Conditions to Second Reading of the MSTW Development Plan THAT Secondary Reading for MSTW Development Plan By-law No. 1-2014 subject to the following edits, such edits not affecting any substantial policy direction in the plan and therefore appropriate for consideration without additional advertising and public hearing within the authority provided by the Planning Act. 1. Add a map to the Development Plan identifying the Aggregate Resources, for information. 2. Remove “Rural Residential Area” from the Legend on all Maps and the colour for Rural Residential Area from the Maps. This will be addressed in the zoning by-law. 3. Name “Rural Clusters” on the map legend to coincide with Policy 7.3(1)(b). 4. Map the location, by outline, of all Rural Clusters. 5. For clarification, add to 9.3(4) “A Development Plan amendment may also be required to apply a land use designation that supports the proposed use.” 6. Change the designation of NE29-2-4 to Emerging Community and amend all related policies. 7. Change the word Tailer to Trailer on Map 9 8. Add “trunk” before “highway” in policies 2.4(3),(5),(8) and 6.9(1),(3) 9. Add “highway and road” to 2.4(10) after “possible future…” 10. Move word “new” in policy 5.4(4) to follow the word “Locate…” 11. Remove “parkway” from the Glossary. 12. Change all 600 series provincial road numbers to “PR” 13. Add word “generally” to the descriptions of agricultural capability classifications to clarify that precise boundaries was not the policy intent 14. Add to 7.3(2) the following criteria: “There is evidence of the following features: i) A well for domestic purposes; ii) an indication that a farm dwelling previously existed on the site; iii) an existing farmyard shelter belt.” 15. Add “and viable lower class lands” after “….3,” to 7.8(1) and 8.3(1) 16. Add to 8.3(6)(f) the following “a dwelling shall have existed on the parcel affected by the proposed subdivision and the residual parcel either on or before the effective date of 2007 of the previous Development Plan”. 17. Add “agricultural operation” and “retired farmer” to the Glossary, using definitions provided by MAFRD. 18. Add “in locations” between “development” and “where” in policy 5.3 (7) 19. Change 5.3 (12) to read: Undertake and adopt a Secondary Plan by the Council of the RM of Stanley for the Stanley Corridor that is endorsed by the Councils of the Cities of Morden and Winkler: a. Such endorsement from Morden and Winkler shall not be unreasonably withheld. b. In the event that concurrence with the Secondary Plan is not forthcoming from one or both cities, “unreasonable” shall be determined by an independent third party arbiter, who shall be agreed upon and appointed by all involved municipalities. c. Should the arbiter deem the objections to be unreasonable, the RM of Stanley will proceed with their Secondary Plan by-law. d. The Plan establishes additional detail about the use of land, infrastructure, servicesharing, and revenue- sharing opportunities. e. Until the secondary plan is endorsed and adopted by the municipalities, development within the corridor requires the agreement of both Cities of Morden and Winkler except for those uses, which were permitted under the previous Development Plan Bylaw No. 4-05 and RM of Stanley Zoning By-law No. 20-08, as amended. 20. Change 5.5 (1) to read: Build on existing sewer infrastructure, using the most strategic connections as a first phase. 21. Add the following as a second sentence to policy 11.7 Zoning By-law: “Zoning by-laws must be updated to conform to this Plan within 12 months of Third Reading of this Plan.”
