Conference
Now in its 26th year, the Legislative Leadership Conference (LLC) is an important and influential event for
emergency physicians and residents of all stripes to attend. Located in Sacramento, just steps from the
State Capitol, 100 emergency physicians, both seasoned veterans and those just embarking in a career in
emergency medicine, will join California ACEP for a day full of advocacy training, interesting policy discussions
and lobbying California’s policy makers on behalf of emergency physicians and patients.

T
he lobbying that California ACEP members do each year at
LLC on behalf of emergency medicine is truly impactful. Last
year, California ACEP welcomed Governor Brown, who spoke at
length about the role of special interests in politics. The Governor also
discussed the current state of healthcare in California, including the
implementation of the Affordable Care Act and Medi-Cal rates.
This unique and fun conference is FREE. Additionally, California ACEP
sponsors one resident from each residency in California to attend both
the LLC on Tuesday, April 21st and the California ACEP Board Meeting
on Wednesday, April 22nd. This residency sponsorship is first-come,
first-served. Please contact Kelsey McQuaid at the Chapter office
after registering for LLC to qualify for the sponsorship and to arrange
overnight lodging in Sacramento.
While this year’s program is still being finalized, I'm happy to announce
that Insurance Commissioner Dave Jones has agreed to speak, and he
will no doubt be joined by other influential presenters continuing in
the rich tradition of LLC speakers past.
Past program speakers include the California State Lieutenant
Governor, Speaker of the Assembly, Senate President pro Tempore,
ranking members of the Senate and Assembly Health Committees and
state agency heads appointed by the Governor.
The program will start at 9:30 am and continue through the morning
with an array of speakers and advocacy trainings. Attendees will break
for a one hour lunch, provided by California ACEP, to meet with peers
prior to participating in lobbying meetings at the Capitol. California
ACEP will arrange legislative meetings on your behalf and will provide
you with a morning of education on important legislation and training
to develop the lobbying skills necessary to partake in the afternoon
meetings.
Following an afternoon of lobbying at the Capitol, attendees are
invited to participate in a free California ACEP hosted reception* in the
Capitol Room at Café Bernardo, conveniently located near the Capitol.

CMS recently released its final rule for the 2015 Medicare
Physician fee schedule and how its two provider-based
quality reporting programs, Physician Quality Reporting
System(PQRS) and the Value-based Modifier (VM) will be
used to calculate a group's payment under Medicare for
the 2017 calendar year - data reported on in 2015 will be
used to calculate your payments in the calendar year 2017.
Quality reporting has become increasingly more onerous,
and the details of each program more complicated. These
are mandated programs built into the Affordable Care Act
(ACA). As such, this article will focus on PQRS and a future
issue will cover the VM in greater detail.

ew in 2015 is that there will no
longer be a 1% incentive to
participate in PQRS, but instead,
only stiff penalties. For groups
of less than 100 and more than 10 eligible
providers (EPs), failure to participate in PQRS
will result in a 2% reduction in Medicare
payments for the 2017 calendar year under
traditional PQRS. Unfortunately, failure to
comply with PQRS would also result in a
penalty from VBM, resulting in an additional
4% penalty. Not only are the penalties
growing, but the burden of reporting has
increased significantly.
In 2015, the requirement for reporting has
increased from a minimum of three quality
measures to nine quality measures across
three distinct domains, including one “cross
cutting” measure. Cross cutting measures are
those that CMS has defined as filling critical
gaps across specialties. For our specialty,
screening for high blood pressure and
documenting follow up (PQRS #317) will count
toward our cross cutting measure. QM 317 is
the only available measure for Emergency
Medicine at this time and it is mandatory that
we report to avoid the penalty.
QM 317 is looking to report the percentage
of patients who were screened for high blood
pressure AND have a recommended followup plan documented, if the blood pressure is
pre-hypertensive or hypertensive. This is to be
reported for all Medicare patients that are 18
years or older.
To make matters worse, four of the 50 quality
measures retired were from the Emergency
Medicine cluster, EKG for syncope, aspirin
for AMI, empiric antibiotics for CAP, and vital
signs for CAP. We are left with exactly nine
measures we may be able to report on, but
many of them are unlikely to apply to elderly
Medicare patients, which will inevitably leave
most groups short of satisfying the PQRS
requirements. For groups failing to report
the full nine measures in three domains, CMS
will implement the measures applicability
validation (MAV) process, which is an audit
of a group’s claims to determine whether
the group was able to report on additional
measures. If they are determined to have
reported on the appropriate measures
according to the MAV cluster algorithm,
they will be given a pass and meet the
requirements for PQRS. We anticipate that
most groups will be subject to a MAV in 2015.
2. If the patient is discharged home and
the final documented reading in the ED
is ≥120 mm Hg Systolic or ≥80 mm Hg
Diastolic, document a follow-up plan in
the provider note specifically related to the
BP reading, i.e. “Patient referred to PCP for
BP management”.
Many of the requirements under PQRS can be
achieved or avoided through an alternative
reporting method, as legislated by the ACA.
Implementation of a qualified clinical data
registry (QCDR) that allows reporting of data
on ALL patients, not just Medicare patients,
is an acceptable option to PQRS reporting,
according to CMS. As such, ACEP is launching
the Clinical Emergency Data Registry (CEDR)
for emergency medicine in 2015.
3. If the patient has an active diagnosis of
hypertension that is being treated, make
sure to include that in the Clinical Impression
because this represents a qualified exclusion.
Quality reporting demands will continue
to expand and to have greater penalties.
ACEP is working with CMS to develop more
meaningful quality measures and methods
of reporting that are less burdensome. ACEP
continues to study the impact of quality
measures on the specialty and to consider
alternative reimbursement strategies in an
ever-evolving healthcare market.
How do we incorporate the blood pressure
measure into our everyday practice? Ask your
billing company to help you with verbiage
in your medical record that will demonstrate
that you are complying with the spirit and the
letter of the measure.
Emergency Groups Office recommends the
following strategy for a patient with blood
pressure greater than 120/80:
CMS still has an ECG measure that we must
comply with, which is that all patients over 40
with non-traumatic chest pain should have
an ECG.

How to avoid reporting of non-performance
of the Quality Measure:
1. Make sure to document that an EKG was
ordered (preferably with interpretation) for
all non-traumatic chest pain patients 40
years or older.
2. If not performed for medical or patient
reasons, document it.
Be sure to discuss documentation
expectations that are unique to your group’s
EMR and practice setting with all of your
providers. California ACEP will continue to keep
you updated as new information becomes
available about the Clinical Emergency Data
Registry. n

How California ACEP
Tracks Legislation

It’s that time of year again! California ACEP
staff, committee members, and board
of directors have reviewed legislation
and taken positions on legislation.
The legislation review process is time
consuming, but crucial for ensuring
emergency physicians are heard and their
practice defended in the State Capitol.
Each year, California ACEP reviews the approximately 2,000 bills
introduced to find those of concern to emergency physicians. As in
past years, over 2,000 bills were introduced between the Assembly
and Senate. The Senate introduced 793 bills, the fewest bills
introduced in the first year of session since 1989. By contrast, the
Assembly introduced 1,504 bills, the most in the first year of session
since 2009.
California ACEP’s bill review process starts with the
Government Affairs staff. Staff reviews introduced
bills throughout January and February and flags all
bills of interest. After reviewing bills individually,
staff cross references their recommendations

to create a final staff recommendation to the Government Affairs
Committee (GAC), in addition to the Reimbursement and Practice
Management Committees which act as GAC subcommittees for the
purpose of legislation review.
Three subcommittees review a portion of the staff recommendations,
approximately 45 bills each, in early March. The subcommittees
review their assigned bills, discuss the staff recommendations,
provide additional input on bills, and offer changes to the
staff recommendations. All three subcommittees send their
recommendations to GAC.
One week after the subcommittees meet, GAC members have the
responsibility of reviewing all subcommittee recommendations for the
132 bills and choose to accept the subcommittee recommendations
or offer a different recommendation. Once GAC has vetted all of the
bills and given their recommendations, the Chapter Board of Directors
has the important role of voting on the final position on all of the
tracked bills.
This legislative session should be an interesting one. The majority of
lawmakers in the 2015-16 session, 72 out of 120, will have 2 or fewer
years of experience at the state-level. As the year progresses we will
find out more about which legislators are allies to emergency medicine
and which are not.
2015 should be a very exciting year in the legislature and California
ACEP staff, committees, and the Board of Directors will be closely

The process described above is just the beginning of the legislative
review process for California ACEP. Throughout the year staff
watches for amendments to bills the Chapter has taken a position
on and tracks hundreds of “spot bills”, bills that are introduced as
placeholders to be amended substantially later in the year. Spot
bills can result in substantive legislation later in the year and staff
watches closely for anything that will affect emergency medicine.
The Board reevaluates our position on legislation throughout the
year as amendments are adopted.
It’s still early in the legislative session, but there are already some
legislative battles developing that may be of interest to Chapter
members. Some issue areas of interest are mandatory vaccines for
school children, prohibitions on electronic cigarettes, and mental
health reform.
