The North American and European auction
marketplace, which we cover in the Weekly Sales
Ticker, bottomed out in 2010, when the sales we
covered saw gross receipts of just over $1-billion
($1,033,910,608, to be precise) for 21,577 horses
sold, an average of $47,917. Two years later, by the
end of 2012, the sales had improved by 22%, to just
over $1.25-billion. Last year marked the recovery in the
horse market; sales jumped by 25%, which was
$318-million, to a total of $1.574-billion and an average
of $72,412. In the three years between 2010 and
2013, with virtually the same number of horses sold
(21,739 in 2013 vs. 21,577 in 2010), the sales= gross
increased by 52%--over $540-million--and the average,
for more than 21,700 horses sold, by 51%. Cont. p9
CASINO LICENSES RING HOLLOW FOR RACING
The New York State Gaming Commission approved
casino-resort plans in three of the possible four
locations Wednesday, and decided not to permit any in
Orange County, the county under consideration which
was closest to New York City. However, Wednesday=s

Officials at the New York Thoroughbred Horsemen’s
Association laid out a six-step process as it relates to the
protest of the recent presidential election for that
organization made by Terry Finley . Finley alleges that many
were denied the right to cast their vote or did not receive
ballots altogether for the election, which was decided by a
handful of votes.

Congress Passes 3-Year Depreciation
A provision that retroactively extends three-year tax
depreciation for all racehorses was passed by the United
States Senate late Tuesday as part of bill H.R. 5771, the
Tax Increase Prevention Act of 2014. The bill, which
extends retroactively through the end of 2014 with
numerous provisions which expired or were reduced at
the end of 2013, passed the House of Representatives
with overwhelming support Dec. 3 and is expected to
pass into law with President Obama's approval..

Ostrager said that a full-scale commercial casino less
than hour=s drive away will hurt Finger Lakes Gaming
and Racetrack and the state=s burgeoning breeding
industry.
The Lago Resort and Casino in tiny Tyre in rural
Seneca County was one of
three proposals
recommended for upstate
New York by the Gaming
Facility Location Board. In
front of a standing-roomonly crowd of several
hundred people in a meeting
room at the Empire State
Plaza in Albany, the board

selected the Montreign
Resort Casino in the town of Thompson, near
Monticello, in Sullivan County and the Rivers Casino &
Resort at Mohawk Harbor in the City of Schenectady.
The five-man board chaired by Kevin S. Law,
president of the Long Island Association, considered 16
proposals to place casinos in three upstate geographic
regions. It decided to make three recommendations to
the New York State Gaming Commission and opted not
to use a fourth selection to place a second casino in
one of the regions.
The board did not recommend any of the six
proposed projects in Orange County, the closest-eligible
county to New York City, saying that a casino there
would likely preclude one in the Catskill Mountains
counties, Sullivan and Ulster, from being successful.
The Lago site is located 40 miles east of the Finger
Lakes Racetrack in Farmington. Finger Lakes, which
was founded in 1962,
has an approximately
160-day season.

Finger Lakes also has
one of the nine video

racinos in the state.

ATo the extent that there is going to be a full-fledged
casino at 45 minutes away from Finger Lakes, that=s
going to have a significant adverse impact on the ability
of Delaware North to profitably conduct its Finger Lakes
operations, including the Finger Lakes Racetrack,@ he
said.

AThe Finger Lakes Racetrack is exceedingly important
to the local horsemen and of particular importance to
the New York breeders because 80% percent of the
horses that compete at Finger Lakes Racetrack are New
York-breds. Those horses not only generate positive
economic impact for the people working at the
racetrack, the feed suppliers and others, but starters at
Finger Lakes generate stallion awards and breeder
awards for New York breeders. So the New York
Thoroughbred Breeders are concerned about the
long-term viability of Finger Lakes Racetrack.@
Ostrager, who is also a member of the New York
Racing Association=s Reorganization Board, said he
hopes that state officials will
make adjustments that will
soften the expected blow to
Finger Lakes.
AWe don=t think it=s the
intent of the Executive and
Legislative branches to
adversely affect the Western
New York racing and breeding

economy,@ he said.
APresumably some kind of fix can be structured to
maintain the viability of Finger Lakes Racetrack. It=s
important to the local community and it=s important to
New York breeders on a statewide basis.@
Ostrager said that a casino in Schenectady, 24 miles
to the south, will not likely be felt during NYRA=s
popular summer season at Saratoga Race Course.
AMy own personal opinion is that Saratoga stands on
its merits and will continue to be a very successful race
meet,@ he said.
Jeff Gural blasted the board for selecting the Lago
site over his proposal to build a casino at his Tioga
Downs Standardbred track near Binghamton in the
state=s Southern Tier. Gural also operates the
Meadowlands in New Jersey and Vernon Downs, a
Standardbred track and racino between Syracuse and
Utica.
AIt will hurt me at Vernon,@ Gural said. AIt certainly
screwed the people in the Southern Tier. There are five
casinos where Lago is and now are no casinos in the
Southern Tier. That=s shocking.@
Gural said he thought his Tioga Downs proposal
would prevail in the Southern Tier/Finger Lakes region
because it made geographic sense and wouldn=t
compete with established racinos and the Native
American casino, Turning Stone, between Syracuse and
Utica. Nevertheless, he said he worried that the board
would reach a different decision.
AI was concerned, to be honest, that they had a
committee of people who knew nothing about the
industry and I guess that=s what you get,@ he said. AI
think they are well-intentioned, but they certainly
screwed Turning Stone. They put Finger Lakes out of
business. They probably put Vernon Downs out of
business. Basically, they put two casinos out of
business and screwed the third one.@

NYTHA ANNOUNCES PROCESS FOR ELECTION
PROTEST In response to runner-up Terry Finley=s
protest of the results of the 2014 New York
Thoroughbred Horsemen=s Association Presidential
Election, that organizations newly
elected Board met Monday evening
and adopted a formal process to
hear the protest. The six steps of
the process are as follows:
1) The Board has adopted a four
stage process for hearing the
election protest (the AProtest@) of
Terry Finley (AFinley@), dated
Dec. 8, 2014.
2) The first stage of the hearing
process will be the submission by
Horsephotos
Finley of a comprehensive and
detailed written statement
specifically describing his objections to the recent
NYTHA election for president, with all supporting
evidence, such as documents and affidavits. This
statement, with evidence (the AFinley Statement@),
should be submitted in hard copy or, preferably,
electronically as soon as possible, but in any event it
must be received no later than 5 p.m. Jan. 5 at the
office of Bryan Cave LLP (ABryan Cave@), 1290 Avenue
of the Americas, New York, New York, 10104,
Attention: James M. Altman, Esq., electronically at
[email protected]. Bryan Cave will then
distribute the Finley Statement to the members of the
NYTHA Board (except for Rick Violette, who will not
participate with the Board in reviewing the Finley
Protest) and Interested Parties (as defined below).

3) The second stage of the hearing process will involve
the submission by Interested Parties of a statement
and/or supporting evidence (a ASubmission@) in response
to the Finley Statement. After review of the Finley
Statement, the Board will request that persons with
information or knowledge about factual matters

submission. Based upon the Protest, the Board
currently considers the following persons to be
Interested Parties who may present a Submission: Rick
Violette, Alan Foreman, and Jim Gallagher. It is possible
that after review of the Finley Statement, the Board will
consider other persons to be Interested Parties as well
and will invite a Submission from them. The Submission
of Interested Persons must be submitted to James M.

4) The third stage of the hearing process may entail the
questioning of witnesses Feb. 10, 2015, at the NYRA
Board Room at Aqueduct Race Track, commencing at
11 a.m. If, after reviewing the Finley Statement and the
Submission of Interested Persons, the Board believes it
is necessary to hear testimony from Finley, an
Interested Person, or another witness in order to
resolve disputed issues of facts significant to resolution
of the Protest, then an oral fact-finding shall be
convened. If the Board does not need to hear testimony
in order to resolve such disputed issues of fact, then
there will be no oral fact-finding. Mike Shanley will
preside over such a fact-finding. At the oral factfinding, the persons the Board wishes to question will
testify under oath. The questioning will be conducted
solely by the Board members. The persons who are
called to testify may be represented by counsel, and
such counsel may attend the oral fact-finding, but such
counsel may not question any witness and they may
not present any argument. They may, however, counsel
their client. There will be a stenographer at the oral
fact-finding, who will make a transcript of the
proceedings. The oral fact-finding will be private; apart
from the stenographer, no one except the Board, Bryan
Cave, the persons testifying, and their counsel may be
present.
5) The fourth stage of the hearing process will be the
Board=s deliberation and decision. After the completion
of the first three stages, and after reviewing the Finley
Statement, the Submissions of Interested Parties, and
the testimony and other evidence adduced at the
fact-finding, the Board will deliberate and render a
written decision.
6) The Board=s discussions, communications and
deliberations regarding the Protest will be strictly
confidential. None of those discussions,
communications or deliberations are to be disclosed to
Finley, to any of the Interested Parties, or to the public
in general.

depreciation for all racehorses was passed by the
United States Senate late Tuesday as part of bill H.R.
5771, the Tax Increase Prevention Act of 2014. The
bill, which extends retroactively through the end of
2014 with numerous provisions which expired or were
reduced at the end of 2013, passed the House of
Representatives with overwhelming support Dec. 3 and
is expected to pass into law with President Obama=s
approval.
Maintaining the three-year recovery period for
racehorse purchases has been a top legislative priority
for the National Thoroughbred Racing Association
(NTRA) since the provision=s initial enactment as part of
the 2009 Farm Bill.

racehorses indicates that lawmakers understand the
contributions our industry makes
to job creation and the country=s
overall economic health,@ said

to depreciate racehorses 24
months of age and younger
when purchased and placed into service on a three-year
schedule as opposed to a seven-year schedule. The
accelerated schedule better reflects the length of a
typical racehorse=s career and is more equitable for
owners.
H.R 5771 also retroactively extends two other
provisions that spur investment in racehorses.
ABonus depreciation@ remains set at 50% and may be
used by business owners who purchase and place in
service qualified new depreciable property. This
investment incentive permits taxpayers to depreciate in
the first year 50% of qualified property purchased and
placed into service. Yearlings that an owner purchases
and puts into a training program are one example of
eligible property.
The ASection 179 expense allowance@ remains set at
$500,000, with a $2-million threshold for qualified new
or used property purchased and placed in service by
small business owners in many industries. Total
purchases of qualified property that exceed $2 million
reduce the taxpayer=s expense allowance dollar for
dollar. Broodmares may be eligible for expensing and
are an example of used property because of their prior
use as a racehorse or broodmare.

The sections of key interest to the Thoroughbred
industry are Item 121 (racehorse depreciation), Item
125 (bonus depreciation) and Item 127 (expense
allowance).

For the most part, 2014 has been a year of
consolidation. The number of horses sold increased by
5% over 2013, to 22,824. Gross receipts increased by
$64-million, or 4%, to $1,638,148,392. The average
for the 22,824 horses sold dipped by 1%, from
$72,412 last year, to $71,773 this year. That=s
essentially the description of a stable market.
Within the overall figures there were a couple of
notable >deviations=. The European yearling market
gross increased by $58-million (17%) and, probably for
the first time ever, actually grossed more than the
North American yearling market: 4,179 European
yearlings sold for a total of $400,588,860, while 5,295
North American yearlings grossed $396,611,300. With
over 1,100 more yearlings sold in North America for
slightly less money, the gap between the European
yearling average ($95,857) and the North American
yearling average ($74,903) widened; the European
yearling average increased 9%, while the North
American yearling average was down 1%. Also the
clearance rate from the catalogues was almost 10%
higher for European yearlings: 75.6% of the European
yearlings catalogued were sold, while just 65.9% of the
North American yearlings catalogued were listed as
sold. That was almost 5% lower than the 70.7% North
American yearling clearance rate from the catalogues in
2013.
Combined NA plus EU yearling sales ($797m)
accounted for very nearly half of the $1.638-billion
total sales. What we classify as >second-half calendar
year= mixed sales (after the yearling sales) accounted
for another 30%, or $491-million. This total was down
7% from the 2013 second-half mixed sale total of just
under $527-million. Just as in the yearling sales, the
North American second-half mixed sales were down
1% in gross, from $276-million to $273-million. The
European mixed sales, though, as we=ve been
discussing the last couple of weeks, were down by
$32-million, or 13%, though we have speculated this
was due to a decline in the catalogues rather than a
decline in market values. Here again the clearance rate
from the catalogues was higher in Europe, where it was
68.5% (down from 69.5%), while the clearance rate at
the North American second-half mixed sales was just
60.9%, down from 67.7%.
Adding in first-half mixed and 2-year-old in training
sales, the overall North American market saw a 2%
gain in gross ($19-million), from $899-million in 2013,
to $918-million this year. The European sales added
$45-million (7%) in gross, from just under $675-million
to just under $720-million. The averages were almost
identical: $71,983 in North America (-4%), $71,558 in
Europe (+3%).
A # will distinguish first-time stakes-winners, a @ will
indicate first-time graded stakes-winners, a s will
denote a first-time Grade/Group 1 winner, a + will
indicate first-time starters, an (S) will be used for statebred races, a (C) will be used for maiden-claiming races
and an (R) will be used for other restricted races.

MARKET DARLINGS: From time-to-time you see a
previously unheralded stallion which becomes all the
rage in the auction marketplace, thus earning the
designation >market darling=; think of it as the auction
sale equivalent of a >TDN Rising Star=. It=s not that >the
market= had a negative view of these horses going in,
rather that the individuals by that sire consistently sold
for well beyond what might have been expected
initially.
This year there were no fewer than three new Market
Darlings at the yearling sales. Darley=s Poet=s Voice
(Dubawi), who defeated Rip Van Winkle by a whisker in
the 2012 G1 Queen Elizabeth II S., is a very
good-looking horse himself, according to the judges,
and he was certainly siring same: 56 yearlings from
Poet=s Voice=s first crop
(of 69 offered) averaged
the equivalent of
US$157,154, making
him the leading
first-crop yearling sire

S. as a 2-yearBold but probably ran his best race when
he nearly caught Frankel in the 2012 G1 St. James=s
Palace S. Zoffany had 103 yearlings sent through the
ring, of which an astounding 94 sold, for an average of
$80,196.

Winchell Tapit Duo On the Grounds in NOLA...
Winchell Thoroughbreds= likely 3-year-filly champion
Untapable (Tapit) and three-time graded-stakes winning
sophomore Tapiture (Tapiture) have arrived to the barn
of Steve Asmussen at the Fair Grounds to prepare for
their respective 2015 campaigns, and have settled in
well, according to Racing Manager David Fiske.
AThey wintered great,@ said Fiske. AThey both got to
the farm after the Breeders= Cup and took about 30
days off. Neither [was] a
problem and they looked
like they were happy to
be doing something
different. Everyone at
the farm really enjoyed
having them, too; they=re
both characters. I don=t
think they really lost all
that much weight, either.
Untapable
Horsephotos
Tapiture probably came in
at about 1,200 pounds and Untapable about 1,150.@
Untapable should be the unanimous selection for her
Eclipse off a season which included victories in the
GI Kentucky Oaks, GI Mother Goose S., GI Cotillion S.
and a defeat of her elders in the GI Breeders= Cup
Distaff. In all, Untapable won six of her seven starts in
2014 with earnings of $2,808,600.
Taptiture bankrolled $1.2 million in 2014, with scores
in the GIII Southwest S., GIII Matt Winn S. and the
GII West Virginia Derby, overcoming a world of trouble
in the stretch to do so. Runner-up to subsequent
GI Breeders= Cup Classic winner Bayern (Offlee Wild) in
the GII Pennsylvania Derby Sept. 20, the homebred was
last seen rallying into second behind Goldencents (Into
Mischief) in the GI Breeders= Cup Dirt Mile Oct. 31.

really not hard for either one to get fit. We=ll start at the
Breeders= Cup and work backwards in five-week
intervals and hopefully have them ready to go at the
end of March or beginning of April. I could envision
[Untapable] doing the same sort of campaign. She does
better when you space her races out and will probably
run no more than seven times. It would be nice to run
her at Saratoga. She was supposed to run in the
[GII] Adirondack as a 2-year-old there, but colicked the
day before. We=ll focus on Grade Is with her.@
As for Tapiture, Fiske believes longer races could be
in his future.
AHis year-end goal depends on how he runs
throughout the year,@ Fiske said. AThe Dirt Mile this year
was around two turns [at Santa Anita] and that=s
preferable for him, as opposed to one turn. In 2015, if
he shows that he=s adept at mile and a eighth to a mile
and a quarter, we=ll stretch him out somewhere to see
if the Classic is an option. The [GII $400,000] New
Orleans H. is possible, but we=ll really have to see how
he=s coming along at that point.@
BARRY IRWIN:
The RCI's latest action (see TDN, Dec. 17) to avoid
irrelevancy is a pathetic and misguided gambit that is
built to fail. Instead of embracing USADA and seeking
to find out where it would fit in when the sport's
regulatory landscape changes, they go off on a tangent.
The RCI chairman has constantly made a fool of himself
by citing meaningless stats which purport to
demonstrate how clean our sport has been, while
ignoring the widespread use of designer drugs. The RCI
has lacked direction. USADA can give it to them and
keep them in the loop. But if the RCI continue to take
its own path convoluted path, it might find itself lost in
the wilderness.
BUFFERING TO TAKE A BREAK
Four-time Australian Group 1-winning sprinter
Buffering (Aus) (Mossman {Aus}) will bypass an
autumn campaign to prepare for the Brisbane winter
carnival middle of next year, trainer Robert Heathcote
told Racing and Sports. The 7-year-old gelding finished

quarantine period in

The Garhoud Sprint is the first of three new listed
stakes on this Meydan card; all are former conditions
events upgraded for the first time this year. With the
scratch of 2013 G1 Golden Shaheen hero
Reynaldothewizard, Sheikh Hamdan appears to have a
stranglehold on this event, with five of the eight
runners set to bear his silks. The Taj (Street Cry {Ire})
was a winner over course and distance in handicap
company Dec. 3, and that effort followed a seasonal
debut second under similar conditions. He is the choice
of Sheikh Hamdan=s retained rider Dane O=Neill.
AWe were delighted with both his starts this season,@
said trainer Doug Watson. AHe was a good second first
up and built on that with a smooth win last time. He
has a [weight] penalty for that which makes life harder
but he is in great form and should run a big race.@
Sheikh Hamdan=s Rafeej (GB) (Iffraaj {GB}) won this
race last year and was chased home by fellow blue-andwhite colorbearer Tamaathul (GB) (Tiger Hill {Ire}). Both

Trainer Dhruba Selvaratnam has a live chance in the
preceding Garhoud Sprint with Sholaan, and thus he
will be hoping for a double when he saddles Uruguayan
Group 1 winner Grand Salute (Brz) (Salute the Sarge) in
the inaugural Dubai Creek Mile. The Brazilian-bred, who
is riding a three-race win streak, will make his first start
since February. He won the G1 Clasico Gran Premio
Pedro Pineyrua over this trip Jan. 6 and followed up
with a conditions score a month later.
AHe has been working nicely but it can take these
horses a while to acclimatize,@ said Selvaratnam. ALike
Sholaan, he too has to give weight away and, whatever
he achieves, he will improve for this outing.@
Grand Salute will have to contend with a pair of
formidable rivals from the Satish Seemar stable with
carnival form: Surfer (Distorted Humor) and Gold City
(Ire) (Pivotal {GB}). The former, who won this event
last year, finished third in the G1 Al Maktoum Challenge
R3 Mar. 8 prior to fading to 15th in the G1 Dubai World
Cup three weeks later, and he makes his first start
since. Surfer is the choice of number one stable rider
Richie Mullen. Gold City was a handicap winner at the
carnival in February and fared better than his stable
companion on the big night, checking in fourth, beaten
just 2 1/4 lengths, behind Variety Club in the G2
Godolphin Mile. He makes his first start since.
