The railway line could only successfully constructed due to sheer grit and perseverance of all those involved with it in the face of the many challenges of Nature right from its construction phase. However, as is said, success comes at a price – many men and women, including labourers and Konkan Railway personnel, lost their lives during the construction of the railway line and some on duty during the operations phase. To salute the courage and priceless con- tribution of these brave men and women, Konkan Railway observes 14th October every year as Remembrance Day. Konkan Railway has constructed a ‘Shram Shakti Smarak’ in front of Ratnagiri Station in the memory of these heroes. The Smarak is made of black granite with the names of all these persons etched on it. A book titled “Smruti Pushp”, containing names of these brave persons and details of how they lost their lives, has also been published by Konkan Railway. This year too, Konkan Railway will observe Remembrance Day on 14th October, and a wreath will be placed at the Smarak by Shri Bhanu Prakash Tayal, Chairman & Managing Director of Konkan Railway, followed by observance of a two minute silence. The RPF contingent will pay Shraddhanjali through Shok Shastra and carry out Shahid-Divas parade. What are the precaution essentially to be taken before going for purchase ? Answer : Purchase of an accommodation, is the highest financial transaction in the entire life of a middle class individual. It is the lion’s share of one’s entire saving, if not, entire amount of hardearned money of the life. None can afford to face any adverse fate of such highest financial investment. As such one must be very cautious and arrange for foolproof safeguard to protect one’s interest. It is undisputed fact that the uncontrollable urban growth due to migration from rural to urban areas and the socio-economic situation has deprived common men, to have their independent houses. It has become the general practice to those needy persons to book/ buy ready-made flats/ units, in a building constructed by the builder/ developer. There is no dearth of example where the flat purchasers are cheated by the unethical dealing of the builder/developer to achieve their ultimate motive of financial gain. Blind faith and ignorance of legal consequences leads the flat purchasers to be cheated by the builder/developer in different mode of techniques. So look before you leap. It is our common experience that many time property purchasers are duped on various accounts. Some of them are mentioned herein under such as : (i) fake docu(iii) owner has given mul- tiple General Power of Attorney in the name of more than one person (iv) dispute on layout of land and ownership of the seller (v) same property is sold to more than one person (vi) selling of encroached neighbours’ plot (vii) wide difference of the area of agreement and actual available etc. The flat-purchaser while selecting the property must not compromise against the essential community services like commutation, social atmosphere, market etc. • basic municipal services - water, sanitation, waste collection, storm water drainage, street lighting, paved footpaths, roads for emergency access. • schools and clinics within reach, safe areas for children to play. • places for the community to meet and socialize. Slums are worsening: • as the average age of people in cities is increasing, the average age of slum dwellers is decreasing, so the youth suffer most from unhealthy conditions. • visible disparities between slums and better-off neighbourhoods increase the social tensions in poorer areas. • unplanned growth of settlements makes conventional service It must be overlooked that such a financial trans- action is first and last for him. When affordable proposed flat for purchaser is finally selected, the first and foremost duty for him is to approach an appropriate lawyer for completion of due legal formalities. Draft contact agreement, made by the lawyer of the owner of the property along with your lawyer to finalise the terms and condition for the transaction. Ensure the responsibilities on your appointed layer to arrange and report of due search to ensure lawful title marketability of the property. Collect the draft copy of the agreement of transaction along with all the required photo copies from the owner for its finalisation by your lawyer to protect allround interest of the purchaser. The lawyer should be entrusted for the following activities along with others before registration of the documents. 1. Request for the documents in originals only for verification. 2. Verify ownership from Municipality or S.R.O by yourself or by legal counsel and make local enquiries 3. Keep a look on signatures in all documents including fingerprints along with the signatures. 4. That their houses have been raided and some of their properties have been confiscated is a small consolation. In our opinion, they need to be awarded much more severe punishment. First, their ticket booking agencies – permits – should be cancelled. That too is not enough. The officials will have to ensure that they do not reapply in another name - the name of a family member, associate or friend. Very often, we see that happening in this country. We know of an instance when the licence of a medical store was cancelled for obviously indulging in malpractices. The fellow applied in another name – from Anil Medical to Sunil medical – and the authorities were happy to grant him his request. The infrastructure remained the same, the place remained the same and the persons behind the counter remained the same. The shop was in full operation in about a week’s time. The authorities should ensure that such a thing does not happen in this case. In fact, the party should be effectively black listed. While suggesting that, we are aware that our laws pertaining to black listing are very lax. In BMC, several black listed contractors are being awarded spicy contracts repeatedly. That is because they have the blessings of some senior officials or politicians. The railways should ensure that such a thing does not take place. Incidentally, we need to bring about fundamental changes in our contracting system. In Navi Mumbai, we see a lot of small civil contractors operating anonymously, so to say. We are only told that the contract has gone to say, Onkar Agencies; we are never told who the people behind it are. Often, several agencies get registered with the same address – Nitin Agencies, Vision Agencies and what not! If one contract is granted to Nitin Agencies, the second one is given to C M Agencies. If Nitin Agencies is black listed, the other Agency operating from the same address does not get affected at all! To prevent such malpractices, they must be made to disclose the names of the persons behind the enterprises – whether they are partners, directors or co-owners. When it comes to black listing, not only the enterprises but also the persons behind them should attract the ban, as in the USA. That is the type of fundamental changes needed to bring about transparency and one hopes that the new dispensation under Narendra Modi’s leadership will be able to bring it about. Having been the municipal commissioner of Navi Mumbai for four years, he knows every secret of his opponent and is sparing no effort to expose him. He has been openly accusing Naik of corruption, especially in the award of municipal contracts. Nahata’s other strong point is his IAS background. He has been losing no chance to run down his ‘boorish opponents’. During the last assembly election, Naik had faced yet another ‘educated’ rival in Suresh Haware. Splitting of votes by MNS candidate and the independents, especially Namdev Bhagat had helped Naik to win the seat. He enjoys none of these advantages this time. The third candidate in the fray is Manda Mhatre who is a BJP nominee. She looks crippled on several counts. First, she is a recent entrant to the party. Second, he is not having enough workers to campaign for her. In the circumstances, she is entirely dependent on the ‘Modi wave’ to see her through. Cont. from pg. 1 The Congress candidate Namdev Bhagat is elated that he is contesting as an official Congress candidate for the first time. During the last election, the alliance with NCP had prevented his party from giving him a ticket. His visceral rivalry with Ganesh Naik had prompted him to enter the fray. I n c i d e n t a l l y, Ganesh Naik, Manda Mhatre and Namdev Bhagat - all come with a village base. That is what makes them cut into each other ’s votes. Bhagat of course is banking on the support of powerful Agri Koli communities. Lest it be forgotten, Maharashtra Navnirman Sena of Raj Thackeray has also put up a candidate. It has nominated its city unit president Gajanan Kale. Opinion polls however do not give much importance to MNS. It also does not have a strong presence in the city. These are considered the main contestants. Of course, there are 10 others, some of them representing smaller parties and independents. The multi-cornered contest makes prediction difficult. In some of the areas, the entries of vehicles are noted by the contractor but the vehicles having gone out or not have not been noted. Virat Kohli is continuing with his poor form. India should try out some new players in ODI series against West Indies. This will help India to decide on the right combination of players for the World Cup which is not far off. Unmukt Chand played very well for India ‘A’ against West Indies, which India ‘A’ won. He scored 79 not out and 101 in the two matches, which helped India ‘A’ win both the matches. He also opened the batting in both the matches. He is the player in form. He should be given a chance to play in the ODI series. He can be tried as an opener also. Sanju Samson was taken to England. But, he did not play a single game there. Now, he is dropped for the ODI series for no reason. He also deserves a chance. India should try out Wriddhiman Saha also, since he is a good batsman and also a wicket-keeper. In case Dhoni gets injured, we need a back up wicket-keeper. - S. Ravichandran, Airoli CMYK fied had been parked in the premises.
