WEEKLY ACTIVITIES OF THE COURT OF BiH Section I, II and III (17 November 2014 – 21 November 2014) MONDAY, 17 November 2014 Friday, 14 November 2014I • In the Stevo Jovanović et al. (S1 1 K 017259 14 Kro) case, the Court rendered the decision terminating custody for the suspects Milosav Jovanović, Marijan Jovanović and Slavko Jovanović and imposing on them the following prohibitive measures: ban on leaving the place of residence; ban on meeting with certain persons. The next review will be on 14 January 2015. • The Court rendered the decision in the Zdenko Andabak et al. (S1 1 K 017302 14 Krn) case terminating custody for the suspect Zdenko Andabak and imposing on him the following prohibitive measures: ban on leaving the place of residence and ban on travelling; ban on meeting with certain persons. • In the Mato Čondrić (S1 1 K 017569 14 Krn) case, the Court rendered the decision ordering the suspect Mato Čondrić into one-month custody. Pursuant to this decision his custody may last until 12 December 2014. Mato Čondrić is suspected of the criminal offence of War Crimes against Civilians. • Upon consideration and acceptance of Plea agreements, the Court pronounced the Verdicts in the following cases: • Zdravko Vujović et al. (S1 2 K 017578 14 Ko) finding the accused Zdravko Vujović, Vukota Bojović, Milenko Perić and Šefik Pivić guilty of the criminal offence of Organizing a Group of People or Association for Smuggling or Distribution of Goods on Which Duties Were Not Paid in conjunction with the criminal offence of Smuggling. In that regard, the Court imposed on the accused the following sentences: Zdravko Vujović suspended sentence in the duration of three months in prison which shall not be executed if the accused within two year period of time as of the day the Verdict becomes final, does not commit a new criminal offence. As an accessory punishment, the Court fined the accused with BAM 500.00; Vukota Bojović suspended sentence in the duration of five months in prison which shall not be executed if the accused within two year period of time as of the day the Verdict becomes final, does not commit a new criminal offence. As an accessory punishment, the Court fined the accused with BAM 500.00; Milenko Perić prison sentence in the duration of two years and BAM 10.000,00 fine; Šefik Pivić suspended sentence in the duration of one year in prison which shall not be executed if the accused within three year period of time, as of the day the Verdict becomes final, does not commit a new criminal offence. As an accessory punishment, the Court fined the accused with BAM 3,000.00. • Uglješa Elčić et al. (S1 2 K 017577 14 Ko) finding the accused Uglješa Elčić, Desimir Ivanović, Mirko Pržulj and Krsto Gašević guilty of the criminal offence of Organizing a Group of People or Association for Smuggling or Distribution of Goods on Which Duties Were Not Paid in conjunction with the criminal offence of Smuggling. In that regard, the Court imposed on the accused the following sentences: Uglješa Elčić suspended sentence in the duration of one year in prison which shall not be executed if the accused within two year period of time, as of the day the Verdict becomes final, does not commit a new criminal offence. As an accessory punishment, the Court fined the accused with BAM 4,000.00; Desimir Ivanović suspended sentence in the duration of ten months in prison which shall not be executed if the accused within two year period of time, as of the day the Verdict becomes final, does not commit a new criminal offence. As an accessory punishment, the Court fined the accused with BAM 3,000.00; Mirko Pržulj suspended sentence in the duration of eight months in prison which shall not be executed if the accused within two year period of time, as of the day the Verdict becomes final, does not commit a new criminal offence. As an accessory punishment, the Court fined the accused with BAM 1,500.00; Krsto Gašević suspended sentence in the duration of six months in prison which shall not be executed if the accused within two year period of time, as of the day the Verdict becomes final, does not commit a new criminal offence. As an accessory punishment, the Court fined the accused with BAM 2,000.00. • The Court reviewed justification of prohibitive measures in the Jerko Ivanković-Lijanović et al. (S1 2 K 010348 12 Krn) case for the suspects Željko Mikulić, Zdravko Ivanković and Draženko Kvesić. The Court found that reasons for the measures still remain. The next review will be on 14 January 2015. ****** • Regarding the case of Vasilije Škoro (S1 2 K009951 12 K) the Court has been informed on 16 November 2014 by the Correctional and Penal Institution of Trebinje that convicted Vasilije Škoro has been released under parole. His parole shall last until 16 March 2015 when his prison sentence expires. • On 14 November 2014, the Court reviewed justification of prohibitive measures in the Husein Bosnić et al. (S1 2 K 014147 13 Krn) case for the suspects Senad Hukić, Mirza Kapić, Ibro Delić and Jasmin Jašarević. The Court found that reasons for the measures still remain. The next review will be on 14 January 2015. • On 13 November 2014, the Court rendered the decision in the Ismet Gutlić et al. (S1 2 K 016485 14 K) case terminating the measure of a mandatory reporting to the relevant Police Station for the accused Ismet Gutlić, Edina Šarić, Enes Gutlić and Adnan Sadibašić while in relation to the accused Edina Šarić and Adnan Sadibašić also the measure of a ban on leaving the place of residence. Other measures shall remain in force. The next review will be on 13 January 2015. • In the Muradif Salkić (S1 1 K 013002 14 Kro) case, the Court confirmed the Indictment on 10 November 2014 charging Muradif Salkić with the criminal offence of War Crimes against Civilians. • The Court sent out the second-instance Verdict in the Aleksandar Arsić et al. (S1 2 K 014984 14 Kž) case on 10 November 2014 dismissing as unfounded the appeal filed by the Prosecutor’s Office of BiH and confirming the first-instance Verdict of the Court of 19 May 2014 in relation to the accused Nihad Muratović and Muhamed Muratović. The appeals filed by Defence Lawyers for the accused Aleksandar Arsić and Darko Arsić were upheld and the first-instance Verdict of the Court of 19 May 2014 was revoked and a retrial was ordered before the Appellate Panel of Section II for Organized Crime, Economic Crime and Corruption of the Court. In relation to the accused Aleksandar Arsić and Darko Arsić, the Court rendered the decision extending their custody. Pursuant to this decision their custody may last until completion of a trial before the Appellate Division up to one year more precisely until 10 November 2015. The next review will be on 10 January 2015. • On 6 November 2014, the Court confirmed the Indictment in the Josip Relota (S1 1 K 009254 14 Kro) case charging Josip Relota with the criminal offence of War Crimes against Civilians. • In the Mate Šimić et al. (S1 2 K 012831 14 Kž) case, the Court sent out the second-instance Verdict on 6 November 2014 dismissing as unfounded the appeals filed by the Prosecutor’s Office of BiH and Defence Lawyers for the accused Mate Šimić and Blago Šimić and confirming the Court’s Verdict of 17 March 2014. • On 6 November 2014, the Court sent out the second-instance Verdict in the Šemsudin Hodžić et al. (S1 2 K 008245 14 Kž) case dismissing as unfounded the appeals filed by the Prosecutor’s Office of BiH and Defence Lawyers for the accused Šemsudin Hodžić, Admir Kovačević and Vladimir Lizdek and confirming the first-instance Verdict of the Court of 22 April 2014. Saturday, 15 November 2014II • In the Husein Bosnić et al. (S1 2 014147 14 Krn) case, the Court rendered the decision ordering the suspects Salko Imamović and Mehmed Tutmić into one-month custody. Pursuant to this decision their custody may last until 13 December 2014 or until the Court renders a new decision. Salko Imamović and Mehmed Tutmić are suspected of the criminal offence of Unlawful Establishing and Joining Foreign Paramilitary or Parapolice Formations. ****** Monday, 17 November 2014 • At a plea hearing before Section I for War Crimes of the Court, in the Miodrag Josipović et al. (S1 1 K 017057 14 Kro) case, the accused Miodrag Josipović and Branimir Tešić pleaded not guilty of the criminal offence of Genocide. • In the Vitomir Racković (S1 1 K 014365 14 KrI) case, the Court reviewed justification of prohibitive measures for the accused Vitomir Racković. The Court found that reasons for the measures still remain. The next review will be on 17 January 2015. • The Court rendered the decision in the Husein Bosnić et al. (S1 2 K 014147 14 Krn) case ordering the suspects Enver Lilić and Fikret Hadžić into one-month custody. Pursuant to this decision their custody may last until 13 December 2014. Enver Lilić and Fikret Hadžić are suspected of the criminal offence of Organizing a Terrorist Group in conjunction with the criminal offence of Terrorism and the criminal offence of Funding Terrorist Activities. • In the Dragan Doderović et al. (S1 2 K 015877 14 K) case, the Court reviewed justification of prohibitive measures for the accused Dragan Doderović, Adis Hadžimahović, Mijomir Tomanović, Dragan Slijepčević, Zdravko Rončević, Ilija Bumbić and Slobodan Papović. The Court found that reasons for the measures still remain. The next review will be on 17 January 2015. • The Court rendered the decision in the Ferald Gazibarić et al. (S1 2 K 014133 14 Krn) case terminating prohibitive measures for the suspects Ferald Gazibarić, Oliver Sivonjić and Dalibor Ivančević. • In the Tihomir Čule et al. (S1 2 K 015636 14 K) case, the Court reviewed prohibitive measures for the accused Tihomir Čule. The Court found that reasons for the measures still remain. The next review will be on 17 January 2015. • The Court reviewed justification of prohibitive measures in the Kemal Čaušević et al. (S1 2 K 014305 14 Krn) case for the suspects Anes Sadiković, Janko Jovanović, Milanko Nikić, Miroslav Kragulj, Zoran Cvjetinović, Enisa Imširović and Jusuf Ćosović. The Court found that reasons for the measures still remain. The next review will be on 17 January 2015. • In the Ahmet Durić et al. (S1 2 K 012725 13 K) case, the Court rendered the decision terminating prohibitive measures for convicted Ahmet Durić. • The Court rendered the decision in the Husein Bosnić et al. (S1 2 K 14147 13 Krn) case imposing on the suspects Samir Hadžalić and Ramiz Ibrahimović the following prohibitive measures: ban on travelling; mandatory reporting to the relevant Police Station, once a week. The next review will be on 17 January 2015. Samir Hadžalić and Ramiz Ibrahimović are suspected of the criminal offence of Organizing a Terrorist Group in conjunction with the criminal offence of Terrorism. • In the Jerko Ivanković-Lijanović et al. (S1 2 K 010348 14 Krn) case, the Court rendered the decision altering the measure of ban on leaving the place of residence for the suspects Jerko Ivanković-Lijanović and Milorad Bahilj in a way that from now on the suspects are allowed to leave the Municipalities where they reside. Pursuant to this decision his custody may last pending the extradition decision more precisely until 9 December 2014. • Representatives of Public Information and Outreach Section, in cooperation with Witness Support Section, have organized for students of psychology a visit to the Court, that is, for a group of 50 students of the Faculty of Philosophy-Psychology Department, Sarajevo. The students were provided with an opportunity to obtain information about the activities of the Court and the way of its functioning, to visit a courtroom and to review video-recordings from a hearing held before Section I for War Crimes of the Court.
