WEEKLY ACTIVITIES OF THE COURT OF BiH Section I, II and III (19 January 2015 – 23 January 2015) MONDAY, 19 January 2015 Friday, 16 January 2015I • In the Ibro Delić et al. (S1 2 K 014147 13 Krn) case, the Court rendered the decision altering the measure of ban on leaving the place of residence of the suspect Enver Lilić in a way that from now on the suspect is banned from leaving the territory of Han Pijesak Municipality. • The Court rendered the final decision in the Dragica Miletić (S1 2 K 17983 14 Ko) referring the criminal proceedings in relation to the accused Dragica Miletić to the Municipal Court in Sarajevo. • In the Branko Vignjević (S1 3 K 018061 15 Eks) case, the Court rendered the decision terminating the custody and extradition proceeding in relation to the requested Branko Vignjević. • The Court rendered the decision in the Iztok Kompara (S1 3 K 018124 15 Eks) case ordering the requested Iztok Kompara into 18 day custody. Pursuant to this decision the custody may last until 2 February 2015 or pending the new Court’s decision. Iztok Kompara is requested by a District Court in Koper for the criminal offence of Illegal Production and Distribution of Narcotic Drigs, Illicit Substances in Sport and Precursors for Production of Narcotic Drugs in violation with Article 186 (3) of the Criminal Code of Slovenia. • A group of 25 students of George Mason University, the United States of America, and their professor visited the Court. The visit is organized in cooperation with the American University in Bosnia and Herzegovina. In the first part of the visit to the Court, the students talked to the Public Information and Outreach Section representative and then they watched a video recording of a hearing held before the Section I for War Crimes of the Court. • ****** In the Predrag Marijanović (S1 1 K 017954 14 Kro) case, the Court rendered the decision on 15 January 2015 imposing on the accused Predrag Marijanović the following prohibitive measures upon confirmation of the Indictment: ban on leaving the place of residence, ban on travelling and mandatory reporting to the relevant Police Station. The next review will be on 15 March 2015. • On 15 January 2015, the Court rendered the decision in the Goran Maksimović et al. (S1 1 K 011258 15 Krn) case extending custody of the suspects Goran Maksimović, Ljiljan Mitrović, Slavko Perić, Mile Vujević, Vukašin Drašković, Gojko Stevanović, Cvjetko Popadić, Rajo Lazarević and Mića Manojlović for one month more precisely until 15 February 2015 or pending the new Court’s decision. In relation to the suspect Radivoje Đorđić, the Court terminated the custody and imposed on him the following prohibitive measures: ban on leaving the place of residence, ban on travelling and ban on meeting with certain persons. The next review will be on 15 March 2015. • On 14 January 2015, the Court confirmed the Indictment in the Miroslav Škalonja et al. (S1 3 K 017724 14 Kps) case charging Miroslav Škalonja and Davor Vuković with the criminal offence of Counterfeiting of Money. • The Court rendered the decision in the Mitar Vlasenko et al. (S1 1 K 016065 14 KrI) case on 14 January 2015 extending prohibitive measures of the accused Mitar Vlasenko, Rade Vlasenko and Drago Končar. The next review will be on 14 March 2015. • On 14 January 2015, the Court reviewed justification of prohibitive measures in the Kemal Čaušević et al. (S1 2 K 014305 13 Krn) case of the suspects Kemal Čaušević and Zdravko Cvjetinović. The Court found that reasons for the measures still remain. The next review will be on 14 March 2015. • In the Jadranko Šaran et al. (S1 1 K 013006 14 Kro) case, the Court confirmed the Indictment on 12 January 2015 charging Jadranko Šaran, Fahrudin Hadžiosmanagić–Tadžić, Samir Šabić and Zijad Kadić with the criminal offence of War Crimes against Civilians in conjunction with the criminal offence of Unjustified Delay of the Repatriation of Prisoners of War. • In the Milkan Gojković (S1 1 K 017634 14 Kro) case, the Court confirmed the Indictment on 6 January 2015 charging Milkan Gojković with the criminal offence of War Crimes against Civilians. • On 26 December 2014, the Court confirmed the Indictment in the Predrag Crnogorac (S1 2 K 017685 14 Ko) case charging Predrag Crnogorac with the criminal offence of Abuse of Office or Official Authority. ****** Monday, 19 January 2015 • In the Vitomir Racković (S1 1 K 014365 14 KrI) case, the Court rendered the decision terminating the measure of ban on leaving the place of residence of the accused Vitomir Racković while the measure of ban on travelling shall remain in force. The next review will be on 19 March 2015. • At the plea hearing before Section I for War Crimes of the Court, in the Adil Vojić et al. (S1 1 K 012506 14 Kro) case, the accused Adil Vojić and Bekir Mešić pleaded not guilty of the criminal offence of War Crimes against Civilians. • The Court reviewed justification of prohibitive measures in the Miodrag Josipović et al. (S1 1 K 017057 14 KrI) case of the accused Miodrag Josipović. The Court found that reasons for the measures still remain. The next review will be on 19 March 2015. • In the Vlado Ilić et al. (S1 2 K 009050 13 K) case, the Court pronounced the first-instance Verdict acquitting the accused Vlado Ilić, Dragiša Vasić and Zdravko Trifunović of the charges that they committed a criminal offence of Organized Crime in conjunction with the criminal offence of Illicit Trafficking in Narcotic Drugs. In relation to the accused Vlado Ilić and Zdravko Trifunović, the Court rendered the decision terminating the prohibitive measures. • The Court pronounced the first-instance Verdict in the Miladin Đurđević (S1 2 K 017388 14 K) case finding the accused Miladin Đurđević guilty of the criminal offence of Smuggling. In that regard, the Court sentenced the accused to six months in prison. The Court seized from the accused items used in the perpetration of a criminal offence. • In the Kemal Čaušević et al. (S1 2 K 14305 13 Krn) case, the Court reviewed justification of prohibitive measures of the suspects Anes Sadiković, Janko Jovanović, Milanko Nikić, Miroslav Kragulj, Zoran Cvjetinović, Enisa Imširović, Almedin Rožajac and Jusuf Ćosović. The Court found that reasons for the measures still remain. The next review will be on 16 March 2015. • The Court rendered the final decision in the Hamdo Dacić et al. (S1 2 K 003354 10 K) case terminating the bail of the accused Haris Zornić, Hamdo Dacić and Can Acik. • In the Jerko Ivanković-Lijanović et al. (S1 2 K 010348 12 Krn) case, the Court rendered the decision altering the measure of a mandatory reporting to the relevant Police Station of the suspects Željko Mikulić, Zdravko Ivanović and Draženko Kvesić in a way that from now on the suspects are obliged to report to it every other Monday while other measures shall remain in force. The next review will be on 19 March 2015. • The Court reviewed justification of prohibitive measures in the Bojan Cvijan et al. (S1 2 K 015384 14 K) case of the accused Bojan Cvijan, Ljubiša Lalović, Marko Krajišnik, Vladan Parađina, Dragan Jevtović, Benjamin Halilović, Muhamed Ramić, Azim Kajević, Davor Elez, Milosav Vesković, Nermin Tahirović, Elvis Zlatić, Dragan Obućina, Dejan Vukosavljević, Elvira Kajević, Mehmed Kajević, Admir Ahmetspahić, Slaviša Bobar, Mladen Mičić and Anes Kurbegović. The Court found that reasons for the measures still remain. The next review will be on 19 March 2015. • At the plea hearing before Section III for General Crime of the Court, in the Dragan Gajić (S1 3 K 016690 14 Kps) case, the accused Dragan Gajić pleaded not guilty of the criminal offence of Counterfeiting of Money. In relation to the accused, the Court rendered the decision ordering the custody which may last up to one year and six months as of the day the Indictment was confirmed. The execution of prison sentence for the convicted Branimir Glavaš pronounced under the judgment of this Court of 20 September 2010 is suspended until the delivery of a new and binding judgment of the state which ordered the prison sentence. • In the Goran Mrđa et al. (S1 1 K 018013 14 Kro) case, the Court confirmed the Indictment charging Goran Mrđa, Milorad Mrđa, Ranko Mrđa and Mile Kokot with the criminal offence of War Crimes against Civilians. • Upon consideration and acceptance of Plea agreements, the Court pronounced the Verdicts in the following cases: • Aleksandar Ivković (S1 2 K 018028 15 K) finding the accused Aleksandar Ivković guilty of the criminal offence of Organized Crime in conjunction with the criminal offence of Illicit Trafficking in Narcotic Drugs. In that regard, the Court sentenced the accused to four years in prison. The Court seized from the accused items used in the perpetration of a criminal offence. • Ranko Koprivica (S1 2 K 018031 15 K) finding the accused Ranko Koprivica guilty of the criminal offence of Organized Crime in conjunction with the criminal offence of Illicit Trafficking in Narcotic Drugs. (S1 1 K 017146 14 Kro) case extending the prohibitive measures of the accused Enes Ćurić, Samir Kreso, Habib Čopelj, Mehmed Kaminić and Ibrahim Demirović. The next review will be on 21 March 2015. • In the Ibro Delić et al. (S1 2 K 014147 13 Krn) case, the Court reviewed justification of prohibitive measures of the suspects Senad Hukić, Mirza Kapić, Ibro Delić, Jasmin Jašarević, Semir Hadžalić and Ramiz Ibrahimović. The Court found that reasons for the measures still remain. The next review will be on 21 March 2015. • Upon consideration and acceptance of a Plea agreement, the Court pronounced the Verdict in the Borislav Bajić (S1 2 K 018030 15 K) case finding the accused Borislav Bajić guilty of the criminal offence of Organized Crime in conjunction with the criminal offence of Illicit Trafficking in Narcotic Drugs. In that regard, the Court sentenced the accused to one year in prison. The Court seized from the accused items used in the perpetration of a criminal offence. • The Court rendered the decision in the Xhavit Lata (S1 3 K 016605 15 Kpp 2) case ordering the suspect Xhavit Lata into one-month custody. Pursuant to this decision the custody may last until 20 February 2015 or pending the new Court’s decision. Xhavit Lata is suspected of the criminal offence of Smuggling of Persons. • In the Luka Josipović (S1 3 K 018037 15 Eks) case, the Court rendered the decision extending the custody of the requested Luka Josipović alias Safet Hrustić until 15 February 2015 or pending the new Court’s decision. • A group of 50 Bihać Law Faculty students visited today the Court. Representatives of the Public Information and Outreach Section (PIOS) of the Court and the RS Helsinki Committee for Human Rights organized together the visit of law students to the Court. As part of this visit, students had the opportunity to learn about outreach activities of the Court. A representative of the Legal Department of the Court of Bosnia and Herzegovina informed the students about the Court's structure, work and accomplishments.
