I, _________________________ desire to participate in a tour of facilities ("Tour") under the control of the Peninsula Corridor Joint Powers Board ("JPB"). I understand the importance of safety and will cooperate with all safety rules and instructions provided by the JPB. While participating in the Tour, I will wear closed‐toe shoes or boots that are over the ankle and that have a defined heel. The JPB representative leading the Tour may prohibit me from participating if I am not wearing the proper footwear. The taking of photographs is not allowed in JPB facilities. Cell phones and cameras will be collected at the beginning of the Tour and returned when the Tour is complete. I agree not to use any photographic images, film/video/sound recordings of any kind taken while on JPB property for any purpose without prior written permission of the JPB. No photographs that include any element of the Tour may be posted on the internet or on any social media sites. I realize that my participation in the Tour may require sustained physical activity. I am in good health, and am not aware of any physical or medical condition that might endanger myself or other participants in the Tour, or limit my ability to participate in the Tour. Acting for myself and my heirs, personal representatives, executors, assigns, and guardian ad litem, I hereby acknowledge and agree as follows: (1) Neither I nor any other person acting for or on my behalf shall hold the JPB, its Directors, officers, employees, agents or representatives or any other person engaged in work connected with JPB facilities, responsible for any personal injuries, property damages or wrongful death (whether such injuries, damages or death are known or unknown, or foreseen or unforeseen) that I may suffer by reason of, or in connection with, my participation in the Tour. (2) I and any other person acting for or on my behalf hereby completely waive and release the JPB and its agents, representatives, employees, contractors, officers, and directors (collectively, "RELEASEES") from any and all claims and liability for injury to or death of any person, including me, and for damage to or loss or destruction of any property, including my own, arising from or related to my participation in the Tour. I fully and completely waive and release the JPB, its Directors, officers, employees, agents or representatives from any and all liability, regardless of the fault or negligence, in whole or in part, of the JPB, its Directors, officers, employees, agents or representatives. I waive any and all claims, demands and lawsuits I may have against the JPB, whether known or unknown, or foreseen or unforeseen. This waiver and release includes claims of negligence of a RELEASEE, but not of gross negligence or intentionally wrongful conduct. I further agree to indemnify, defend, and hold the JPB and its Directors, officers, employees, agents and representatives harmless from: (1) Any and all claims and judgments for damages to which the JPB, its Directors, officers, employees, agents and representatives may be subjected, and (2) Any and all costs and expenses that the JPB, its Directors, officers, employees, agents and representatives may suffer or incur as a result of the actions or the presence upon JPB property of myself or any other person acting for or in my behalf, or the presence upon JPB property of materials or equipment that I own or use in connection with the purpose stated above. I acknowledge that I have read, understand and fully waive the provisions of California Civil Code Section 1542, which states, “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.” I HAVE CAREFULLY READ THIS PARTICIPANT AGREEMENT AND RELEASE AND
FULLY UNDERSTAND ALL OF ITS CONTENTS AND LEGAL EFFECT. I AGREE THAT
THIS RELEASE IS CONTRACTUALLY BINDING, AND I SIGN IT OF MY OWN FREE
WILL AND WITHOUT DURESS. I FULLY RECOGNIZE THE RULES OF PARTICIPATING
IN THE TOUR, AND I VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH MY
PARTICIPATION.

Parent or Guardian of a minor (if participant is under 18 years of age): I, as parent or guardian of the minor
named below, give my permission to my child or ward to participate in the Tour, and also agree,
individually and on behalf of my child or ward, to all of the terms of this Participant Agreement and
Release.
