through SRMJEEE (SRM

NEW DELHI, Nov 17: Women making false rape allegation to
settle personal scores need to be prosecuted and punished, a Delhi
court has observed, saying such matters cause intense misery and
humiliation to the accused which continues even after acquittal in
the case.
Additional Sessions Judge Virender Bhat while acquitting
two Delhi youth from the charges of gang rape, directed the
court staff to lodge a complaint against the woman with Chief
Metropolitan Magistrate for making false allegations.
"Time has come to curb such tendency by directing the
prosecution and punishment of the women making patently
false allegation of rape to settle personal scores," the judge
said. Noting that the accused undergo emotional distress during the trial, the court said, "it is high time that court should
shoulder some kind of responsibility and duty towards the
persons, who are made to face the trial for false rape charges."
"It is very difficult, nay impossible, to restore the lost
honour and dignity of a rape accused after his acquittal from
the court. They are never compensated for the emotional distress, humiliation and pecuniary damage suffered by them," it
said.
According to prosecution, the woman in this case had
lodged a complaint with Dwarka South police station alleging
that two youths have gang raped her after offering her cold
drink laced with vodka. During the trial, the woman however
retracted from her statements and denied that she was sexually
assaulted by the accused.
She also confessed in the court having written a letter to
the SHO of Dwarka South police station on the very next day
of lodging of complaint and the arrest of the accused saying
that she had lodged a false against the accused and no sexual
assault had taken place.
"From the aforesaid deposition of the prosecutrix (woman)
it is abundantly clear that she had made a false complaint of
intoxication, gang rape and physical assault against the two
accused as she wanted to teach them a lesson for the reason
that they had refused to drop her at her residence when she
was heavily drunk," the court said.
"Resultantly, both the accused are liable to be acquitted and
are hereby acquitted as such," the court said.

Controversial
'godman'
Rampal was on Monday
whisked away from his ashram
here to an undisclosed
destination for "treatment", his
supporters claimed hours after
he again failed to appear before
Punjab and Haryana high court
and sought more time citing
illhealth.
With his followers resisting his arrest, Rampal did not
appear in the high court today, the deadline set for his
appearance in a contempt
case, with his counsel saying
he was "unwell".
Hours later, ashram
spokesman Raj Kapoor
claimed that 63-year-old
Rampal was taken to a hospital at an undisclosed place for
medical treatment.
Declining to disclose the
name of the hospital or the
city, he said, "We were facing
problem in treating him as the
administration had stopped all
supplies, including of medicines, to the ashram."
"We were left with no
option but to shift him to a
hospital at an undisclosed
place."
The Haryana government,
meanwhile, told the two-judge
HC bench that it is taking
steps to comply with the
court order but it has to take
every step carefully as a
number of women and children were present in the his
ashram in Hisar district here.
The court had reserved its
verdict till afternoon.
The high court had last
Monday pulled up the
Haryana government for failing to produce the self-styled
'godman', against whom a
non-bailable warrant was issued recently in a contempt
case.
It had set a deadline of
today for his production.
Rampal's counsel S K Garg
told the bench, comprising
Justices M Jeyapaul and
Darshan Singh, that the
'godman' was "unwell" and
not in a position to travel
from Barwala to here. "He is
unwell.... We are not avoiding court appearance. He has
been appearing on past occasions. Give us some time,
once he feels better, he will
appear," the counsel told the
bench.
On behalf of the state government, home secretary and
the DGP appeared before the
court. Advocate General
Baldev Raj Mahajan told the
court that the state was taking
steps to comply with the
court order. He pleaded that
since a number of women and
children were present at the
Satlok Ashram in Barwala,
the police and administration
had to take every step carefully. With regard to the
issue of cancellation of
Rampal's bail in the 2006
murder case, the bench posted
the matter for tomorrow asking the defence counsel to file
their reply by then.
A large number of his
supporters, including women
and children, remained on
guard inside and outside the
Ashram around which security personnel, including those
of the central Para military
forces have also been deployed in strength.
Earlier in the morning, his
spokesman said that Rampal
remained "unwell" and would
not travel to Chandigarh.
