Note :1) The Sweaters are to be provided as per the specification given in ‘Annexure-I’ with
the tender form and as per the sizes mentioned above.
2) Rates to be quoted separately for the sizes mentioned above. The quantity to be
supplied is given approximately and can change without prior notice at any stage.
3) I/We have read all the conditions and agree to abide by the same and these
conditions be binding on me/us.
4) The demonstrative samples of Sweaters are available for seeing at the office of the
Commissioner, Tribal Development, Maharashtra State, Nashik so as to have fair
idea of colour and stitching pattern of the Sweaters.

5) Bidders will be evaluated on the basis of the total cost of all units together and not
on the basis of individual units.
6) This statement is to be submitted in Commercial Bid (envelop No.2)

E-Tenders are invited (on the web site http://maharashtra.etenders.in)from the
manufacturers (or their authorized dealers) for the purchase of Woollen Sweaters for
the students of Government Ashram Schools and Junior Colleges under the control of
Commissioner, Tribal Development, Maharashtra State, Nashik. Tenders would be
accepted only Online in Two Bid System.

If it is not possible, due to any reason, to open the tenders on the date and time
given above then the tenders will opened on the date and time that the Purchase
Committee will decide. New conditions, other than the ones that are enumerated in
this form, can be incorporated at the discretion of the Purchase Committee and these
will be incorporated in the contract.

Tenders should be submitted online only.

Conditional and incomplete tenders will not be considered.

Attested documents to be uploaded with the tender are
ENVELOP NO. 1 (TECHNICAL BID)
(3-A) Essential documents in the technical bid
a) Duly signed prescribed tender form
b) Demand draft of earnest money deposit Rs. 20,85,000/Or
Latest Exemption certificate, regarding EMD given by the competent authority.

c) Latest CST/VAT clearance certificate (at least upto December 2011) or
application submitted to competent authorities for getting VAT clearance
certificate or exemption certificate given by the competent authority.
d) VAT registration number certificate.
e) Latest Registration certificate under Bombay Shops Act, 1948.
f) If the tenderer is a registered Small Scale Industry for the item for which the
tender is called then the latest certificate given by the Director of Industries in
this regard must be attached with the tender.
g) If the tenderer is a distributor then he should attach the original authorization
letter issued to him by the producer in the proforma given in ‘Annexure-II’.
h) Turnover certificate and balance sheets of last 3 years duly signed by a Chartered
Accountant. The average turnover of the tenderer must be over Rs. 6,00,00,000/(Rs. Six crore).
i) The ISI certificate (as per latest specifications) given by the Bureau of Indian
Standards. If sufficient bidders with ISI Certificate doesn’t bid in this tender then
the bidding tenderers without ISI Certificate will have to give undertaking that
they will supply the material as per ISI specifications.
j) Profession Tax clearance certificate issued by the competent authority or
exemption certificate issued by the competent authority.
(3-B) Complimentary documents in the technical bid
a) Experience certificates and detailed information regarding the tender
processes of similar nature in which the tenderer has participated
previously.
b) Information regarding the machinery available with the manufacturer
useful for this tender.
NOTE :- All the above documents must be attested and duly signed with seal.
ENVELOP NO. 2 (COMMERCIAL BID)
a) The rates should be filled in the proforma given with the tender form.
Rates filed any where else will not be considered. All the rates should be
filled with all the taxes and rates inclusive and with supply at the
destinations (Government Ashram Schools) given in the tender form.

The tenderer should submit 6 samples of the Woollen Sweaters (3 of boys and 3
of girls) before the opening date and time. The samples should be submitted duly
sealed and labeled.
5.
All the witness and sureties shall be persons of status and their full name,
occupation and address shall be stated below their signature.
All the signatures
should be dated.

If any of the information furnished by the bidder is found to be incorrect, the bid
/ contract is liable to be rejected / terminated and the EMD / Security Deposit will be
forfeited and further necessary action will be taken as per the Rules.

7.
Canvassing in any form or any approach, official or otherwise by the bidder to
influence the consideration of his bid shall render the bill liable to be summarily
rejected.
8.
At the time of opening of tenders, Envelop No. 1 will be opened first. The
samples of the tenderers who qualify in the technical bid will be sent to the recognized
laboratories for inspection. All the expenses regarding inspection will be borne by the
tenderer.
9.
Incomplete technical bids or the tenderers whose samples fail in the laboratory
tests will not be considered for the opening of the commercial bid.
10. A demand draft of an amount of 3% of estimated cost of the tender drawn on
any Nationalised Bank and payable to “Assistant Project Officer, Commissionerate of
Tribal Development, Maharashtra State, Nashik” must be send to the department
before the opening date and time of the technical Bid. as EMD. This EMD will not fetch
any interest. The EMD of the tenderers, whose tenders have been rejected, will be
refunded on the request in that regard. But the successful tenderer will have to deposit
the Security Deposit and will have to enter into an agreement within the stipulated
time period failing which the EMD will be forfeited.
11. The successful tenderer will have to make an agreement on a stamp paper of Rs.
100/-. All the expenses in this regard will be borne by the tenderer.
12. An amount equal to 5% of the actual cost of the tender as a Security Deposit will
be required to be deposited with the Commissioner, Tribal Development, Maharashtra
State, Nashik within a period of 7 days. The EMD, if already paid, can be adjusted
against the Security Deposit. The security deposit will not fetch any interest. The
security deposit will be refunded after all the supply is over and after complying with all
deficiencies and lacunas as per tender conditions.
13. The rates in the commercial bid should be inclusive of all the rates and taxes and
with supply to the site of Ashram schools and Hostels under the control of the
Commissioner, Tribal Development, Maharashtra State, Nashik. The estimated number
of Sweaters to be supplied is given in the separate chart attached herewith. The actual
demand may increase or decrease and all the rights in this regard are reserved with the
Commissioner, Tribal Development, Maharashtra State, Nashik.

14. The successful tenderer will have to submit 30 certified samples as per the
samples submitted with the tender form. Separate charges for the samples will not be
payable. Samples will have to be submitted within 15 days from the date of confirmed
purchase order and supply should be completed within 45 days from the date of
submission of samples. If the supply is not started within the stipulated time period
then the contract will be terminated, security deposit will be forfeited and appropriate
legal action will be taken to compensate the loss caused to the department. Also the
name of the tenderer will be black listed and he will not be eligible to participate in
future tenders of Tribal Development Department.

15. The successful tenderer/s will have to supply the Sweaters to Ashram schools
and Junior colleges. The cost of transport and other incidental charges will be borne by
the tenderer. The tenderer will have to observe that all the Sweaters supplied to the
Ashram schools and junior college fits the students properly. Odd sizes will have to be
replaced with proper sizes, immediately.
16. The quantity of Sweaters to be supplied is tentative and actual quantity may
vary. All rights to increase or decrease the quantity of Sweaters to be supplied are
reserved with the Commissioner, Tribal Development, Maharashtra State, Nashik.
17. If required quantity of Sweaters is not supplied or if the supply is not completed
within the stipulated period, the Sweaters will be purchased from other sources and the
excess price difference, if any, will be recovered from the tenderer.
18. Material not complying with the specification should be replaced within 10 days.
Also the responsibility of such stocks will be with the tenderer.
19. Supplied Sweaters will be tested for specifications. The random samples will be
taken as per receipt of the lots. And they will check against the certified samples
already supplied to the Project Offices. Nonconforming Sweaters will be rejected and
the same will have to be changed within 10 days without any additional charges.
20. The rates accepted in the tender will be valid for 6 months. And they will be
binding on the tenderer.
21. After supply as per the certified samples the bills in triplicate will have to be
submitted to the Commissioner, Tribal Development, Maharashtra State, Nashik. The
prescribed receipts duly signed by the concerned Head Master of a Government
Ashram School or junior college along with the report of the Project Officers must be
attached with the bills. Without these receipts payment will not be released.
22. The payment will be made as per availability of funds. The tenderer can not claim
interest on the delayed payments of the bills, due to any reason. Also no legal action
can be taken in this regard.
23. Penalty will be levied on the delayed supply of the material at the rate of ½ % per
week. The maximum limit of the penalty will be as follows:
a) If the cost of material not supplied within the stipulated period is less than Rs. 1
lakh then 10% of such value.
b) If the cost of material not supplied within the stipulated period is Rs. 1 lakh or
more than Rs. 1 lakh then 5% of such value.
c) If there is a likely delay due to any unavoidable circumstances the time limit to
supply the material can be extended at the discretion of the Commissioner,
Tribal Development, Maharashtra State, Nashik and his decision in this regard
will be final. For this purpose the tenderer will have to apply with justification
before the expiry of the given time period.
24.
No price rise on any ground can be claimed during the period of supply.
25. 80% payment will be released on the basis of the receipts from the Government
Ashram Schools and bills produced by the tenderer in the prescribed format as
enumerated in clause 19. Remaining 20% amount will be paid after getting the random
samples tested from laboratory.

26. The amount of security deposit will be 5% of the value of the supply order. And
security deposit will be refunded only after all the supply is over and all the payments,
payable have been made to the tenderer.
27. The Commissioner, Tribal Development, Maharashtra State, Nashik has all the
rights to accept or reject one or all the tender either partially or fully without assigning
any reasons therefor.
28. In case of dispute the decision of the Commissioner, Tribal Development,
Maharashtra State, Nashik will be final and binding on the tenderer.
29. Tenders must be submitted in the prescribed format and by prescribed channel
only.
30. Laboratory testing fess of Rs. 7,000/- (Rs. Seven Thousand) ) or the actual
laboratory testing charges, whichever is higher must be paid in cash in the office of the
Commissioner, Tribal Development, Maharashtra State, Nashik.
31.
Legal jurisdiction will be Nashik.
32. Department will not be responsible for any delay due to internet, electricity,
computer etc. failure problem.
33.
Tender send by e-mail, fax, or hand delivery will not be accepted.
