014 and closes on 23 November 2014 (‘Entry Period’). 3) How to enter Entrants must sign up to the Peter Alexander ‘Sweet Dreams’ Mailing List and provide a valid email address to receive promotional offers and information about Peter Alexander during the Entry Period. Entrants may sign up to the Sweet Dreams Mailing List instore or online at peteralexander.com.au (‘PA Website’). No responsibility is accepted for entries that are late, lost, incomplete, indecipherable, misdirected or not received by the Promoter during the Entry Period. Entrants may only enter once. Entrants who have signed up to the Sweet Dreams Mailing List prior to the Entry Period will be automatically entered into this Competition. 4) Prizes and prize conditions There will be one winner as drawn by the Promoter in accordance with clause 5 below. The winner will be invited to meet with Peter Alexander at their nearest Peter Alexander store during Peter’s National Christmas Tour from 4 -12 December 2014 and will be given a $1,000 Peter Alexander gift card to spend in store. The winner must be available to meet with Peter Alexander on the date as notified to them by the Promoter. If the winner is not available to meet with Peter during the National Christmas Tour, then the winner will receive a $1,000 Peter Alexander gift card by mail, with no other prizes or compensation provided. If the winner is a resident of the Northern Territory or Tasmania, one economy class return flight and one night’s accommodation at a hotel selected by the Promoter in its sole discretion will be booked by the Promoter and provided to the winner at no cost to their nearest interstate capital city. The prize must be taken as offered, is not transferable and cannot be exchanged for cash. The Promoter accepts no responsibility for any variation in the value of the prize. If any prize element is out of stock at the time of redemption, the Promoter may substitute the prize with another of equal or greater value. Any operating, repair or ancillary costs associated with redeeming the prize (including but not limited to travel, accommodation, meals and out of pocket expenses, except as specified in this clause) is the sole responsibility of the winner. The total prize pool is AUD$1000 (excluding any applicable flights and accommodation), which is correct at time of printing. 5) Selection of prize winners The Competition draw will take place on 25 November 2014 at 11:00am (AEDST) at 658 Church Street, Richmond, Victoria, 3121. The first valid entry drawn will be deemed to be the winner. The Promoter’s decision regarding the prize winner is final, and no correspondence will be entered into regarding the outcome. If the prize winner is under the age of 18 years, the prize will be awarded to that person’s parent or guardian on behalf of that winner. 6) Rights in entries All entries become the property of the Promoter. Entrants warrant and represent that they own all rights in their entry submitted to this Competition and that the entry does not infringe any third party’s rights. 7) Notification of prize winners and distribution of prizes The prize winner will be notified by email on 25 November 2014. The prize winners’ name will also be published in an email to all Peter Alexander Sweet Dreams’ subscribers on or before 30 November 2014. 8) Unclaimed prizes 1 Subject to any written directions issued by any regulatory authority, any prize that remains unclaimed 3 months after the draw date will be distributed by way of an unclaimed prize draw at the same place as the original draw on 25 February 2015 at 10.00am (AEDST). This draw will be made up of all entrants who have entered the Competition. 9) Ineligible entries In addition to other requirements in these Conditions, entries must not contain anything unlawful, misleading, discriminatory or defamatory. The Promoter also reserves the right to verify entries and to disqualify from the Competition any entrant who the Promoter has reason to believe has breached these Conditions or engaged in any unlawful or improper misconduct. 10) Limitation of Liability The Promoter and its agencies associated with this Competition shall not be liable for any loss or damage whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss or for any personal injury or property damage) in connection with this Competition, except for any liability which cannot be excluded by law. To the maximum extent permitted by law, entrants release the Promoter and its agencies associated with this Competition from any all or any claims that may arise in connection with this Competition. The Promoter assumes no responsibility for any technical error, omission, interruption, deletion, defect, delay, loss or damage in the operation of the PA Website and/or participation in the Competition. If for any reason the Competition is not capable of being run as planned, due to causes beyond the reasonable control of the Promoter, the Promoter may modify, suspend, terminate or recommence the Competition, subject to the approval of any regulatory authority. 11) Promotional Activities and Privacy At the request of the Promoter, entrants and (if entrants are aged under 18 years), their guardians agree (without charge) to participate in any promotional activities planned by the Promoter and consent to their name being used in the Promoter’s marketing materials. By participating in this Competition, entrants consent to the use of their personal information as set out in this clause. The Promoter may collect and use personal information submitted with each entry for the purpose of running the Competition, contacting winners, sending prizes and marketing materials. Personal information may be provided to third party organisations that assist in maintaining the PA Website and/or running the Competition.
