the violations identified in the report, a written corrective action plan is required. The
corrective action plan is due 15 days from the date of this letter and must include the

ALLEGATION:
The licensee, Ms. Wise, is never present at home when children are picked
up from care in the afternoon or evening hours.
INVESTIGATION:
On 2/7/13, I interviewed the complainant, who stated that whenever she picked
up Child A (4 year old female) from child care, Ms. Wise was never there. Due to
her varied work schedule, she has picked up Child A at different times; 1 pm, 2
pm, or between 5pm and 6.30 pm. Since early summer of 2012, she has not
seen Ms. Wise on a consistent basis while picking up her child. She would ask
for Ms. Wise, and the assistant caregivers stated that either she was at a doctor’s
appointment or she had some important work. Child A had discontinued
attending Ms. Wise’s child care since December 15, 2012. The complainant said
that in most of the occasions she did not know the reason for Ms. Wise’s
absence.
On 2/11/13, I interviewed the licensee Angel Wise. She said that she has been
away for doctor’s appointments once a month and sometimes to run some
errands. She would usually leave at nap time. Ms. Wise stated that she always
informs the parents about it, and she does this once or twice a month but nothing
more than that. Ms. Wise said that she would be gone for just over an hour when
she left child care. Ms. Wise stated that she had not maintained any record of her
absences from child care.
On 2/11/13, I interviewed the assistant caregiver Ms. Mosley. Ms. Mosley stated
that she has worked at the child care for over 9 years and she has not seen Ms.
Wise take off too often. Sometimes when they need some supplies for child care,
she would leave. Ms. Mosley stated that this might happen once or twice a
month, but she is here otherwise. Ms. Mosley is not aware of any record of
absences for Ms. Wise.
On 2/11/13, I interviewed the assistant caregiver, Ms. Coleman, who is also a
household member. Ms. Coleman said that she has not seen Ms. Wise leaving
child care except for doctor’s appointments once a month and to run some
errands sometimes. Ms. Coleman stated that she was not sure how often Ms.
Wise leaves the child care, but she knows that it is very rare. Ms. Coleman was
not sure if the parents were informed because Ms. Wise is hardly gone for long
hours. She is usually gone for just over an hour when she leaves the child care. If
Ms. Wise was not available for long periods of time, the child care would be
closed.
On 2/11/13, I interviewed the assistant caregiver, Ms. Lee. Ms. Lee indicated that
she has been an assistant caregiver to Ms. Wise ever since she was a teenager.

Ms. Lee stated that she has seen Ms. Wise leave child care only for emergencies
like doctor’s appointments. Most of the time Ms. Wise does not leave for more
than 30 minutes a week. Ms. Lee said that Ms. Wise does not have any other
commitments outside child care.
On 2/15/13, I interviewed Child B’s mother. Child B’s mother stated that she uses
child care for Child B (2 year old male) 3 times a week since February 2012. She
picks up Child B between 4 pm and 6 pm on a regular basis. Child B’s mother
said that Ms. Wise is present at the child care most of the time. She estimated
once a month when Ms. Wise may be absent. Child B’s mother said she does not
ask for Ms. Wise when she is not there because it does not happen very often.
Moreover, there is always an assistant caregiver.
On 2/19/13, I interviewed Child C’s mother. She said that Child C (2 year old
male) attends child care five times a week full time. She picks up Child C
between 4.30 pm and 6 pm due to varying schedules at work. Child C has
attended child care since December 2012. Child C’s mother stated that in the last
three months that she has been there she has always seen Ms. Wise at home
except once when she had a doctor’s appointment.
On 2/19/13, I interviewed Child D’s mother. She stated that in the last one and a
half years that she has been sending Child D (2 year old male) to child care, Ms.
Wise was always there when she picked up Child D. She does not recall a time
or day when Ms. Wise was not present.
On 2/19/13, I interviewed Child E’s mother. She stated that Child E (9 month old
male) has been attending child care for two months. Child E’s mother said that
she has always seen Ms. Wise when children are in care. She picks up Child E
between 3 pm and 4 pm and Ms. Wise has always been there. A couple of times
she has visited the child care unannounced and she has seen Ms. Wise present.
There was only once that Ms. Wise was not present during child care in the past
two months. Ms. Wise had informed her that she was going for a medical
appointment.
I conducted an unscheduled home inspection on 2/11/13. Ms. Wise was present
in the home along with the assistant caregivers, Ms. Mosley and Ms. Coleman.
APPLICABLE RULE
R 400.1903
Caregiver Responsibilities.
(1) A caregiver shall be responsible for all of the following
provisions:
(a) Be present in the home on a daily basis and provide
direct care and supervision for the majority of time children are

(i) When the child care home is in operation, vacation or
personal leave shall not exceed 20 days within a calendar year.
(ii) Medical treatment and subsequent recovery.
Ms. Wise is present in the home on a daily basis and provides
direct care and supervision for the majority of time children are
in care.
VIOLATION NOT ESTABLISHED
APPLICABLE RULE
R 400.1903
Caregiver Responsibilities.
(1) A caregiver shall be responsible for all of the following
provisions:
(e) Maintain a record of the dates of caregiver absences.
These records shall be maintained for a minimum of 4 years.

ANALYSIS:
Ms. Wise did not maintain a record of her absences when she
attended the doctor’s appointments or other absences during
child care hours.
CONCLUSION:
VIOLATION ESTABLISHED
ALLEGATION:
Children are allowed to watch TV shows that are inappropriate for their age.
INVESTIGATION:
On 2/7/13, I interviewed the complainant that stated that Child A told her that Ms.
Wise allows the children to watch Maury Povich and Judge Judy on TV. Ms. Wise
stated that she has not seen her daughter watching these shows at the child care
personally but she believes her daughter. She has seen her daughter watching
cartoons sometimes when she picks up Child A from child care during evening
hours.
On 2/11/13, I interviewed the licensee Ms. Wise, who stated that she has never
allowed any child in child care to watch any of the TV shows that have adult content
in them. She does not know of a time when children were allowed to watch Mary
Povich or Judge Judy. She stated that they follow a theme and a daily activity
schedule on a daily basis.
On 2/11/13, I interviewed the assistant caregiver Ms. Mosley, who stated that she
has not allowed any child in her care to watch Judge Judy or Maury Povich. She
stated that they hardly have any TV time for the children.
On 2/11/13, I interviewed the assistant caregiver Ms. Coleman, who stated that they
have an outline of activities for the children, and they adhere to that as much as
possible. Ms. Coleman stated that her four year old son also attends the child care
and is well aware of the activities that are appropriate for young children. Ms.
Coleman pointed to the daily schedule posted and stated that they follow the outline
most of the time. Ms. Coleman does not recall a time when she allowed the children
in care to watch Judge Judy or Maury Povich on TV.
On 2/11/13, I interviewed the assistant caregiver Ms. Lee. Ms. Lee stated that she
has not allowed children in her care to watch inappropriate shows. She has not at
any time allowed children to watch either Judge Judy or Maury Povich on TV.
Child B’s mother, Child C’s mother, Child D’s mother and Child E’s mother indicted
that they had never seen or heard that their children are allowed to watch Judge
Judy or Maury Povich on TV. Child E’s mother added that she has always seen the
children together either playing with blocks or with other toys.

On 2/11/13, I conducted an unscheduled inspection to the child care home. I
reviewed the daily activity guide/outline that contained age appropriate themes and
activities for the children. There was no TV time allotted in the schedule. Ms. Wise
indicated that they do video time once or twice a month for special days.
APPLICABLE RULE
R 400.1914
Daily activity program.
(6) The use of television, video tapes, movies, electronic
devices, and computers by children in care shall be suitable to
the age of the child in terms of content and length of use.
ANALYSIS:
The children in child care were not allowed to watch Judge Judy
and Maury Povich on TV.
CONCLUSION:
VIOLATION NOT ESTABLISHED

RECOMMENDATION
Upon receipt of an acceptable written corrective action plan, I recommend no changes
in the license status.
