Here’s how it works: General: Acceptance of merchandise to consign is at the discretion of Hello Again (HA). The Consignor is the owner of all goods to consign with HA and has the legal right to enter into this Consignor agreement. HA agrees to place the Consignor’s furniture, home décor, and artwork in the store for sale within a reasonable time and as space permits. HA retains the right to accept or decline any merchandise for consignment for any reason. We only accept items free of stains, holes, and odors. All mechanical items must be in working condition. Consignment Term: The term of this contract is 60 days, with an option provided at the discretion of HA to extend the consignment on select items for 30 additional days at terms mutually agreed upon by HA and the consignor. The consignment contract begins on the day the merchandise is entered into our inventory system. HA will remit 55% of the selling price to the Consignor for any item sold during the 60 day consignment agreement. Markdowns will be as follows: After 21 days, unsold merchandise will be reduced by 15% off the original HA determined retail price After 42 days, unsold merchandise will be reduced by 25% off the original HA determined retail price Initial____________ ! Consignment Term Expiration: At the end of the 60 day agreement, Consignor will be given the option of donating all the remaining unsold items or they may pick up their unsold items within 7 days of the contract expiration. HA will provide a tax receipt for donations if given notice on the Consignment contract to do so. NOTE: It is the Consignors responsibility to track the 60 day expiration and HA will not be liable for any items left in its possession beyond the contract period. Once expired, items not picked up in the 7 day posting period following expiration will become property of HA.. Initial____________ Pricing: HA prices all of the items to ensure the best possible price for the merchandise. HA has the sole right to establish the merchandise pricing. While determining price HA will take into consideration original valuation, current market price, condition, and age of a piece. If HA deems necessary, select consigned items may have a small handling, storage, or cleaning fee. HA reserves the right to discount items for purpose of sales and special events. Initial ____________ ! Payments to Consignors: Payment for each month’s sales will be processed to Consignor on the 10th of the month following the sale date of merchandise. Consignors are responsible for picking up their checks any time on or after the 10th of the month. A special request can be made of HA to mail Consignor’s check for a fee of $2.00 which will be deducted from balance owed. Balances under $25.00 will carry forward to the next month’s sales and once balance reaches $25.00 a check for the balance will then print during the next month’s pay cycle. Consignor retains right to cash out balances under $25.00 or use in store credit at any time. Initial ____________ ! Liability, Damage or Theft: Though all reasonable care will be taken to ensure the safety of articles consigned with HA, HA will not be liable for loss or damage to merchandise consigned by any reason including but not limited to, theft, fire, water damage or natural disaster. Under no circumstances will payment be made to the consignor for any of the above reasons. Should a dispute arise between HA and Consignor that results in court litigation, venue shall be solely in the state court system of Wichita County, Texas. Initial ____________ !
