WEEKLY ACTVITIES OF THE COURT OF BiH Section I, II and III (23 February 2015 – 27 February 2015) MONDAY, 23 February 2015 Friday, 20 February 2015I • The Court reviewed justification of prohibitive measures in the Umrislav Jozić et al. (S1 1 K 007527 14 Krn) case of the suspects Umrislav Jozić, Luka Jozić and Mato Jozić. The Court found that reasons for the measures still remain. The next review will be on 20 April 2015. • Regarding the case of Hedin Džambegović (S1 1 K 017843 14 Kro) the Court rendered the decision in relation to the accused Hedin Džambegović to the Cantonal Court in Goražde. • In the Miroslav Ćosić (S1 2 K 018342 15 K) case, the Court rendered the decision terminating the measures of ban on leaving the place of residence and ban on meeting with certain persons of the accused Miroslav Ćosić while other measures still remain in force. The next review will be on 20 April 2015. • The Court rendered the decision in the Adin Subašić et al. (S1 2 K 014155 13 Krn) case terminating prohibitive measures of the suspects Adin Subašić and Džemal Škrijelj. • In the Robert Iličić et al. (S1 2 K 017556 14 Krn) case, the Court rendered the decision extending the custody of the suspect Robert Iličić for two months. Pursuant to this decision the custody may last until 23 April 2015. • The Court reviewed justification of custody in the Haris Čaušević (S1 2 K 002596 14 Kžk) case of the accused Haris Čaušević. The Court found that reasons for custody still remain. The next review will be on 20 April 2015. • ****** On 21 February 2015, the Court rendered the decision in the Husein Erdić et al. (S1 2 K 018367 15 Krn) case ordering the suspects Husein Erdić and Midhat Trako into one-month custody. Pursuant to this decision the custody may last until 18 March 2015. Husein Erdić and Midhat Trako are suspected of the criminal offence of Unlawful Establishing and Joining Foreign Paramilitary or Parapolice Formation. • In the Robert Iličić et al. (S1 2 K 017556 14 Krn) case, the Court rendered the decision on 21 February 2015 terminating custody of the suspect Mujo Smajlović and ordering the following prohibitive measures: ban on leaving the place of residence and ban on travelling, ban on meeting with certain persons. The next review will be on 21 April 2015. • On 21 February 2015, the Court rendered the decision in the Milorad Nenadović (S1 3 K 018385 15 Eks) case ordering the requested Milorad Nenadović into 18 day custody. Pursuant to this decision the custody may last until 10 March 2015 or until the Court renders a new decision. Milorad Nenadović is requested by the Prosecutor’s Office of Luzern Canton, Switzerland due to the criminal proceedings for the criminal offence of Immoral Behavior towards person under the age of 16 in violation with Article 187 of the Criminal Code of Switzerland. • On 19 February 2015, the Court confirmed the Indictment in the Shaban Hadjiu et al. (S1 3 K 018209 15 Kps) case charging Hadjiu Shaban and Šerifi Idris with the criminal offence of Illicit Trafficking in Narcotic Drugs. • In the Fikret Planinčić et al. (S1 1 K 007511 15 Kžk) case, the Court rendered the decision on 17 February 2015 terminating the measure of ban on leaving the place of residence of the accused Fikret Planinčić, Sead Menzil and Mirsad Vatrač while other measures shall remain in force. The next review will be on 17 April 2015. • On 16 February 2015, the Court confirmed the Indictment in the Ilija Jurić (S1 1 K 018179 15 Kro) case charging Ilija Jurić with the criminal offence of War Crimes against Civilians. ****** Monday, 23 February 2015 • In the Andrija Bjelošević et al. (S1 1 K 014931 14 Krn) case, the Court rendered the decision terminating the custody of the suspect Andrija Bjelošević and imposing the following prohibitive measures: ban on leaving the place of residence (house arrest) and ban on travelling, ban on meeting with certain persons. The next review will be on 23 April 2015. • The Court rendered the decision in the Ilija Jurić (S1 1 K 018179 14 Kro) case extending the prohibitive measures of the accused Ilija Jurić upon confirmation of the Indictment. The next review will be on 23 April 2015. • In the Novak Mitrović et al. (S1 1 K 016205 14 KrI) case, the Court reviewed justification of prohibitive measures of the accused Novak Mitrović and Dragan Glogovac. The Court found that reasons for the measures still remain. The next review will be on 23 April 2015. • The Court rendered the decision in the Mile Puljić (S1 1 K 017799 14 KrI) case altering the measure of ban on leaving the place of residence in a way that from now the accused is allowed to leave his home address once a week while other measures still remain in force. The next review will be on 23 April 2015. • Upon consideration and acceptance of Plea agreements, the Court pronounced the following Verdicts: • Vladimir Grubačić (S1 2 K 018294 15 K) finding the accused Vladimir Grubačić guilty of the criminal offence of Organized Crime in conjunction with the criminal offence of Illicit Trafficking in Narcotic Drugs. In that regard, the Court sentenced the accused to one year in prison. • Igor Milutinović (S1 2 K 018295 15 K) finding the accused Igor Milutinović guilty of the criminal offence of Organized Crime in conjunction with the criminal offence of Illicit Trafficking in Narcotic Drugs. In that regard, the Court sentenced the accused to one year in prison. The Court seized from the accused items used in the perpetration of a criminal offence. • In the Vlado Delić et al. (S1 2 K 013430 14 K) case, the Court rendered the decision terminating the custody of the accused Božidar Kundert and imposing the following prohibitive measures: ban on leaving the place of residence (house arrest) and ban on travelling. (S1 1 K 014931 14 Krn) case, the Court rendered the decision terminating the measure of ban on leaving the place of residence of the suspects Milan Savić and Dušan Kuzmanović while in relation to the suspects Marinko Đukić, Dobrivoje Ćulibrk and Miroslav Pijunović the measure of a mandatory reporting to the relevant Police Station. Other measures shall remain in force. The next review will be on 24 April 2015. • At the plea hearing before Section II for Organized Crime, Economic Crime and Corruption of the Court, in the Esad Jazvin et al. (S1 2 K 017738 15 Ko) case, the accused Esad Jazvin and Safet Čolaković pleaded not guilty of continued criminal offence of Tax Evasion. • Upon consideration and acceptance of a Plea agreement, the Court pronounced the Verdict in the Adnan Sadibašić (S1 2 K 018235 15 K) case finding the accused Adnan Sadibašić guilty of the criminal offence of Illicit Trafficking in Narcotic Drugs. (S1 1 K 012159 12 KrI) case of the accused Safet Mujčinović, Selman Busnov, Nusret Muhić, Zijad Hamzić, Ramiz Halilović, Nedžad Hodžić and Osman Gogić. The Court found that reasons for the measures still remain. • In the Svetozar Perućica et al. (S1 2 K 017854 15 K) case, the Court reviewed justification of custody of the accused Svetozar Perućica, Neđeljko Kuljić and Srećko Trifković. The Court found that reasons for custody still remain. The next review will be on 25 April 2015. • The Court rendered the decision in the Aleksandar Ivković (S1 2 K 018028 15 K) case terminating the measure of ban on travelling of the accused Aleksandar Ivković. • At the plea hearing before Section III for General Crime of the Court, in the Dragan Panić (S1 3 K 013049 14 Kps) case, the accused Dragan Panić pleaded not guilty of the criminal offence of Counterfeiting of Money. • In the Mirela Hasanović (S1 3 K 018401 15 Eks) case, the Court rendered the decision ordering the requested Mirela Hasanović into extradition custody. Pursuant to this decision the custody may last pending the expedite extradition. Mirela Hasanović is requested by a Court in L Aqualla, Italy due to the criminal proceeding for the criminal offence of Associating in a Criminal Organization for the Purpose of Smuggling of Narcotic Drugs in violation with Article 73 and 74 of the Italian Law on Drugs.
