Business Manager’s Repor t
Dear Brothers and Sisters:
Finally!! Oregon Clean Energy has broken
ground on the new plant in Oregon. The
natural gas-fired plant will replace a coalfired plant that has been closed for two
years. The $800 million project is expected
to create about 450 construction jobs over
three years and 25 full-time permanent
positions at the facility. Black & Veatch, the
General Contractor for the project, should
be hiring electricians very soon.
Other projects coming up this year include:
amendment that allows retirees to return to
covered and contributory employment for a
period of 600 hours during 2015 without a
loss of pension benefits. Please note: there
are consequences with social security and
the IBEW Pension Benefit Fund if you return to work.
At this time, we are not recommending our
retirees sign the book since unemployment
is so high and we currently have over 400
on Book I. We anticipate work to pick up in

Ask the Attorney

MARK YOUR CALENDAR
I work in a nail and beauty salon. I earn $4.05 per hour plus tips
from customers. Sometimes customers are generous and other
times they are not. Last week I worked 35 hours and only made
$210.00. Is that legal? - Jane D.
Eight Federal Credit Union’s 44th Annual Meeting
May 4, 2015 at 5:30pm
727 Lime City Rd., Rossford, OH 43460
Dear Jane,
EFCU is looking for Volunteers!
Probably not. If you and your co-workers each make at least $30 per
month in tips, your boss is allowed to take an offset from the legally required minimum wage – this is called a “tip credit”. The credit allows your
boss to pay you an hourly rate that is much lower than the minimum
wage. But if the amount of wages plus the tips does not equal minimum
hourly wage, then the employer must make up the difference. In Ohio,
employers must pay tipped employees at least $4.05 per hour on top of
the employees’ tips.
Nominations are being sought for four open positions
on the volunteer Board of Directors. Candidates meeting
EFCU’s qualifications will appear on the ballot. Interested
members should contact a credit union staff member or
Jeff Zimmerman of the nominating committee by
February 15, 2015.
Are you paying a high interest rate on your vehicle loan? You could qualify for a rate as low as
2.49% APR* at Eight Federal CU. Call today to
reduce your payment and save hundreds in interest. Finance your 2013 or newer model vehicle and get 100%
financing.
Direct Deposit Your Tax Refund
So, when you earned $210.00 for 35 hours of work, your average hourly
rate was only $6.00 per hour. This is below Ohio’s minimum hourly rate
of $8.10, and your employer should have made up the $2.10 per hour
difference. Call me to talk about your options.
I am a waiter working at a local restaurant chain. My employer requires all of us to pool our tip money which is then divided among
all of the employees, including the hostess, dishwashers and
cooks. Can they do that? - John D.
Dear John,
You can receive your income tax refund safely and quickly
into your EFCU account. The process is easy and convenient for you. All you have to do is:
It doesn’t sound like you are getting paid properly. A valid tip pool must
be shared only by employees who regularly receive tips, such as waiters, waitresses, bussers and bartenders. If your boss distributes the
mandatory tip pool among non-tipped employees, such as dishwashers
and cooks, then it loses the ability to take a tip credit for tipped employees, it can only take a tip credit for the amount the employee actually
receives and the employee must still earn an hourly rate at or above
minimum wage. You should call me to discuss what we can do to help.
1. Provide your account number on your tax return;
2. Provide our routing number 241281976;
3. Check the proper box on your tax return for either
your savings or checking account.
Here is something else to remember: you can also receive
your net pay, retirement checks and other types of government payments via direct deposit. You won’t have to worry
about your check being stolen or lost in the mail because
funds are sent electronically. Call 419-666-7334 if you have
any questions about direct deposit.
The rules and regulations regarding the pay for employees can be complex and
confusing. Each situation is different and requires a fact intensive review to determine whether an employee’s rights are being violated. The information contained above is for educational purposes, is not a complete overview of all of the
requirements the law mandates employers follow to ensure proper payments to
employees, and is not intended as legal advice. If you, or someone you know,
believe your rights have been violated, please contact us at:
*Annual Percentage Rate. Rates are subject to change. Rate and
term are based on members credit worthiness, age of collateral
and amount financed.
