“KEEP AN EYE OUT IN YOUR
MAILBOX FOR THIS YELLOW
POSTCARD”
Some of you have already
received this little
yellow card in your
mailbox and I appreciate
you giving us a call to
do an annual review of
your current insurance so
we can get you all the
discounts you deserve.
with us. Our lives are
so fast paced these
days that it is very
important that you give
us just “5” minutes of
your time so we can make
sure that your insurance
is keeping up with your
busy lifestyle and that
you’re still getting all
the discounts that you
deserve. I also want to
let you know that every
year we review all of
your current insurance
about 60 days before
your insurance renews
and if any of your rates
increase even 5% we are
automatically shopping
your insurance with
our Top-25 Insurance
Companies to make sure
you are always getting
the best value for your
insurance dollar.
As always, thanks again
for your business and
for your generous
referrals. We are
nothing without YOU!
We are mailing out these
yellow postcards to you
about 60 days before your
insurance is renewing

Our clients ask great questions
and we’d like to share this
useful information with you.
Q.
As a car is driving
down the highway behind a
truck, something flies off the
truck. The car can’t avoid
the object and runs over it,
causing a puncture in the gas
tank. Is this comprehensive
(falling object) or collision?
Also, does this constitute a
chargeable accident?
A.
Because it came off the
truck and made the accident
unavoidable, most insurers
would treat this as an “other
than collision” loss. The
only New York case I know of
addressing a similar scenario
is Getzoff v. Piedmont Fire
Insurance Co. 122 N.Y.S. (2nd)
43, where a stone fell off
a truck and rolled under an
auto, damaging its underside.
The court held the loss to
be attributable to a falling
object.
If the loss is attributable to
a falling object, such “other
than collision” loss would not
be chargeable. If the insurer
deems the loss a collision, it
may be chargeable subject to
its underwriting rules.
