The Court rendered the decision in the Boban Inđić et al. (S1 1 K 013061 14 Krn) case upholding
the appeal filed by the Prosecutor’s Office of BiH and modifying the Court’s decision of 5 March
2015 in a way that the custody of the suspects Boban Inđić, Petko Inđić, Novak Poluga, Radojica
Ristić and Obrad Poluga has been extended for one month.
•
Upon consideration and acceptance of Plea agreements, the Court pronounced the Verdicts in the
following cases:
• Miroslav Rakić et al. (S1 2 K 015894 15 K) finding the accused Miroslav Rakić and Milan
Grgić guilty of continued criminal offence of Organizing a Group of People or Association for
Smuggling or Distribution of Goods on Which Duties Were Not Paid and continued criminal
offence of Smuggling. In that regard, the Court sentenced the accused Miroslav Rakić to one
year in prison and a BAM 3,000.00 fine; Milan Grgić was imposed with a compound prison
sentence in the duration of seven months and a BAM 500.00 fine. The Court seized from the
accused items used in the perpetration of a criminal offence.
• Drago Perić (S1 2 K 018331 15 K) finding the accused Drago Perić guilty of continued
criminal offence of Organizing a Group of People or Association for Smuggling of Goods on
Which Duties Were Not Paid and continued criminal offence of Smuggling. In that regard, the
Court imposed on the accused a compound suspended prison sentence in the duration of six
months which shall not be executed if the accused within two year period of time, as of the
day the Verdict becomes final, does not commit a new criminal offence. As an accessory
punishment, the Court fined the accused with a BAM 2,500.00.
• Miroslav Maksimović (S1 2 K 018326 15 K) finding the accused Miroslav Maksimović guilty
of continued criminal offence of Organizing a Group of People or Association for Smuggling or
Distribution of Goods on Which Duties Were Not Paid and continued criminal offence of
Smuggling. In that regard, the Court sentenced the accused to one year in prison and a
compound fine in the amount of BAM 12,000.00.
• Vladislav Anđelić (S1 2 K 018493 15 K) finding the accused Vladislav Anđelić guilty of the
criminal offence of Organizing a Group of People or Association for Smuggling or Distribution
of Goods on Which Duties Were Not Paid ad continued criminal offence of Smuggling. In that
regard, the Court imposed on the accused a compound prison sentence in the duration of
seven months and a BAM 500.00 fine. The Court seized from the accused items used in the
perpetration of a criminal offence.

The Court rendered the decision in the Vlado Delić et al. (S1 2 K 013430 14 K) case separating
the proceedings in relation to the accused Suad Kuralić and the legal entity of “Kusmi prom” d.o.o.
Tuzla, therefore from now on this case shall be conducted under the number of Suad Kuralić et
al. (S1 2 K 018505 15 K).

In the Jasmin Ahmetović et al. (S1 3 K 018407 15 Kps) case, the Court accepted the Sentencing
Warrant of the Prosecutor’s Office of BiH and pronounced the Verdict by which the accused
Jasmin Ahmetović and Jasmin Kujović were found guilty of the criminal offence of Counterfeiting of
Money. In that regard, the Court imposed on the accused the following suspended sentences:
Jasmin Ahmetović prison sentence in the duration of eight months; Jasmin Kulović six months
which shall not be executed if the accused within two year period of time, as of the day the Verdict
becomes final, do not commit a new criminal offence.

On 12 March 2015, the Court sent out the second-instance Verdict in the Abduladhim Maktouf
(S1 1 K 013517 14 Krž) case partly upholding the appeal filed by Defence Lawyer for the accused
Abduladhim Maktouf and modifying the Court's Verdict of 11 July 2014 in the part of the decision to
render the verdicts partially ineffective and in the decision on the sentence by rendering partially
ineffective the second instance Verdict of the Court of 4 April 2006, so that, the accused
Abduladhim Maktouf was sentenced to a prison term of three years for the criminal offence of
which he was found guilty under the Verdict that was partially rendered ineffective and which was
qualified as War Crimes against Civilians under Article 142(1) of the Criminal Code of the SFRY.
The appealed Verdict remains unchanged in the remaining part.
In the Zemir Kovačević (S1 3 K 018353 15 Kps) case, the Court confirmed the Indictment on 6
March 2015 charging Zemir Kovačević with the criminal offence of Attack against the Official
Person on Tasks of Security, Detection and Apprehension of Perpetrators of Criminal Offences.
On 5 March 2015, the Court rendered the decision in the Nedžad Hodžić et al. (S1 1 K 008978 13
Krl) case separating the proceedings in relation to the accused Nedžad Hodžić, therefore from
now on this case shall be conducted under the number of Nedžad Hodžić (S1 1 K 018439 15 Krl)
while proceedings in relation to the accused Dževad Salčin shall continue to be conducted under
the number Dževad Salčin (S1 1 K 008978 13 Krl).
In the Mladen Kurdija (S1 1 K 017735 14 Kro) case, the Court confirmed the Indictment on 18
January 2015 charging Mladen Kurdija with the criminal offence of War Crimes against Civilians.

Monday, 16 March 2015

In the Zdenko Andabak et al. (S1 1 K 012625 15 Krn) case, the Curt rendered the decision
extending the custody of the suspect Muamir Jašarević for one month more precisely until 13 April
2015 or until the Court renders a new decision.
•
The Court rendered the decision in the Osman Abdel Salam et al. (S1 2 K 018452 15 Krn) case
ordering the suspects Osman Abdel Salam, Amar Šljivo, Adis Ramić and Enver Džanko into onemonth custody. Pursuant to this decision the custody may last until 13 April 2015. Osman Abdel
Salam, Amar Šljivo, Adis Ramić and Enver Džanko are suspected of the criminal offence of
Terrorism.

In the Nikola Pilatić (S1 2 K 017252 14 K) case, the Court reviewed justification of prohibitive
measures of the accused Nikola Pilatić. The Court found that reasons for the measures still
remain. The next review will be on 16 May 2015.
•
The Court rendered the decision in the Husein Erdić et al. (S1 2 K 018367 15 Krn) case
extending custody of the suspects Husein Erdić and Midhat Trako for one month. Pursuant to this
decision the custody may last until 18 April 2015 or until the Court renders a new decision.
•
In the Boris Kordić et al. (S1 2 K 014225 13 Krn) case, the Court reviewed justification of
prohibitive measures of the suspect Luce Cobre. The Court found that reasons for the measures
still remain. The next review will be on 16 May 2015.
•
The Court reviewed justification of prohibitive measures in the Marko Božinović et al. (S1 2 K
014960 14 K) case of the accused Marko Božinović, Robert Ljiljak, Momčilo Mijanović and Veis
Husković. The Court found that reasons for the measures still remain. The next review will be on
16 May 2015.
•
In the Nikola Erstić (S1 3 K 018510 15 Eks) case, the Court rendered the decision ordering the
requested Nikola Erstić into custody. Pursuant to this decision the custody may last until expedited
extradition but not longer than 40 days as of 14 March 2015. Nikola Erstić is requested by the
Basic Court in Kotor due to the execution of a final Verdict under which the requested was
sentenced to one year in prison for the criminal offence of Assault and Aggravated Theft in
violation with Article 242(1) of the Criminal Code of Montenegro.

The Court reviewed justification of prohibitive measures in the Slavko Savić (S1 1 K 017213 14
KrI) case of the accused Slavko Savić. The Court found that reasons for the measures still remain.
The next review will be on 17 May 2015.

In the Mirsad Šijak (S1 1 K 007209 15 Krž) case, the Court sent out the second-instance Verdict
partially upholding the appeal filed by convicted Miras Šijak and modifying the Court’s Verdict of 24
December 2014 in the part regarding the compound sentence, therefore Mirsad Šijak is imposed
with a compound sentence in the duration of seven years and nine months in prison.
•
In the Ali Lokaj et al. (S1 2 K 016635 14 Krn) case, the Court rendered the decision imposing on
the suspect Darko Pervan the following prohibitive measures: ban on leaving the place of residence
and ban on travelling; ban on meeting with certain persons; mandatory reporting to the relevant
Police Station. Darko Pervan is suspected of the criminal offence of Organized Crime in
conjunction with the criminal offence of Illicit Trafficking in Narcotic Drugs. The next review will be
on 17 May 2015.

• In the Vitomir Racković (S1 1 K 014365 14 KrI) case, the Court reviewed the justifiability of
prohibiting measures in relation to the Accused Vitomir Racković, and found that the measures
were still justified. The next review is due on 18 May 2015.
•
At a plea hearing before the Section I for War Crimes of the Court in the case v. Ilija Jurić (S1 1 K
018179 15 Kro), the Accused Ilija Jurić entered a not guilty plea for the criminal offense of War
Crimes against Civilians.
•
In the case v. Jerko Ivanković-Lijanović et al. (S1 2 K 010348 12 Krn) the Court rendered the
Decision granting the defense motion for the Suspect Jozo Ivanković-Lijanović, and so in relation to
the said Suspect and the Suspects Slavo Ivanković-Lijanović and Jerko Ivanković-Lijanović
likewise, the prohibiting measure of ban on meeting with certain persons is altered in as much as
the ban on the Suspects to meet with their father is now revoked.

In the Mijo Golub case, second-instance Verdict is handed down under which the Accused Mijo
Golub is acquitted of the charges for the criminal offense of Abuse of Office or Official Authority and
the criminal offense of Disclosure of Secret Data.
•
A group of 30 law students, members of the European Law Student Association from Sarajevo on
Thursday visited the Court of Bosnia and Herzegovina. Representatives of Public Information and
Outreach Section and Legal Department of the Court of Bosnia and Herzegovina informed the
students about the structure, operation and achievements of the Court of Bosnia and Herzegovina.
The students had the opportunity to visit one of the courtrooms of the Court of BiH and watch a
video recording of a hearing held before Section I for War Crimes of the Court of Bosnia and
Herzegovina.
