IPR Filing “Bubble” that Wasn’t, Why? The 300-Plus IPR’s Per Year
A large filing “bubble” had been anticipated for the new Inter Partes Review
that became effective September 16, 2012. Thus, the procedure is tilted
toward a patent challenger and the new law is retroactive for patents still in
force no matter when filed or granted.
Just 300+ IPR’s per Year at the Current Rate: The first week “bubble”
never happened: Only eleven (11) IPR filings took place the first week.
The second week there were only six (6) filings, and through October 22,
2012, the six (6) filings per week on average has held for this month.
At the current rate, discounting the first week “bubble”, the total filings for
the first year should be 332 IPR’s per year.
The Guild System, One Reason for Very Low Filings: Fantastically, the
only people “qualified” to practice at the PTAB are patent agents and patent
attorneys; the bulk of the profession does not comprise patent litigators,
who are the ones able to understand the practice under the Federal Rules
of Evidence necessary as a de facto matter to handle an IPR. So, the
patent prosecution bar has been reluctant to step into the deep waters of
patent litigation rules.
On the other hand, patent litigators who do not happen to have a patent
agent or attorney registration number are barred from practice at the PTAB
absent special case specific pro hac vice representation. No wonder they
are not pushing their clients to an IPR proceeding.
The guild system lives, but where are the litigants!
