RESOLUTION 96-45 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ALACHUA COUNTY, FLORIDA, REVISING THE COUNTY BUDGET OFFICER'S ESTIMATE OF RECEIPTS OTHER THAN TAXES AND OF BALANCES TO BE BROUGHT FORWARD; ADOPTING A SUPPLEMENTAL BUDGET FOR FISCAL YEAR 1995-96; AMENDING RESOLUTION 95-65, AS AMENDED, ESTABLISHING THE SCHEDULE OF FEES AND CHARGES FOR SERVICES; PROVIDING AN EFFECTIVE DATE. WHEREAS, on September 21, 1995 the Board of County Commissioners held a public hearing for the finalization of its fiscal year 1995-96 budget; and, WHEREAS, the board of County Commissioners of Alachua County, Florida, has complied with all conditions precedent to the adoption of a Fiscal Year 1995-96 Supplemental Budget; and, WHEREAS, said budget contained estimates of revenues and balances to be brought forward; and, WHEREAS, the Board of County Commissioners wishes to revise the adopted estimates of receipts other than taxes and of balances to be brought forward based upon the most accurate information available as of the date of this resolution; and, WHEREAS, the Board also wishes to amend the schedule of fees and charges for services that was established in ~esolution 95-65, as amended, to add certain fees and charges; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF ALACHUA COUNTY, FLORIDA: 1. In accordance with the requirements of Section 129.03, Florida Statutes, the adopted estimates of receipts other than taxes and of balances to be brought forward are revised as set out in Exhibit "A" attached hereto and incorporated herein by reference. 2. The fiscal year 1995-96 Adopted Budget is hereby amended as set out in Exhibit "A" attached hereto and incorporated herein by reference and is hereby adopted as the Supplemental Budget for Fiscal Year 1995-96. 3. That Resolution 95-65, as amended, establishing a schedule of fees and charges for services for Fiscal Year 1995-96, is hereby amended with the addition of fees as reflected in Exhibit "B" attached hereto. 4. That this resolution shall take effect immediately upon its adoption. DULY ADOPTED in regular session, this 14th day of May, A.D., 1996. Rezoning requests for a residential district, where the resulting parcel does not permit more than one dwelling unit, shall be charged a fee equal to the fee applicable to the "A" District. Comprehensive Plan Amendment: Where an applicant submits a proposal for territory other than under his/her direct control, only that area under his/her direct control shall be included for the,pukpo&es of calculating the fee. Small scale amendments are applications which conform to Section 163.3187(1)(c), 'Florida Statutes. No rezoning or plan amendment request shall be accepted for processing until the required application fee, or reduced fee as established by Fee Policy number six, is paid. An application fee may be refunded only if the application is withdrawn prior to the County incurring direct costs in processing the application (i.e., copying and distributing copigs to staff, advertising, postage, printing reports, etc.) In the event that readvertisement of an application due to any delay or postponement requested by the applicant, or necessitated by some act or failure to act on the part of the applicant, a supplemental fee of $150 plus postage costs per advertisement will be charged for a Zoning Application and a supplemental fee of $560 per advertisement for a Comprehensive Plan Amendment. This supplemental fee is intended to cover additional costs for readvertisement. No additional fee shall be charged if the postponement is requested by the County. In the event the zoning Administrator determines that the specific purpose of an application is to correct an existing situation which has been determined to be, or is alleged to be, a violation of a County zoning ordinance provision or regulation, a supplemental fee equal to the scheduled application fee shall be charged. This policy shall apply whether or not an actual notice of violation has been issued by the Department of Growth Management, Office of Codes Enforcement. This supplemental fee is intended to cover the additional administrative costs and expenses associated with the investigation of the existing situation and the determination of any corrective action required. Notwithstanding any other provision to the contrary, any filing fee required under the rezoning application fee schedule shall be waived for any applicant which is an agency of the government of the United States, an agency of the State of Florida, and agency of the City of Gainesville, or any agency of Alachua County. However, a minimum advertising fee of $150.00 plus postage costs shaSl be required from the governmental agency which is the applicant for a requested zoning action. The Director of Growth Management may redoce a required application fee where they find: (1) that special circumstances, not under the control of the applicant, justify a reduction in the fee; and ( 2 ) that the-actual direct cost to the County for processing the application will not exceed the actual fee collected. In no case may a reduced fee be less than advertising cost. No request for reduction in the fee shall be considered unless the request is received within five working days following the date of the application submitted to the Department of Growth Management, Office of Planning and Development. The Board of County Commissioners may waive portions or all of the temporary permit fee as a condition of approval when the Board determines that a personal hardship exists on the applicant.
