The federal court system hears matters relevant to the violation of federal laws. The federal courts are the United States District Courts (90 of them); United States Court of Appeals (12 districts) and the United States Supreme Court. There are also the United States Tax Court, United States Bankruptcy Courts, and military courts to name a few. The federal courts have original jurisdiction. In some instances a matter can be filed in the circuit court and be removed to the federal court because it may contain a violation of federal laws, In Illinois the United States District Court consists of the Northern District, the Central District and the Southern District. In each district there are geographic divisions. Matters arising in certain counties in each District will be heard by the particular division which that area is located. Matters heard by the United States District Court include civil rights violations such as age discrimination, gender, disability discrimination; matters violating rights given under the Constitution; patent matters, interstate commerce, antitrust, copyright,. The United States District Court also hears criminal matters brought by the office of the United States Attorney such as drug enforcement matters, fraud matters or other criminal acts defined by Congress. The rules of practice before the United States District Court are the Federal Rules of Civil Procedure. They are promulgated or prepared by the United States Supreme Court. Each District Court may also and usually has Local Rules. Be familiar with each. The United States District Court is a trial court. A matter brought before the court may be tried by jury or judge. This is determined by statute. Not all matters brought before the court are tried by jury. The jury in federal matters may be smaller than the traditional twelve. It generally is six jurors with two alternates. If a party is unsuccessful before the District Court an appeal may be filed with the United States Court of Appeals. Like the Appellate Court on the state level, this is a reviewing court. It hears matters “de novo” or reviewing the evidence as new. No new evidence is submitted. The Federal Rules of Appellate Procedure set forth the schedule for filing briefs and other court procedures. The rules specifically set forth what is contained in a brief including the type, color of cover, length, sections, table of contents and table of authorities. Failure to faithfully observe these rules will result in rejection of the party’s brief. After submission of briefs oral arguments are held before the Justices. Oral arguments can be lively. Parties are given strict amounts of time in which to make their arguments. The opinion of the Court of Appeals is called a slip opinion. This opinion, like a district court opinion or decision, may be reported. If a party objects to the opinion of the United States Court of Appeals it may be appealed to the United States Supreme Court. This is done by preparing a petition for writ of certiorari to the United States Supreme Court. Like the matters before the United States Court of appeals, there are strict guidelines to follow regarding the submission of the petition and other briefs. Printing and binding a petition to the United States Supreme Court is required and costly. As with the Illinois Supreme Court, few petitions are heard by the United States Supreme Court. If the petition is allowed arguments are scheduled and the attorney must travel to Washington, D.C. to present the argument of the party. In addition to federal courts there are federal administrative agencies such as the Equal Employment Opportunity Commission and National Labor Relations Board (just to mention two) which hear matters.
