A current contract is required at the beginning of each season for each mare. 1a. A non-refundable deposit of $350.00 is required with a new Contract. 1b. The total service fee is to be paid on or before the mare’s arrival on the property. Please note. Mares will not be served unless the full service fee has been paid. 1c. All accounts for agistment and other associated expenses are to be paid monthly to H & R Ryan Pty Ltd. Veterinary accounts will be sent direct from the Veterinary Practice. 1d. All accounts and other associated expenses must be paid in full before any mare leaves the property. 1e When purchasing chilled semen - there is a non-refundable collection fee of $330.00 for each shipment, which includes transport costs, and full payment of this fee must be made before the semen is sent. On weekends and public holidays surcharges may apply. 1f When purchasing frozen semen – there will be a non-refundable surcharge of $330 for transportation costs and full payment of this fee must be made before the semen is sent. 2 Please note that no Contract is said to have been made until the completed Breeding Contract and non-refundable deposit is received by H & R Ryan Pty Ltd. Payment information is found at the end of this contract. 3a A refund of service fees will be offered if, within fifty (50) days of the last service, H & R Ryan Pty Ltd is in receipt of a Veterinarian Certificate stating that the mare is not in foal. Refer to condition 10 on Live Foal Guarantee. 4. Due to (a) the number of visiting mares, (b) quarantine restrictions on stallions involved with semen export, (c) nervous mares, (d) chronic infections, (e) foal-proud mares, (f) safety considerations or (g) any other circumstances deemed appropriate - stud management reserves the right to use Artificial Insemination techniques without prior owner consultation. This is a very gentle way to get a mare in foal and many difficult breeders will happily conceive using this method. Any extra costs, including veterinary costs, will be borne by the mare owner. 5. In order to minimise stallion use, maximise stallion fertility and maximise mare conception, Stud Management reserves the right to direct and implement policy on Follicle Testing, Pregnancy Testing and subsequent drug therapy, such as antibiotics, Prostaglandin, Oxytocin, Ovuplant and Flushes. At all times minimising the cost to the mare owner and maximising the successful conception without compromising the mare's wellbeing, which will be the highest management priority. All costs will be met by the mare owner or agent. 6. Mares must not have hind shoes on if they are to be served and/or turned out in a group. If the mare is shod behind, we reserve the right to remove the shoes with the costs borne by the owner. 7. In all cases Veterinary Charges are the responsibility of the owner or agent of the mare. The stud management has the right to call the Veterinarian at any time, for any reason, without consulting the owners or agent. All reasonable efforts will be made to keep owners or agents abreast of developments. 9. The stud will take all reasonable care, but shall not be liable to the owner or agent in the event of the death of the mare (s) or in the event of the same receiving any injury or suffering any illnesses howsoever arising. 10. There is a Live Foal Guarantee for all Services. Heath and Rozzie Ryan are very interested in mare owners or agents getting a live, healthy foal on the ground. In the event of bad luck, the mare slipping, foaling difficulties, or some other disappointing circumstance the stud should be notified immediately and in most cases a “Free Return” may be negotiated. In the event of a Stallion being unavailable – due to death, injury, competition commitments or sold – Heath & Rozzie will offer an alternative stallion where possible. If the Service Fee was purchased before the Current Season, there will be no refund on monies but a “Free Return” may be negotiated. Mares not covered as a result of Stallions being away or injured will not be compensated for daily charges. 12. Agents please be aware - If signing on behalf of an owner who subsequently defaults on payment the agent then becomes liable for all outstanding costs.
