After months of searching
for a new group or person to
take over Thunder Over the
Indian River, I gave notice to
the new Parks and Recreation
Director that the event would
not take place this year and likely
not return. I don’t believe anyone sent
in the
renewal fee for the corporation and although
there has been a lot of buzz that Someone should
do the fireworks, none of the buzzing voices said
the magic words, “I’ll do it.”
Perhaps there will be a large enough company
or group here to start it again some day, but for
now, keep an eye on other fireworks shows and
make your plans early. I’ll try to have several
dates and locations in Happenings next month.

Residential Lot Elevation Issue
If you live with an empty lot adjacent to you,
you could end up having to sue your neighbor.
To build a house, Florida Residential Build Code
states depending on Lot Drainage Type, the lot
must be up to 24 inches above the crown of the
road, which will most likely put your neighbor’s
lot higher than your lot. This will mean your lot
will most likely be flooded. But, County Ordinance states you cannot flood your neighbor’s
property. So where does this leave the homeowner with the water damage?
According to the county, the flooded homeowner must sue the offending neighbor, even
though both the neighbor and the victim have
followed state law. The flooded out victim has
done nothing to deserve this added cost and damage. Surely the county has given out permits for
the elevated houses to be built, knowing full well
what will happen. This is absurd.

new subdivisions, but in previous years Port St.
John has legally built homes that are at or below
the crown of the road.

Canaveral Port Authority
I attended the Informational Public Meeting
the Canaveral Port Authority (CPA) held on
April 30th. I assumed we’d be hearing about the
Florida Today front page story published that
day by Dave Berman, “Port plugs barge plan to
link rail, cargo ships,” which discussed barging
cargo to Mims, then loading the cargo onto the
NASA railway. Surprisingly, there was nothing
mentioned at the meeting of the Mims Barge
Canal Proposal.
There was standing room only with overspill
into the foyer, some with signs or T-Shirts with
slogans like “No Fill/No Kill.” I saw environ-

mentalists, homeowners and fishermen. I was
unhappy when the agenda stated there would be
no public comment and I wasn’t the only one.
At the end of the presentation, one of the groups
started to yell questions at John Walsh, which he
did try to answer. However, some of his replies
were met by laughter and jeers, which was well
deserved.
There were 3 speakers: John Walsh, the chief
executive officer of the CPA; Jim Dubea, the
port’s Deputy Executive Director for Government and Strategic Partnerships; and Brad Swanson, state Freight and Logistics Administrator
for the Florida Department of Transportation.
All were basically giving a pep talk on how this
will help our economy and why some rail route
must be to benefit the Port, Brevard and Florida.
The main areas that the presentation covered
were 1) the Environmental Impact Study will
be complete in about 24 months and is being
conducted by the Surface Transportation Board.
It is a federal independent review of the project’s

environmental impacts. 2) The Secretary of the
Air Force has given 58 reasons why the Port’s
rail cannot go through Cape Canaveral Air Force
Station’s land, however they will perform a study
over the next 8 months to determine if the Air
Force has any land they could lease to the Port
Authority. 3) It currently costs NASA $9 million per year to maintain their railway and the
railway is very underutilized. However, at this
point NASA has not agreed to the Port’s plan.

The meeting was nothing but informing us
on how much this growth will benefit us all and
the jobs it will bring. The presentation did not
mention how many jobs would be lost by the
fishermen, how much in Ecotourism will be lost,
or how much our riverside property values would
drop when the Lagoon is dead.
Florida Today writer Ted Lund’s article,
“Anglers drive Port Canaveral meeting off the
rails,” in the Florida Today pointed out the many

reasons attendees at the meeting were against the
Port’s Rail plans. Besides the opinions stated by
attendees, I was particularly impressed with the
paragraph stating the problems for their preferred
routes: “Although the CPA is looking at several of
its alternatives, the two preferred options cut directly through the northern Banana River lagoon,
which has been off limits to powerboats for more
than 20 years and is a sanctuary to the world’s
largest population of the endangered West Indian
manatee. It is also wildly popular with kayak
fishermen targeting world-class fishing for black
drum, redfish and spotted seatrout.” Ted Lund
stated in his article, “If Thursday’s meeting is any
indication, it’s going to be a bumpy ride over the
next 12 months as anglers, environmentalists and
homeowners square off with the CPA.”
As far as the Mims’ Barge Canal Proposal, using Google Maps, you can see there are 4 parallel
tracks just west of the Jay-Jay Railroad Bridge
east of Mims. It looks like a barge could park
next to the bridge and box cars could be lifted

article in Thursday’s Florida Today stated John
Walsh wanted to start barging box cars to the
Mims site within the next six months. The Titusville.com website, although it has significantly
dated information, does state the barge canal was
designed to have a 15-foot draft, but a lot of the
barge canal has only a 9-foot draft and it states
the barge will need a minimum of a 12-foot draft,
so the barge plan could not take place without the
Army Corps of Engineers completing significant
dredging along the route.

Brevard County Building Report
April was a so-so month, unlike previous
months concerning building in Brevard County.
April single family home permits issued dropped
from (64) to (27), the first time April numbers
were lower than March’s numbers since 2013,
when it had decreased from (45) down to (29).
As I reported last month, the county changed
their monthly report to only go back to 2010 in
March. Overall construction values were also
down for April with a total of $29,833,787. One
month is not necessarily bad, so we need to wait
for another month or two to see where construction is going.

Living by an Airport
Whilst watching a Brevard County Commission meeting, I heard Commissioner Barfield
remark on an issue; he used the old phrase, “If
you buy near an airport, how do you complain
about the noise?” to make a point. In Port St.
John, Atlantis Elementary was built on donated
land. Brevard County voted at the time to build
the school on the site regardless of the fact the
school was directly in line with the north/south
runway. Ed. note: That is against federal law.
A few years later when the airport wanted
to extend the north/south runway, which would
bring the runway that much closer to the school,
the Port St John Homeowner’s Association opposed the extension, and the Airport Director at
the time stated they had come up with an Airport
Master Plan which would move the main runway
in a northeast, southwest direction in such a way
that would prevent any impact to Port St. John
at all.
I’m sure the information was passed on by
real estate. Why wouldn’t it be, we had a Master
Plan to rely on. But as time went by, developers
and Titusville discussed developing property just
north of us on Grissom Blvd. The “Master Plan”
was revoked. Just like that. No retribution for the
airport misleading the people.
State Makes the Rules Different for Themselves
When House Speaker Steve Crisafulli walked
out in a tantrum, he walked out on the people in
his District and the Constitution. The legislature is mandated to pass a budget. That is why
Governor Scott will require both the House of
Representatives and the Senate back for a special
session to complete a budget as required by the
Constitution. It also cannot be a “Continuation
Budget” as there is nothing defined as such in
Florida law, but that is another story. Also unfortunately, good bills have died along with the
bad bills for this session.
Someone said to me that Speaker Crisafulli
should be recalled, to which I said that he
couldn’t as state elected officials are exempt.
The look on her face was disbelief. So I thought
I would write on a couple of such unfair and
deliberate actions by the state to make sure the
people of Florida have as little knowledge and
power as possible.
1. Sunshine Law – Sunshine laws were put in
place to make sure we have open and transparent
government. All County Commissioners, City
Council members and all appointed boards and
committees have to adhere to these sets of law
or face the consequences, even jail. Under the
Sunshine Law, no elected or appointed members
of a county or city can talk on a subject that is
coming before that elected or appointed body,
except during a public meeting that has been
noticed (public told of the agenda, date and time).
For example, while a committee that is appointed
by the County Commission to look into a new
park is under this law, members can’t talk outside
of a public meeting under penalty of fines or jail.
The state elected officials are not included in this
law. They put the law into effect and intentionally
did not include themselves.
There are many facets of the Sunshine Law,
but many watchdog groups like the First Amendment Foundation say transparency in Government is at its lowest level ever.
2. Recall of Elected Officials – Any elected
official in the City or County can be recalled by
the people. There are strict guidelines on how it
is done. Recall, however, is not possible for any
elected state official. They have made sure any
state elected official is exempt from this process.
There are more such laws the legislature has
made to protect themselves. This is how deals are
done behind closed doors. We, the people are the
least of their worries.
Charter School Unaccountability
The Miami Herald Columnist Fred Grimm
had an interesting column on May 13th on Charter Schools. Apparently Florida is trying so hard
to try to make Charter Schools successful, there
seems to be a lack of accountability. According
to his column, the Naples Daily News did a study
on charter school failures in Florida and found
since 2008, there have been 119 charter schools
that have had to close throughout the state,
“mostly because of financial mismanagement,
others for academic failures or various administrative screw-ups. The closings often came
in the middle of the academic year, forcing the
public school districts to find desks for 14,000
displaced students. Unhappily, the charters had
already devoured the state money earmarked for
each student.”
“Florida law, meanwhile, does nothing to
preclude this same dodgy outfit from opening up
another charter. Charter operators need not bother
proving their financial viability. It doesn’t matter
if they’ve been associated with failed ventures,
or even whether they have education credentials.
The law doesn’t require criminal background
checks for the charter applicants. Charter schools
aren’t required to produce a certificate of occupancy until just 15 days before the beginning of
the school year, precluding proper inspections
before school doors open.”
The column stated charter schools usually
stay up with the public schools academically, but
there are too many openings where it lets those
just wanting to make a quick buck keep raking in
public dollars at the expense of the kids.
Not to say all charter schools are bad, but there
ought to be accountability as I also know they do
not have the same testing requirements as public
schools have. You would think that Tallahassee
would try to weed out those just trying to make a
quick buck, but the only state charter school law
change that was even considered this year by the
Florida Legislature before the House walked out
was a proposal to force school districts to share
construction funding with charter schools.

You may be tempted to forget all about your
taxes since you’ve filed your tax return. But, you
now need to start thinking about your taxes for
this year. If you start your tax planning now, you
may avoid a tax surprise. Here are some IRS tips
to give you a leg up on next year’s taxes.
Take action when life changes occur. Some
life events can change the amount of tax you
pay. This would include a change in jobs, marital
status, birth of a child, family members move in
with you, retirement or possibly disability. If it
happens, you may need to change the amount
of tax withheld from your pay. To do that, file
a new Form W-4, Employee’s Withholding Allowance Certificate, with your employer or if self
employed, make adjustments to your estimated
tax payments.
You may also need to report changes in circumstances to the Health Insurance Marketplace.
If you enrolled for insurance coverage through
the Health Insurance Marketplace in 2015, you
should report these changes in circumstances
when they happen. Report life events such as
the ones previously mentioned to help you avoid
getting too much or too little financial assistance
in advance.
Keep your records safe. Put your 2014 tax
return and supporting records in a safe place. If
you ever need your tax return or records, it will
be easy for you to get them. For example, you
may need a copy of your tax return if you apply
for a home loan or financial aid. You should also
use your tax return as a guide when you do your
taxes next year. Stay organized. Make tax time
easier. Have your family put tax records in the
same place during the year. That way, you won’t
have to search for misplaced records when you
file next year.
Also, start shopping for a tax preparer and hire
a tax preparer to help you with tax planning. Be
sure to choose your tax preparer wisely. Use the
Directory of Tax Return Preparers tool on IRS.
gov to find tax preparers in your area with the
credentials and qualifications that you prefer.
Evaluate if you’re able to itemize your deductions or not. If you claim a standard deduction on
your tax return, you may be able to lower your
taxes if you itemize deductions instead.
Always stay informed. Subscribe to IRS Tax
Tips to get emails about tax law changes, how
to save money and much more. You can also get
Tax Tips on IRS.gov or IRS2Go, the IRS mobile
app, to receive tax information that will broaden
your tax knowledge. Early planning may pay off
with savings when you file your taxes next year.
Now, let’s give consideration to special tax
rules that may apply to some children who receive investment income. The rules may affect
the amount of tax and how to report the income.
Here are five key points to keep in mind if your
child has investment income: Investment income
generally includes interest, dividends and capital
gains. It also includes other unearned income,
such as from a trust. There’s a Parent’s Tax Rate.
If your child’s total investment income is more
than $2,000, then your tax rate may apply to part
of that income instead of your child’s tax rate.

WOW!! What a season!! The turnout for the
NFL COED Flag Football was amazing. We want
to thank all of the athletes for the great action during games. Also, a HUGE THANK YOU to the
coaches who volunteered their time - not only for
the time, effort and energy to coach a team - but
also for refereeing the games too!!
At the time this is going to print we still have
8 teams playing in the Super Bowl on May 30th.
We want to congratulate them on their hard work
and efforts to make it to the championship game!

2015 REGULAR SEASON REGISTRATION
Registration has started for our regular fall
season: flag football (4-6), tackle football (7-14)
& cheerleading (3-15). We offered a special rate
for the month of May at $50 per athlete and we
had a tremendous response. However, as of June
1st the rates are now $85 each (but with a great
referral program offered – see below). You may
register online and we will have live registration
events, so be sure to watch our Facebook page
and website for dates, times and locations.
We are encouraging as many as possible to
register online as it is offers a streamlined process
for everyone involved and allows for better communication for the league / team events, including
schedules, field closures, celebrations and such.

Researchers for the Massachusetts Turnpike
Authority found over 200 dead crows near greater
Boston recently, and there was concern that they
may have died from Avian Flu. A Bird Pathologist examined the remains of all the crows and,
to everyone's relief, confirmed the problem was
definitely NOT Avian Flu. The cause of death
appeared to be vehicular impacts.
However, during the detailed analysis it was
noted that varying colors of paints appeared on
the bird's beaks and claws. By analyzing these
paint residues it was determined that 98% of the
crows had been killed by impact with trucks,
while only 2% were killed by an impact with a
car.
MTA then hired an Ornithological Behaviorist
to determine if there was a cause for the disproportionate percentages of truck kills versus car
kills. He very quickly concluded the cause: When
crows eat road kill, they always have a lookout
crow in a nearby tree to warn of impending danger. They discovered that while all the lookout
crows could shout “Cah,” not a single one could
shout “Truck.”

Camps from June 8 through Aug 7.
Camp Kaleidoscope - for teens with disabilities. Located

Nature Camp - for children who have completed 5th grade
through 6th grade. Located at Rotary Park Nature Center, 1899

Start Smart Youth Program
Brevard County Parks and Recreation, Central
Area, will offer two summer sessions of Start
Smart, a youth sports developmental program,
at Kiwanis Island Park, 951 Kiwanis Island Park
Road, Merritt Island.
Session I is June 3-24; Session II is July 8-29.
Each session is four weeks in duration with
classes every Wednesday evening from 6 p.m.
to 7 p.m.
The Start Smart Program is a parent-child
program that helps prepare children ages 3 to 5
years old to enter the world of organized sports
by teaching fundamental motor skills such as
throwing, catching, kicking and batting. Using
age-appropriate equipment to conduct fun exercises, children learn basic skills that will help
them to succeed and excel once they enter youth
sports. Parents will have the opportunity to learn
how to be the coach and mentors.
Cost is $20 for the session or $6 for an individual class. Class size is limited.

Personnel Picnic
The Military Affairs Council (MAC) of the
Cocoa Beach Regional Chamber of Commerce
will host its annual picnic for our area’s junior
enlisted military personnel (active duty only)
from all branches of service on Friday, June
19th, from 12:00 p.m. to 3:00 p.m. at The Beach
House, 259 N. Highway A1A, Bldg. 236, Patrick
Air Force Base.
Each year, MAC members and Chamber partners provide a down-home picnic for the men and
women in uniform who protect our country, right
here on the Space Coast.
The picnic is open to all armed forces junior
enlisted personnel and their spouse or guests free
of charge. The complimentary tickets they receive
will entitle them to a complete barbeque meal,
various refreshments, games, entertainment and
eligibility for many great prizes donated by the
Space Coast community!

these homes and do the inspections. Their number
is 888-419-3456. You will need documenting
evidence to support your complaint.
Another concern of mine is that this group
home is being operated as a business in a residential area, which is not legal. They are not there
out of the kindness of their hearts. They are being
paid X number of dollars per client at the facility.
Contact Commissioner Robin Fisher with
your concerns and complaints, as well as the
AHCA. We are just going to have to keep knocking on elected officials doors, sending e-mails,
letters and making telephone calls until we can
find someone who will stand up for our rights as
homeowners. This is certainly not over!

All Aboard Florida continues with its construction in south Florida. As I mentioned in an
earlier article, if you have friends or family considering moving to the Groves, have them make
sure that the Realtor gives full disclosure about
the high speed rail that will be running along
528. Our Realtors work long and hard to give
their clients the best deal they can, but there is
always someone trying to bend the rules to their
advantage. Buyer beware!
I would like to congratulate all of our graduating seniors. You are now entering the next phase
of your life. Some of you will be going on to college, some will enter the service and some will
go directly into the work force. A lady told me
many years ago that the secret to success was to
never leave any door unopened. As long as the
task is legal, ethical and moral, go for it. If you
are of the Christian Faith, the rule of thumb is L1
and L2; love God and love people. You certainly
won't go wrong with that ethic. The main thing
is that I wish you well and success in all you attempt. You, young ladies and gentleman, are our
future and it looks brighter every day.
Just remember, when you walk through a
storm with your head up high, make sure that
you don't drown. That was fiction and fact from
Uncle Willie’s Almanac.

Medical Reminders to Help
You Prepare for a Hurricane
Get a 30-day supply of necessary medications!
If you are taking prescription medications and normally purchase them from your local pharmacy,
try to have a 30-day supply on hand. This is not
as easy as it sounds — many insurance companies
will not authorize the filling of additional days or
months worth of a medication unless ordered by
the state to do so in emergency situations, such as
natural disasters.
Make your medication plan now. This plan
should include speaking with a health insur-
ance representative, pharmacist or your physician
about options to acquire extra medications, one of
which may include paying cash for your 30-day
supply.
If you are on dialysis, call your dialysis center
to make a plan of action for your care. Don’t count
on them being open. Power outages may happen.
Do not miss a treatment prior to bad weather
and make sure to follow your doctor-ordered diet
very closely. Read the patient care information
provided to you by your doctor. It includes medical information to assist you and phone numbers
to the End Stage Renal Disease (ESRD) Network.
Only your doctor can recommend if it is medically safe for you to miss treatments and can advise
you on whether or not you should be admitted to
a hospital during a hurricane. Special needs shelters do not offer dialysis and some centers may be
closed during a hurricane. When the storm passes,
contact your dialysis center for further instructions or go to your hospital for short-term care if
your center is closed.
The hospital is not a county shelter. County
shelters are designated throughout the county,
mostly in elementary schools. The hospital is not
a designated shelter and does not take evacuees.
In North Brevard, the designated shelters are located at Mims, Apollo, and Imperial Estates elementary schools.
Make shelter arrangements if you are oxygen
dependent.
You may be eligible for care at a special needs
shelter, based on your medical needs and availability. If you are an oxygen-dependent person, be
sure to get your oxygen tanks filled. You should
try to have two days worth of oxygen on hand.
Also make shelter arrangements now. If you do
not plan to evacuate, contact the Brevard County
Office of Emergency Management at 321-6376670 for more information on how to register for
special needs shelter. If you wait until a hurricane
hits to make shelter arrangements, it will be too
late.

Vancouver. A group calling themselves Friends
of DCF opened this facility as a group home
for six teenage boys without having to make
any changes to the zoning. In speaking with a
resident close to the facility, I learned that most
everything that the director of the facility told
the neighbors prior to opening has proven to be
false. To quote from the Vancouver resident,
"Just as we had feared as residents, there has
been an increase in police calls for service,
we have received reports that indicate some of
these boys have punched holes in the walls of
the home, indicating a propensity to violence.
Area residents are reporting that the clients are
bringing boys in from other areas outside of
Canaveral Groves into the neighborhood, in-
creasing exposure to outside influences, possibly
criminal in nature. Now we are hearing about this
organization looking for an additional site in the
area for a female group home."
I looked AHCA up on the computer and according to their paperwork, the Vancouver facility
is only licensed for 5 beds. Their seems to be a
discrepancy with this figure and the actual number
of clients on site.
I have spoken with many of the P & Z staff
about this situation. Most recently I spoke with
Ms. Robin Sobrino, Director of P & Z. She told
me that the county had no control over this facility as long as they met all the requirements of the
Fair Housing Act. She did reveal to me that we
would have to enter a complaint with the Agency
