nomenklaturi li jindikaw il-maskil jinkludu wkoll ilfemminil.
In accordance with clause 3.1(l) of the current Collective
Agreement, nomenclatures importing the male gender
include also the female gender.
1.0 Introduzzjoni
1.0 Is-Segretarju Permanenti fil-Ministeru għallEdukazzjoni u x-Xogħol jilqa’ applikazzjonijiet għallpost ta’ Technician (Xjenza) fid-Direttorat għal Servizzi
Edukattivi (DSE) biex iservu f’Għawdex. Uffiċjali Pubbliċi
fis-Servizz Pubbliku ta’ Malta li huma sekondati/mislufin/
detailed/deployed/attached ma’ organizzazzjonijiet fisSettur Pubbliku jistgħu japplikaw ukoll.
1.0 Introduction
1.0 The Permanent Secretary, Ministry for Education and
Employment, invites applications for the post of Technician
(Science) in the Directorate for Educational Services (DES)
to serve in Gozo. Public Officers in the Malta Public Service
who are on secondment/on loan/detailed with/deployed
with/on attachment to Public Sector Organisations may also
apply.

1.2 The mission of the DES is to ensure the effective
and efficient operation and delivery of services to the State
Colleges and schools within an established framework of
decentralisation and autonomy.

1.3 The functions of the DES are established by the
Education Act (as amended by Act XIII of 2006) which
may be consulted on: (https://education.gov.mt/Legislation.
aspx).
2.0 Termini u Kundizzjonijiet
2.0 Terms and Conditions
2.1 Is-salarju ta’ Technician (Xjenza) huwa ta’ Skala ta’
Salarju 15, €12,810.00 fis-sena, li jiżdied b’€298.00 fissena sa massimu ta’ €14,598.00.
2.1 The salary for the post of Technician (Science) is
Salary Scale 15, that is, €12,810.00 per annum, rising
by annual increments of €298.00 up to a maximum of
€14,598.00.
2.2 Persuna fil-grad ta’ Technician (Xjenza) tiġi promossa
għall-grad ta’ Senior Technician fi Skala ta’ Salarju 14
(€13,659.02 x €316.83 - €15,560.00), wara seba’ (7) snin
servizz fil-grad, jew ħames (5) snin, jekk tkun fil-pussess
ta’ Higher Technician Diploma (HTD) jew kwalifika xierqa
komparabbli u rikonoxxuta, jew kwalifka xierqa teknika
ogħla, dejjem jekk tkun qdiet dmirha b’mod sodisfaċenti.
2.2 A Technician (Science) will be promoted to the grade of
Senior Technician in Salary Scale 14 (€13,659.02 x €316.83
- €15,560.00), on completion of seven (7) years service
in the grade, or five (5) years, if in possession of a Higher
Technician Diploma (HTD) or a recognized appropriate
comparable qualification, or an appropriate higher technical
qualification, subject to satisfactory performance.
2.3 Il-Higher Technician Diploma hija meqjusa bħala
kwalifika f’Livell 5 fil-Qafas tal-Kunsill tal-Kwalifiki
(MQF). Persuna li għandha fil-pussess tagħha kwalifika
xierqa u relatata f’Livell 4 tal-MQF, segwita b’sentejn (2)
esperjenza ta’ xogħol xierqa, titqies bħala li tissodisfa rrekwiżiti f’paragrafu 2.2 hawn fuq.
2.3 The Higher Technician Diploma is rated at MQF
level 5 within the Malta Qualifications Framework (MQF).
A person in possession of an MQF level 4 appropriate
qualification followed by two (2) years proven appropriate
experience shall be deemed to satisfy the requirements
mentioned in paragraph 2.2 above.

inkarigati biex ikunu fformulati listi ta’ tagħmir flimkien
mal-ispeċifikazzjonijiet bil-għan li jinxtara tagħmir ġdid jew
partijiet għall-bdil;
Coordinating with Head of Department/teacher-in-charge
to compile lists of equipment complete with specifications in
view of purchasing new equipment or spare parts;
Li jkun żgurat li r-riżorsi u t-tagħmir huma f’kundizzjoni
tajba u disponibbli f’kull ħin/meta meħtieġa;
Ensuring that resources and equipment are in good
running order and available at all times/when required;
Il-komunikazzjoni mal-għalliema u t-tħejjija u t-twaqqif
ta’ tagħmir għax-Xjenza għax-xogħol prattiku, kemm għaddimostrazzjoni kif ukoll għax-xogħol individwali u/jew fi
grupp tal-istudenti. Dan jinkludi li jkun ipprovdut tagħmir
għall-attivitajiet tax-Xjenza li jsiru barra;
Liaising with teachers and preparing and setting up Science
equipment for practical work, both for demonstrations as well
as for students’ individual and/or group work. This includes
providing equipment for outdoor Science activities;

Dismantling equipment, cleaning it and returning it to
storage after laboratory sessions;

tal-laboratorju bl-użu tal-proċeduri stipulati fil-manwal
tas-servizz u/jew il-koordinazzjoni mal-fornituri għallmanutenzjoni u t-tiswija ta’ tagħmir ieħor;
Servicing and repairing ordinary lab equipment using the
procedures stipulated in service manuals and/or coordinating
with suppliers for the maintenance and repair of other
equipment;
Il-koordinazzjoni tal-manutenzjoni u t-tiswija u/jew ilkalibrar ta’ tagħmir permezz ta’ fornituri tas-servizz barra
mill-iskola;
Coordinating the servicing and repairing and/or
calibration of equipment by outside school service providers
and/or suppliers;
It-tħejjija ta’ reagents u soluzzjonijiet meta meħtieġa bi

Regulations, 2007”.

Technician Trainee Course, organizzat mid-DSE huwa
kkunsidrat ekwivalenti għall-Technician Apprenticeship
Scheme (TAS).
For the purposes of paragraph 4.1 (iii), the Science
Laboratory Technician Trainee Course run by the DES is
considered as equivalent to the Technician Apprenticeship
Scheme (TAS).

In accordance with Article 70 (1) of the Local Councils Act
(Cap. 363), the Xagħra Local Council notifies that the annual
locality meeting will be held on Sunday, 25th January, 2015,
at 9.30 a.m. in the Local Council’s Administrative Office,
in Vjal it-8 ta’ Settembru. During this meeting, the Council
will hear the residents’ proposals regarding the financial
estimates (budget) for the period January-December 2015,
and the three-year budget plan. All residents are invited to
attend.

namely, with Dr Peter Xuereb both in his own name, as well as
in the interest of his children according to a power of attorney
which they had given him to purchase and acquire from them
the property, or rather the divided portion of land which is
situated in the limits of Saint George’s Bay, Birżebbuġa.

Illi l-unika limitazzjoni għall-eżercizzju tal-azzjonijiet
spettanti lid-debitur mill-kreditur tiegħu taħt l-Artikolu 1143
hija l-esklużjoni ta’ dawk l-azzjonijiet li huma ‘għal kollox
personali’.
That the only limitation to the exercise of the actions due
to the debtor by his the creditor under Article 1143 is the
exclusion of those actions which are ‘completely personal’.
Għaldaqstant, huwa evidenti li dak li jinsab eskluż
mid-dritt mogħti lill-kreditur taħt l-artikolu in kwistjoni
jirrigwarda dawk l-azzjonijiet li huma għal kollox personali
bħalma huma azzjonijiet għal separazzjonijiet u dawk
marbuta ma’ familja, u mhux dawk marbuta mal-patrimonju
tal-persuna.
Thus, it is evident that what is excluded from the right
given to the creditor under the article in question relates to
those actions which are completely personal such as the
actions for separations and those related to the family and
not related to a person’s patrimony.
Illi għalhekk il-fattispecie tal-preżenti kawża huma
tali illi jirrendu l-actio debitor debitoris mei applikabbli.
L-esponenti ġew reżi kredituri ta’ Dr Peter Xuereb u ta’
wliedu, Olga Mifsud u Peter Xuereb permezz tal-konvenju
ta’ nhar l-20 ta’ Ottubru, 1989, u liema debituri fil-mansjoni
tagħhom bħala koeredi kellhom għad-dispożizzjoni tagħhom
il-fakoltà li jistitwxxu kawża għad-diviżjoni tal-proprjetà
miżmuma in komun, u dan sabiex ikunu jistgħu jissodisfaw
l-obbligazzjoni tagħhom li kellhom favur l-esponenti skont
l-imsemmi konvenju.
That thus the facts of the present case are such to render
the actio debitor debitoris mei applicable. The applicants
were rendered creditors of Dr Peter Xuereb and his children
Olga Mifsud and Peter Xuereb by means of the preliminary
agreement of the 20th October, 1989, and which debtors in
their position as co-heirs had at their disposition the faculty
to institute a cause for partition of property held in common,
and this so that they may satisfy their obligations they had
in favour of the applicants according to the preliminary
agreement.
Illi b’referenza għad-dritt li għandhom l-esponenti,
l-Ewwel Onorabbli Qorti irrimarkat illi l-bejgħ skont ilkonvenju surriferit, u cioè d-dritt tal-esponenti kien wieħed
li ‘jiddependi mill-assenjazzjoni tal-art’. Bl-akbar umiltà u

That with reference to the right which the applicants have
the Honourable First Court remarked that the sale according
to the preliminary agreement above referred to and namely
the applicant’s right was one ‘which depended on the
assignment of the land’. With the utmost humility and with
the utmost respect, the applicants feel that this conclusion
was not correct. The relevant clause reads as follows:

that the function of this clause is simply declaratory, intended
only to clear the position.

cause due to their debtors, and this to satisy the credit due to
them on the basis of the actio debitor debitoris mei.

11th July, 2014, Argus Insurance Agencies Limited (C 597),
for and on behalf of the foreign company Argus Insurance
Company (Europe) Limited, of La Concorde, Abate Rigord
Street, Ta’ Xbiex, and this as subrogated in the rights of its
insured Jonathan Mallia, on the basis of a comprehensive
type of policy and of law, and the same Jonathan Mallia
(ID 556286M), whilst referring to the car accident which
occured on the 24th June, 2013, at about 7.30 p.m. in Triq ilWied, Msida, between the vehicle registration number ABG
413, insured by you Citadel Insurance plc and driven by you
Mandy Cassar at the time of the accident, and the vehicle
property of Jonathan Mallia with registration number IBP
724, solists you in solidum between you so that within three
(3) days you pay the interpellant Jonathan Mallia, the sum
of €55 representing the excess payment paid by her to the
company Argus Insurance Agencies Limited as a result of this
accident, and you pay also the interpellant company Argus
Insurance Agencies Limited the sum of €524.52 for all the
payments paid to its insured as a result of the said accident,
which accident occured solely because of your carelessness,
negligence and lack of observance of the traffic regulations
on your part Mandy Cassar.
