Sehr geehrte Kunden!
Unser Schulungsangebot wurde den Bedürfnissen der Teilnehmer angepasst. Die Lehrgänge
vermitteln die für komplexe Systeme erforderlichen Kenntnisse und Fähigkeiten zur speziellen
Installation, Parametrierung und Instandsetzung.
Für die Teilnahme an den einzelnen Lehrgängen erheben wir eine Kostenpauschale von € 60.pro Teilnehmer und Tag. Die Gebühr beinhaltet die Schulungsunterlagen, Getränke und Mittagessen.
Auszubildende zahlen keine Gebühr. Ausgaben für Verpflegung, Unterkunft, Fahrtkosten usw. sind von
den Lehrgangsteilnehmern selbst zu tragen.
Wir bitten um Anmeldung bis spätestens drei Wochen vor Schulungsbeginn. Bitte benutzen Sie für
jeden Lehrgang den Vordruck am Endes dieses Heftes. Ihre Anmeldungen werden in der Reihenfolge
des Eingangs bearbeitet und von uns bestätigt. Alle Schulungen finden in unserem Werk in Ellerbek
statt. Übernachtungsmöglichkeiten in günstiger Lage zum Schulungsort finden Sie in der beigefügten
Hotelliste. Die Hotelreservierung und Zahlung ist selbst vorzunehmen. Bei Interesse an einer Werksführung vermerken Sie dieses bitte auf dem Anmeldeformular.
Zu den aufgeführten Schulungen besteht die Möglichkeit, Seminare zu anderen Terminen oder
speziellen Inhalten am Ort Ihrer Wahl durchzuführen. Bitte sprechen Sie uns bei Bedarf an, wir
unterbreiten Ihnen gerne ein entsprechendes Angebot.
Dear Customers!
The content of our Training Courses is continually improved to offer courses tailored to your requirements. Building up on the participants’ basic knowledge the various courses teach the skills that are
necessary for installation, parameter setting and maintenance of these complex systems.
A fee of € 60 per person and day is charged for training documentation, food and beverage
during the course, with the only exception of trainees / apprentices for whom the courses are free of
charge.
We kindly ask you to register at least three weeks before the course starts using the
registration form included in this brochure. Your registration will be processed in the order they are
received and will be confirmed. The training courses will be conducted in our company in Ellerbek,
Germany. In the hotel list you will find details of hotels located close to the facility. We ask you to
make your own reservations. Any hotel charges are to be paid directly by the participants.
Upon request, a plant tour can be organized which will include our shops and testing facilities.
When registering, please let us know if you are interested in such a tour.
In addition to the courses listed in this leaflet we can also organize special trainings on different
topics, at other locations and dates, and in different languages. Please let us know about your
demand, and we will gladly offer you a customized course.

TEILNAHMEBEDINGUNGEN
TERMS AND CONDITIONS OF
PARTICIPATION
Allgemeines
Die nachstehenden Teilnahmebedingungen gelten zwischen der Smith
Meter GmbH - F. A. Sening GmbH - im folgenden „Organisator“ genannt
- und deren Vertragspartnern bzw. den Teilnehmern - im folgenden
“Kunden“ genannt - für Schulungsveranstaltungen der Smith Meter GmbH
- F. A. Sening GmbH. Abweichende Bedingungen eines Kunden, denen der
Organisator nicht ausdrücklich schriftlich zugestimmt hat, sind nicht Inhalt
des Vertrages. Änderungen dieser Teilnahmebedingungen bedürfen der
schriftlichen Zusatzvereinbarung.
General
The participation in training courses organized by Smith Meter GmbH –
F.A. Sening GmbH (hereinafter called the „Organizer“) is agreed with his
contractual partner, or the participant respectively (hereinafter called the
„Customer“), in accordance with the following Terms and Conditions of
Participation. Any Terms and Conditions of the Customer which are
different from the below Terms and Conditions are not applicable unless
the Organizer has accepted these and agreed in writing. Any
modifications the Customer makes to these Terms and Conditions require
written approval of the Organizer prior to the confirmation of participation.
Anmeldungen
Anmeldungen können schriftlich (Post, Telefax oder E-Mail) oder
telefonisch bei der Serviceabteilung des Organisators vorgenommen
werden. Der Organisator bestätigt jede Anmeldung schriftlich. Mit dieser
Bestätigung wird der Vertrag für beide Teile verbindlich.
Registration
Registration can be made in writing (by letter, fax or E-mail), or by phone
call to the Organizer‘s Service Dept. The Organizer will confirm each
registration in writing. Upon receipt of this confirmation at the Customer‘s
location, the contract will be binding for both parties.
Absagen
Schriftliche Stornierungen von Anmeldungen sind für den Kunden
kostenfrei, wenn sie spätestens 10 Werktage vor Beginn des Lehrgangs
beim Organisator vorliegen. Im Falle einer späteren Absage oder bei
unterbliebener Teilnahme - auch aus wichtigem Grund - wird die volle
Lehrgangsgebühr fällig.
Cancellation by Customer
Any written cancellation will be accepted free of charge as long as it is
received at the Organizer no longer than 10 working days before the
training course starts. In any case that a cancellation is made later than
10 days before the start of the course - irrespective of whether for
important reason or not – the full training fee is due.
Umbuchungen
Aus organisatorischen Gründen - z.B. zu geringe Teilnehmerzahl - behält
sich der Organisator das Recht vor, Termine abzusagen. Der Kunde erhält
in diesem Fall bereits für den Lehrgang geleistete Zahlungen erstattet,
weitergehende Ansprüche bestehen nicht. Falls der Kunde es wünscht und
dieses möglich ist, wird der Organisator jedoch vor Ausübung des
Rücktrittsrechts versuchen, die Anmeldung kurzfristig auf einen anderen
Termin umzubuchen.
Cancellation by Organizer
The Organizer reserves the right to cancel a course – e.g. because the
number of registrations received is too low. In such a case any fees the
Customer may already have paid, will be returned. No claims above this
will be accepted. Before canceling the registered participation and
returning the fee, however, the Organizer, provided the Customer agrees,
will try to enable participation in a training course dealing with the same
subject at a different date.
Änderungen
Der Organisator wird die Lehrgänge entsprechend der jeweiligen
Beschreibungen in den Schulungskatalogen durchführen; geringfügige
Abweichungen - wie Einsatz von Ersatzdozenten, zumutbare Orts- und
Terminänderungen - bleiben jedoch vorbehalten.
Modifications
The Organizer will carry out the courses as laid down in the Training
Catalog. However he reserves the right to make certain amendments, e.g.
change of lecturer, of subjects, of date or venue.
Lehrgangsgebühren
Es gelten die in den Schulungskatalogen angegebenen Lehrgangsgebühren zu-züglich der jeweils geltenden Mehrwertsteuer in gesetzlicher Höhe.
Die Lehrgangsgebühren beinhalten die Lehrgangsleistungen, einschließlich
Unterlagen und - soweit vorgesehen - die Nutzung von Systemen und
Einrichtungen, sowie Getränke und Mittagessen während der Lehrgänge.
Der Rechnungsbetrag ist mit Zugang der Rechnung ohne Abzug sofort
fällig.
Training Fee
The training fees apply as stated in the training catalog, plus VAT as in
effect at the time of invoicing. Training fees cover the lectures and active
training sessions including documentation and – if required – the use of
hardware, as well as beverage and lunch during training hours. The
invoice is due upon receipt without any deduction.
Gewährleistung/Haftung
Unterricht und Übungen werden so gestaltet, dass ein aufmerksamer
Teilnehmer mit entsprechenden Vorkenntnissen das jeweilige
Lehrgangsziel erreichen kann. Für den Lehrgangserfolg haftet der
Organisator nicht. Der Organisator haftet, gleich aus welchem
Rechtsgrund, soweit vorliegend nichts anderes geregelt ist, ausschließlich
für Vorsatz oder grobe Fahrlässigkeit von gesetzlichen Vertretern
und leitenden Angestellten. Im Fall grober Fahrlässigkeit ist die Haftung auf
den vorhersehbaren Schaden beschränkt, im übrigen, insbesondere für
Mangelfolgeschäden, ist die Haftung des Organisators ausgeschlossen.
Warranty/Liability
Lectures and active training sessions are structured in such a way that
any participant provided he has the required skills and pays attention, will
reach the training goal. The Organizer will not be liable for the training
success. Irrespective of the legal issue, the Organizer will only be liable for
damages originating from deliberate action or gross negligence of one of
his legal representatives or senior managers. In case of gross negligence
the liability is limited to foreseeable damages. The Organizer will not
accept any liability for consequential damages.
Urheberrechte
Alle Rechte an Lehrgangsunterlagen, einschließlich Übersetzungen und
Nachdruck - auch auszugsweise - behält sich die Smith Meter GmbH - F. A.
Sening GmbH vor. Ohne vorherige schriftliche Zustimmung seitens der
Smith Meter GmbH - F. A. Sening GmbH dürfen keine Reproduktionen,
gleich welcher Art, vorgenommen werden. Der Kunde wird die von ihm
angemeldete(n) Person(en) entsprechend informieren und verpflichten. Für
eventuelle Schäden aus Zuwiderhandlungen haftet der Kunde.
Copyright
Regarding training documentation, including translation and reprints – in
full oras an extract -, all rights are reserved for Smith Meter GmbH – F. A.
Sening GmbH. No reproduction whatsoever may be made without prior
written consent of Smith Meter GmbH – F. A. Sening GmbH. The Customer
will duly inform and obligate the persons registered for the training course.
The Customer will be liable for any damages arising from an offence
against this clause.
Datenschutz
Der Kunde erklärt sich mit der Verarbeitung seiner persönlichen Daten
insoweit einverstanden, als dies für die Zweckerfüllung des Vertrages
erforderlich ist.
Protection of Personal Data
By signing the registration form, the Customer agrees to his personal data
being stored and processed as long as required to fulfill this contract.
Sicherheit
Der jeweilige Kunde ist verpflichtet, die am Schulungsort geltenden
Sicherheitsbestimmungen zu befolgen.
Security
The Training Participant is obliged to follow the safety regulations
applicable at the venue of the training.
Gerichtsstand
Gerichtsstand für alle Streitigkeiten ist, soweit es sich bei dem Kunden

Governing Law
As long as the Customer is a merchant, and as long as the legal case is
not one of legal proceedings, any disputes will be governed by the
German laws, with the court of competency being Pinneberg. The
Organizer may also file a suit at the Customer‘s legal headquarters.
Sonstiges
Diese Teilnahmebedingungen bleiben auch bei rechtlicher Unwirksamkeit
einzelner Punkte im übrigen verbindlich.
Severability
Invalidity of any terms of participation shall not affect the viability of any
other terms.
