In addition, ten members of the Shiawassee Artists’ Guild (SAG) are displaying their multi-media offering 20 percent off one purchase from this exhibit during the reception. The show is sponsored by Donna Hebert. **While growing up in rural Michigan, Tomasek was instilled with an appreciation of the land that surrounded him. He explains, “I feel my mission as a landscape artist is to document the views our state provides, whether it is the everyday scenes, owossoindependent.com or the spectacular views of the Great Lakes. It is all important.” His paintings have been exhibited throughout the state and can be found in many permanent collections including the Shiawassee Arts Center. Tomasek’s work has been exhibited at the Saginaw Art Museum, Muskegon Museum of Art and Dennos Museum in Traverse City. Three of his paintings were selected for exhibition in 2010-11 at the Michigan Governor’s Residence in Lansing. Also, the book, “Art of the Sleeping Bear Dunes,” as well as the “Pastel Journal” and “My City” magazines have published his work. He has conducted pastel painting workshops at Interlochen Center for the Arts, Saginaw Art Museum, the Shiawassee Arts Center and for the Mid-Michigan Art Guild. In 2014, Tomasek was one of four Michigan artists selected to exhibit in the “Art from the Lakes” art and artist exchange program with Michigan’s Sister State, Shiga Prefecture, Japan. The artists traveled throughout Shiga, exhibited at two galleries and had the chance to visit with Japanese artists and tour their studios. She, along with her daughter, Bernadette Lois, climbed 70 flights of stairs. Lois completed the climb in 22 minutes and 8 seconds, finishing number 739 out of 938 people. She was number 431 overall of total women and number 1 overall in the 70-plus age category. She raised $810. As of Wednesday, March 18, the event had raised $346,000. There is a registration fee and $100 must be raised before contestants can compete. The Fight for Air Climb is one of the American Lung Association’s signature fundraising events. With events in more than 65 cities, participants young and old, climb to raise funds in support of the mission of the American Lung Association: “To save lives by improving lung health and preventing lung disease.” These unique events are hosted in prominent skyscrapers, stadiums or arenas and challenge participants as they walk, run or race up hundreds of steps. Sometimes called a “vertical road race,” teams and individual participants can use the event as a fitness target, as a race or as a great way to be active and meet new friends while raising money for much needed research and programs. Last year alone, Fight for Air Climbs raised more than $7 million to help provide lifesaving education, research and advocacy so we can beat lung disease and soon find a cure. This was Marta’s third time completing the climb. The first time, in 2011, she went halfway – 40 flights of stairs, the following two times, she went all 70 flights. When asked if she plans on competing again next year, she said, “I will continue as long as I feel good enough to. It is a good cause. We also participate in memory of my brother and my dad, who both passed away from lung cancer.” Marta practices at Memorial Healthcare, walking up and down the five floors twice a week. She also tries to keep active, walking and working outside in her yard. Marta and her daughter keep busy, participating in events like the Crim Race in Flint, other 5K events and once they even made a 30-mile bike ride from Petoskey to Charlevoix and back to Petoskey in three hours. Dr. Albert A. Elsesser Dies Longtime Perry-area veterinarian, Dr. Albert Elsesser, died Monday, March 23, 2015. Albert A. Elsesser, age 89 of Perry, was born Feb. 25, 1926 in Lansing, Mich. to Albert and Olive (Martin) Elsesser. Al graduated from East Lansing High School in 1944 and Michigan State College of Veterinary Medicine in 1947. Al married Joyce E. Johnson in 1947 and she predeceased him in 2002. He married Audrey M. Cole in July of 2012 and she survives. He is survived by his four children, Terri (Lou) Lambert, Richard (Rebecca) Elsesser, Chuck (Cathy) Elsesser and Mary (Dan) Willett; his seven grandchildren, and four great grandchildren. Also surviving are Audrey’s four daughters, Terry (Dave) Schanski, Jackie (Richard) Hohenstein, Chris (John) Dukes, Cathy (Don) Grill; 14 step grandchildren, and 31 step great-grandchildren. He leaves two very special friends, Ray Reynolds and Rich Hudson, with whom he enjoyed many years of friendship. Al’s many friends will be remembered dearly by the family. Al spent his career helping animals, large and small, in the Perry area. He was an avid hunter and fisherman, even traveling to Great Bear and Great Slave Lakes in the Arctic Circle to fish for Arctic Char. He hunted deer until this last season. Al was a member of the Perry Congregational Church for over sixty years. He served in many capacities as Board member, Treasurer, and Deacon. He served on the Perry and Woodhull townships Board of Trustees for many years, was a member of the local Food Bank and served on the Shiawassee Salvation Army board for many years. His avocation was woodworking. He created many pieces of beautiful furniture, which the entire family has in their homes today. Funeral services will be at the Perry Congregational Church at 11 a.m. Saturday, March 28, with Pastor John Walworth officiating. Burial will follow at Rose Lawn Cemetery. The family will receive friends at Watkins Brothers Funeral Home in Perry 6 to 8 p.m. Thursday plus 2 to 4 and 6 to 8 p.m. Friday 2-4 and 6-8 p.m. In lieu of flowers, the family would prefer donations to be made to the Perry Congregational Church or to Sparrow Hospice. Cook Grant Allows Arc Shiawassee Staffing Support to Expand Programs, Increase Public Outreach The Arc Shiawassee County is continuing to work on expanding its programs and services for individuals with developmental disabilities in the county thanks to a $17,558 grant awarded from the Cook Family Foundation for staffing. Using the funds, the organization will be able to continue to employ its three full-time employees at that capacity over the next year, and work to expand the new Representative Payee program, which is a partnership with the Social Security Administration. This means that the organization is appointed or chosen by an individual who receives Social Security or SSI benefits, and will assist the individual by assessing the beneficiary’s needs to best decide how benefits are spent. An individual’s personal care and well-being are always of utmost importance, and support to function as independent adults in the community. “Our agency is also working to secure funding for a job skills program, and to increase community visibility,” it was noted. Executive Director Lynn Grubb and the board of directors have attended the Nonprofit Capacity Building events sponsored by the Cook Family Foundation for Nonprofits in Shiawassee County through the Nonprofit Network, which is an asset to the members of the organization. “The Nonprofit Capacity Building Program has helped us identify opportunities to strengthen our organization and identify ways that volunteers can help us grow our programs,” said Grubb. The Cook Family Foundation provides a great deal of support for The Arc Shiawassee throughout the year, said Foundation Executive Director Tom Cook when asked about the Arc: “We are impressed with the hard work the board and staff have put into building up The Arc. Major Industrial Expansion A 50,000-square-foot addition Site Plan at the Machine Tool and Gear plant, 405 S. Chestnut in Owosso, was conditionally approved Monday night by the city Planning Commission. The 200 by 250-foot addition will be on the east side of the present building. A review of drainage and lighting by an engineer was requested by planners. The company’s first plant in the area is on N. Shiawassee in Corunna’s in northside industrial park. “It’s great to see industrial facility construction!” said Shiawassee Economic Development Partnership President/CEO Justin Horvath on Monday. Machine Tool and Gear, which produces components for the auto and truck industry, is the largest manufacturing employer in the county with more than 400 employees between the two plants. NOW THEREFORE, THE CITY OF CORUNNA ORDAINS: Sec. 24-1. Grant, term. The CITY OF CORUNNA, SHIAWASSEE COUNTY, MICHIGAN, hereby grants to the Consumers Energy Company, a Michigan corporation, its successors and assigns, hereinafter called “Grantee,” the right, power and authority to lay, maintain and operate gas mains, pipes and services on, along, across and under the highways, streets, alleys, bridges, waterways, and other public places, and to do a local gas business in the CITY OF CORUNNA, SHIAWASSEE COUNTY, MICHIGAN, hereinafter called “City”, for a period of thirty (30) years. Sec. 24-2. Consideration. In consideration of the rights, power and authority hereby granted, said Grantee shall faithfully perform all things required by the terms hereof. Sec. 24-3. Conditions. No highway, street, alley, bridge, waterway or other public place used by said Grantee shall be obstructed longer than necessary during the work of construction or repair, and shall be restored to the same order and condition as when said work was commenced. All of Grantee’s pipes and mains shall be so placed in the highways and other public places as not to unnecessarily interfere with the use thereof for highway purposes. Sec. 24-4. Hold harmless. Said Grantee shall at all times keep and save the City free and harmless from all loss, costs and expense to which it may be subject by reason of the negligent construction and maintenance of the structures and equipment hereby authorized. In case any action is commenced against the City on account of the permission herein given, said Grantee shall, upon notice, defend the City and save it free and harmless from all loss, cost and damage arising out of such negligent construction and maintenance. Sec. 24-5. Extensions. Said Grantee shall construct and extend its gas distribution system within said City and shall furnish gas to applicants residing therein in accordance with applicable laws, rules and regulations. Sec. 24-6. Franchise not exclusive. The rights, power and authority herein granted are not exclusive. Either manufactured or natural gas may be furnished hereunder. Sec. 24-7. Rates. Said Grantee shall be entitled to charge the inhabitants of said City for gas furnished therein, the rates as approved by the Michigan Public Service Commission, to which commission or its successors authority and jurisdiction to fix and regulate gas rates and rules regulating such service in said City, are hereby granted for the term of this franchise. Such rates and rules shall be subject to review and change at any time upon petition therefor being made by either said City, acting by its City Council, or by said Grantee. Sec. 24-8. Revocation. The franchise granted by this article is subject to revocation upon sixty (60) days written notice by the party desiring such revocation. Sec. 24-9. Michigan Public Service Commission jurisdiction. Said Grantee shall, as to all other conditions and elements of service not herein fixed, be and remain subject to the reasonable rules and regulations of the Michigan Public Service Commission or its successors, applicable to gas service in said City. Sec. 24-10. Repealer. This ordinance, when accepted and published as herein provided, shall repeal and supersede the provisions of a gas ordinance adopted by the City Council on May 20, 1985 entitled: AN ORDINANCE, granting to CONSUMERS POWER COMPANY, its successors and assigns, the right, power and authority to lay, maintain and operate gas mains, pipes and services on, along, across and under the highways, streets, alleys, bridges and other public places, and to do a local gas business in the CITY OF CORUNNA, SHIAWASSEE COUNTY, MICHIGAN and amendments, if any, to such ordinance whereby a gas franchise was granted to Consumers Energy Company. Sec. 24-11. Assignment. Grantee shall not assign this franchise to any other person, firm or corporation without the prior written approval of the City. The City shall not unreasonably withhold its consent to an assignment if the assignee is financially able to carry out Grantee’s obligation under this franchise. This assignment of this franchise to a subsidiary, division or affiliated corporation of Grantee or its parent corporation shall not be considered an assignment requiring the consent of City. Sec. 24-12. Compliance with City Charter and Ordinances. During the term of this franchise, Grantee shall comply with all applicable City Charter provisions and ordinances, provided, however, that nothing herein shall be construed as a waiver by Grantee of any of its existing or future rights under state or federal law. Sec. 24-13. Effective date. This ordinance shall take effect upon the day after the date of publication thereof; provided, however, it shall cease and be of no effect after thirty (30) days from its adoption unless within said period the Grantee shall accept the same in writing filed with the City Clerk. This Ordinance shall be known and cited as the “City of Corunna Payment in Lieu of Taxes (PILOT) Ordinance”. Section 2. Preamble It is acknowledged that it is a proper public purpose of the State of Michigan and its political subdivisions to provide housing for its citizens of low income and to encourage the development of such housing by providing for a service charge in lieu of property taxes in accordance with the State Housing Development Authority Act of 1966 (1966 PA 346, as amended, MCL 125.1401, et seq, MSA 116.114(1), et seq). The City is authorized by this Act to establish or change the service charge to be paid in lieu of taxes by any or all classes of housing exempt from taxation under this Act at any amount it chooses, not to exceed the taxes that would be paid but for this Act. It is further acknowledged that such housing for persons of low and moderate income is a public necessity, and as the City will be benefited and improved by such housing is a valid public purpose, the continuance of the provisions of this Ordinance for tax exemption and the service charge in lieu of taxes during the period contemplated in this Ordinance are essential to determination of economic feasibility of housing developments which are constructed and financed in reliance of such tax exemption. The City acknowledges that Cavalier Greene Limited Dividend Housing Association Limited Partnership (a sponsor) has offered, subject to receipt of a mortgage loan from the Michigan State Housing Development Authority, to erect, own and operate a housing development identified as Cavalier Greene on certain property located at 106 S. Shiawassee Street in the City to serve persons of low income, and that Cavalier Greene Limited Dividend Housing Association Limited Partnership has offered to pay the City on account of this housing development an annual service charge for public services in lieu of all taxes. Section 3. Definitions [The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:] Act means the State Housing Development Authority Act, being public Act 346, of the State of Michigan, as amended. Annual Shelter Rent means the total collection during an agreed annual period from all occupants of a housing development representing rent or occupancy charges, exclusive of charges for electricity, water and sewer utilities furnished to the occupants. Authority means the Michigan State Housing Development Authority. Contract rents are as defined by the U.S. Department of Housing and Urban Development in regulations promulgated pursuant to Section 8 of the U.S. Housing Act of 1937, as amended. Housing Development means a development which contains a significant element of housing for persons of low income and such elements of other housing, commercial, recreational, industrial, communal, and educational facilities as the Authority determines improve the quality of the development as it relates to housing for persons with low income. HUD means the Department of Housing and Urban Development of the United States Government. Mortgage Loan means a loan to be made by the authority or Farmers Home Administration or the Department of Housing and Urban Development to a sponsor for the construction and permanent financing of a housing development or a mortgage loan insured by HUD or a federally aided mortgage as otherwise defined by the Act. Persons of low Income means persons and families eligible to move into the Housing Development. Sponsor means a person(s) or entity, which has applied, to the authority for an allocation under the LIHTC Program to finance a housing development. Utilities mean gas, and/or electrical service, which are paid by the Housing Development for the apartment units. Section 4. Class of Housing Developments It is determined that the class of Housing Development to which the tax exemption shall apply and for which a service charge shall be paid in lieu of such tax shall be family rental housing, which are assisted pursuant to the Act. It is further determined that Cavalier Greene is of this class. Section 5. Establishment of Annual Service Charge The Housing Development identified as Cavalier Greene and the property on which it shall be constructed shall be exempt from all property taxes from and after the commencement of construction for a period of sixteen (16) years. The City acknowledging that the Sponsor and the Authority have established the economic feasibility of the Housing Development in reliance upon the enactment and continuing effect of this Ordinance and the qualification of the Housing Development for exemption from all property taxes and a payment in lieu of taxes as established in the Ordinance, and in consideration of the Sponsor’s offer, subject to receipt of a Mortgage Loan from the Authority, to construct, own, and operate the Housing Development, agrees to accept payment of an annual service charge for public services in lieu of all property taxes. The annual service charge shall be equal to 4% of the difference between the contract rents actually collected and utilities. Section 6. Limitation on the Payment on the Annual Service Charge Notwithstanding Section 5, the service charge to be paid each year in lieu of taxes for the part of the Housing Development which is tax exempt and which is occupied by other than low income persons or shall be equal to the full amount of the taxes which would be paid on that portion of the Housing Development if the Housing Development were not tax exempt. Section 7. Contractual Effect of Ordinance. Notwithstanding the provisions of section 15(a)(5) of the Act to the contrary, a contract between the City and the Sponsor with the authority as third party beneficiary under the contract, to provide tax exemption and accept payments in lieu of taxes, as previously described, is effectuated by enactment of this Ordinance. Section 8. Payment of the Service Charge The annual service charge in lieu of taxes as determined under the Ordinance shall be payable in the same manner as general property taxes are payable to the City except that the annual payment shall be paid on or before June 30th of each year. Section 9. Duration This Ordinance shall remain in effect for and shall not terminate so long as the Mortgage Loan remains outstanding and unpaid or the Authority has any interest in the property but shall not exceed 16 years. Section 10. Severability The various sections and provisions of this ordinance shall be deemed to be severable, and should any section or provision of this ordinance be declared by and court of competent jurisdiction to be unconstitutional or invalid the same shall not affect the validity of the Ordinance as a whole or any section of provision of this ordinance other than the section or provision so declared to be unconstitutional or invalid. Section 11. Copies Available This Ordinance may be purchased or inspected in the City Clerk’s Offices, Monday through Thursday, between the hours of 8:00 a.m. and 5:00 p.m. Section 12. The RM-2 multiple-family residential districts (high rise) are designed to provide sites for high density multiple dwelling structures adjacent to high traffic generators commonly found in the proximity of central business districts and areas abutting major thoroughfares. The district is further designed to provide for the convenience needs of persons living in the apartments with central services. This district is further designed so as to provide a zone of transition between these major thoroughfares and high traffic generators and other residential districts through the requirements of lower coverage which, in turn, will result in more open space. Sec.86-152A - Principal uses permitted. In an RM-2 district, no building or land shall be used and no building shall be erected except for one (1) or more of the following specified uses unless otherwise provided in this chapter: (a) All principal uses permitted in an RM district meeting the requirements as set forth in the district with the exception of single-family dwellings and Mobile Home Parks, which shall be expressly prohibited from this district (b) Multiple-family dwellings in structures in excess of two (2) stories; (c) Retail and service uses accessory to the principal use in accordance with the Required Conditions listed in the next section (b)(c). (d) Accessory buildings and uses customarily incident to any of the above permitted uses; Sec 86-153A - Required conditions. (a) A site plan shall be submitted for all uses permitted under this article in accordance with section 86-391. (b) Any business uses on the site shall be developed as retail or service uses within the walls of the main structure. Such business uses shall not exceed seventy-five (75) percent of the floor area at grade level and shall be prohibited on all floors above the first floor, or grade level. (c) The entire area of the site shall be treated to service the residents of the apartment and any accessory buildings, uses, or services shall be developed solely for the use of residents of the main building. Uses considered herein as accessory uses include: swimming pools, recreation areas, pavilions, cabanas and other similar uses. (d) An open space area shall be provided with a minimum area of two hundred (200) square feet per dwelling unit creating open space suitable for recreation, landscaping or a similar use, and such area shall not be located in a front yard. Such requirement may be reduced, increased, or altered by the planning commission if it feels that the full intent of this section is provided for. (e) The minimum floor area per unit shall be in accordance with the following schedule. 1) Efficiency 350 square feet 2) One bedroom 450 square feet 3) Two bedroom 600 square feet 4) Three bedroom 800 square feet 5) Four bedroom 1,000 square feet Sec. 86-154A - Area and bulk requirements. See article XI, schedule of regulations, limiting the height and bulk of buildings, the minimum size of lot by permitted land use, and providing minimum yard setback requirements for RM-2 districts. The concert started before sunset with a performance by the popular local duet “Levi & Shannon” singing all original songs. Mandy Senor and Nicholas Pidek (formerly of sosaveme) then entertained the sold-out seated audience, playing covers of several ’90s songs, including a surprise rendition of “I Want it That Way” by the Backstreet Boys (including the key change). In keeping with tradition surrounding Pidek’s musical history of the past eight years in the local band sosaveme, he played an acoustic version of his old band’s song “Gentle Slope” and ended the set with a Bob Dylan cover made famous by Johnny Cash and June Carter, “It Ain’t Me Babe” with everyone singing along. The audience reaction to the new concert series was enthusiastically positive. Keen interest has already grown for the next concert which hasn’t been announced yet. The “Concert in the Castle” show, with a seating capacity of 50 people was sold out in six days for the very inviting, cozy, warm and intimate concert setting by Curwood’s famous fireplace. Attendees came from surrounding areas of Flint, Lansing and Midland. A professional video crew captured the event live including discreet audio, to be made into promotional materials for the “Concert In The Castle” series, off-street parking, and other provisions for RM-2 districts. All signage for the RM-2 district must adhere to the provisions and requirements listed under the RM district under Chapter 58 (Uniform Sign Code) of the Corunna Code Book. Parking requirements must adhere to the requirements listed under Sec. 86-337 with the Planning Commission having the right to utilize a combination of the requirements for Multi-family dwellings and Housing for the elderly in the case of a multiple-family unit having both young and senior citizen tenants and a mix of single and multibedroom units.
