INTRODUCTION/BACKGROUND

At each Planning Committee meeting, Members are informed of current Planning and
Enforcement Appeals and of Communities and Local Government (CLG) Appeal
Decisions that have recently been issued.

The original certificate was refused on the basis that
Officers considered that the use was not lawful as it fell
outside the terms of the original planning permission for
the site. Further, it was felt that the use would represent a
material change in use from holiday use to a permanent
residential use.
The Inspector did not consider that the appearance of the
site would change “dramatically” when seen from the
public highway. Whilst the introduction of caravans onto
the amenity land would be an encroachment he did not
consider that they would be particularly visible from the
public realm, especially during the summer months. As
such he concluded that the proposed siting of an
additional six caravans for residential occupation would
not amount to the making of a material change in the use
of the land that would require planning permission.
