WEEKLY ACTIVITIES OF THE COURT OF BiH Section I, II and III (13 October 2014 – 17 October 2014) MONDAY, 13 October 2014 Friday, 10 October 2014I • The Court rendered the decision in the Yavuz Avar (S1 3 K 017269 14 Eks) case ordering the requested Yavuz Avar into 18 day custody. Pursuant to this decision his custody may last until 27 October 2014 or until the Court renders a new decision. Yavuz Avar is requested by the Regional Court in Vienna due to the criminal persecution for the criminal offence of Murder in Attempt under Article 15 in conjunction with Article 75 of the Criminal Code of Austria. ****** • On 8 October 2014, the Court rendered the decision in the Jerko Ivanković-Lijanović et al. (S1 2 K 010348 14 Krn) case extending custody of the suspects Jerko Ivanković-Lijanović, Slavo Ivanković-Lijanović, Jozo Ivanković-Lijanović, Milorad Bahilj and Mirko Galić for two months. Pursuant to this decision their custody may last until 10 December 2014. • In the Elmedin Čaušević (S1 1 K 014205 14 Kro) case, the Court confirmed the Indictment on 8 October 2014 charging Elmedin Čaušević with the criminal offence of War Crimes against Civilians. • On 8 October 2014, the Court rendered the decision in the Denis Zahović et al. (S1 2 K 009948 12 Krn) terminating the bail of the suspect Irfan Bidžević imposed on him by the Court’s decision of 25 September 2012. • On 3 October 2014, the Court sent out the third-instance Verdict in the Suad Kapić (S1 1 K 016638 14 Kžž) case partially upholding the appeal filed by Defence Lawyer for the accused Suad Kapić and modifying the Court's Verdict of 11 September 2009 in the part regarding the application of the Law and the sentencing part in a way that the accused Suad Kapić was found guilty for the criminal offence of War Crimes against Prisoners of War under Article 144 of the CC SFRY and sentenced to 12 years in prison. • On 2 October 2014, the Court confirmed the Indictment in the Željko Stanarević et al.(S1 1 K 017149 14 Kro) case charging Željko Stanarević and Dragan Dopuđa with the criminal offence of Crimes against Humanity. • On 1 October 2014, the third-instance Panel of the Appellate Division of the Court sent out the third-instance Verdict in the Šefik Alić (S1 1 K 006104 14 Kžž) case partially upholding the appeal filed by Defence Lawyer for the accused Šefik Alić and modifying the Court's Verdict of 20 January 2011 in the part regarding the application of the criminal Law and the sentencing part in a way that the accused Šefik Alić was found guilty for the criminal offence of War Crimes against Prisoners of War under Article 144 in conjunction with Article 22 and 30 of the CC SFRY and sentenced to eight years in prison. • In the Nedeljko Đukić (S1 1 K 016964 14 Kro) case on 1 October 2014, the Court confirmed the Indictment charging Nedeljko Đukić with the criminal offence of War Crimes against Civilians. • On 1 October 2014, the Court confirmed the Indictment in the Miodrag Josipović et al. (S1 1 K 017057 14 Kro) case charging Miodrag Josipović and Branimir Tešić with the criminal offence of Genocide. • On 1 October 2014, the Court confirmed the Indictment in the Dalibor Purić (S1 3 K 017188 14 Kps) case charging Dalibor Purić with the criminal offence of Illicit Trafficking in Weapons and Military Equipment and Products of Dual Usage. ****** Monday, 13 October 2014 • In the Dragiša Kenjić et al. (S1 2 K 012688 14 K) case, the Prosecutor’s Office of BiH dropped the charges against the accused Nebojša Brborić. • Regarding the case of Mirsad Ćerimović et al. (S1 2 K 012795 13 K) the Court has been informed by the Correctional and Penal Institution of Bihać that on 10 October 2014 convicted Mirsad Ćerimović was released under parole which shall last until 15 December 2014 when his prison sentence expires. • In the Mario Ćosić et al. (S1 2 K 014792 13 Ko) case, the Court reviewed justification of prohibitive measures of the accused Miroslav Ćosić and Aldin Zatagić. The Court found that reasons for the measures still remain. The Court found that reasons for custody still remain. The next review will be on 13 December 2014. • In the Dragiša Kenjić et al. (S1 2 K 012688 13 K) case, the Court pronounced the first-instance Verdict acquitting the accused Dragiša Kenjić and Muamer Mezit of the charges for the criminal offence of Organizing a Group of People or Association for Smuggling or Distribution of Goods on Which Duties Were Not Paid while Dragiša Kenjić also for the criminal offence of Disclosure of Secret Data and Muamer Mezit for the criminal offence of Abuse of Office or Official Authority. In relation to the accused Nebojša Brborić, the Court dismissed the charges for the criminal offence of Organizing a Group of People or Association for Smuggling or Distribution of Goods on Which Duties Were Not Paid and the criminal offence of Abuse of Office or Official Authority. • Upon consideration and acceptance of a Plea agreement, the Court pronounced the Verdict in the Feđa Jahura (S1 2 K 014790 14 K) case finding the accused Feđa Jahura guilty of the criminal offence of Organizing a Group of People or Association for Perpetration of Criminal Offences of Human Trafficking and Smuggling of Migrants in conjunction with the criminal offence of Smuggling of Persons. In that regard, the Court imposed on the accused a suspended sentence in the duration of six months in prison which shall not be executed if the accused within one year and six months period of time, as of the day the Verdict becomes final, does not commit a new criminal offence. As an accessory punishment, the Court fined the accused with a BAM 1,000.00. • In the Arif Peleš et al. (S1 2 K 017043 14 Ko) case, the Court rendered the decision separating the proceedings in relation to the accused Predrag Vrakelja, therefore from now on this case shall be conducted under the number of Predrag Vrakelja (S1 2 K 017309 14 Ko). • Upon consideration and acceptance of a Plea agreement, the Court pronounced the Verdict in the Kristina Mišić (S1 3 K 012057 13 Kps) case finding the accused Kristina Mišić guilty for the criminal offence of Counterfeiting of Money. In that regard, the Court imposed on the accused a suspended sentence in the duration of six months in prison which shall not be executed if the accused within one year period of time, as of the day the Verdict becomes final, does not commit a new criminal offence. The Court seized from the accused items used in the perpetration of a criminal offence. • In the Sulejman Abdulkadar (S1 3 K 017300 14 Eks) case, the Court rendered the decision ordering the requested Sulejman Abdulkadar into 18 day custody. Pursuant to this decision his custody may last until 2 November 2014 or until the Court renders a new decision. Sulejman Abdulkadar is requested by the Basic Court in Skopje due to the execution of a two year prison sentence for the criminal offence of Tax Evasion under Article 279 of the Criminal Code of Republic of Macedonia. Ibrahim Demirović is suspected of the criminal offence of War Crimes against Civilians. • In the Dragan Šekarić (S1 1 K 014550 14 KrI) case, the Court rendered the decision ordering the accused Dragan Šekarić into custody. Pursuant to this decision his custody may last up to three years more precisely until 6 October 2017 or until the Court renders a new decision. The next review will be on 16 December 2014. • The Court rendered the decision in the Dušan Gavran (S1 2 K 015644 14 Krn) case terminating prohibitive measures of the suspect Dušan Gavran. • In the Vehid Sadiković et al. (S1 2 K 014873 14 Krn) case, the Court reviewed justification of prohibitive measures of the suspects Mensur Mašetić, Taufik Šemdin, Branka Tešić, Muhamed Hanjalić, Emir Čaušević, Zijad Hadžifejzović, Vasvija Ragipović, Amir Trnka, Mirsada Tarić, Azem Saračević, Dario Vujica, Alem Kordić and Selver Saračević. In that regard, the Court imposed on the accused a suspended sentence in the duration of ten months in prison which shall not be executed if the accused within two year period of time, as of the day the Verdict becomes final, does not commit a new criminal offence. • In the Tihomir Čule et al.
